Well, I don't have any info on Morocco specifically but my husband flew from Algeria to Minneapolis in July. I would expect his experience to be similar. He flew Air Algerie from Algiers to Paris and then Delta from Paris to Minneapolis. We used skymiles for the Delta portion and paid about $350 for the Air Algerie ticket. Absolutely no problems in Paris. Their website actually says that those travelling to or from the United States, with valid visas in their passports, do not require a transit visa as long as they stay in the terminal.

Try looking at the airline websites because often times they have good fare sales that are better than the big flight search engines.

My fiance just bought his ticket at the airport.. Royal Air Maroc is having really good rates right now like 800 to new york then get a ticket from new york to your city.. That was the best price for us anyways

we looked into that, but it only leaves a 2 1/2 hour layover for getting thru customs, collecting bags and getting to next flight to check in for it

My IV bill was showing available to pay on 06/10/09. When I called customer service they said you paid the bill before it was generated, so now they have to fix it on their side that my bill has been paid, and that will delay my case. They will need one to two week to fix it.

I had that problem too, with her address information. Just answer on a seperate piece of paper titled additional answers for form I-129F or whatever form it is. Enumerate which questions you are providing the full information.

No, not true. The case will be opened at the consulate when they receive the peition from the NVC. The only letter I can imagine you having to write is a new, updated, letter of intent required by some consulates at the inerview. Just use the one your sent for the I-129f and change the date.


Some of the nicer, low fraud consulates will actually send out packet 3 prior to receiving the case from NVC, if you ask them nicely. Auckland will do that sometimes. I don't think somewhere like Morocco would be willing though...

What he probably means is that once your case is approved by USCIS (while it is going through NVC and in transit to the consulate), you can ask the consulate to open a provisional case (or whatever you want to call it). Its asking the consulate to start their paperwork before they receive the case from NVC. It can give you a head start on the consulate sending out packet 3 and probably buy you a few weeks time. Not sure that all consulates would do this.

This would benefit you if your case was taking a while to get to NVC or you were stuck in AP at NVC.

I don't know which consulate are willing to do this. Auckland sometimes is, but we ended up going super fast from NAO2 to the consulate that I never asked them.

There is NO filing fee for affidavits of support for marraige based visas

For the interview you use the I-134 form. For AOS the I-864. Same standardsa apply to both.

Workman's compensation IS acceptable income if it is documented and check stubs are provided. The affidavit of support is not sent with the I-129f, it is presented at the interview many months down the road. A co-sponsor simply presents an additional I-134 with their supporting documents. For the AOS they complete the I-864 or I=864a if in your same household. They must be a US citizen or LPR o be a co-sponsor, additionally Manilla requires they be a close relative.

First, you ARE the sponsor because you're the one whose petitioning. If you get someone else to help then you'll be getting a co-sponsor, or what USCIS calls a "joint sponsor". I believe the USCIS term is technically inaccurate because it implies they're combining or "joining" their income with yours in order to help you qualify (like a joint tax return), but that's not how it works. They have to qualify on their own.

The USCIS rules for the I-130 say you only need to make 100% of the poverty level for your household size to qualify, but the rules for I-864 (which is filed after your fiance arrives and you get married) requires 125% of the poverty level, unless you're active duty US military. Most consulates, who have absolute discretion over whether they believe your fiance will become a public charge, require you to meet the 125% threshold with the I-130 because this is the threshold you'll need to meet later.

The 125% threshold for a household size of 4 is $27,562 for 2009. It may go up slightly for 2010, which is when your fiance is likely to go to her interview. Will you be working again by then? If so, and your income will be adequate at that time, then don't worry about it. They do want to see tax records, but current income is what counts. If you won't be working by then, and your income does not meet the threshold then you may be able to make up the difference with assets, provided the assets are liquid (they can be converted to cash within 12 months), and they total at least 5X the difference between your income and the 125% poverty level. If you can't make the threshold with income AND assets, then you need a co-sponsor who can meet the the threshold.

Note that the household size for the co-sponsor includes his or her dependents PLUS your fiance and any children who are also being sponsored - it does not include you or your dependents.

Note that Manila has been known to deny applications with co-sponsors unless they believe there is a very low likelihood the co-sponsor would abandon their responsibility. Your chances are better if the co-sponsor is an immediate relative of yours, and lives with you.

I've been lurking for a bit but just signed up today.

My girlfriend (USC) and I (British Citizen) are going to start a K1 application soon, and I had a question regarding the importance of living together once you are married.

We are going to get the process started soon, but she is still in Grad School right now. If I get the approval and the Visa before she is finished with grad school, and we aren't living together right away, does this cause problems for the AOS side of things? Or do they take into account that she is still away at school and we will be living together as soon as she is done in a few months?

To cut a long story short, I have been in the US on several E2 visas over the course of the past 8 years. My last one was denied, so I am in Spain right now.

I have been with her for the last 2 years I was in the US, during which time, she went to school in Orlando, about 2 and a half hours drive away from where I was living in Palm Beach, and where my family (parents and one sister) still live.

When I move back to the states, and become legally able to work, I will be living back in Palm Beach and working at my parents company again. Her family also lives in Palm Beach, and she will be moving back down upon graduating.

So are you suggesting it is such a large problem that I should hang fire with sending off the application until it would line up with her being finished with school and moving back to Palm Beach again?

Ah, I see - the interview stage would use the I-134 (both Sponsor and Co-Sponsor) and the I-864 (Usually for both, sometimes differs depending on financial and living arrangements) when adjusting status in the US. (Guess I skipped right over that.)
