Removing Conditions on Residency General DiscussionAnybody from St. Louis, Missouri?

Walkins are done by people who have an appointment but they go in early. You cannot go in without an appointment and without the appointment sheet.

Thanks, I wasn't sure about that. I'm glad you could clarify this for the rest of the people :)

The office is on 1222 Spruce Street. I don't really know if you can show up without an appointment...I think I read some posts of people who just walked in and had the biometrics without an appointment but you might not wanna do that. When I had my biometrics they put a "biometrics processing stamp" on the notice of action...I think it's good to have that as proof that you went through that step. If I were you, I would wait to get the appointment letter. It doesn't take that long for them to send it.

K-1 Fiance(e) Visa Case Filing and Progress ReportsOctober 2010 CSC filers!

I am one of those people... I cried today, on skype with my fiance. It's becoming a common thing for us this past week. I am so over it. It is so unfair, happy for the people moving on but it just is NOT right that they have only filed less than a month ago, and there are so many of us that have waited past the point that they've given us.

This is so sad. :( I really hope you hear some good news soon.Sending you all my positive thoughts so that you get your NOA2 next week!

It becomes more and more difficult every day. When we started this journey we both knew how long it would take. We both knew that it could be a little shorter or maybe a little longer. We were both prepared to wait OUR turn knowing that it would come. Every day that I have to tell my fiancée that we are still not approved is painful. Every day that I have to tell her that there was another January or February filer approved is like driving a stake into her heart. I don't know what to do, except to try and console her. To again tell her that our turn will come. To hope that tomorrow I can call her and tell her that we are approved and to not drive another stake into her heart.

John

John, I'll be sending my positive thoughts to you too! That NOA2 has to come soon! This craziness and unfairness must come to an end.

K-1 Fiance(e) Visa Case Filing and Progress ReportsOctober 2010 CSC filers!

It's been a slow week for CSC, I really was hoping at the beginning of the week, CSC would start working on us October filers. No, now I am here on a friday night feeling disappointed, frustrated, upset, desperate...and overall tired of the waiting! I am so ready to be over with this whole process, and seeing those February filers approved before us.. no words to that! All I want is seeing some progress, period.

I think we all feel the same way. You know this waiting wouldn't bother me so much if they weren't approving petitions that were just sent. Honestly, I really wish there was some way to find out why they are doing things that way. If I don't get my NOA2 on my 5 month mark, I'm really gonna go nuts just like it's happened to so many october filers already..

Hi All,
I've been following this thread, agonizing over how much longer it will take for us October filers.
I just wanted to give you all hope, as I just received the email that our NOA2 was sent out today!
Our NOA1 was dated Oct 12, 2010 and we never had any touches. Now on to scheduling the interview..
Best of luck to everyone, I hope this means the October people are well on their way!

That's great!Congratulations on your NOA2 and thank you for sharing it with us!It's nice to see october filers are being approved!

So I just called USCIS. The lady seemed nice at first, and I told her that a few days ago the lady told me to call back on the 1st (today) and she said ok yes I see that your file has reached 5 months so I can go ahead and put in a service request, and then she asked me some questions about military and random stuff, and then she said Im sorry maam you have to wait and call back in 15 days.

baahhhhhhhhhhh

you gotta be kidding me!!! they told you to keep waiting ??????as if you hadn't waited enough!! don't they know that long-distance relationships are about waiting ALL THE TIME!!?? all we want is to be approved within the 5 months mark...that's all...why can't they do it? I hope you don't have to call again and get your NOA2 before the 15 days.

K-1 Fiance(e) Visa Case Filing and Progress ReportsSerious Stress...

I am a generally patient person I think but this is driving me mental... How do you guys deal with your stress? The wait is taking its toll on our relationship. It's hard to spend all this time on the phone and online and keep up a normal schedule.

This month the time changes here in Wisconsin and I will be an hour AHEAD of Carlos in El Salvador and that makes it even harder!! I work 6a-2:30p and 10 hours of mandatory overtime per week.

The worst part about this whole thing is his dad is the Deputy Chief of the USCIS Forms Center West and he can't even help us expedite anything. :(

Give me your ideas on how to get thru this trying time... :bonk:

One hour is not that bad!!! As you have seen from previous posts, there's worse than that! And people can still keep their relationships going...

IR-1 / CR-1 Spouse Visa Process & ProceduresPatience is running out and this rollercoaster is the hardest yet
I know the feeling. I spent 5 years apart from the person I love and it was not easy. Saying good bye got harder every time. The long waiting period without news that USCIS put me through was not easy either. But it all comes to end. I know that right now you don't care about people telling you to be patient but waiting is the only thing you can do right now. Just think about all the happy days to come with your loved one and it will help you get through this. I hope you have the news you want soon :)

hi, i read this post and it was very useful for me, i am interested about my case, its number is WAC......., but i know our case is in VSC, do you know something about?

I don't understand. If your case number starts with WAC, then it means your case is at the California Service Center. Why are you so sure it's at the VSC? Was your case transferred for some reason? Also, if your case is at the CSC you might get NOA2 a few weeks before or after 5 months because they are working fast. If instead it is at the VSC, then it might take 6 or over 6 months...unless things change and they start processing petitions faster.

Wait about a week then start calling the NVC. You will need to give them your USCIS # that you got on your NOA1. Also email them, sometimes the person on the phone doesn't give you squat but the same day you get an email reply with the requested information.

They will give you your new case # which you will use from now on. Soon after, if it isnt put in AP, they will ship it to the embassy/consulate.

K-1 Fiance(e) Visa Process & Proceduresoverstay & visa approval

hi. i just need some opinions on our case. i will just describe the situation in couple sentences.. i am a beneficiary. i overstayed my visa for a year (couple days over a year).i returned to my homecountry volunteerly because my fiance and i decided to get married and i was pregnant.it may sound funny but i left the US so we could start our new family the right way (i.e. apply for a k-1, get married, etc). our baby was born in Dec.my fiance came over to meet his son. we spend some time together, reported for CBA, did the DNA.... i have an interview coming up and i know that i have an overstay...but... i still have a hope too. i am going to the interview with the baby.my question is: is there ANY hope that i will be approved on my visa? i just want to hear some thoughts from you guys.thank you in advance

Well I guess it depends on the type of visa you had. I know of a girl who overstayed a J1 for over a year and was approved. The petitioner in the states talked to a lawyer and this lawyer wrote a letter that was presented on the the day of the interview. This is the link you can look at to see if your case is similar to this girl http://www.visajourn...do/page__st__15

This is the answer of one of the members. Thanks to this, the girl I'm telling you about could solve her problem:

"OP - you guys don't need a I-601 waiver and your fiance's overstay should not be an issue if she was here on J-1 visa and left the US voluntarily!!!
Her I-94 was marked D/S (Duration of Status), which means she was not told what date she exactly needs to leave the country. This is a loophole that will save you! Unless she was placed in removing procedures, she should be fine!

In the case of I-94's marked D/S one is not considered "out of status" until it is declared by an immigration judge!

Here is the law:

7. Under the revised interpretation, aliens admitted for duration of status generally will not/not be subject to 222(g), regardless of their activities in the U.S., unless either:

(A) INS finds a status violation while adjudicating a request for an immigration benefit, or/or

(B) An Immigration Judge finds a status violation in proceedings against the alien.

8. Under the revised interpretation, a 222(g) refusal of an alien previously admitted for duration of status may not be based on the Conoff’s assessment of whether the alien did or did not maintain status. For example, even if a former F or J visa holder admits in his/her visa interview that he/she stayed in the U.S. months or years after studies ended, or worked without authorization, or never enrolled in school or undertook any studies at all, or never engaged in practical training that was authorized, the alien would still not/not be subject to 222(g), absent a prior finding of status violation by the INS or an Immigration Judge under the circumstances set forth in Para. 7.

Please research more (www.immigrate2us.net) or find a really good immigraton lawyer. Someone here suggested Laurel Scott, who specializes in cases like yours.
Your chances of bringing your fiance/wife back home are really high!

GOOD LUCK!"

K-1 Fiance(e) Visa Process & ProceduresWill it be an issue if my fiancé buys a two-way ticket?

My fiancé is preparing to buy his last ticket here upon his visa approval, and we've discovered that a one-way ticket is about $300 more than a two-way ticket, confusingly enough. We were thinking it would be a good idea to just buy a 2-way ticket and not use the return ticket, since it's cheaper. I wondered if the immigration folks at his point-of-entry are going to raise an eyebrow if he enters with a fiancé visa but has a two-way ticket. Will this be an issue?

That won't be a problem at all!I bought a two-way ticket in may just for the same reason you want to do it. One-way tickets were freaking expensive!Nobody told me anything at the port of entre. Actually, there was no way for them to know I had a return ticket.

K-1 Fiance(e) Visa Process & ProceduresDoes the I-134 Affidavit of Support need to be notarized?
I'm from Argentina and we didn't have to get it notarized. It didn't say anywhere we were supposed to. However, like they said in the previous post, it can be different depending on the country. Do the instructions you got say you need to have it notarized? If so, then do it. If not, there's no need to worry about it.

K1 Argentina

Check that link. There are lots of detailed posts on the k-1 process in Argentina. On the first page you will even find the links to the forms and instructions you will need to assemble for the interview. It is important that you start gathering your documents for the interview right now since it takes time to get some of them.

Also, form I-129 comes with instructions that you can download from the USCIS website. There it explains all that you need to submit together with that form.

K-1 Fiance(e) Visa Process & ProceduresSpecial privileges for lawyers
Unfortunately, lawyers have no privileges...They cannot speed things up and USCIS gives the same information to lawyers or petitioners dealing with the applications themselves. I know it is frustrating but there's nothing to do but wait...
