We hired a lawyer too and we undergone RFE not because of mistake with the forms or anything. Its just our lawyer waited for the letter from the NVC and he is really doing it step by step. He once spelled my surname wrong but they changed it before sending it to NVC, I always check every forms they do filled up for me and when I saw some mistake I always report to my hubby. so they can correct it. Good luck to us all. smile.gif

For question part8 question G, my husband was married before. Do I put her information (legal name) when they got married or her legal name at the moment? She's married now too and instruction didn't really specify. I am assuming her legal name now BUT I don't want to assume, I want to make sure. Thanks in advance. And it's so nice to be back :)

I qualified for both A and B but if I check A, I do not need to send my husband's birth certificate, divorce paper, marriage certificate and tax stuff, etc right? To my understanding, if I check B, that is when I send them paperwork. I just want to simplify and turn these forms in. Thanks in advance.

Let me see if I understand.

Passport: Santos Jamoragan Golf

GC: Jamoragan Santos-Goff

What does your marriage license say?

Do I have the names correct on your Passport and your GC?

I would think the name on your marriage license is the name which should be on your GC and SS card and State ID.

Let me know about the names. Thanks.

Thanks for the response..

Last name, First name, Middle name

In my GC: Santos-Goff, M, Jamoragan
Passport: Goff, M, Santos

Removing Conditions on Residency General DiscussionI need help pls...
Here's the situation:

My social security card (SSC) doesn't have my middle name. When me and my husband applied for a state ID, the lady told us that the SSC need to have a middle name since I am using my middle name. They told us to go to the social security office to change it. We went there, I brought my Philippine passport with me since that's the only identification I have aside from my green card. They looked at both and asked us which name I am going to use. We're both surprise since we didn't know that there's something wrong with it saince they didn't question it at the USCIS, NVC or even the Manila Embassy. My name on my passport is Goff = last name, first name, Santos = middle name and on my GC is Santos-Goff = last name, first name, Jamoragan (which is my middle name when I was single) = middle name. My name on my GC is what they have in the USCIS files since our lawyer did that. I know it is confusing. They told us to change either the PI passport or my GC. And since we are here in the US, we decided to just change the GC.

The problem is my GC will expire this year on November. So, we need to file for Removal of condition. Me and my husband wants to just do it at the same time. The changing of the name and the removal of condition since the fees are high. I called the U.S Immigration Office here in FL and they told me to just change the name in the form and send a marriage certificate at the same time of filing. I think he misunderstood my situation and thought that I was single when they issued me the GC but I am not, so I am confuse.

The question: Can we file it at the same time? Changing the name and removal of condition? We're thinking of saving from the high fees since we all know the economic problems we're all having.

Somebody please help me. We need advice. Thank you so much.

Removing Conditions on Residency General DiscussionQuestion about removing condition and naturalization
Here is my situation..My 2 yr GC will expire 11/28/09. But then, I can apply for naturalization If I'm not mistaken, next year 2010. (I got my conditonal GC 11/28/07). So, my question is, can I just wait for next year to file for naturalization and skip my removing of condition to avoid wasting fees? I mean, when you apply for naturalization, you need to surrender/give back your GC, right? that means I will just use my 10 yr GC for 1 yr. Can I do that? Every info will be very much appreciated.

Removing Conditions on Residency General DiscussionLuz and Robins's GC in hand, Luz's has wrong birth date on it.
QUOTE (GaryC @ Sep 28 2009, 01:13 PM) <{POST_SNAPBACK}>
Luz and Robin got their GC's today. Luz's card has the wrong birth date on it. The year is wrong. I looked at the USCIS web site and it looks like she needs to file an I-90 to replace her GC. It says the fee is $290 plus $80 for a bio fee. I looked at the I-751 form that we filed and the date is correct on it. Does this mean we must pay an additional $370 to fix a USCIS screw up?

On page 2 of the instruction packet, it says if the card is issued with incorrect information because of USCIS administrative error, you are not require to pay the application base fee or biometrics fee.

Hope this link helps u.. http://www.uscis.gov...m/i-90instr.pdf

I think you said you got divorce last August. Then, you should not file the petition jointly. You need to have it waived. Here is the link for you, you need to download & read the Instructions for Completing Form I-751 USCIS FORMS

Thanks. I filed the l-751 based on marriage in good faith/ divorce on 9th Sept 09 and received the NOA (I-797) 1st Oct 09. My question, if I still need to submit the documents their asking for. Below are the documents need to submit;

: Lease of joint tenancy
: Joint mortgage agreement and/ or property
: Joint ownership of asssets
: Tax returns
: Birth certificate(s) of any children born from the meriage
: Joint policies of life, medical and/ or car insurance

Yes. I think you need to submit it since I read the instruction packet and this is what I just found:

If you are filing to waive the joint filing requirement because your marriage has been terminated, also submit a copy of the divorce decree or other document terminating or annulling the marriage with your petition.

It says "also", so that means you need to submit all the required documents and ALSO the divorce decree..

Removing Conditions on Residency General Discussionchange the last name now or wait until filing for I-751?
QUOTE (indy_benji @ Oct 15 2009, 01:06 AM) <{POST_SNAPBACK}>
Dear All,

I would like to ask for your opinion based on your experiences regarding change the last name.
I want to add my husband's family name to mine. I still have about a year and a half before I have to file for Removing Condition. But if I file for Green Card Replacement now (I-90) I have to pay $350 then after that when I want to file I-751 we have to pay $465.. that is money for sure. So I was thinking if it is possible to change the last name when I file for the removing condition instead of now while i am still in conditional status.

Please help. Thank you in advance.

I had the same problem. The lawyer that we hired when we applied for CR1 visa, hyphenated my last name to my husband which I do not prefer and so it ended up my passport and GC has different last name. We wanted to change the name but like what you said, it's just a waste of fees. So, we waited 'till it's time for the ROC. We just filled up the form with the right name we wanted and that's it. No hassle. LOL tongue.gif So, what I would suggest is that you do the same. Have a good one. biggrin.gif

The wife's green card was just approved and received in the mail this week. We enclosed two letters written by friends who knew of our situation. They were each very different in form, and neither were notarized. Since these statements were at best "icing on the cake" documents, and not primary evidence of our marriage, I didn't feel the need to make the drafters of the letters go the extra step and have them notarized.

Hi all.I just want to share my experienced. I was being interviewed for my removal of conditions.
I filed by myself because i was battered by a US citizen.I had to wait for almost a year before
i finally got my new card in my hand.I had 3 police reports but i didn't get any restraining order
it is because i wanted our marriage work. But unfortunately the marriage didn't work and that i had to
leave the house and find new place to stay because im afraid he will hurt me because he was mad at my
police reports. He told me all my reports are false allegations. It is very questionable to the officer on
why i haven't get any restraing order.Officer also asked me why my friends made letters telling our marriage
was in good faith. And i was being videotape also on the interview.every single word i say he is also writing in
the paper.I had like 10 questions.I cried while i was talking to the officer cuz i can't help it.I know i had
no bruises to show them but i was abused in so many many ways.At the end of my interview the officer told me
he can't make decissions.I told him i wanna know the result as soon as possible. He told me he will notify me
or call me if they need more information from me.I went home sad.I cry in my prayers hoping they will grant my
stay.Oh i am not divorced either till now cuz my x hubby to be was making it difficult for me.But im glad i also
bring my divorce paper. That is my story.Goodluck to all of you are still waiting.

I am so sorry for that terrible experience u had. How long you've been married with this guy? Are u from the Philippines? Your name is filipiname, so maybe I can assume that. But there is no country of origin in the profile. Anyway, congrats on the approval.

More evidence. Apparently I didn't supply enough to satisfy their "good faith" requirement. It's pretty open and shut really. I did what they asked, included some extras and put it in a nice little package. That wasn't good enough.

I don't have joint cable bills, joint water bills or any of that non sense. That stuff was all set up before she got here and I didn't have hindsight to go through the trouble to think about that. I wish I had now, but I don't. It just seems pointless. She gets all kinds of mail, but the document implies joint type of documents were best.

We have no children, no loans. Even her car is in my name because it's cheaper that way because we get a military exemption. We save over 100 dollars on registration costs. How do I explain that to good old paper pusher at USCIS? I've got 20 years military service and this stuff is stressing me out more than anything at work.

I'm looking at all kinds of stuff now. Receipts for money we sent her brother back home, receipts for money we spent on the dogs for medical costs (it has both of our names on it), anything...I'm going to include anything that has both or just her name and our address on it and send it in.

Does anyone have any suggestions?

I'm sorry to hear about this, mrc..

All of our utility bills is in my husband's name bec. like what u said, we do not want to go thru the trouble of putting my name and it is non sense..The only one we got that had both of our name is the car insurance bill..Do u have a health insurance card that got her name as a beneficiary? We passed ours, too bec. we really do not have anything together except our daughter :D Oh, we do have bank account filed jointly..Oh, and how about the tac return every year..We filed jointly, too and we passed that as well.. Butm whatever it is, we wish u the best here..They will approve you, watch.. :)

Lhedy, Jesus your signature is out of control...you make 3 posts and the forum engine has to create a new page ....

What do u mean "the forum engine has to create a new page?" Maybe because it does needed to be on the next page because it reached the posting limit? I made my signature like what I wanted and I haven't read anywhere on VJ that u need to shorten out your post because it created a new page or something. Thanks for the concern but I don't know why it does bother u that much that u need to use Jesus' name? I had the same signature and never change it from the date I joined VJ and so I do not have plan to change it either. Thanks again and have a nice day....

Woohoo... awesome start in the new year. Decision date was 12/23/09. However, the letter only says the first initial of my name and not my whole first name, should I call them up and make sure they put my whole name on my new GC or are they automatically going to do that?

No update guys? I just want to bump this post so we'll be on the 1st page.. lol tongue.gif

Seems like by looking on the VSC filers' timeline that it took them 4 months from filing to approval so guys, we might have approval letter next month..Yay! Hopefully.. tongue.gif

"Initial review"...I guess they have a lot of stuff do to at VSC. As if the next few months won't be stressful enough for us anyway.

I saw a post somewhere here where the PO said that there is no update on the website and no email either but he received the approval letter on the mail. I am expecting mine next month. lol tongue.gif Hopefully.
