Hi Everyone!

 

I have read many of the posts on this topic and I guess I just need a little extra reassurance regarding the "proof of having met in past two years" part of our I-129F application.

 

As a Canadian citizen who lives fairly close to my love, I have always travelled to the States by driving. This makes me nervous, since I don't have a lot of the primary documentation that the USCIS suggests. We have no boarding passes or flight receipts, no hotel receipts (always stayed with him or his family), no passport stamps, no lease agreement etc. etc.

 

Here is what I do have, and I am interested to hear opinions on whether or not it will satisfy an adjudicator/qualify as evidence:

 

1. Bank statements and credit card statements, showing purchases made in his hometown (highlighted).

2. Receipts for gas over a range of dates (these include my name and dates)

3. One dinner receipt

4. A parking receipt, showing date/time

5. Brochures from a visit we took to the local museum

6. Three photographs (one from August 2013, one from November 2013, and one with his mom)

7. A letter from me (signed and dated) explaining our situation and why we do not have flights/hotels/passport stamps.

 

I'm a little worried about the lack of photographs. We have been dating since August 2012, but my guy HATES photos, so we don't take many.

I'll also include some evidence of ongoing relationship, just to be safe (facebook logs, Skype logs, video chat screencaps).

 

What do you folks think?

Hi folks!

 

Question 15 on the I-129f asks if the beneficiary has ever been in the US. Obviously, the answer is yes.

 

The form then says "If your fiancé is currently in the US, complete the following"...

 

My question is, if the beneficiary is not currently in the US, should I still fill out 15e, g, and h? These parts of the question ask for passport number, country of issuance, and expiry date, respectively.

 

I'm asking because there is no separate question for passport information of the beneficiary and I wouldn't want to leave it blank if they need that info.

I've searched the forum for answers without finding one, so apologies if this is a repeat question.

 

The guide says that the check sent with the 129F must be drawn from a U.S. Bank in U.S. funds.

 

It was my intention (I am the beneficiary/Canadian) to pay for the application fee using a certified check from my bank in Canada.

 

My fiancé (the petitioner/USC) does not have a bank account and works in cash only.

 

My bank, TD, has U.S. branches, so I'm wondering whether this will be an issue. Will they accept my check?

I loved reading your story of how you met because it so closely mirrors mine! We spent so many hours on Skype. :D So happy for you that you met!

 

As everyone else has said, the most important part of the K1 petition is to prove you have met in person.

 

I don't think that your girlfriend should have trouble staying for three months, but I believe that is the absolute maximum she can stay. She will need to show her return ticket to prove that she plans to return within that time. If she stays any longer than 3 months, she will be there illegally and could jeopardize your future K1 plans. She may have to undergo quite a bit of questioning by the border officials.

 

The border officials will probably ask questions about how she is going to support herself during that time, so it would be a good idea to have proof that she has available funds to stay for that length of time. She could get a letter from her bank, showing that she has the money in her account. If she doesn't have money in her account, she will need to somehow prove that she has the support funds (through her parents or whomever will be paying for her trip). 

 

It doesn't matter how long your visit is for K1 purposes, but make sure you keep as much proof of the visit as possible. Have her keep her airline tickets and boarding passes, any receipts she gets, and take plenty of photos of the two of you together and with your family/friends, if you can.

 

Right now, I would worry mostly about getting the "proof of having met in the past two years" requirement out of the way and finding a job so that you meet the poverty requirements down the line. Not having a job doesn't automatically disqualify you, though, so don't stress too much. If you do not meet the requirements, you may be able to have a co-sponsor (another U.S. citizen who will promise to support her when she moves). This will be something to worry about months down the line, though.

 

I hope you are able to find a job and that you and your girlfriend's first "meeting" is a huge success!!

Similar situation. Our package arrived on the 22nd, according to USPS tracking. We haven't heard yet.

It's so hard not to have any control. I think that is the worst part. Once the package is sent, it's all out of your hands.

I have a spring break from my job as a substitute teacher in Canada from March 7-16 and plan to visit my boyfriend in that time.

 

I will be crossing by car at the Windsor/Detroit border. I'm very nervous about having a hard time with border agents.

 

We just filed the I129f this month and have yet to even receive NOA1.

 

Here is what I plan to bring with me to prove ties to Canada:

 

- the I129f package/application

- my last pay check

- a copy of the school year calendar

- a letter from an outside employer who I will be working for from April 6-14

 

I live with my parents at the moment and do not have any lease/rental documentation.

 

Is there anything else I should try to bring?

When they ask me the nature of my visit, what is the best thing to say?

Eep! I hope the 30 day thing isn't true. I signed all the paperwork when I was visiting at Christmas and I know my fiancé didn't until closer to our package being sent out. In fact, we took about three months to get all of our stuff together, so the dates will span that entire time.

I think at the medical they will ask you something along the lines of "Do you have any history of mental health problems?"

 

At the medical, the doctor will not have access to the answers you gave at the border. The only way they will know that you had an eating disorder is if you tell them. I would not tell the doctor if they do not ask.

 

I have never had a border agent ask me medical questions when crossing. Again, if they do not ask, do not offer up information.

 

If they explicitly ask "Do you have an eating disorder?" just be honest. Say "I had an eating disorder for ___________ (however long you had it), but I was able to overcome it."

 

I don't think you should worry about it. They let you into the country the first time, so obviously an eating disorder is not enough to make them turn you away. You will be absolutely fine. :D :D :D

 

This is just my advice.

I am worried about this too. I don't know if they will specifically ask about an eating disorder, but I know they will ask about mental health issues at the medical. My plan is to just be honest if it comes up. I am also planning on bringing a note from my doctor explaining that my depression (which went hand in hand with the ED) has been treated.

 

I don't think your past border crossings will come up in the interview at all other than to ask about your visits to the petitioner.

 

From what I have read here, a history of psychological issues don't pose a problem, unless they are along the lines of uncontrolled schizophrenia or episodes of violent psychosis.

 

My suggestion to you is to answer their questions honestly. Only answer what they ask. Don't offer up information beyond their questions.

 

Congratulations on beating your eating disorder. I know how hard it can be. :D

My sense is that they just wanted to make sure that you had the full document. I think you have shown them that and the missing page (assuming it isn't a crucial page in the document) is not a big deal.

It would seem that if you have not provided the evidence that they wanted, you will get another RFE.

 

So, to answer your specific question, it is unlikely that they would deny you outright and more likely that they would request more evidence.

Typical supporting evidence with an I-134 is most recent tax transcript, letter from employer and/or recent pay stubs.Those that are self-employed tend to use the last 3 years to document and prove their income, since the tax returns are all they use for proof of income.

What to send to your fiance(e) once the I-129F is approved (Receive NOA2): 

1. A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one). Your fiance(e) should review this information in advance of the interview (the embassy will have copies of this as well).

2. Send copies of the documentary proof that you submitted with the I-129F for your fiance(e) to have on hand for their interview at the embassy. Your fiance(e) should review this information in advance of the interview (the embassy will have copies of this as well).

3. Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F). 

4. I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all

5. You will need several items (for the above form). Gather duplicate evidence of income and resources as appropriate: 

(A) Statement from an officer of the bank/financial institution with your deposits, identifying the following: 1. date account opened; 2. total amount deposited for the past year; 3. present balance 
(B) Statement(s) from your employer on business stationary showing: 1. Date and nature of employment; 2. salary paid; 3. whether position is temporary or permanent (also include copies of your last two pay stubs and your previous W-2 for the associated employer if available) 
© If Self Employed: 1. Copy of last income tax return filed (or IRS transcripts); or 2. report of commercial rating concern 
(D) List containing serial numbers and denominations of bonds and name of record owner(s). 
 





6. A copy of the NOA2 that you received in the mail. (backup information; the embassy will have copies of this as well)

7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, online chat logs (pick several over the prior few months), etc.. from between the time you filed and present (NOA1 until date-now).

Examples: Copies of land line and cell phone bills, appropriate emails and letters you have sent including the stamps on envelopes (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)

 

-I personally don't foresee the color of the pen being an issue, but I personally if it is possible to just do it over and use black ink since each consulate is different and might be overly strict.

Everything I've seen on here says last 3 years of tax returns only if you're self-employed. You only need last year's return if you are not self-employed. Do I have it backwards? I tried looking for even ONE place I had seen that and of course I can't find anything in a hurry :blush:

 

All of the information I have found on visajourney guides and on the USCIS instructions say that you need the following for the I134:

Does this seem sufficient?

 

Do I need to bring the original pay stubs and W2 to the interview or are copies suitable?

 

The instructions say to bring the items in duplicate - so two copies of EVERYTHING- including original letters?

 

Last question and it's a silly one- the instructions say fill in the form in black ink, but both my fiance and our cosponsor filled it in blue ink. Is this a REAL issue?

They joint filed their taxes- so her official household income is ~130,000 but her individual income (listed on the i134, question 7) is 30,530. She has savings of roughly 6,200 and other personal property of about 10, 000. They owe 79,000 on their house.

Will her income combined with assets be enough?

We are cutting this close. I leave for Montreal on Friday, interview on June 10... So quick answer are very,very appreciated.

Hi!

 

Quick question about income requirements for the I-134. We're using a cosponsor, my fiance's sister. She has three kids, one of which is 18 and lives on her own.

 

Her occupation is a nurse but she is contingent, meaning she makes as much as she wants during the year. (36.00 an hour) This can range from $30,000 part-time or up to $70,000 for full-time the whole year.

Anyway, this past year she only made $30,000 which falls short of the 5 people minimum income of ~$35,000, although as a household, her husband and her earned ~$130,000.

Should we be worried about this or will they see the household income and her hourly rate as enough? Do we need to find another cosponsor?

I'm not 100% sure about this, but babysitting may fall under the category of self-employment. I, personally, would treat it as such.

Have you been doing it for long? Do you claim it as other income on your tax return?

I would include the letter from your babysitting employer, along with the last three years of tax transcripts (and other required documentation).

Just include whatever documents you can to give a clear picture of how you meet the 125% guideline.

If you are very nervous, you could obtain a cosponsor.

Is it on your record? Were you arrested? Was there a penalty? Does it show on your police check?

 

They will definitely ask you at the interview if you have ever been arrested, even if the case was dismissed, your record cleared, or expunged.

 

I'm not 100% sure how it will affect your case or how to proceed, but I thought I'd chime in and let you know that you will definitely be asked about it.

You will be totally fine. After we filed the i129f, I travelled to the US about five or six times. Just answer their questions honestly and don't offer any information they do not specifically ask about. It is always a good idea to have some form of proof of your ties to Canada (letter from work or lease agreement or anything that shows you will be returning to Canada).

My fiance did not want to do the visa...he didn't have any hope in the 'system'.   And, he dragged his feet because it's always been an issue between us that he thinks I (or my family) will suspect him of wanting a visa to US...he is very sensitive about that.  He always wanted us to go to Europe and he never wanted USA,  he is doing it for me.  

 

I knew it would take a long time, but I just dove in and started it anyway.   I just didn't know what else to do.  And, in 'those days', TSC seemed to be clipping along pretty well so I thought we would be lucky.   Then it came to a halt and that's what's pushed me over the edge.

 

Have you and your fiance talked about these issues? It sounds like he was reluctant to start the process in the first place, so his reluctance might be adding another level of stress to the process. 

 

I feel for you. This journey takes a whole lot of strength and patience and will frustrate you every step of the way, but in the end it is SO worth it.

 

I'm sending good thoughts your way and hopefully it will be a short wait for your approval from Texas.

I know a lot of people ask about this and to be honest I wasn't sure myself. Yesterday, Sunday, after another weekend missing my fiance, I emailed my immigration lawyer to ask what the deal was with visiting after application. If there was any possibility I could visit for a week or two. Within 2 minutes he emailed me back saying point blank, "Scrap the idea, you will be denied entry"

 

I'm not saying others havn't been lucky enough to experience something different but this is mine and thought I should share.

 

 

 

I think your lawyer might have given you overly cautious advice. I understand, because who wants to spend money on airfare just to be denied entry?

 

That said, I have visited twice without any problems. The k1 didn't even come up in questioning.

 

I think the people that run into problems are those who plan to stay for extended periods of time and can't show much proof that they intend to go home. If you have a return ticket and documents showing that you have ties to your country, you should not have any problem.

 

I hope you're able to visit. It's so hard to be away. :D

My fiance has visited 3 times since NOA1 and she has never been asked about the K1. She has always volunteered that she is visiting her fiance and one time did tell the agent we were in the process of securing a visa but was not questioned further. Basically they asked her general questions about her classes (she's a student) and about me, where I lived and where I worked, etc. 

 

She has always had some proof of ties documents with her but has never been asked to produce any. I am cautiously optimistic about another two trips we have planned but crossing from Canada has been a breeze so far. This next trip will be a land crossing we're keeping our fingers crossed, hoping it goes as smoothly as the airport POE crossings.

 

I crossed by land last time and will again this time. they didn't ask me anything different than the other times I had visited prior to filing. should be nice and smooth for her! :D

Out of curiosity, when you are crossing the border, does the border agent know you have filed by pulling up your passport info?

Last time I crossed the border, I was expecting lots of K1 related questions, but got none. I didn't volunteer the fact that I had a K1 in progress and they didn't bring it up.

You would answer NO to that particular question. And answer yes to this question: "Have you ever been refused a U.S. visa, been refused admission to the U.S., or withdrawn your application for admission at the port of entry?" and in the box where it asks for explanation write that you were denied entry and ESTA was cancelled.

You didn't violate the terms of your visa, the officer assumed that you were not going back to your country, that is not on you.

Last year I fly to the US under the visa waiver program and was not allowed to entry, they assumed that I was probably stay not go back, so my ESTA has been cancelled. They typed my answers on a computer and then made me sign my application. I have a copy of the interrogation. Also, in my passport, there's a stamp.
 
After that we filed I-130, now my case at NVC and should I mention about  been denied entry to the US before? and it's not violated the terms of a U.S. visa right? The DS-260 asked:
Have you ever been unlawfully present, overstayed the amount of time granted by an immigration official or otherwise violated the terms of a U.S. visa?
 
confused and worried.. :unsure:

For all those looking for flights (now or for the future), I find the "google flights" has really good fares... the best I've found, at least for us from the Caribbean to the US west coast. At the top of your search results, it will even give you suggestions on how to get a cheaper flight (i.e. leave a day later or leave from another airport nearby). It also has a really awesome calendar that has a graph at the bottom showing which days have the lowest fares for the selected route, which is good for us because we won't have to leave on any specific day after we get the visa, just which ever day has the cheapest flight!

I miss our puppy so much. We adopted her from the local Humane Society when she was about 5 months old. We chose her birthday to be in May, so she'll be 3 next week. After spending practically every single hour of every day with her for 15 months, I haven't seen her in 18... We won't have kids. She's our "dog-ther". My husband sent me a little video of him picking her up from "daycare" this week. Before I got out of bed this morning I watched it four times! Yeah... This wait is so hard in so many levels. I'm thankful for this group, that makes things bearable!
