IR-1 / CR-1 Spouse Visa Process & ProceduresAnybody got Military history ?
lquin,

Note that internetkafe's country is Turkey. The NVC schedules interviews and collects originals for Turkish applicants but for British Applicants (such as yourself) the NVC won't ask for military papers or originals.
You'll be required to present them at interview at London, once the embassy schedules it.

IR-1 / CR-1 Spouse Visa Process & ProceduresAnybody got Military history ?

Ok heres the situation...

I was briefly with the Army reserves in the UK, however I left during training..
On the DS-230 form it asks for prior military history, so I am listing it..

Becuase I was only in reserves very briefly and only did a little training they did not issue me a discarge certificate (or it was lost when they posted it). I contacted the Army personnel office in Glasgow and they confirmed my dates and the fact that I was discarged at my request.

Do you know during the I-130 process if any military paperwork is required ?..

Thanks !!

lquin,

No military papers are required for the I-130. At the Immigrant Visa intervew, if you stated any prior military history in your DS-230, then you are required to bring with you:

Military Record - One certified copy of any military record should be obtained covering periods spent in military service, including wartime or national service.

i just recieved a letter from NVC after sending the I-864 and it said im missing a document OF-230-I what is that?is that RFE? :help: :help: :help:

wilmaron,

If your I-864 has succesfully completed review but your case does not have your completed DS-230 part 1 + documents, then the system will indicate this to be missing even if they haven't generated the DS-230 package to be sent to you.

Call the NVC to confirm the status of the I-864 and find out if it has indeed undergone a succesful review. If so, then simply wait until the NVC generates the DS-230 package and proceed from then onwards.

I read this in a Lawyer's report a while back.

Thanks for the info.... 1 Problem when i goto the link below and I press the link on the national visa center link, I get a can't display this page. What can we do about this.

Which link are you referring to?? Within the link I posted or somewhere else?

It was the link within the response

and I placed an expedite request with NVC and it was approved there also.

Shortie81,

What was 'approved at the NVC'?
The NVC does nothing but collect fees and documents.
You still have to wait for the DS-230 packet and respond to it before anything can be sent to the Embassy.

I put in a request to have the process expedited and speedy process request was granted. There is one certain person that is handling my case

Sorry, going off topic here but on what grounds are the DHS and DoS expediting your case?

IR-1 / CR-1 Spouse Visa Process & ProceduresPolice certificate

Hi Guys..

Hope everyone is doing well... I was a bit premature and applied for my police certificate early and it arrived today!!..
My understanding is that the UK police certificates are valid for one year. Does anybody know whether the UK certificate just needs to be valid for the interview or must it be valid at the time you enter the US..?

Thanks!!

Lewis,

Valid for the interview.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 and Tax Release Authorization

Hi,

I received our I-864 today and it scares the hell out of me...My income for 2005 did not make the cut, as I lost a business-but thankfully, my sister will be helping us by co-sponsoring.

I am all set with my 3 years of tax transcripts (2003, and 2004) and a copy of 2005's. My sister is almost all ready to go as well, with her 2003 and 2004-although she e-filed today and now has to wait 2 days to get a copy...

I only saw one "tax release authorization" form in the envelope and I am now under the impression that our co-sponsor needs one too. Of course, I realized this after I filled it out and could not make her a copy.

Am I right in assuming she needs one too??

Any advice of getting another one for her?
Should I have the NVC fax one over to her???

I saw one on the 'Shortcuts" page, but do not know how to change the case number...If I were to do that and generate the bar code, how should it be affixed???

Please help !!

Thanks,
Rose

Rose,
The NVC have stated in the past that only one tax authorisation is needed. However, it is a simple matter of photocopying the one you have and completing it for the Joint Sponsor. Doesn't hurt.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 Household size... HELP!

My question is in regards to the household size section of the I-864. My wife and I have been married for a little over 5 years. I have claimed her and my three stepchildren on my tax returns for the previous 4 years. They are the same people I am sponsoring on the I-864.

Question number 4.B.2 states: "number of persons being sponsored..."; which would be 4. Then in question four, it wants to know how many people are claimed as dependents on my tax return; which would be 3... then including myself, for a total household size of 8.

This is not right because the dependents on my tax return are the same ones who are being sponsored. The total household size should be 4.

Common sense would suggest that maybe the person processing the form at the NVC would notice that the names are the same on my tax returns as the people being sponsored but there is no way to indicate this on the form.

After trying in vain to get ahold of the NVC for many days now, I'm hoping someone here may have already had the same situation arise. Thanks in advance for your replies.

Jim

Jim,

Read Section 4B of the I-864 again.

It states:

Number of persons who are otherwise dependent on you, as claimed in your tax return for the most

"Otherwise dependent on you"

This means that you don't include anyone in this part if you have already mentioned them previously. But you do include anyone else who is dependent on you as claimed in yout tax return.

IR-1 / CR-1 Spouse Visa Process & ProceduresNew VSC Processing Dates

I see that the new processing dates for I-130 have been posted for Vermont.. but they are still processing 03 Dec 2005 !!... they have been processing this date for the past 4 weeks....!

Is this normal ?

lquin,

It is quite normal for there to be a backlog or some other delay that induces the freezing of processing dates. The only thing you can do is wait and hope that the dates change next time round.

IR-1 / CR-1 Spouse Visa Process & ProceduresMistake on DS230

Hi, everyone,

after, we submitted DS-230 form; I realized that there was a mistake/typo on the form. What should I do now?
By the way we have to submit form DS230 I & II again at the time of our interview in embassy. Can we correct the date at that time? Does this really big matter?

Please advise.

If you feel that the error will result in a checklist being generated by the NVC then mail a corrected DS-230 to the NVC with a cover note explaining why you are sending it in again.

Otherwise wait until the interview and get it corrected with the CO then.

K-1 Fiance(e) Visa Process & ProceduresI-129F -- State or County birth certificate?

I have just found out that my county and state that I was born in, both have a birth certificate (from what I understand, they are different). I am filing a I-129F and would like to know which birth certificate I should use?

I know it seems like splitting hairs, but I want to give the best paperwork, to reduce the chance of my file sitting, waiting for more information/documents.

Thank you very much, jeff

Jeff,

In what way do they differ?
If one of them or both are in long form (showing both parents' names) and the information on them do not contradict each other, why not just submit copies of both.

Are you trying to request a Visa with a longer validity?

Removing Conditions on Residency General DiscussionAffadavits for I-751
Well, I send out the I-751 petition today without the affadavits and feel so good to have it sent in. Thanks for everyone's responses. It is a relief to get it in since my husband's card expires on July 7th and I don't have lots of free time to get this stuff around with 2 month old twins!

Removing Conditions on Residency General DiscussionAffadavits for I-751
Thanks to all who have replied. I put 'should have' in quotes and Yodrak is right, it does not say that. It was confusing to me the way it is stated on the instructions, because it falls under a bullet point as if you need to have affadavits. It's great that they are not required.

Removing Conditions on Residency General DiscussionAffadavits for I-751
YuAndDan That first link you posted is where I found that you MAY send affadavits, but they are not required. The second link looks more like what USCIS says.

We have lots of evidence, including the birth certificates of our new twins. I feel like our evidence is strong enough without the affadavits. If I have to have affadavits, I will have my parents and a friend of mine write them up, but it seems to me that 'hard evidence' like birth certificates, bank accounts, etc. would be more trustworthy in the eyes of the USCIS than letters from my friends and family.

Kristi
KJandSHFemaleSouth Korea2007-06-01 14:26:00
Removing Conditions on Residency General DiscussionAffadavits for I-751
On the instructions that come with the I-751 from USCIS, it says that 'you should have at least 2 affadavits from people who have known you since your conditional permanent residence status was granted and have personal knowledge of your marriage and relationship'

On the visajourney directions it says 'if you are short on documents that have both of your names listed on them you MAY include affadavits from people who know you as a couple.'

So, are the affadavits actually required? I have plenty of other evidence and would like to skip them if I could to get the paperwork out quickly.

Any personal experiences of people who have NOT done affadavits and had their petition accepted and did not hear from USCIS that they were required?

We'll be sending ours out no earlier than a month before the card expires (since I haven't sent it out yet and the card expires on July 7th). Good to hear that it won't be a big problem.

Having new babies makes it hard to get this stuff around, right?!

Removing Conditions on Residency General DiscussionCan we Move to Japan and still keep Green Card
This is interesting. My husband and I plan on living in Korea for a while in the future. Korea also does not allow dual citizenship and, in addition, they require that citizens periodically return to Korea to retain Korean citizenship. So my husband has to make sure he spends time in each country to retain his Korean citizenship and make sure he doesn't lose his status as a permanent resident (he ultimately wants to retain his Korean citizenship rather than becoming a U.S. citizen).

Sorry I didn't see this before. Seung-ho and I went through the Korean consulate back in Dec. of 2003. It was pretty painless really. I was lucky enough to be present with him and I think that made it a lot easier. The man interviewing us was an extremely nice American (young too) and he was very kind and wished us well. We had a short personal interview at the window, about 10 minutes or so. I will look to see if I posted the experience elsewhere on this site and link to it.

Haha! I did all the paperwork too.

I know what you mean abotu the family register having 'creative' information on it. My husband's estranged dad has screwed his totally up by disowning kids and erasing them off the register. Hopefully people know the culture of Korea and can understand that the dates are not always accurate and that as long as the wife is deceased the specific date isn't particularly important.
