My feeling is that if you make the 125% by even only $1 you will be approved. The number is harder on those in CA and NY than many other states where life is much cheaper. Even if you have a paper route to make up the 1% it counts. Personally I'd get a way to hit the 125% and leave it alone then. If you are at 124% only then I'd include a letter stating is work was seasonal, if a raise was due, or other expected changes in the positive direction.

It was probably a combination of things, plus once they had his file up it is too east to just expedite rather than stick it back in the old box. I am military and have been deployed, I received no special treatment.

I had opted to send my 864 and 134 at the same time, it was a waste, I needed the 864 later on. If you do decide to send something ahead of schedule, plan on it getting lost and provide it when they ask for it later on. And at the interview they will want things you have already given them three times already! Make LOTS of copies!

I've read here that the govt will sometimes pull a "Lexis Nexus" report on the petitioner and use that as a source of information. Maybe you could request your free copy and if it anything is amiss?


Very true. When I worked at an Embassy and needed a visa to go through Russia, the application was immense. The reason was ####### for tat, we ask THEM a bunch of questions. I asked the consular what can they find one me, not having access to US databsses like FBI, etc. They ran me on Lexis Nexus and the info flowed right out. At one time I got a former girlfriend a credit card in my name. She abused it so I cancelled the card. That was 1994. Then in 2007 her entire bio is forever attacked to mine, including ALL of her life even to the present day. Cross referencing is incredible. Newspaper searches, county and city record databases, you name it. They do not have everything, but they have everything that counts.

So today after administrative review K-1 visa for my fiance was denied. reason: not enough evidence of the relationship. We're together for 4 years. There was nothing wrong with our case (no criminal records, no past marriages, no past entries or attempts to enter USA). How long does it take for the embassy to send the paperwork back to USCIS and what can I do after that?

The line about the judge failing to listen made me shake my head too. Another thing to OP should learn about is American culture. If a judge says brown is red, then brown is red. Accept it. Our citizens vote in a law and then just one judge can overthrow it, and it happens. They listen, and they probably know what you are going to say before you say it. The only person buying your story is yourself. You need to think how the judge thinks and go from there.

He did the crime and he did the time, I'm not going to judge him after the courts did that. The deportation could have been permanent, so he has a chance in a decade to come back. To those who say he deserves to stay out because he is a criminal, etc, I think they believe that a leopard cannot change its spots. I'd love to see posts of those who have been deported then won out and came back, but I guess that is the exception rather than the rule.

You do not mention your age at these events, but if your father became a US citizen before you were 18 years old, and he had sole custody of you at that time, and your mother is not around due to divorce or other reason (as she was not a US citizen I assume), then you have derived citizenship.

This is how I got my US citizenship.

If he was an upstanding why was he shoplifting ? I think someone needs to rewrite the definition of upstanding to something other than " he didn't get caught for a really long time" because I will bet that wasn't the first time he comminted a crime in that time.


He was upstanding because he was a great guy in between events. I could go steal a candy bar tomorrow and throw away my job and life to this point, but I won't. There are plenty of people who are psychotic criminals from Day One, and plenty who just do a stupid thing. The point about the shoplifting is that it got the attention of the police, and then he was deported due to an event decades back. Maybe a traffic ticket would have done the same thing. Until you are a citizen you need to pay VERY low and not get in trouble, you have so much more to lose.

I knew an Aussie. He came here with his parents when he was 1. When he was 18 he stole a car and got busted for it, then after he completed his sentence he was free. He became an upstanding citizen and then in his 40's, 45 I think, he got popped for shoplifting. When they ran a background check they saw the age old felony for GTA.

Between when he was 1 and 45 years old, an administrative law was passed to deport convicted felons. Being administrative, it does not allow for grandfathering like changing the speed limit or other criminal definitions.

He was deported to a country he never knew. As far as I know he is still there. He was a really nice guy. NOT a threat, and just did dumb things at 18 which we all do. He just got caught.

I feel for you, I really do.

For this reason I encourage everyone to get their US Citizenship.

The last 11 months is not consistent enough, they want three years to show longevity. They will probably just take your info wqithout a co-sponsor after another year or two. Did you file for 2011 yet?

Do you mean Administrative Processing or Advance Parole?

Administrative processing: They need to look deeper in your case. Expect a delay of maybe a year.
Advance parole: You can leave the country with this paperwork before you get your green card.

Highly likely. As a former Embassy employee, even the application for the job can be daunting. The I-129F and AOS paperwork here is a walk in the park!

Is there any real benefit for the "system" to work like this, not really because it is corrupt, fallible, inefficient, time and money wasting.


It used to be as simple as "Come on over, welcome to the USA" until some people violated the spirit of intent. Every single piece of paper we fill out now is because someone ruined it for us.

I'd enjoy standing toe to toe or sitting eye ball to eye ball on "even ground" with some of these SOB's that think they are so smart and doing such a great job "serving America". All they do is perpetuate their jobs and careers. Generation after generation. :blink:


Those types don't last long, and if they do ensure it's likely because they have some amazing deed in their files that guarantee their career.

Don't hand me all this ####### about how dedicated these State Department people are if they conduct business and their jobs this way.


That's a generalization. I am proud of my overseas work and those I served with.

That is one of the most condescending things a person can say to another (unless it is from a parent to a child), "It's for your own protection". Well kiss my grits and slap my face, I was so naive. WHO are they "protecting". They are merely in CYA mode according to protocol.

You have no idea who is being protected. Maybe they stopped another 9/11. Maybe they have a bet as to whose client can get angriest. You may never know. Doesn't matter, time is still stopped until resolution arrives.

A highly trained, educated and experienced Consular Officer would grasp the fact initially that Marina was being truthful and honest. Someone (and the rest of the unperceptive world or someone with negative inclinations) else would be overly skeptical and accusatory in the meeting.

You said that she had rehearsed what to say. If I ask a person the same question three times and get the same answer I can see it had been rehearsed. That will raise flags. She is reading from a script not from the heart. I would for sure have that checked out if I had interviewed her.

I was in commercial lending for 30 years and dealt with many people from all walks of life, different views, different goals and different circumstances in their lives. If I began my dealings with them in a negative manner, I would have not gotten anywhere and I would not have been doing my job. And you learn with experience to get an impression from meeting a person the first time about their credibility. You have to be objective, somewhat neutral and willing to understand their side of the situation. That is your skill as a person with discretionary authority, education, maturity and training.

And have you not in your career approved one loan that you were sure would pay back and it never did, or maybe you disapproved another loan and the guy went elsewhere and made millions? Yes the "FBI method of obtaining its own information in its own manner" is well known and utilized. It is a narrow path and one heavily interspersed with misleading rabbit trails and false impressions. But the ultimate goal is to find the truth as long is fits your agenda. If it doesn't then keep looking and ignore anything objective, good or helpful to the opposite persons even though it be factual.

The ultimate goal is to prove or disprove a point. Proving is easy, disproving requires more work. And then toss in federal holidays, vacations, holidays of the host country, etc.

Robert/Karen, I truly appreciate your input, although I can grasp a sense of your skeptical outlook running your thoughts and deeds. It is good to be skeptical in some ways as long as it is tempered and balanced. Nonetheless your input is valuable to me to give me the other side of this equation although I do not agree with the manners and methods employed. I am not "whipped", I am in this for the long haul if it is a long haul. I am indignant because the SYSTEM does not have to be this way to achieve its goals and provide the service it is intended to provide to American Citizens and potential immigrants. You only need to look at history and learn that just because something is legal or made legal, does not make it right or correct according to the pervading morality standards and culture of a society. Conversely something that is against the same standards may be entirely legal as we see in the news each day.

My skepticism is part of what you are seeing from the government. I can easily go along with you and say you are right over and over again, but it does not make the wheels turn faster. As a former insider I thought I'd lend you some ideas as to the inner workings of the Dept of State. What you can do in a day they take a month. What you can do in a month they do in a year. In fact I had one case that as a civilian can be solved in about 2 weeks, but it took almost 15 months to resolve via State channels. Things move very slowly on that side of the counter. I understand that you do not agree with the way things are done but that is because YOU know the final answer. The AP folks need to find it on their own, they won't take any help from you even if it does speed things along.

Robert&Karen, IF I were given the opportunity to talk to them, yes, I agree. I have not been given that opportunity and do not expect it to happen. THAT IS THE ISSUE HERE, COMMUNICATION. There has been little or none between us and it is not for lack of trying on my part.

Yes, I love America, but it has a number of malfunctions that need addressing and repair. Take a broad look at the big picture with some objectivity instead of wrapping up in the flag. I merely point out the glaring malfunctions that are so evident to everyday American Citizens and I do not want to get into a political discussion. The surest way to flame someone up is to talk about their money, their religion, their family or their politics.


You may not be given the opportunity until the very end, if at all. If there is a classified process involved then don't expect much at all. The details they find may not be classified but the methods and sources used to obtain the information may be. Thus the data is classified solely to protect others and is not about the information itself.


Marina just handled it all as any person would who knows the facts and speaks the truth. There is nothing to hide or fear.


You know that and she knows that, but the rest of the world does not.


Since you and Robert&Karen both have or do work for the Foreign Service and seem to light up with suspicion on the same things, let me point out that it is a sign on your parts of initial skepticism in your demeanor.


We are very limited here, we do not know you, we have not seen your packet, we never spoke on the phone or hung out at a ball game. All we have is the impression that you leave us. Remember the old adage "It is easier to trap flies with honey than with vinegar." You can ask the same question in two ways and have completely different reactions. Going around berating America and how it conducts business is the vinegar way, and you will get resistance from any government office with that attitude. on the other hand if you mention how great they have been so far but you have a teensy problem and are wondering what's going on, you will be viewed with a different attitude. I'm not saying information will be withheld if you cop an attitude, but you can easily find doors opening to you for service with a little kindness. It sounds to me like you may have started off great but feel beaten down by the system and are now frustrated. Remember you are not the only person to every go through this, there re those who are told nothing and suddenly they never hear from their fiance again. Some countries also generate more suspicion than others because of past rates of fraud. Yup, someone else can make you look bad. It sucks, but it happens.


Another thing about affidavits. If they don't mean "squat", why did my attorney who is Board Certified to practise Immigration Law, a member of high standing in AILA and frequently gives lectures and writes columns about Immigration Law, tell me to get these affidavits and have them notarized? I guess he thinks they were a good idea to include. I will tell him that they are viewed with little or no validity in these petitions the next time I see him.


You'd have to ask him that. He may see that 5% of the clients get an RFE so he figures if everyone gets notarization it is one less possible issue.


Consider this scenario: Your doctor calls you with the latest report from you last bloodwork. He/she says they need to see you right away and can you come right away to their office.
How does the doctor handle this situation which may be serious or may be routine? You have no idea what is going on but it has the potential to be bad and the outcome is serious one way or the other, good or bad.


Happens all the time. How about your boss asking you to come into his office? And then he talks slowly about your work? Are you promoted or fired? You don't know! My tax guy is like yhis, he wants to tell me all about the calculation she made, I just want him to tell me if I owe or have a refund.

And you further state that any documentation can be "faked somehow". If that is the case and I provided the documentation as required to the letter by the guidelines, what is the purpose of providing certified, original, translated, notarized, etc. documentation if it is viewed as probably faked? You are giving off some negative vibes and skepticism I addressed in one of my posts about US Government employees with discretionary authority. A pre-determined mental attitude of "this deal can't be good" from the beginning.


Anything that you give the government, plan on them looking up the original themselves.

This situation is like most things in life, it involves "communication". The protocol of handling a petition in 221g does not involve communication with the parties involved between themselves. It is like being tried in a court and you are not allowed to be present, your information you provided as required is questioned as if it was all fraudulently prepared for fraudulent purposes. And the basic decision to approve or disapprove has already been made before it even goes to court. You were never given the chance to set things correctly.


Things are still in motion. They will come back later and say all is well, or all is not well because of this or that. At that time you can refute their reasoning -- probably. there are times a denial is not given any reason because of the source classifications I stated above. We will always have 1% of the bad guys sneak in and 1% of great people kept out. It is not a perfect system. I understand your desire to want to know more, to be able to offer assistance in any form in order to expedite the process. Believe me when I say the government wants this off their table as much as you do. The wheels of the machine turn VERY slowly, especially in an Embassy (We had a new guy, a former Infantry Officer, want something done in a couple hours. It took a month. He was not used to Dipnotes and other internal systems at the start. Now HE was frustrated!).

I can feel the tension, worry, and concern in your voice. I can see that it is eating at you, and you wonder if you have been hung out to dry. Even a post card once a month saying they are still looking into things would be nice. But that's just now how it works. This process is slower than watching cars rust. I wish there was a quick answer for you, I truly do. I'd hate to be in AP land. Check the boards here, I have yet to see a couple come out of AP and not look whipped.

I wish someone like yourself would handle this matter in my K1 petition. This is my first dealing with Foreign Service employees. My past experience has been with many other departments of the US Government. Unfortunately this left me with some bad impressions no doubt. Maybe I just never encountered someone like yourself who worked for the government. My bad luck.


If you can imagine the lies they hear, how they are berated, how they are talked down to, you'd understand their indignation at the slightest offense. Give them a little credit, be the person they WANT to talk to, be the person they wish everyone was, and watch their attitude change in an instant. You'd be surprised.

Yes, I am also familiar with the US Government's idea of "protection". Many times I have seen it and many times I have seen it fail and falter. We are getting into politics here but let's witness Hurricane Katrina's aftermath, the dictatorship and diefication of J. Edgar Hoover, the failure to follow through with the impeachment removal of Bill Clinton (for only God know how much he did wrong or illegal as President), the manipulation of information about WMD in Iraq leading to war a second time, the slap on the wrists of Charles Rangel for not paying taxes (not only as a private citizen but also as a trusted elected member of Congress), like the one sided railroad system of "Justice" backed by the deep pockets of the United States Treasury, like utter failure of handling the illegal alien community within the law, like giving the child of an illegal alien US Citizenship after being born here of illegal parentage and paid for by US tax dollars. Yes, it's here to "protect" me and perserve my way of life, the average US Citizen. But, I digress.


Are you sure YOU don't want to leave the USA?


All I want is fairness, consideration and the basic courtesy that any human being deserves. A person has the right to know about what is going on in this type of matter. Even my fiance said that. After all it is our life and our life together.


Investigations require more than searching a facebook page. Unless you know the inner workings, don't complain about them. It is a much bigger animal than you think. it is there because in the past there was an issue. And then to solve that they increase the AP task list. Every step taken is because someone in the past slid under the radar and we are determined that it won't happen again. You have been told the case is in AP. AP can take a year. They owe you no more than that.

I don't find anything in my posts about "idiots". I am familiar with this type of government bureaucrat, the "career" type with powers over people in daily life or business.

They are known as "lifers". They are in it for life and they handle the job like the robots they were trained to be.


I resent that. I worked at the US Embassy in Dushanbe for the Dept of State. The people who get jobs in embassies are not your typical DMV employees. You get highly educated people with advanced degrees. Heck even the cleaning lady had a Masters. Have you even seen the entrance test for State? It makes the GRE look like tic-tac-toe. If you think you can do better, I encourage you to apply and change the system for the better.

Yeah that 4th Amendment "the right to pursue life, liberty, and happiness" doesn't mean squat.
Except if you're an illegal alien, then you're provided all of those very protections that a law abiding citizen trying to follow the rules isn't afforded.


Life, Liberty and the Pursuit of Happiness is in the declaration of Independence. Note it said pursuit, not achievement. You can be a hamster on a treadmill for many years.

That's the part that concerns me. Rehearsed means it will sound the same every time. She will answer questions from memory and not from the heart. This can send up some flags. This is the only thing that I can see on YOUR end that may be an issue. AP involves so may deeper things that are out of your control. It can be a while under AP, keep logging evidence if a relationship and press on.

Pikeys: Yes it seems that as a group their socio-economic levels are a bit low. I'm still learning. I do not hang around them voluntarily, they are in the neighborhood and I try to get along with everyone. A few are very kind to me. I agree, they are not a fair view of the whole of England nor shall I judge a country based on the people I meet in 3 city blocks. But they are the people I see most frequently as my finacee has more than a couple as neighbors.

Guns: I told my bride to be that I will buy her a sniper rifle the day she gets US citizenship. :-) On her last visit here I took her to Las Vegas where she fired an Uzi machine gun. She is not into guns, but she is int freedom. And root beer. She loves nothing more than American root beer!

Saker and Sapphire1965, I have been there many times with her and seen it. There are a group I never heard of before called "Pikeys" who seem to like no one but their own kind, from my limited experiences. As for the standard Englishmen I have met, I asked about their feelings towards my fiancee and generally they find her accent unkind to their ears, a few even said she sounded angry all the time. I think the closest I can relate is that I am in California and if I hear a Brooklyn or New Jersey accent it sounds to me like they are always looking for a fight. I know this to be untrue, it is just an accent. But psychologically that is the initial effect it has on me. When she was in the states however, her accent was loved by all. She does have friends in England but she simply shines while in the states.

On a side note, last night I watched the movie "Snatch" and it had a good deal about Pikeys. I need to research that group more.

My fiancee is despised in England because she is Scottish. But she comes here and is an instant celebrity. She even talked a cop out of his rifle and got to examine an unloaded M-16. I told her cops NEVER give up their guns, she is the charmer!
