On to your question.  Last time VSC had a transfer like this was on May 20.  They sent a lot of Dec/Jan filers to Texas where they are currently being adjudicated.  It is assumed the same process for this batch as well, but you should know better when your notice arrives.

 

As I said though, if you find a thread with this discussion and follow the threads, you will likely get updates from others in the same issue as you, and they may have info before you.

Last year was a bit of an Anomaly.  The Presidential order for the DACA cases went into affect at the end of August.  They got slammed with an unprecedented amount of cases in a very short period of time.  They put these on a priority and got behind on other cases.  Of course there is only anecdotal evidence of this, but shortly after each processing center transferred out DACA cases they got caught up with I-129F petitions.  

 

There really is never any guarantee with this system, but if you want to help yourself out, file a little earlier than you planned (if at all possible).  You can stretch it out a few months after the initial approval if you need to.

Your post is confusing to me, but I'll try to give a brief explanation of the K-1 process and see if that helps:

 

1) USC files 1-129F petition with USCIS along with the original fee (currently $340)

2) USCIS Receives petition you get NOA1

3) USCIS Approves petition you get NOA2

4) USCIS sends I-129F to NVC

5) NVC logs it in and assigns it a consular case number

6) NVC sends the petition off to the embassy where the beneficiary will file for the actual K-1 Visa

7) Embassy receives petition and logs it into their system

8) Embassy requests proper forms from Beneficiary be filled out and returned

9) Beneficiary gets forms filled out and returned

10) Beneficiary gathers all necessary support documentation including Police certificates, Medical, I-134 from petitioner and any other supporting documents required for the embassy

11) Interview scheduled with Embassy

12) Payment of fee either before interview or at the interview depending upon the embassy rules for your particular embassy

13) Interview (hopefully successful)

14) Embassy sends back passport with Visa

15) Come to America.

 

Does that make sense?

My RFE was just my overthinking and using logic instead of just following the guides verbatim.

 

I have had two previous marriages.  My assumption was, since I had to prove myself divorced to legally marry my second wife, that I'd only need to send the divorce decree for the most recent marriage.  They asked for the Decree from the first marriage.

Mine showed up in about the same number of days as it took my NOA1 to arrive in the mail after I was notified.  I'd say that is a good way to estimate it.  Mail delivery varies depending on where you live.  Sometimes it takes a day or two before they actually mail out the RFE from the date on the email notification, but as I said, mine took about the same amount of time to arrive in the mail as my NOA1 took, so go back, and check that information from your case and that should give you a rough estimate

I really can't say for VSC/TSC, especially with the strange way they seem to be operating.  My RFE only took a little more than a week, but I hate to commit to anything with the way TSC has been.

Oh wow mine looks really different and has nothing that u have on ot right now.. it says department of homeland security and says it cam from texas and is written like a regular letter and has no date and it also says that attach the gold paper with it but I didnt get any gold paper????

 

Hmmmm sounds like maybe texas is formatting differently since they are new to the I-129F petitions.  I'd definitely call the number listed tomorrow and get more information, especially since the sheet they say to send back isn't there or perhaps it's there but not on the colored paper it's said to be on.  Mine was on standard white background paper.

To be a July 3rd due date, they'd have had to send you the RFE back in April sometime.  I received my hard copy in the mail less than a week from the date they sent it.  I'd guess that July 3rd was the date they requested the information.  

 

I'm attaching a redacted jpg showing my RFE, so you can see how mine looked and compare it to yours.  Note that the RFE date was June 5 towards the top and the date I had to respond by is at the bottom of the image.  This was basically the top 2/3 of page 1 of my RFE.  Hope it helps

I am a february 4th filer and just received an rfe in the mail saying that they want more proof that we have met in the 2 year!! But it states that I should respond to the request as early as possible and not layer than the due date ! The problem is that I dont see no due date.. the onyl date written on the top of the paper is july 3rd and I jusy received this july 8!! What should I due someone help im paranoid sad.png

 

I received an RFE on June 5th and the date I was given to have it returned by was August 28th.  My return date was written in extra large and bold font just below the box with our names and case number and date of RFE.  All this was on page 1 and page 2 is where it told me what I information I needed to supply them with.  Mine was relatively simple so I sent it the next day, but if you need more time, you should still be ok if you get it out as soon as you can.  As the other poster suggested though, it won't hurt to call USCIS and get clarification from a tier 2 person.

I haven received my hard copy yet so I dont know what they need, I called uscis and they said they will send me another letter since I never recieved the original, does the I129F petition has an expiration date after an rfe??

 

I'm not sure exactly what you are looking for here.  From what I've read, RFE's give approximately 3 months to reply.  Mine was exactly 12 weeks from the issue date to the date I had to reply.  As for the I-129F petition itself, the only date of expiry that I know of is set when you get your approval.  My notice was on June 20 and they said I had until October 19 (basically 4 months).  I know people have gotten extensions past this date, but I believe you have to resubmit portions of your information if you go past that date.  

 

To sum up, basically you have about 12 weeks from the date your RFE was issued to get the information back to them in most cases.

 

Once you return the RFE and get your approval you should get an NOA2 and on it you will have Validity date range which will start the day you were approved and end about 4 months later.  

 

That validity date can be extended, but it means extra paperwork if that becomes necessary.

I am K1 and my priority date is blank, too.  Funny, I was just getting ready to post a question about that and I saw this post.  I'm trying to go online and schedule our interview (which is how its done in Lagos) and I have the receipt number for the fee we paid.  But, after filing in name and passport information it keeps asking us for a priority date and it won't let us continue without it.  I even tried 00/00/0000 but that doesn't work.  I know I'm on the right page because I followed all the prompts that had me chose K1 fiancé.  Any suggestions?

 

Sorry, I can't help you out here...The way they do it in london is you send them a notification when you have done the medical and filed all the paperwork and are ready for an interview and then they assign a date.  You should check in the regional forum for Lagos.  I'm sure there are others there who have gone through the process who could probably answer this pretty easily

I-129F petitions for K-1 visa do not have a priority date.  There is a receipt date, but no priority date.  Priority dates are given to certain types of visas that have quantitative limits placed on them, so for instance if only so many applicants of a certain type of visa from certain countries are allowed in a given year, they give them a priority date and each year, they allow through the next group of applicants in order of their priority date.  There is no limit for K-1 visas, and as such there is no priority date.  You show that you have your NOA2 already, so if you have the hard copy, you will see that the box listing priority date is blank and this is perfectly normal.

I'm not sure if you have seen this or not, but there is a Regional forum just for the UK and the first thread pinned at the top covers everything you need to know about what to do from NOA2 through the interview.  You can find that thread here:

As far as your timeline is concerned, Here's the basics as I've noticed them following others and my own progress thus far.  These numbers are fairly consistent from AFTER the time NVC receives your file.

 

1) NVC receives your file, assigns a case number (yours will start with LND) and usually within a few days they ship it to London.  You get this number by calling the NVC using the contact information listed above in another post.

 

2) About a week later (give or take a few days) London will receive your file

 

3) Generally within a week or so, London will mail the beneficiary a letter with information on where to download the forms they need to file with instructions (you can find all this information in the thread linked above so you can get a head start if you are in a hurry).

 

4)  Now comes your part and the faster you work the faster it moves.  Here you have to return your forms to the embassy and schedule your medical exam.  They are generally about 2 weeks to get an appointment but sometimes you can get one sooner than that.  You can actually make the appointment once you get your case number from NVC (pretty much everything from step 3 down can be found in the linked thread above)

 

5) you gather all the documents you need, including the I-134 from the petitioner or co-sponsor, and send in the form stating that you are ready for your interview.  Currently I've seen most London K-1 get their interview date between 4 and 6 weeks after this form is sent in.

Funny how I was happy to be at VSC in the beginning and now it's a pain in the rear. You never know with their wishy washy processing rates.

 

Also, Alaska to the UK? Lordy. That must be one helluva long flight, and here I thought 10 hours from Houston was bad!

 

Yes, it is quite the long haul.  The shortest regular route is about 15 hours and that's with just one stop in Seattle, but it's also the most expensive.  The more reasonably priced routes I can usually find around 17-18 hours long with 1 stop. I have yet to have to book anything longer than 19 hours thankfully.  Luckily though, Icelandair started seasonal service from Anchorage, so I am going in July and the flight time is just over 12 hours one way and just under 12 the other direction.  That's including the stop in Iceland, so that's not too bad at all.  

 

And about the processing, yes, I think it's destined that everyone will have times they wish they were at the other service center.  It's really a lot of luck to get into the service center that is processing quickly and stays that way throughout the process.  Hopefully they get this straightened out soon and both get within the goal and everyone gets their decisions in a timely manner.  

 

Guys, I was told by my case worker this afternoon that MY CASE was sent to TEXAS. IDK WHY! I am not married yet but I have a i129f Case and the Senator's case worker said its sent to Texas! Idk why but I am confused. I filed in December to Vermont. 

 

Should be interesting to see what happens from here.  I am hopeful that this means that they actually realized that getting behind wasn't fair to anyone and that these transferred cases are going somewhere that they can get a higher priority.

Someone else who is a regular on this forum said it and it makes sense considering how far behind CSC was and then miraculously got faster. I think there may have been a news post on the USCIS website or something.

 

I've seen it posted here and tried to explain to people that it is absolutely not true.  CSC did transfer files, but they were DACA cases which were transferred to Texas, NOT I-129F cases to Vermont.

 

It looks like Vermont is likely backlogged with a different type of visa, possibly the flood of employment based visas recently or another type that they need to prioritize.  Seems that quite a few I-129F cases from VJ have been suddenly shifted to another Service Center.  Unless they post it on the site, we'll have to wait until someone gets a hard copy notice in the mail to find out which one.

If I'm reading this correctly, it sounds like you are saying that they are incorrect in stating that you have filed any of these previous visas and you have, in fact, never been married?

 

If so, it sounds like there's the possibility that they got your name crossed with someone of a similar name in your background checks, or the worse scenario would be possible identity theft.  If it were me I'd call USCIS immediately and speak to a Tier 2 rep and find out if it's possible a mistake on their part and I'd also check with the credit reporting agencies to look into the possibility of you having had your identity stolen.  

 

If my assumption is wrong, and you actually did have all those visas requests, then all I can say is to respond to the RFE with as much detail as possible.

Well, the next step, is USCIS will send your case to NVC (National Visa Center) and they enter it into their system and create a case number for you.  At this stage they send it to the embassy that will be handling your case.  The timeline for this can vary.  If you were approved at VSC or CSC, your case will likely be at NVC within about 2 weeks (although they say it can take up to 15 business days).   If you got transferred to Texas, they seem to be taking up to 4 weeks to transfer files to NVC for some reason.  

 

After waiting a week or so, you can start calling NVC for your case number.  Here's the contact information:

To use this page to check your status, you will select the IMMIGRANT VISA selection from the drop down menu (yes K-1 is non immigrant but you can only search your case number under immigrant) and then enter the case number including the 3 letters at the beginning which is for your specific embassy and do NOT put in any spaces.

 

Once you get a number, NVC usually sends out the case to the embassy within a few days.  I don't know how long it takes to get to your embassy.

We filed our K-1 application on June 24th and have not yet received NOA1 (it's been almost a month). We contacted our lawyer who said she hasn't 'seen the filing fee check clear the bank yet, but we should be seeing it go through soon, along with receiving the receipt notices'. She also mentioned about current backlogs and that many applications are being trasfered to the Texas Center...

 

Is this time too long of a wait for a NOA1?! Should we call the Center and check up or give it a little more time?!

This would make me wonder if your lawyer wasn't slow in getting it sent in.  The package is received at the Texas Lock box where they open them, make sure the basics are there, remove the payment and get the petition ready to send off to whichever service center it is going to.  Cashing the check is the FIRST thing they do and should have cleared within a week of your petition arriving.

They don't ship it to NVC (Department of State) unless they approve you, so they must have approved you.  I would give it a week or so then start calling the NVC and get a case number.  Once you have your case number you can begin to schedule your medical and prepare your forms for the next steps.

I was one of the filers who got approved without receiving any electronic notifications such as email/text/website, however I received an approval thru a tier 2 representative. Problem is its been 2 weeks now since my approval date and still no hard copy of NOA2 in mail. Should I be worried? Is the tier 2 rep lying about my case which is not actually approved?  What should I do? I know hard copies were usually received wihtin a week. Damn this is so stressful and depressing. I need to take a vacation asap.

 

There really is so many possibilities of how this could happen.  If I were you I'd do two things, neither of which can be done before Monday....First I'd call NVC since it's been 2 weeks since your approval and see if by chance they'd received your case.  If they have, then you can rest a little easier knowing you were in fact approved.  If they haven't, don't get too worked up, sometimes it takes a little bit, so it's not for sure going to be there yet even if you were approved, but it's a good starting point.  Next, I'd call USCIS and ask to speak to a tier 2 again.  This time don't ask them if you are approved, but tell them that you have not received our hard copy and are concerned it may have gotten lost or sent to the wrong address and have them check for you and possibly re-send it.  

 

Hopefully it's just being slow in the mail and you get it over the weekend though.

same here I got my approval on june 12,2013. I am still waiting my case number from the NVC. Some of you mentioned, the petitioner (I am the beneficiary) will fill I-134. the USCIS says don't use this form I-134 if the alien you are sponsoring (me) is required to have form I-864.

 

The I-864 and I-134 are both affidavit of support documents.  Generally the I-134 is used for K-1 visas then the I-864 when you adjust status.  Is your need for the I-864 something extra that your consulate requires?

That's pretty much word for word what I got, and I too only received an email.  I got a text for my NOA1 and my change of A# notifications, but after that they never texted me, just email and hard copies in the mail.  I got my email on June 20 and received my NOA2 in the mail on June 24.  

 

As for what to do next, as the petitioner, you should be sure to get the I-134a filled out and gather the supporting documentation and get it sent off.  For The beneficiary, I don't want to give bad information, and since each consulate have their own way of operating, I'd recommend going to the Regional forum that covers your consulate and search for similar topics or ask in there.  That way you will get the specific information for the beneficiary there.

I express delivered mine so that won't really help you, but sometimes they, for whatever reason, don't sign people up for the email even when you file the proper form.  When this happens you have to wait for the hard copy in the mail and this can double the wait time.  The best way to know if your application was accepted is to see when they cash your check.  Once they cash the check then they have accepted it and you will receive an NOA1 eventually.  If you go 10 days and they haven't cashed your check, there may be an issue, but for now it looks like it's the first in what will be many waiting games throughout the process.

Hey, I PM'd you a reply to your PM on this, but to add the gist of it here..mine took around 2 weeks to get a letter, and got no email or any other notification of the interview date.  Some people are taking longer than that and the embassy says UP TO 4 weeks.  I do think about 2 weeks is more the norm right now so that means you'll likely get your letter in the post next week sometime possibly.  Hard to tell what the date for an interview you'll get.  May depend on what dates you put in your cover letter.  Best of Luck. Hi everybody I just want to ask... The intent to marry letter can be sign with black ink or blue?

 

We signed ours in black and didn't have an issue, but I recommend using blue.  That helps them differentiate from it being a photocopy.  The reason I recommend not doing it my way is that it lead to me wondering the entire time if it would come back as an RFE.  Even though it didn't, anything you can do ahead to give you less worry down the road is highly recommended.

The fact that a DS-260 is not needed is indeed general information for all K-1 applicants at this point in time.  I cannot speak for other embassies, but the DS-230 is indeed required at the London Embassy as of this posting.

Are the RFE's done by when they are received too, because I seem to notice only early June RFE's (and RFE'S before then) are getting approved. We sent our off the 18th of this month, and someone told me at times it only takes a few days. I know it can take up to 60, and other say it took them 30 or more---but, do some people actually get their approval within the 10 days ?

 

Hey Lemon, I'm glad to see you're moving along in the process.  If you look at my timeline, you'll see I also got an RFE. I got mine in the mail on June 10th and sent it back Express June 11th.  They received it on June 12th and I got my approval on June 20th (although I am still waiting on the hard copy, but expect to see that this week).  

 

From what I saw when I was checking other RFE's around the same time as mine was the fastest to go from received to approval was 6 days and then a lot of others were under the two week mark, with some of the longer ones pushing 3 weeks.  I only saw one that took a month and didn't see any get denied.  

 

The good thing about RFE's is they usually ask for what they need to get you approved.  If you supply that and it's acceptable, you should be on track for approval.  If they were going to deny the petition even with the extra evidence, they wouldn't ask for the extra evidence, so as long as you sent exactly what they were asking for, be confident that you should have your approval within a week or two most likely

They asked for one affidavit from a friend or a neighbor, pictures, tickets, itineraries, passport pictures or scanned all pages a statement from the fiancee.

 

At this point, they are asking for proof, so sending in as much as you can is your best option.  Birth Certificate is a good start to show you have had a relationship, but the requirement is within 2 years of filing and that age doesn't fit as far as that particular evidence is concerned, but it will show ongoing relationship so I would send a copy of that.  If you have actual boarding passes for either of you or both of you, do send those and whichever one of you has traveled, send in copies of all the pages of that particular passport as well.  This really should be sufficient to answer the RFE.  

 

Personally I only sent some boarding passes and a few pictures, but the pictures (as mentioned above) or only secondary evidence.  Boarding passes and the passports should be sufficient, but just send in whatever you have as they'll look at it all and from the sounds of things you should get approval from what you have available to send.

We went for our interview today, and it was approved!

 

Just a tip, you can go in early; but I would advise not to arrive too early, as it will still be a bit of a wait. What they did with our grouping was alphabetical order, regardless of when you checked in (rather annoying as we are towards the end of the alphabet, and one of the first to check in). They also seemed more concerned with joint assets (which was expected), and how we met (which was a surprise); he didn't ask for any evidence. Fairly simple process, just a long wait... We arrived 30 mins prior to our interview time, we got in about an hour and 20 mins after our interview time, and the interview was about 10 mins. I should expect my green card in the mail in about 2-3 weeks.

 

This isn't meant to be a guide for every homeland security office, just our experience today.

Congratulations on the new home, that's exciting! We were thinking about buying a home, but with Carl's job; we could possibly move next year and decided that it might not be the best time. We had to deal with the government shutdown as well for SSN round 2 (changing my name), and it took a while, but I received it eventually. Even though I can work (only for about 2 weeks now, mind you...), I probably won't start looking for a month or so- we just have too much going on right now. We adopted a dog, and he is the best little guy in the world. He's a pug/beagle mix and loads of energy! Looking forward to our second wedding (more for family and friends than us) in the summer, and going back to school in the fall!

Ah yes the name change...that was the one good part about marrying first.  We got her married name on the first application for the card, so we didn't have to do the part 2 (although it still took two trips to their office so I guess we broke even).

 

We are also adopting a puppy.  It's only 7 weeks old this week, but we are going to be getting him right after we move into the new place, so things are really coming together.  Hopefully the AOS stage will go smoothly as well

It's been awhile since I've had an update, I have lived in the states since August and have adjusted well- not too homesick (although I miss some Canadian treats!). I am now entitled to work and have my interview on February 6. I'm not stessing out this time around vs. the visa interview- I was a hot mess... Hope all is well with everyone, just think; we all applied for our k1's around this time last year- crazy how much can change in a year smile.png

 

Good to hear an update.  Glad to hear things sound like they are moving pretty smoothly for you.  Although we did apply at this time last year (beginning of February), we didn't get her over here until early October.  When she got here, it was in the midst of the government shut down, and we didn't want to delay the wedding, so we went a little off course and got married before getting her SSN.  It ended up working out ok, but it was a slower process.  We applied for her SSN in late October after the offices had started accepting new applications again, but it didn't arrive in the 4 weeks they tell you to wait.  We ended up having to go back down there and get ask them what happened.  They said it got delayed due to the immigration system (not that I believe them, I think they misfiled it honestly, but I didn't argue the point).  They said we'd get it in the next few weeks, so we waited some more.  Finally she got the card in mid December.  At this point, we were dealing with the Christmas holiday and also right in the middle of negotiating to purchase a home.  Long story (kind of short), we are almost set to close on the place and move in at the end of this month, so we've delayed filing the AOS until we get settled.  We are looking forward to getting settled into our home and getting all this paperwork finally caught up.

We filed AOS, travel, and employment paperwork together as well. I fortunately didn't have to deal with the headache of medical insurance (not that I'm against the affordable care act- I didn't want to deal with anything that was avoidable). And I also was caught by the government shutdown and wasn't able to change my name, and get a bank account, until after. C'est la vie

Now the wait begins again...

 

Insurance won't be a headache for us.  She was covered under NHS (I think that's what it's called in the UK) so she can go directly on my insurance coverage and it's dated back to the date we were married.  We just want to have the social security number to make the process of getting her added a lot more simple.  Without the social security number, they'll want more information and evidence.  With it, all they will want is a copy of her passport ID and her social security card and our marriage license.  We have 2 of the three and just waiting on the last.  We didn't want to change her name yet, because her only current ID is her passport and we didn't want to go through the hassle of getting that changed just yet.  Once we have the social security card, everything else should fall into line, then we adjust status and we should be good for a few years :)
