You should call and schedule the medical soon. The doctor in Stockholm, Bulow, is really good, but the end of June is vacation time in Sweden so you want to make sure you get an appointment.

Then everything should be golden. But the embassy will most likely want to see a document of some kind that shows that she got sole custody. If that is hard to get, ask the father to write another letter stating he is ok with the kids moving. Not just going abroad but actually move.

Nah it's not harder for Canadians!
But you do have the option of getting married and then apply for the cr1 visa...maybe that would work. You'd still be apart waiting but hey if the K 1 don't work...

Yes it is a complete mystery to the people at the immigration document centre and the immigration lawyer....i am at a loss! And dispondant!


Call back on Tuesday when uscis are open again, demand to talk to a tier 2 person and ask them what they mean with classification sought. The tier 2 will know.


To me classification sought sounds like they can't determine what visa you are applying for....but that makes no sense either since you sent along everything you needed.

You must have missed something major for them to send it back twice not even cashing our money order! Usually they take your money and then reject you or ask for more supporting documents.

I tried to google the classification sought thing and came up with nothing. Call back to uscis and ask for a tier 2 person, the people answering usually don't know what they are talking about anyway..

We finally heard back from USCIS with an RFE. I am unsure if we should be happy (that we werent flat out denied), sad, worried (that we might now have what they ask), or hopeful that its something simple. I guess its a good sign they felt an RFE was in order, vs. flat out denying us.

 

* Do people that get RFE's generally get approved?

* Are the RFE usually something simple?

* How long after answering an RFE does it generally take to hear something back?

You're ahead of me so I can't really answer too many of those, but I wanted to say that I'm happy for you.  Most of the RFE's I've seen through this forum have been pretty simple.  Most difficult ones I've actually seen are people who didn't have any proof of meeting in the past 2 years.  I would guess there's just something on the form that wasn't filled in properly or something missing.  Once you get it and get it back to them it probably won't be too long for your approval.  Glad to see you making progress on your case

Hey guys just wanted to update you all. My petition was transferred last week as many of you at the Vermont Center were from Dec/ Jan. I just got a text alert about my case...it didn't really provide too much information but thought I'd share anyway. My NOA1 date is December 11, 2012.

 

On May 29, 2013, we transferred your I129F, PETITION FOR FIANCE(e), to your local USCIS Office for further processing. The new office has jurisdiction over your case and will send you a decision as soon as processing is complete or you will be notified if further information or action is needed. If you move, please use our Change of Address online tool to update your case with your new address.

I'm aware that these questions have been asked several times but I really need some assistance for my current situation. 

I went to the US with a student visa ( for an exchange program) to complete my MBA. During this time, I have met an american guy and we have decided to get married. He's still a college student and is being taken care of by his family. 

Instead of getting married in the US, I have decided to go back home and ask for the visa K. 

Do you think that the fact that he's still a student is going to be an issue ? I have enough resources to take care of myself financially before starting to work. What is the exact procedure, the costs and the timeline to be able to come and marry him?

Whether you have the means or not, the rules of the k-1 visa say that you must have a sponsor who has sufficient income to support you when you come over here.  If that person doesn't make enough money, there is a formula that would allow them to count their cash assets.  I'm not sure exactly what the formula is, but it's a certain amount more than the difference (I think it's either 3 or 5 times).  For example, if you need to make $19,000  to qualify as a sponsor and the petitioner only makes $12,000 then the difference is $7,000, so if the needed cash asset were to be 5 times, then they would need to have cash in the bank of $35,000.   

 

If the petitioner cannot satisfy the requirements, then they will need to find a USC (generally a family member but it could be a close friend) who does have enough income to satisfy the requirement and they would then be the co-sponsor of your petition.

You shouldn't wait, contact your senators.  Most Senators have aids who take care of these things on a regular basis.  There's really no reason you should have to wait for someone to look into your case after so long

Agree with this totally.  You should contact not only your congressman, but both of your senators.   The more of them you get involved, the better the chances they actually look at your case.  July should be completely done by now and they honestly should immediately expedite any July cases for people who put in a service request after this long.

I just recently got an RFE from CSC myself, so I went back and looked through Igor's list and it looks like 2-5 weeks is pretty standard to get your case approved after the RFE, assuming that you sent in what they were looking for.  I'd guess from your timeline that you should expect a decision one way or the other very soon.

One of two things are most likely IMO.

 

First, it could easily be a mix-up and your status just isn't true on the website.  I've seen that happen before

 

Second, they may have decided to transfer some files out of vermont to help ease their caseload.  

 

Personally until you receive a notice I'd lean more towards the first one, but if you don't get the notice in a week or so, I'd definitely call and find out where it's at and what's going on with your online case status.

We've waited six months to see this:

On June 13, 2013, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E).

 

I was told yesterday by my senator and congressman offices that I was approved, but it just updated on the web site and I got an email!

 

Finally some movement for the cases that were transferred from VSC to TSC! 

 

Now time to wait for NVC to assign our MNL#

 

I really am so glad to see one of the transfer cases go through.  Honestly I thought they'd have gotten some of these done earlier this week, but it's good to see that you made it through.  Hopefully the damn will now break and the rest of the people transferred will get their approvals soon as well, and hopefully VSC will then get moving on the remaining case load they have.

I had the same RFE plus proving we had met in person.  Both of which we had originally provided. We USPS priority overnighted the reply and we received our NOA2 3 days later!  Good luck!!!

 

3 days is very reassuring.  I'm sending my RFE back in about an hour.  So it should arrive there by tomorrow (wednesday) which means if it follows your time frame, we should have an approval either the end of this week or early next week.  The anticipation is killing me.

Thank you for your reply. I created a new letter of intent in my own words. Orginally, I used the template that was provided on this site for both her and my letter of intent. I realized I made one very small error in my own letter saying I cannot wait until "my" arrival and it was supposed to be "her" arrival. This error could have led to requesting a new letter or again it may have been lost in the many documents I provided.

 

I will work on the timeline later this week. Once I created a new letter, I overnighted it immediately to the California Center. Within one day, they updated the system that they are reviewing my response. I found that very positive since previously I had heard nothing since in close to three months. Best of luck to you as well in this tiring process! Thank you to anyone else that can share their input or insight.

 

Thanks for the update.  I have already gotten an express mail envelope and am ready to send it (assuming they don't ask for something more).  I am also going to express it directly to the address on the RFE, so I would assume our timeline's will be similar.  Best of luck to you.  Hopefully they find your new  letter sufficient and you have your approval very quickly.  I've heard many reports about RFE taking from a few days to a few weeks after they have been returned, so it will be interesting to see what happens here.  I wouldn't be surprised if you were approved this week sometime.

Can't quite answer your question as you seem to be pretty much 2 weeks in front of me across the board.  I am still waiting on my RFE in the mail, but I expect mine to be similar.  I didn't send her original in though, because she didn't realize I needed the original when sending me her documents.  I submitted a copy so I expect that will be what my RFE is for.  I did have her bring over the original when she visited as I thought it could cause an RFE, so if that's it I should be alright submitting that.

 

I am curious though, since they want an original, and you had already sent that in, did you send a copy and explain that you'd sent the original with the petition, or did you make a new original and send it in to them?  

 

I will be interested to follow your timeline and see how the timing is for your RFE to gauge how mine may go.  If it's not too much trouble, could you add the RFE info to your timeline?  Thanks

I just checked my case status at uscis and found out that they requested for evidence. It says that I will receive a letter which will tell me what evidence they need. However, in 2 days I have a flight to Russia and I'll be there for three weeks! I am not going to be able to sent back everything they need. I asked my sister to do it. However, the question is: what they may ask for the evidence? I

 

Basically they could ask for anything.   Either something you sent isn't sufficient to fulfill the requirement they set forth, or you forgot to add something that they require.

 

It could be letters of intent, proof of meeting within 2 years of filing, it could be you didn't prove your US citizenship, or that you were free to marry.  It's impossible to guess without knowing exactly what you sent.

 

 

When I sent mine in, the only thing I was concerned about was that the letter of intent was a scanned copy, but when I got my RFE it was for the divorce decree from my first marriage (I'd supplied them with my most recent (second) divorce decree only).  

 

If it's just some sort of document like divorce or birth certificate and your sister has access she could mail it back for you, but if they require something signed such as letters of intent to marry, she won't be able to do that.  

 

They do give you 2 months to reply to the letter though, so if worse comes to worse you can reply upon your return.

Everyone is absolutely correct, find the cheapest solution that works best for you.  The K-1 Visa will grant her access, so there is no need to show a return ticket or ties to her country as you do with a tourist visa, but it's not an immigration visa.  As others have said, you have a 90 day grace period to get married.  At any time in there you can change your mind and go home.  You are considered an immigrant when you file to Adjust status after the marriage.

If they request original documents from what you sent scanned copies of, you should be fine to just send the originals in, assuming you still have them.  

 

In my case, my fiancee sent me the form signed and original which I sent in, but she forgot to send the letter of intent, so I had her scan it and email it to me and I sent in a copy of that.  I got approved without asking for the original, although i've heard of others who've had to supply it.  

 

I had her send me the original so I could send it in if we got an RFE, but it turned out we got an RFE on a totally different matter and we didn't need it after all.

Hello there!!! I am a Jan 2013 (16th January) filer & got transferred to TSC last month. At the time of submission of I-129F, we have submitted a scanned copy of my G325A form & letter of intent. I am the beneficiary. And I am expecting a RFE for the same.  But just wondering, is it possible that sometime they approve my K1 application with scanned copy? Because it has been 5 months now since we have applied for K1 visa & haven't received any RFE yet.  Is there any particular time frame for getting a RFE??

 

The timeframe for RFE is the same timeframe for approval.  

 

The basics are this:

 

Send in your Form with payment and supporting documents to the Dallas Lockbox

They receive it, make sure you have the bare basics and cash your check, then send your petition to the proper service center (CSC or VSC)

They will receive it and get it in their system

At some point around here, whatever background and security checks are necessary will begin

Then your file sits and waits while all the necessary checks are ran

After all the checks, at some point it gets appointed to an adjudicator who then checks through each portion of the petition to insure that you do indeed qualify.

At this point they will either find that you do and approve you, find that you don't and deny you, or be missing some piece of information and request further evidence.

 

So, as you can see by this basic timeline above, the RFE will come at whatever time your case would normally be adjudicated.  

 

If you do get an RFE (as I did), be sure to have any possible requirement ready to go and get it back to them quickly.  Once they receive it back you should have your decision within a few weeks (Mine took 8 days I've seen as short as 6 and as long as 3 or 4 weeks, but 2 weeks is pretty standard in most cases.

There are tons of threads on this and I'm sure someone will get a main one going soon enough.  I'd recommend finding the main one and following it as this is likely going to be an ongoing thing with everyone updating everyone else throughout the transfer.

 

On to your question.  Last time VSC had a transfer like this was on May 20.  They sent a lot of Dec/Jan filers to Texas where they are currently being adjudicated.  It is assumed the same process for this batch as well, but you should know better when your notice arrives.

 

As I said though, if you find a thread with this discussion and follow the threads, you will likely get updates from others in the same issue as you, and they may have info before you.
