I am a British Citizen and back in 2008 i was studying in Australia for just over 2 years, and then back to travel for 9 months at the start of this year . . . . .so i know i need a police certificate for Australia, BUT do i need to get finger prints done for it as well?
because i read that in some cases finger prints are not required.

Just an update for Carl and I:

We finally were able to file my paperwork. We would have filed earlier, but had to prepare to go to Oklahoma for 2 months for Carl's work (or maybe we were just lazy after getting married lol). We're about halfway through our time in Oklahoma and we're excited about returning to Washington.

The paperwork that I received with my social security card stated that I am a lawful alien allowed to work, but when I contacted uscis I was told that I still had to file an I-765. So just a heads up for those who intend to work.

My wife and I were married on October 11 and of course with the government shut down, they were not issuing social security numbers, so we put ourselves into a holding pattern waiting on that to end. We went in and got her a social security card on October 28 and are currently waiting on it to arrive.  As soon as it does, we plan to get her on the medical insurance, bank account and then file the AOS paperwork with travel and employment requests all together.  We have until early January to be within the 90 day limit, but we want to move it along in the hopes of beating out the medical expiration.  Seems like a waste to have to re-do any of that stuff if it's avoidable.

So I know most people on this thread have celebrated the simple NOA2 already, but we FINALLY got ours! It feels like it has been forever. We got an RFE a couple weeks ago and then got our NOA2 today, so that part was at least fast. I'm just thankful they didn't forget about us! smile.png

Thanks to everyone for everything so far in this process, and congratulations to those who have recently gotten their interview and approval, and for those still waiting, god speed.  

 

Today, my fiance received her K-1 visa package.  She is now scheduled to fly here on october 8th and everything is set for an October wedding.  

 

For those still waiting, all I can say is that it is a stressful process, but there is a light at the end of the tunnel, just hang in there and be prudent and you will eventually prevail to be with the one you love

"Return travel document shipment notice" with a DX tracking number.

 

So they do actually use the email on file.  I gave them hers and mine when I got the number from NVC and they've never sent a thing.  I was starting to wonder what the point was lol

Just an update...

My visa was approved on August 9, in hand on August 15 and I know I broke the cardinal rule by giving notice at my job before my interview (I couldn't help it, I was too excited!). But by doing so, I was able to move as soon as I got my visa... Not that I should be recommending this to anyone lol.

I moved to the USA yesterday. I didn't have any problems at the poe, easy peasy. I hope that everyone else's journey can be just as smooth.

I am so happy to be able to live with Carl, and not have to return home in a couple of days.

I really hope that everyone will be with their loved one soon!

Hello February 2013 filers! I am a May 2013 filer, and just recently received a RFE. We submitted the items requested to our lawyer, which she presumably overnighted to the CSC. I am wondering this: any February 2013 filers who had RFEs? If so, how long until the service center acknowledge they received the evidence? How long after receiving, did you receive your NOA2s? 

 

I am hoping the wait isn't too long, though I know there is still a wait/process even after getting NOA2. 

 

My events timeline is in my signature.  I was a CSC filer with an RFE and all the dates are listed.  Hope that helps

I got an update on the 8th which I really thought was going to be the interview, after a call to DOS it turned out to be logging my DS 2001, which I had sent weeks before!

 

I hope your update turns out to be better news than mine did.

 

Sounds like we are both on a similar timeline.  Hopefully we get that interview date sooner rather than later.  I really want to be able to book a flight for no later than October 1.  There are only a few airlines that give a one way fare that is comparable to half the return fare, and they only serve my city seasonally.  The last flight for either is October 1.  Would be nice to be able to cut a thousand dollars off the price of the trip, that would save me just about the amount needed to file the AOS.  I'll keep thinking good thoughts and maybe we'll both have the interview scheduled soon.

Thanks so much for your recommendation. I have contacted the Sydney Embassy and waiting to hear back their suggestions. I will pop a cover letter in with my paperwork too before i ship it off.

 

It is a little reassuring to hear there is a possibility of leaniancy regarding the time frame at least!

 

I'm not going to test the 4 month limit, as we are currently in the waiting for an interview stage now, but it is my understanding that the 4 month period is the time limit for the fiancee to apply for the Visa at the consulate after approval is given via the I-129F.  If no filing occurs by the end of the 4 months, they consider the petition abandoned.  Since you are filing your application for the visa before that, it won't expire.   As others have said, they may require you to submit certain documents again, but this would be embassy specific,and since you've contacted them already, I'm sure you have your bases covered.  Best of Luck

Sorry for not posting anything in so long! I've been on holiday and prepping for medical/interview... Which leads me to say that my visa has been approved! I had my interview this morning (only an hour and fifteen minutes to boot!). I wasn't nervous at all (I thought I would be), rather I was excited. I am beyond happy right now, I don't think my smile will fade for a couple of days! smile.pngsmile.png

I have been over in the UK visiting my fiance the last few weeks myself and just got back.  We've gotten her medical done and her forms all sent in.  The ceac website updated on August 5 and again on August 8.  They have to send the letter with the interview date, and I suspect that the August 5th update was for receipt of the medical information (medical was done July 30) and that the August 8th update was the scheduling of the interview.  I expect she'll have that letter with the all important date by next week.  

 

Hope all the rest of the February filers are having similarly good results

Hey just wanted to update - we are now NOA2! We were informed via an answer phone message from USCIS two weekends ago. That being said we are still waiting for our status to change online and for the hardcopy! My fiancé called to double check - as I had not read of USCIS calling to let applicants know but it is all legitimate!

You have to call NVC or wait for them to send you a letter in the mail.  The choice is yours.  I can tell you that NVC assigned my case number on June 28 and I didn't receive the hard copy letter until July 13, so if you are impatient, I recommend calling. Does anyone know if I will get another notification (email or txt) when our petition is sent to NVC?

 

I have noticed that quite a few of the VSC/TSC transfers have gotten that message, and I think it was because there was a delay between approval and shipping to NVC.  Most cases are just shipped directly after the approval and thus no message.  My case, for instance (CSC) was shipped to NVC, assigned a case number, shipped off to London and received there, where they mailed my fiancee the "packet 3" letter of instructions, and my USCIS status is still saying approved.

For the two who got apparent approvals without notices, first of all, congratulations...second, I was getting texts and emails at the beginning and by the end of my time with USCIS I was only getting emails.  I've heard many people at different times not getting any notices and the NOA2 showing up in the mail so it does happen.  Have either of you checked your status online at the uscis website?  What is the status there?  Hopefully you are both honestly approved and if so, you should have a hard copy of your NOA2 next week sometime if all is normal.  Hopefully the rest of your journey is smoother than the first part.

We made the announcement of our approval in the forum yesterday but didn't make one here. We received our approval last night around 9pm EST! We were even lucky enough to be together as Jo is currently on holiday visiting me for the summer. I hope more approvals come down the line for others soon! 

 

Congratulations to you as well.  We weren't together when the NOA2 came through, but I am going to be there 2 weeks from now and she has her medical scheduled for then and by the time I leave, we will have done everything but the interview.  It is never easy when we have to part at the end of each trip (as I'm sure you and everyone else filing for a K-1 understands), but this time will be different because I know it's going to be the last time and only a brief time apart for us.  Of course after the marriage there is still plenty of USCIS headaches to deal with, but they will be much easier to deal with as husband and wife living together than they have been being apart.

We haven't received our NOA2 just yet or planned a wedding date but I am going over to the US on the 6th of September for 2 1/2 months (waiting 10 months to see each other again is just too long). We were hoping to have our NOA2 this month (We have a receipt of the NOA1 21st Feb). I want to try and have as much stuff ready BEFORE I go over to the US so that we can organise as much as possible, documents ready, file everything and schedule the consulate meetings while I am over in the US for as soon as I get back. I will have to visit the Sydney US consulate as there is no US consulate in Brisbane.

 

I was just wondering if there is a thread somewhere for Australian's similar to the UK posted earlier? It would be really handy to read over and get the opportunity to start getting what we can together now.

Just another quick update on my case....London has received our file and we have a medical scheduled for later this month.  We could have scheduled the medical a little earlier, but she wanted to wait to do it while I was there.  After the medical is done, we'll get an interview date, then we can get a plane ticket and make the actual wedding plans.  It seems almost surreal how much smoother this process goes once it leaves USCIS and goes to the State Department (NVC & Embassy).  I am feeling quite lucky indeed.  I hope for the best for the rest of my fellow February filers as well.  Hopefully we'll all be with the ones we love by year's end

Hey guys we received noa2 today.

Unfortunately our wedding has been booked for a long time and is on September 7th so probably gonna be too late were still gonna try but if I don't get the K1 in time I'll have to cancel and file for the marriage visa as were not cancelling the wedding






 

If you haven't already done so, you should make sure to read the thread pinned at the top of the UK forum regarding what to do from NOA2 til Interview.  It has lots of helpful advice.  A brief version of it is, that if you have a wedding planned (I won't harp on the bad idea part, I'm sure you understand now why it is so) you should be sure to get the petitioner information for the I-134 printed right away and get the supporting documents and get it sent to the beneficiary.  Once you have your case number (starting with LND) the beneficiary can fill out the forms (all listed in that thread in the UK forum) and schedule the medical.  Hopefully they have a police certificate, if not they need to order that ASAP as well as it takes 2-3 weeks (10 days AFTER they receive the request).  If you have all this done, then when the case arrives in London (about a 7-14 days from the time you get your case number assigned (mine took 11 days) you will be able to file your interview readiness documentation.  I've heard that if you have a date and put it in there, they do try to get you in with a quicker interview date.  Obviously, they can only get you into an available slot, so still no guarantees, but it's worth a shot and if it works could save you from another long wait for the Spousal Visa.

Yes,

On the 21st I learned that I had been transferred to another office, Then 3 days later I received in the mail a letter saying that it had been transferred to TSC. Now today I received another email saying the case has transferred to a uscis office. I thought the letter stating it was transferred to TSC was the confirmation of transfer?

 

 

It's really hard to say for sure.  Maybe you could find one of the threads from the previous transfer (there were a bunch in late may from Dec/Jan that had the same thing done.   Perhaps one of them could explain the way they received their notices and see if it matches up to what's happening this time. 

 

I think there were some threads in the Service Center Forum, and I know there are quite a few in this NVC thread who had the original transfer from TSC

my case was transferred on june 21st from vsc to tsc. I just received an email stating:

The i129 petition for fiance was transferred and is now being processed at a uscis office. Does this mean it was transferred back to vsc?

Sounds like you are saying that you got a transfer notice on June 21 and then another transfer notice today (July 2).  Is this correct?

 

If so, then I'd guess that the transferred files are actually now at the TSC and the first notice was when it was first appointed to be transferred and the latest may be saying that it has made it to the destination.  

 

Not 100% on this, but it sounds about right.

I just want to wish Good luck to those who are still waiting to hear something, I have all my fingers and toes crossed for you all!

 

We had our NOA2 on June 14th and our papers are already enroute to the UK. I just booked my medical exam too so the next few steps are upon us. But it's all still very stressfull and tiring, believe me it's the toughest times my fiance and I have had on this journey, so i COMPLETELY feel for those who are still waiting for part 1.

Do you mind if I ask if you know about how far out they are in scheduling the medical exam?  I am going over there the last week of the month and luck of the timing, I'm going to hand deliver the documents she needs from me for her interview, but she was hoping to get the interview in while I was there.  Since she lives an hour outside of london, we figured it would be easier to do it when we are already coming into london for other things anyway, and she would be more relaxed if I were there, so I was just curious about where they were at in scheduling appointments to get an idea of when to have her call and book it.

Hi Guys, I do hear this a lot here about people getting in touch with their congressman, etc. Does this really help you think? Also, how did you get them to write the email/letter? Is there a online process for this or do you just have to call them up and request one?

 

Each senator has their own website, so you can google search for your local one, and find the contact information online.  What happens is after you contact them, they will get you a form you have to sign and submit which legally allows them to look into your case for you.  All of this is usually done by an aide or intern or some other assistant type person working for the Senator.  Once they receive that form, they contact CSC and inquire about your case officially. Each service center has dedicated employees who deal with congressional requests.  They have a time limit to reply to any of these requests.  They must look up your case and reply to them by that date and then your congress person replies to you.  If there are no snags in your petition then this will generally get your application out of any possible black hole and onto the desk of an adjudicator.  

 

 

Many times, I've actually read where people were in the midst of starting to work with their senator when they get approved, and sometimes there's an issue with background checks or something else that is an actual cause for the delay, but at least you can get a reason out of them if not an approval or RFE.

 I assume that I go to the USCIS site and use the "e-request" link to request they do their job and process my petition already? Yes, thick with cynicism and sarcasm. Just flat out frustrated.

 

I understand.  I was fully prepared to have to file requests and contact my congressman and Senators to push mine through.  Luckily I didn't have to resort to that, but they are options that beat the heck out of waiting without anything to do to help the process like the first 5 months.  

 

CSC still seems to be churning out approvals (according to Igor's list) at a pace of 3-6 per day, and although this seems really slow compared to more recent times, just go back to april and you will see that it would take a week or more to get that many out.  3-6 per day on here is pretty much the pace they need to have to get through all the petitions at the pace which they come in (100 ish per month).  Hopefully they get to yours before you have to push further with service requests and congressional assistance, but either way, hopefully it'll come for you soon.  I'm rooting for you as well as the rest of my fellow February filers
