Yes there is a procedure once he gets here, the customs will go through his paperwork, stamp his visa etc. Some airports are easier than others, some are busier than others. Read some of the reviews here on VJ about different experiences at different airports.

K1 are for fiancées
K-3 is more or less obsolete and CR1 she has to go back home and have her medical and interview there...

Good day all.

We submitted our paperwork about a month ago and received an e-mail back that it had been accepted.

Just today when we checked with our Receipt Number it is saying that our case cannot be found.

Anyone have a similar experience?

When you file your returns, you do so for the entire year, so anything earned during that year (even before becoming an LPR) has to be reported. When we did our first tax returns as married filing jointly, we availed ourselves of the help of a CPA in order to sort out what to do with my non-US income. He confirmed that you report everything, but you do not pay taxes due to certain international tax treaties.

It doesn't really matter where you live, the first stage at uscis is the same for everyone. It can take anywhere between 6-8 months to get the approval there and the you are off to NVC before you get to the interview. If you are lucky, the visa will be in hand in about 8-10 months in total depending on uscis....

You still have to be your husbands sponsor and send in all that comes with it, your am taxes for the last 3 years etc. if you didn't have to file you send a letter explaining why and so on.... What you also need is a co-sponsor. Someone in the us who makes enough according to the guidelines and are willing to take on the responsibility.

Well if you are married you don't really have a choice. CR1 is it! And if you are unmarried and going for a K1 the wait is just as long. It is what it is...

But once you have your approval on the I-130, it usually speeds up. Some embassies will schedule your interview pretty fast.

Dont send in your orignial marriage certificate. just send a copy of the marriage certificate and the translated copy. because the original marriage certificate is needed during the NVC stage. during uscis stage is only certified copy and other things you have like skype, facebook, phone records, text messages, pictures and so on. This is what i did and we have no rfe and got approved even though it took us 8 weeks and 1 week. 


Well they might as well send in the original cause all their paperwork will be forwarded to NVC anyway...

You do not both have to go to file for the CRBA and apply for the US passport.  Check the Embassy website for how to authorize your wife to do all that in your absense.


I do believe South Korea is one of few countries where both must be present when filing for CRBA. On the embassy web page it says with bold letters that both parents and the child must be present. At other embassies it will give you info on how to go about it if only one parent can attend but no such info there...

Thanks for the quick reply. Yes, ideally, we'll be able to go to the embassy together to report the birth. But I'm just planning for a worst case scenario. If we can't make it up together (e.g. if my wife or baby is hospitalized longer than usual), then that means we can't do the CRBA. But then if I don't file for another I-130, what options remain?
 
Also, does the baby need to be present at the reporting of the birth, or just proper paperwork/photos for the baby?

Are you attending the interview with your wife? If so, talk to the people at the embassy when you are there and see what advice they give you.

I do believe the best would be if your wife and baby could go with you and report the birth before you leave. I know you can feel like ####### after giving birth but your child needs that passport to travel with your wife. ( I had to travel to the embassy in my country very shortly after giving birth so i know it ain't fun, but it is well worth it in the long run).
You don't file another I-130, your child is a us citizen!

Your timeline scares me a little.  When I have talked to the visa office via phone they have made comments like, "Straight forward case from Australia shouldn't take more then 6 months, year at worst case scenario."  Yet damn near everyone's timeline I have seen is a year or more.  My spouse and I spent the majority of our relationship at long distance.  We are really hating the fact we may be in for as much as another year of it after filing for a CR1.


6 months from start to finish is a dream, for some it happens for the rest of us no.
The waiting part sucks! Skype gets old and even though my husband flew over to Sweden as often as he could it was still never enough. BUT I have now been in the US for almost a year and you know what? It was well worth the wait!!!
A year seems long when you have it ahead of you but when its over you got the rest of your lives together!
