When I read about some lawyers I feel really lucky. We also had a lawyer but she kicked ####, had everything prepared and even contacted our congress man for us when it took too long to get the Noa 2. Get on your lawyers back, read up here on VJ so you know what to expect and then have a word with your lawyer!

We got in touch with our congress man when we had waited longer than the stated waited time. He helped us out, and kept an eye on our case all the way through. He even sent me a welcome to America post card....Now that post card was probably sent out because its election year lol

I already submitted for a CR1 but it wasnt front loaded which was suggested by other members since I/my husband would be dealing with the Lagos Embassy. I'm hoping the CR1 gets processed faster but it doesn't hurt to send the K-3 with all of the information.

I met my wife here in July while she was here on Vacation. After I went to Italy for 2 weeks, and then she came back here to stay with me on Oct 5th. We decided to get married, and now we are trying to complete the forms needed. Right now I am working on the I-130.

She now lives here with me, but she is technically on a VWP that expires on Jan 5th 2013.

Ok, here goes...

For Section C, and question 2, should I put her address in Italy, or my address here in Ohio?

For Section C question 14, She never received an I-94. I wrote in that she came as a visitor, but I am unsure what to write for the Arrival/Departure record (which is the number from the I-94), Date arrived (Im assuming Oct 5th?), and the expiration date (which says its on the I-94 form).

At the bottom of the form it has spaces for, Initial receipt, resubmitted, relocated, rec'd, sent, completed, approved, denied, ret'd. Is this for use for USCIS or do i need to fill this stuff in?

For Section C question 19, this goes with question 2. I am not sure if I should put her address from abroad if she is now staying with me because question 21 asks about the last time we lived together, which is now. Technically she is just staying with me on a VWP and her address is in Italy, but she is and will continue to live with me. Should I put N/A on her address abroad, and put our Ohio address for question 2 and for question 21? or should I use her Italian address?

Other than that, I think I have everything else, but any advice is greatly appreciated, as I am nervous to submit the wrong information and this get rejected.

I don't really have any answers for you but I do have some questions. When she came over here, had you already decided to get married and to adjust her status from vwp or was it a spur of the moment kind of thing?
If you had it planned out in advance it will be considered fraud, so be very careful to how you fill out documents and also when you tell them about how it all went about.

My husband hadn't paid his taxes or even done them for the last 7 years when we were about to send in the i130. So what he did was that he filed the last 3 that he needed to send in, didn't pay anything. That is all they look for anyway.
Now he has filed all his missing years and made a payment plan, but that he did after we got our visa approved, so no you don't have to have paid your taxes...

Your port of entry will be where you land in the us. This is also where you hand over all your paper work to the customs people. If you need to catch another plane to get to your final destination make sure you have enough layover time. Some airports take longer than others to process you!

Now that you mentioned it i went to read it too and I guess you don't, I sent my stuff in back in aug 11 and then you needed it! I suppose you can leave them out but than again there is nothing wrong to send too much so had it been me i would send it anyway.... But that is just me.

Yes those are vital documents, if you don't send in those how will they know who you are trying to get a visa for?

Hello,

1. Some people have told me that K3 visas don't exist anymore. Is this true?

2. My wife and I got married last year, here in Ukraine, and are now working on applying for her visa. Which visa should we apply for?

3. We no longer need to submit her documents with the visa packet, right?

4. We don't have much proof of a bonafide marriage, though we have pictures traveling with our parents together, pictures from our wedding, as well as documents from our apartment. Should we submit all of these things? Do pictures mean anything? If so, how many do we send? (just a few I'd assume)

I think that's all I need for now, I hope you can help us. Thanks in advance.

For VJ members who have their interview dates- approximately how soon after your NOA2 did you find out what your interview date will be? (For Montreal specifically).
I know it depends on how quickly the next forms were submitted etc but we have to plan moving around my interview date so are just trying to get an idea :)

It is impossible to say, it can be sitting in the mail room for weeks before it gets sent off to NVC. Then it can hang around in th mail room at NVC for a bit.

K3 is no longer used so that won't work. Besides you already have your Noa2, I say go for the interview where you will get a ref for not having enough income and in the meanwhile do all you can to find a sponsor or move home ahead of your spouse and get a job.

Maybe you wanna ask in your regional forum it can vary from country to country.
In Sweden for example you can book your medical before you have the letter in hand, the doctor will send the result to the embassy and they will keep it until the interview.
Over here the medicals are valid for 1 year, unless you have some kind of condition then it's 6 months. So check your regional forum to see how it works over at your end.

If you want to move there and then come back yes you would have to either find a job over here where you make enough money to sponsor your husband or find a co-sponsor. If you now have a job where you make enough money, why don't you just fly over, get married in his home country and then you fly bak and start the visa process. It will take anywhere between 8-12 months no matter how you do it.

My husband, who also is a sponsor even though not making enough, sent in all the stuff you listed above.
My co-sponsor didn't include pay stubs or employment letter but it worked fine for us.

The sponsors are responsible the whole period no matter how much money the immigrant makes. But if the immigrant and the spouse makes enough money the co-sponsor don't have to worry...

At the required medical exam, the doctor will ask if you have any health issues or take any medication. He answered that he takes medicine sometimes for blood sugar issues. The doctor then put that information in the paperwork that he filled out for the Embassy's information. My husband didn't take a test to prove that he has diabetic issues or anything, and diabetes is not a disqualifier as far as immigrant visas are concerned. The consular officer didn't even say that the health insurance policy had to insure for issues with diabetes. Just asked for a general policy that would last for 1 year and not be "traveler's insurance". They implied that it is an optional requirement that they can place on an applicant. When I asked for more information, the consular officer would only say to look at the USCIS website (where there is no information). I had to call the Embassy later to try to pin down the real requirements, and still feel like I don't have all the information.


To me it all sounds very strange, there is no such requirement in order to get the visa. No one can force you to get an insurance, if you want to pay out of your own pocket that is all good. You need to talk to some more people about this, maybe actually talk to someone at uscis or something cause it sounds to me like the consular officer don't really know what he is talking about.

Well if you got your Noa1 in January, you should get your Noa2 within 5-7 months. Then you are off to NVC before being scheduled for an interview date.
You are probably looking at 8-10 months for the whole process. Your child will most likely be born in Portugal.

Of course it matters if they ticked the box for the passport!! You think they ask for the passport just for fun?
Had they not asked specifically for the passport then no you don't send it, but now they did. I know you want to see him but I really don't understand why you wouldn't send in what they ask for when they ask for the passport??

If his papers check out they will put the visa in his passport and he is good to go!

It also has the box passport checked. It's at the end of the paper on the second page. Right after medical examination results.

He did report his name change on all forms. The CO wanted to know why he changed it.


If it has the box passport checked he must send it in! Not doing it will just prolong the process and might raise more issues. Why not just do as asked and get it over with?

But if they are satisfied with the documents he sends in he can have his visa in no time, but if they have to request his passport after looking through the papers the visa itself will take longer. He must give up his passport at one point or another. And if they ask for the passport why not just send it?

She will have to write and explain why she doesn't have the tax returns, shouldn't be a problem.
She needs to be making the right amount of money by the time of the interview and have papers to back it up, pay stubs letter from employer etc.. There isn't a certain time for how long she must have made the right amount of money.

But if she gets a job just before the interview they might hesitate, it's not a bad idea to have a co-sponsor lined up in time for the interview in case you are worried.

But if guys are not married yet K-1 is the route for you, and then the income won't be an issue at that stage..
