The beneficiary has their own forms to fill out for which they will receive instruction once the petition arrives at their consulate.  To get a head start, I'd recommend going to the consulate which will handle the case and find the specific information there as details will vary from country to country.

You don't have a timeline, so I'm not really sure where you're at with your case.

 

Did you get a notice online or text saying you were being sent an RFE or did you actually receive it via post?

 

If you haven't received the paper version yet, wait for that to show up.  It will have a list of exactly what they are looking for.  

 

If you have received that, can you tell us what is asks for so we can be of more specific assistance?

1)  RFE comes in the same timeframe as approvals would come if there were no RFE.  Basically when the adjudicator looks through the file and makes sure everything is in order, they either find everything they need and approve it or they find that they need more information and they request more evidence (RFE)

 

2) NOA2 is simply a Notice of Action.  It can be an approval or a denial.  K-1 is approved at somewhere around 90% so  odds are in your favor

 

3) Cannot tell you how long for the interview, as the process varies from consulate to consulate.  My advice would be to go to the regional forum for your consulate and read through posts there.  If you don't find what you are looking for, then make a post and ask.  People who have gone through the process there will be able to answer this much better than people who go through other consulates.

cray5ol.gif my cousin filed a k1 visa petition for her spouse, it was approved on the 25th of march 2013, he didn't receive his letter/packet, THREE weeks ago she found out the deadline is near and he still hasn't received anything so she sent a email to NVC and they replied saying they sent it to the console office in Jamaica and they will send it to him, whatever Jamaica said that they didn't receive it but there names r in the system. So she made an appointment for him to go pick it up in Kingston Jamaica, which he did they fill out the forms and email to Kingston office 6 working days now and the deadline is JULY 4th smh. who should they do? can they get more time? what will happen if the date pass ? thanks in advance

 

I'm not sure of the answer to your question, but I do believe you can request an extension.  I don't know if they commonly grant them or not at that particular consulate, but perhaps someone who has gone through there would better be able to answer that.

 

I do find it curious that you said she filed for a K-1 for her "Spouse".  If it's her spouse, they won't qualify for K-1, as the K-1 is only for a fiance visa.  That brings them over and they then marry within 90 days. If they are truly a spouse, they should have filed a spousal visa.

On the forms, you need to be sure to have both of your original signatures where they are required.  I believe the Beneficiary only signs the G-325a form and the petitioner signs both the G-325a and the I-129F.  Also, sometimes you can sneak through letters of intent with scanned copies, but since they need to mail you the original G-325a, I'd recommend having them mail you the letter of intent as well.  Also I advise using blue ink to sign with black ink for the form so they don't mistake it for a copy if you sign in black ink.

So, do you think it'll be alright to send off the necessary forms now and then have her arrange the medical once she gets back to the UK in September?

 

 

I am still awaiting my consulate number from NVC, but I believe that London will send her a letter detailing what they need. If she has someone checking her mail, she could have them open it and give you guys the information and she should be able to start filling out documents from here.  She could also schedule her medical for after she returns.  If she gets everything done ahead of time, and just waits to do the medical and send the "ready for interview"  form after she returns, I don't see why she wouldn't be able to get it all in before the expiration on the NOA2.  you may want to give her a new Intent to marry document to take with her just in case it goes past, but hopefully that wouldn't be necessary.

 

Like the other poster said though, check in the UK forum, I'm sure there are enough people in there who have gone through the process who could give you better details.

When I filled out my form I simply put in the box something like this:

 

Her Trips here:  2/17/2011 - 2/23/2011, 7/28/2011 - 9/5/2011, & 12/15/2011 - 1/8/2012, 

My trips There:  12/24/2012 - 1/7/2013

 

(These are just random dates, not the actual ones I put in, but am using as an example)

 

Then I supplied separate sheets of paper with copies of boarding passes for each of the dates, and one picture from each of the trips of us together.  With this section, I supplied a cover letter explaining each of the boarding passes and each of the pictures.  

 

Remember, you only have to prove meeting once, but it won't hurt to add extra.

In my opinion, the date on her intent or her G-325a don't necessarily need to be after your decree.  Both of these documents can still be true having been filled out the day before.  Your documents though must be dated after receiving the decree.  You can't say you are free to marry her when you aren't.  She's perfectly free to marry, so hers are probably ok.

 

Now, with that said, although I think hers should be fine, I wouldn't risk it.  It's not worth the stress you will inevitably feel during the wait time for processing, always wondering if they will deny you because of it.  If it were ME, knowing the anxiety one can feel during the wait, I'd go ahead and get newly dated papers from both of you and then file.  The feeling of security, knowing you did everything above board and properly is well worth it in the long run.

You're absolutely right, though.  I just reread the instructions that came with the I129F (as opposed to the instructions on VJ) and there is nothing about proof of ongoing relationship.  Oddly enough, I am less worried now!  This is a whole new feeling for me! wink.png

 

I will say, though, that I received a PM from a local person whose Londoner fiance just came over on his K-1, and she said they did ask for photos of them together or something like that at the embassy.  I made a page-by-page copy of everything that I sent with the I129F so I think we'll print that off on his end so he can bring them with to the interview, just in case.  

 

 

I did include photos with my I-129F packet.  Basically what I did was make a "relationship section" with boarding passes from trips and one pic of us together during each trip, labeled by date and place.  Since that packet is sent to London, I expect they shouldn't need to see pics from her, although I am supplying her with a copy of my packet just in case it were to be lost.  

 

Sounds like you have things totally under control.   Now for them to get on track and get you your approval :)

We're not even that far yet.  Still haven't gotten our NOA2.  I was referring to the items I put in the I129F packet.

I'm absolutely paranoid about getting an RFE, because I'm really good at worrying, and mama always said stick to what you're good at whistling.gif

 

I didn't send them in for that either.  Nothing in the instruction asks for it.  I know some consulates want to see more evidence of a real relationship, so including it in your packet helps with that, but I went through USCIS without any logs of any kind.  All USCIS needs is evidence that you have met in person. At the consulate is where they get more concerned with the details of having a real relationship. 

 

Having sent them in won't hurt you in any way, but not sending them in won't hurt either, so as far as the chat logs are concerned, you have no worries, no matter how GOOD you are at worrying  :)

 

Also, I can say from experience that RFE's aren't so bad either. They are very specific about what they want when they send them.  I got mine, sent it back right away and had my approval 15 days from the date of the RFE.  

 

I know I said don't worry several times, and I know you still will, because we all do, but hopefully the worry will be at least a little less now :)

Have no fear, I don't think in the UK you'll need them at all.  I didn't send in a single chat log from any of the methods we use (Skype, Whatsapp, email etch).  I have them and if they make a fuss over it at the interview I'll get it to them, but I haven't heard anyone not getting through London because they didn't print their chat logs.  

 

I realize that other countries do require a higher level of proof, so I'm not telling others not to print the logs, and they definitely won't hurt your case, but I'm just saying what I'm doing in my particular case.

I don't want to comment on what you may need or not need, as it seems every consulate has their own pre-requisites.  If nobody answers you here, you may try reading through the regional forum for the country the beneficiary will be filing for the K-1 and get consulate specific needs answered there.  That's what I would recommend anyway.

Sounds like you should have plenty IMO

 

When I filed my K-1, what I used as proof of meeting was boarding passes from most of our trips (couldn't find all of them but got most of them), along with one photo of us together from each trip with a note on the back stating time and place.    That was sufficient to get me through the USCIS phase of the process.  We are currently on the consular phase, and that's pretty unique to each country, so I can't really comment as to how yours would operate, but you should have plenty for the I-129F portion of the K-1 visa.

     We met online. I saved up thousands of dollars to be with her in person since she can't visit the U.S. I have been to Morocco in November 2012 and have tickets to go August 2013. I would visit more often if I had the money. We communicate daily via email, phone, skype, and instant messaging. Have tried visitor visa,DV lottery-none worked. Sufficient evidence will accompany. 

 

 

 

 

Is this enough?      Do you think we should add more informations?        Do we need to add a separate letter where we give more details about the circumstances where we met?       Do you have any  samples to share with us?

What I put in my answer was two lists one for her trips here with dates and one with my trips there and dates.  I sent boarding passes for each trip as evidence and one picture of us together from each trip as secondary evidence with the date and place written on the back of the picture.  This was enough in my case.

This is among the worst advice ever posted on VJ.

 

1. If the above poster's petition got approved with such thin evidence, it was purely luck, or sloppiness on the part of the adjudicator.  Primary evidence of having met within the 2 years before filing the petition includes boarding passes, passport stamps, etc.  Photographs are secondary evidence at best.  This is very well known and is beyond debate.

 

2. In no way can the above poster's situation be generalized to "the California centre aren't [sic] super strict on following things word for word."  No way at all.

 

3. Poster, again:  PLEASE avoid giving advice that could be misconstrued, and offering opinions as fact, when belief in either one could very realistically get people into deep or time-consuming trouble if they followed it.  People who haven't yet filed a petition are reading this thread.

 

Original Poster:  Wait for an RFE, if any.  Do not (do NOT!) attempt to send anything extra at this time, because the chances approach zero that it would be matched up with your petition.  Anything that you wish to send should wait for an RFE.  This includes information that satisfies the RFE plus any extra "front-loading"-type material that you might want the consulate to see.

 

You do realize, and I've seen it done on these boards multiple times, that people type "airline ticket" meaning boarding pass?  Not to say that is what either of these people did, but that is a possibility here.  If what they sent was a copy of their boarding pass they are definitely within guidelines, if it was just a copy of the ticket, they may well get an RFE and should be prepared, but just because you SHOULD get an RFE doesn't always mean you will.

 

I sent in a scanned copy of the beneficiary G-325a form before I realized it had to be the original and readied myself for an RFE on this, but they let that go by.  Different adjudicators adjudicate differently.  

 

My advice to the OP would be to go ahead and prepare as much evidence (boarding passes, Passport Stamps and such) from the 2 year period previous to your filing as you can.  If they send an RFE you wlll be ready for a quick reply and if they don't send an RFE you will still have the information if they ask at the consulate.   You can't have too much back up, because you never know from country to country and person to person, what will be asked of you.

hey guys, hope you all fine today, wel i would like to know what kind of papperwork must i have during the interview so i can start preparing now when i still have the time....  my fiance hadly has time to exchange mails or even chat, actually the little mails he sends is because we will be asked for evidence, we communicate through phone and chat on Whats App all the time,,, this is all i have for now:

       -a few mails like 20

       -photocopy of his passport and visas

is that enough, should he keep writting to me more letters?

I don't know the specifics of the Uganda Embassy, but I would like to point you in the direction that may be helpful. At the top of the page where it says "Forums", if you click this and scroll down to the 5th Blue Line which says "General Discussion Area"  you will see a list of forums.  The fourth from the top is called "Regional Discussion" and it has a list of forums covering all the different regions of the globe.  Find the one region which Uganda is in and go to that board.  There you can ask the same question and be able to find people who have gone through that embassy to help you with your specific questions.

As for the phone number bit, that is just plain silly.  It should just be a long blank box that allows you to type in whatever you need.  Whoever made that up wasn't thinking very well.  If it were me I'd probably fill in the rest of the form, leave that blank, then just hand write the number beneath the boxes before signing it and sending it in.

Unless they reject the package when it first arrives, which only happens if you drastically fail to follow guidelines, then no, it won't be denied sooner than approval.

 

Basically the process involves a lot of background and fact checking and waiting, but once an adjudicator begins to look at a file, it is either Approved, Denied or you are sent an RFE (Request for Evidence).

To file the I-129F with USCIS they do NOT need to be notarized.   I know that many places require them notarized if you take to long for the consulate (embassy) stage and pass the expiration of the I-129F approval (4 months past issue date), but to file for USCIS I-129F they you just need to each provide a letter of intent with your signatures on them.  It is best to provide the originals as sometimes people get an RFE for sending in copies, but since you are currently together, that shouldn't be an issue.

So, essentially the petitioner makes under US poverty line. We were going to have a sponsor but for various reasons they can't do it anymore. 

We always thought that in our circumstance a sponsor would be needed. However today checking the State Dept site we saw
 


 

 

The beneficiary has been guaranteed to keep their job when working in the States, working remotely - essentially they are key employee with knowledge of a bespoke systems, so hard to replace. The employer would sign an affidavit acknowledging continued employment in the States. The salary exceeds the Minimum poverty line +1 dependent after tax (US) and PAYE.

Would that be sufficient for proof of financial support?

Only a few (currently, TSC and CSC, plus VSC as a backup) centers handle I-129F petitions.  The location of the petitioner determines which center will be handling the request.  See attached map of the U.S. .. find the state the petitioner is in, and you'll have your answer.

 

(note: no, I did not create the map myself.. found it somewhere, and can't even remember where to give proper credits!)

The odd thing about the whole TSC/VSC thing, is that last year at this time it was the EXACT OPPOSITE.  VSC had been doing a pretty good job through the winter and they were the other center besides CSC.  CSC came to a near stop while VSC was chugging along.   FInally in the spring of 2013, CSC prioritized I-129F and they started speeding up...at nearly the same time VSC seemed to just stop.  Suddenly people started getting transfer notices saying they were being sent to TSC.  Then TSC became the regular stop for East side of the country petitions.  Now it looks as if they are perhaps starting to send people back to VSC.  

 

What makes no sense to me is if they are both having so much trouble keeping up, why not split the load...Southeast petitions to TSC and Northeast petitions to VSC.  They both have trained personnel and it would be a much smoother process.  But then again, since when did the government do things that made sense?

I scanned through the thread, and didn't see this one posted yet, so I thought I'd add it to help those in the future.

 

I received an RFE for a divorce decree, which seems basic enough, but my mistake was trying to use logic instead of just doing what I am supposed to do blindly.

 

See, I've been married twice previously.  Of course to apply for my 2nd marriage license, I had to show my divorce decree from my first wife.  I did this and they gave us the license. Well I figured that knowing you have to prove the previous divorce to marry the 2nd time, that my divorce decree from the most recent marriage would be all they would need.  Apparently that is not so.  The only thing they wanted for my RFE was a legilble copy of my legal divorce decree.  I went down to the state office that has them and got a certified copy and sent it off straight away. 

 

I just thought I'd add it here so anyone else in the future may see it before filing and be sure to send in copies of all divorce decrees.  At least my ignorance might be helpful to someone else down the line.

Yeah,  it's really the worst thing we've been through together so although it's tough for us at least we can see from this how committed we are to each other.  I would wait forever (hopefully sooner!) for her,  we will find a way to make it work in the end i know.
 
Next time she goes for the interview i will attend it.  This time when she got back to the hotel skype was so bad we had to resort to texting and it's so hard to show how supportive you are via text.  During her interview i wrote her a nice supportive email just in case of the worst-case to let her know i am hers forever.....and of the 1000's of emails we've sent back and forth,  that is the one email Yahoo sent to spam.  I guess that's why they have the '!'  on Yahoo!   So next time,  even if it doesn't contribute toward a successful petition,  i will be there for her.  Tears in my eyes now just thinking how she must have felt.   Well,  i did at least pay for her sister to fly to Manila to support her,  so she was not alone.  But next time yeah,  i will attend for sure - and i'd suggest anyone who can attend should do so,  it's going to be easier to ask questions there and then if there's 2 of you and one is a native English speaker - rather than contacting the embassy later.

Yeah,  i considered that for the first time last night.  First i will consult with a lawyer to make sure doing something like that won't just slow everything down.

I have to say I feel for you. The one thing I did was to fly over. Brutal trip, anchorage to manilla Saturday, arrive Sunday, rested Monday, interview Tuesday, fly back Wednesday and back to work in Thursday. But just being there eliminated lots of questions. I bet we weren't questioned a total of 5 minutes. Some girls were being grilled and we followed them to the same window and no issues at all. So I think you are on the right track to go back when the time comes.....good luck

Sometimes people don't know how to phrase it in the search engine. I read everything I can when I have a question ( and there have been a few) until I finally ask and get the answer. Sometimes the forum and its members don't have an answer. I do agree that you should read the quids and then search before you ask. That makes you a whole lot smarter than just getting the answer from some one. But I myself would never refuse to answer a question asked by others if I know the answer. This process is tough enough, why make it any more difficult.......

Keep in mind that you are sending it express to China. When I send things via the USPS to Thailand it goes quickly but when the Thai postal service takes over it might be another 3 weeks. Someone has to translate the English address into Thai so the rural postal person can deliver it. Remember, not every one in Thailand or China speaks/reads English. They also might open it and inspect the documents to see if there is gift tax to be paid. I'm not sure if this is what happened in your case but I can tell you that delays in delivery are probably not the fault of usps. I am NOT a fan of the USPS but I think other countries screw up the delivery times with processing and not the USPS. My wife is here now and in the naturalization process so when we send documents to her family or photos we do the English address to help the folks here and beside it we do the address in Thai. I think it speeds up the process a bit.

I do not blame any courier service anyway..i was just asking some advice where to send it. Of course I am aware of that not a lot of people in china does speak or write english..I do not had a problem sending letters to her since 2005, it just recently the last card I sent to her i took a month to received and the package the I just sent for her interview was returned and as the other member telling me that I would not find out the mistakes till I get my package back from the USPS..so it has nothing to do just to resend it and my problem would solve hahaha..this is life... :dance: Not really a big problem though ..thanks for everyone at least we share each other experience...Well goodluck!!! The holidays will over so tomorrow I could get to pick up my package.

I do not have her Chinese Address she is not a chinese..she is filipino just living and working in Macau their address is in portuguese words i did not wrote Hong Kong as she is not living in HK ..she is in Macau but you are write I will found out the mistakes once i get my package back..but normally when i send her letter or gift I used the same address as MAcau SAR China..and it was alright..so I wonder why this is the first time I used Express mail which everytime I use regular mail and it was ok.

another thing,i didnt have a very pleasant experience with DHL,the tracking number they gave us didnt work,so we had to wait over a month to receive our noa 1,HOWEVER,things didnt get lost,and my fiance had to use DHL in japan,so none of the workers spoke english and they couldnt understand what the problem was.


Well I heard a lot of problem sending package to China...the last card i sent to her she received it after a month..so I use express mail as i thought it would be ok but suck it won't.
Well..I hope it will be ok to send through Fedex..anyway thanks for all the respond I do appreciate..Merry Christmas to All of you!

my fiance sent docs for my interview on the 20th via fedex. got it on the 23rd.

Fellow Alaskan! I would use FedEx hands down over UPS/DHL in AK. The service is cheaper and much easier for us.


Thanks Grant!!! I will once i get my package as my fiancee advice me to send through FEDex more easy for her...I was slacker not not thinking about. :rofl:
