K-1 Fiance(e) Visa Process & ProceduresHelp with G-325a question

Your work status isn't relevant to the USCIS portion of your approval.  They just need the facts of your case.  Even if you didn't work the entire time, you can still get approved, it just may mean needing a sponsor on the next stage of things.  It's at the interview where you need the ability to prove your affidavit of support with documentation such as work records, tax returns etc.  If you can prove that at that time, then you are fine.  If not then you would need a co sponsor who could fit the financial criteria.  Either way that has no bearing on your G-325a form, so just fill it in with all your factual data and you'll be fine

K-1 Fiance(e) Visa Process & ProceduresIs Printout of TurboTax E-File Return Acceptable with I-134?

A copy of your forms with the documentation such as W-2's are fine, and as others mentioned, you can use your IRS Return Transcript.  They are free and can be ordered at this link:

http://www.irs.gov/I...er-a-Transcript

They generally take less than 2 weeks to arrive and no extra printing on your part

To be totally honest, there is no way to know.  It is in a constant state of flux. It could be anywhere from 3-10 months.

At this moment they are moving along at a good pace, and there are people getting approved from February, but there are also people without approvals or anything since October.  It's really a matter of luck of the draw.  Also, there are bound to be times during your wait that they will seem faster and other times where it doesn't seem like they are doing much at all.  There really is no rhyme or reason to it.

Best advice is to hope for the best but plan for the long haul, and absolutely do NOT make any plans that you cannot change.  Nothing in this process is absolute until the beneficiary has crossed through customs with that Visa in hand.

Best of luck to you

K-1 Fiance(e) Visa Process & ProceduresJust another question - beneficiary.

The petitioner has to send in proof that they are able to financially support you.  You take these documents with you to the interview.  Your financial status doesn't have a bearing on it, because it is expected that you would not be able to support yourself, as you are not even immediately eligible for work in this country when you first come over.

K-1 Fiance(e) Visa Process & ProceduresK1 Visa Expiry
Like they all said, you have to be here before it expires, then be married within 90 days. One other thing is to make sure to get your state I.D. Or drivers license before the visa is expired (7/10). We missed that one and couldn't get the state I.d.

Pay the fee and then schedule the interview. Pretty simple, just be persistent in setting the appointment. They get busy.

You need to build the folder as you suggest. I kept adding to it each week. Emails, proof of relationship, etc. I made a folder with everything and FedEx it to her. You have things she will need like tax returns, etc.

Schedule medical 8 to ten days prior to interview date. Need two days.

Best advice I can give you is to follow through on you intention to be with her at the interview. I did that and believe it made all the difference in the world. I only saw 5 Americans there that day.

Just google the forum for what to do after noa2. More information than you can possibly use. All good. Just prepare your documents using the examples and you will be good.

His assets in a different country will not help him. You could go and get a valuation on the gold and so on but they might not accept it as an asset. Might be easier to have someone else to sponsor if possible

I'm seriously considering calling on monday, we have waited a little over 5 months and I can't take it anymore! Our priority date is august 15 and I've seen people with dates from sept and october being approved! This sucks!

I'm really happy we got a lawyer, my husband is totally not organised and I would probably end up with an ulser if I was gonna rely on him getting all the paperwork done!

But we have an awesome lawyer who really knows what she's doing, she's not sitting around waiting for official emails she's one step ahead all the time. I say it's money well spent!

Usually you do the the medicals first so that the embassy has the result of it in time for the interview. If you were to do it at the same day the blood works result wouldn't be ready.

K-1 Fiance(e) Visa Process & Procedureswill we ever make it?

No he's not, he's automatically ELIGIBLE to be a USC provided the USC fiance has fulfilled residency requirements (if the child is born outside the US). If the USC hasn't lived in the US for long enough the child wouldn't be eligible. They will have to file CRBA, and he will need to prove he was there around the time of conception, or a DNA test will be done.

Yes the USC must prove that he has lived in the us for at least 5 years of his life. And the USC must sign a bunch of documents.
He will NOT need to prove he was around for the time of conception and DNA testing is very rare!
The USC doesn't even have to be at the embassy to register the birth, with the right documents the mum can do it herself.
I went through all this in May, its a lot of paperwork to take care of but its fairly easy!

Plus giving birth in your home country OP, the baby will have dual citizenship once you registered the birth at the embassy.

Would you be working abroad for a longer period? If not maybe just go through with it for now, once you have your noa2 you can delay things by not sending in paper work immediately etc. I think you can delay stuff for quite a while. At least that works for cr1

Yes you can enter on vwp and adjust status. It is not an automatic denial! As long as you didn't enter the country with the intent to do so from the beginning.

No they won't ask that. And even if you don't qualify for insurance you can always get one for your fiancé when she arrives or get married. Unless you rather just pay for whatever medicals she might need in the future. An insurance is not a a requirement to get the visa.

K-1 Fiance(e) Visa Process & ProceduresPregnancy during K1

USCIS won't speed up your petition and I doubt the UK consulate will, but once your petition reaches London, you can always call.

That being the case, please look into the CRBA for your child if your husband meets the residency requirements. Your child will need a US passport to travel and that can take a few months.

Please be prepared for no expedite, although I hope it does happen

good luck

The CRBA won't take that long if you make sure everything is in order. Have all the papers in order and call in for an appointment the day after the baby arrives and you are good. Once we had the appointment we had our baby's birth-certificate and passport within a week. But with that said, OP should be in the us before the baby arrives, she's only 19 weeks...

K-1 Fiance(e) Visa Process & ProceduresPregnancy during K1
Nope, sorry to say it won't do anything for you. And being pregnant wont speed anything up either. I was in your shoes last year, almost anyway, I got my interview one month after the baby was born cause California was way behind back then.
Once you get your Noa2 it all depends on how fast NVC is, and how fast you send in what they want. The interview will be scheduled after that. Usually about 3-6 weeks after case closed at NVC.
But you should still be good time wise, the airlines will let you fly until you are 36 weeks pregnant.
