I didn't use them verbatim, but you could. The meaning of "original" in this sense, isn't words that have never been used in such a way before. What they want is the original document and not a copy. At least that's how I interpreted it.

I would recommend just writing up a simple letter of intent and signing it, have your fiance(e) do the same and make sure to send in both of the originals (of course, also make a copy for your records).

Yes, in your case, being that you are a CSC filer from September, it is likely a safe bet they are working on your case. You are smack in the middle of the dates they've been currently processing (according to Igor's List). Sounds like you should either get an RFE or NOA2 sooner rather than later. Best of luck

The A# is assigned right as the casefile sits in front of an adjudicator, on an I-129F petition.


Just to be clear, this may have been the case before, but more recent filers are receiving their Alien Registration # right after acceptance of their petition and LONG before an adjudicator starts working the file for acceptance. I filed in February and received the A# for my fiancee right after the NOA1 and so have quite a few other recent filers.

Not saying that what you posted wasn't true at one time, just to let more recent filers know that this is common and no longer necessarily means that your case is being adjudicated.

Just because they are before you doesn't really mean they will be processed first. I've had 3 behind me already approved this last Monday and 2 others getting a RFE. You want to find all same kind of petitions with the same NOA1 date as yours. all the best.


Yes, I am sure that the odds say that others after me will be approved before I am, but I'm going to try to limit knowing just how many of those they are. My goal in this whole process is to try to keep an even temperament until the Visa is in her possession, then let my emotions flow. I have no idea how successful I'll be, but watching the cases after me get approved is unlikely to help me with my goal, so I'll just do my best to watch those before me. I see your Feb 8th. Im actually Feb 1st, as are all those others in my group I showed, but their alien numbers were all then changed on Feb 7th - and mine was not!

I know the Alien Number change dosent mean anything in itself and is just a mistake, but does it mean something if the mistake was applied to all but one case? Could it be that it didnt get seen at a certain stage where it should have been and so didnt trigger the message?

Still perplexed!


ah yes, I see. So you are a week ahead of me then. As for the reason it's not on yours, it's hard to know since there's never been any official explanation of why they started adding it early in the first place.

I'm guessing since you got accepted, you should be ok, but it's really hard to tell. I'd recommend possibly calling a tier 2 rep and asking them, but it may be hard to explain that you know this information because you use the online data to snoop in other people's cases Posted Image

I know! thats why Im a little surprised and annoyed to see someone behind me (WACxxxxxxx25) has already been approved! Are they really approving Feb '13 Filers already??

Also, the first numbers after the letters "WAC" is the year received (so we are 13) and the next number is what business day that fiscal year it was recieved so on mine its 90 (Feb 1st NOA1) and yours will probably be 91 (if your Feb 2nd and as long as the next day wasnt a weekend) so If you want to get to a different day you just have to change the 3rd and 4th number after WAC.

At this point, anyone who was approved from February is almost guaranteed to be an expedited case. For my own sanity, I just assume all expedites are for active military members needing specific timing on their petitions. There could be other reasons, but that one works well enough for me to overlook them

Why has 19 out of 20 cases had their Alien registration numbers changed and ours has not? What does it mean by "was transferred and is being processed at a USCIS office" ?


If anyone can help answer this it would be much appreciated, Im starting to worry and feel rather left out!!

I tried doing this with my case numbers, and went back 60+ case numbers and not a single one of them was an I-129F petition. I may try again at a later date and see how far back I have to go to find one, but luck has not been with me thus far

Sometimes people NEVER get the notification even tho they included the forms.

When you get your NOA1 - take this to your computer and make an account on the USCIS website. Log in and put your case number into your portfolio, select to have email and text msging for your case via the options and you will then start getting email / text for your case updates.

It could just be that the person with your information to enter into the computer was out of work that day or maybe they lost or mistyped your email information so you didn't receive it. Hard to know for sure, but if they cashed the check, they accepted your application, and you should have an NOA1 within 2 weeks. If it goes more than 2 weeks after your check was cashed and you still have no hard copy of your action notice, then you might consider making a phone call, but I'm pretty sure you'll be just fine.

Stamped or not, all passports are swiped on both entry and exit. CBP has this information in the system.


Oh I know she has to swipe it when entering the UK, and it's all entered into their system, but that particular border agent (it was in Seattle) earlier this month hadn't a clue on the length of her visits. Maybe there was an issue with the computer systems at the time, maybe it was a new agent who didn't quite understand how to check it. I really can't explain it, I can only pass on the experience as it happened.

They do know. When I entered this time, the officer at passport control said 'I see you stayed the whole 90 days last time'.


I think I will err on the side of caution and use other evidence.


That's odd, because when she came a few weeks ago, they asked her about it because there were no return stamps in her passport. Maybe she just got a rookie agent that day. Odd though because that was also the only time she was actually pulled aside and asked secondary questions. You'd think they'd have more experienced agents in the secondary area.

The UK is part of the VWP - visits of up to 90 days at a time are allowed and re-entry is allowed (no guarantee you get in!)


I imagine it would be hard for US immigration to track how long you were out of the country, because when my fiancee travels back to the UK, she just scans her passport, so there is no stamp ever showing her return. Only stamps in her passport are all US entry stamps. She's always returned WELL within the 90 days and never spent more than 12 weeks in any year here, but I don't see how they'd be able to know that from looking at her passport with the VWP

Honestly, I'm not certain all the emails are even necessary with the london embassy. I'd recommend reading through the United Kingdom Forum and this thread London Embassy NOA2 to Interview Thread In particular. Lots of good information there. From what I've read, it seems like you would be fine without the emails, but read through for yourself and bookmark that forum. Lots of good advice from previous filers

If the ceremony there is THAT important to the family, have you considered actually making it legal and then filing for a spousal visa (I-130) Instead of a fiance visa (I-129F)? This takes a little longer to process, but then the family would be happy and you'd still be keeping everything legal. Just a thought you may wish to consider if you haven't already

The important thing is to include that you are free and intend to marry within the 90 days and that you sign it and be sure to send in both ORIGINALS and of course make copies for your records

I just received an email stating that an RFE is being mailed to me. It states in the email that once they receive the requested information a new processing time will begin. I called them and they said my processing time won't start over. They said the only delay should be the time it takes me to receive the letter and return it.

I was hoping someone might be able to let me know what stage in the process this is for them. Or maybe it can be at any stage. We are already 6+ months since submitting the petition so I hope this is a sign that they are close to making a decision once they receive the requested information. So I guess what I am asking is what might be a typical timeline for them to send me a decision once I send in the information requested on the RFE.

Sorry if this sounds redundant or if I neglected to include anything that would help answering the question. I am a first time poster. Thanks.

I am still going through the process myself and have not received any RFE's, so my comments on it are not from personal experience, but from reading these forums.

You are an October filer at the CSC. CSC is just recently started adjudicating in this timeframe (while still clearing up July - Sept as well), so I'd say that once you receive the details of the RFE and get back to them, historically it seems that it could be anywhere from a few weeks to a month, although there are random cases that seem to take longer.

Hi, we filed on august 20th and are now at 8 months and 6 days and still no approval...the lady we spoke to said that we couldn't put a service request in for another 33 days because that's when we'll be outside of normal processing time...can someone explain this???


Because the website date shows they are processing July 18, when you call the number, they will only tell you that is the processing date, even though we all know they've gone past this.

The first person you talk to has only limited knowledge and answer your question based on a limited list of answers. To get more details, you would need to talk to a tier 2 representative.

I doubt ti would do a lot of good at this point, because the website says July 18 until they update it in May. You may want to consider contacting a Senator to see if they can get a better response for you, or wait until they update the site next month, but since that update will only move it forward to the end of March, it likely won't go past August 20 either.

Sorry I couldn't be of much help. Hopefully your approval comes soon though

Best advice I've seen on here in a while! I don't care how many skype hours you've logged - the honest truth is until you've spent time with someone in real life, you can't know what they are like as a person, and whether you'd be happy as their partner. Then add on the financial responsibilities you will have in sponsoring an immigrant. Spend as much time with the fiance as possible given job constraints before and during the petition filing. If you don't, you may live to regret it.


I was going to say something quite similar myself. I understand completely the ability to "love" someone before physically meeting them, but in almost every instance it will be different when you meet. I'm not saying it won't be love, but it will be different. You could totally mismatch physically and everything falls apart, or maybe you could get that much closer, but one thing is for certain, you won't know until you meet and spend time together. Some may not believe this, but those who have fell in love before meeting in person will understand, there's just nothing that compares to the way the feelings manifest when you meet in person. I think for the majority, love will blossom, but there are plenty of examples out there where it just didn't work out and I'm not even counting the cultural shock people can get when moving to a new country.

What it says here is that you can file yourself from your home country, but ONLY if you are applying for an immigrant visa.  Since you are filing a K-1 NON-IMMIGRANT visa, you don't qualify for this.  The other option is to apply for yourself when you get here.  I  recommend reading the link for yourself, it will help you understand a little better

When I went to fetch this form it said "You file this form only as instructed on another Immigration application or petition" - I only fetched it because the VISAJOURNEY check list mentioned it. Is this included as a precautionary measure or is this really required? Just a question out of curiosity.

 

 

4. A#

 

I've seen in mentioned on the I-129F and also on G-325A. On the I-129F it says A# and on the G-325A, it says "File Number A" / "Alien Registration Number A". They all begin with A - are they all the same number? What do I write in each field?

Sorry I can't help with all your questions but I can with 3 and 4:

 

3)  The G325-a form is required to be filled out by both the petitioner and the beneficiary and be sent in with your I-129F application.  Also, be sure to send them the original and make a copy for your records.

 

4)  The A# is the Alien Registration Number.  This is the number assigned to any non citizen living in the USA.  Assuming you've travelled on the VWP from Canada (no Visa necessary), you likely don't have one.  For my fiancee we just put NONE or left it blank (can't recall which off the top of my head)

Thank you that is all I am asking if it's okay for him to travel to Hawaii within that 90 days period and get married there instead of Seattle. Because we have most of our family back here in Maui Hawaii and this is where we want to get married. After getting married we plan to have our Honeymoon there and stay just for a little bit then back to Seattle to start our life together. smile.png I appreciate the help I really hope that it gets approve soon.

 

The other poster was absolutely correct.  Once the beneficiary has the Visa and enters the US, they can then travel throughout the US without any restrictions.  You can get married in Hawaii, Florida, Alaska or wherever you choose within the US.  The only travel that is not allowed is travel outside of the country.  If he leaves the US before he gets the proper documents, he will not be able to re-enter the country until he has his green card or he gets travel approval, which can be applied for when adjusting status.

SOP nowadays.  Used to be that they didn't add that number until they were ready to adjudicate the case.  More recently they started adding that number right after you file.

 

All it means is your case is filed and you are waiting in line with the rest of us.  Everything is normal

I, like you have to spend most of the process away from my fiancee, but others, have different situations.  It's very possible to overcome the support issue by having a co-sponsor, so the financial issue may be overcome like that.

6 months is most definitely a long time, and may be given some extra scrutiny.  I can't really speak to that because I only go over for a few weeks at a time.  My only real advice would be to make sure to have your return flight booked when you go over and print up the e-ticket for the return to show as evidence.  Also, it might be a good idea to bring your NOA1 with you.  If they push the issue of thinking you are trying to immigrate there, that might help them to see that you actually plan to have him immigrate here and could be your "ace in the hole" to get you past their passport control.   One other thing, and I'm not looking for you to share the details, but I just want to say to make sure that with you spending the 6 months over there, that you will have a co-sponsor or some other way to be able to prove your Affidavit of Support.  Best of luck to you

This is a recent change in how they operate.  They didn't used to add the A# on until they pulled the case out to start adjudication, but the past several months it's most common that the number changes a few days after acceptance.  I assume it means that it has arrived at it's designated service center but have no facts to back that up, just the timing.  

 

SInce you're NOA1 is in late April, you are getting yours at the start instead of the end.

Pretty much ANY change at this point in the process is good as long as it's not a denial.  Anything else means they have actually done something with your case.  

 

More recent filers are getting that number change message shortly after filing, so we don't know ours is being looked at until we get either the approval or the RFE.

 

Since they are doing SOMETHING with your case, it's HIGHLY likely, as others have said, that you'll see some sort of notification very soon.  We won't know if it's an RFE or an approval until they send it, but either thing means you are much closer than most of us.

The way the system works is they must count every person in the household from which the income is counted, so when you get a co-sponsor, they have to be accounted for not only you and your fiance, but also for anyone living in their home.  It doesn't matter if they are solely responsible or not.  

 

I don't know all the details of it because my income was well over the limits needed, but I've read here that you can add cash on hand to your income to help make up the difference.  The cash isn't equivalent though, and needs to be more than just the difference (I think it's 3 to 5 times more, but hopefully someone can chime in who knows)

 

Let's assume it's 5 times the difference and you need to have 18,212 total per year to qualify.  Let's say you only show making 16,212 per year.  If it were 5 times the difference, then having a savings of 10,000 could put you at a qualified level.  This might be worth looking into if it's at all possible.

I hope everyone is having a good day, today i received my letter from the London embassy and i have a couple of questions.

 

I have filled in and printed off the forms DS-230 part I, 2 copies of DS-156, 2 copies of DS-157, DS-156k and just need to fill in and print the DS-2001.

 

My questions are, in the letter it also says i need my results of the medical examination and on 1 of the forms it says i also need evidence to support my fiance(e).

 

how do i go about getting the medical and for the evidence of support, is that from me of from my U.S Fiancee?

First of all Congrats on making it this far

 

The above poster is correct in that you need your fiance to send you a signed copy of the I-134 with supporting documentation.

List it.  You'd be amazed at what the governments already know about you.  Having too much information won't hurt you, but not listing enough or omitting things will cause you headaches down the road that you could easily avoid.

The only entity that can place mail into a PO Box is the USPS.  This is why there are two addresses for sending the original I-129F Forms.  One for express which you can use the USPS or UPS or FedEx or DHL or whatever service you like, so it is delivered to an address and the other for regular postal service that goes to the post office box.  

 

So basically if your only recourse is sending it to a PO Box, just send it through the USPS mail and choose the delivery service between 1st class, Priority or Express.  First Class is supposedly the longest but generally takes no more than a week and is the cheapest route.

Completely agree with Jay-Kay....customs is a variable that just cannot be positively quantified.   One person could sail through smoothly while another could be taken aside for review.  My fiancee has been here multiple times and has cleared customs in various airports in plenty of time to catch connections ranging from an hour to 2 hours, but the last time she came over, her flight was late leaving so they'd already booked her on a flight for the next morning, so she had a long wait and customs did pull her aside for further screening on that trip.  Sometimes it's just the luck of the draw.  You can plan the trip with that layover, but make sure you have a contingency plan for what to do if the flight is missed.

Thank you Azsara, you were the only one that was really understanding my point. My fiance {HE}, is not as organized as I am but can do it if necessary. So basically I was wanting to see the norm not that gender mattered. I am still new at this and still learning.
 

 

It really doesn't matter who is the most organized,there are portions that each person must handle.  Yes, one person is likely to be best at learning the rules and steps and all, and will likely have to help the other with their parts (I did that in our personal case), but there are parts that I cannot do and she must, and there are things that she cannot do that I must.  It truly takes both people working together to get through the entire process.

The USC should be filing the petition

Not only SHOULD the USC file the petition, they MUST file the petition regardless of gender.

 

Filing the I-129F form is basically the USC asking for permission for his fiance to then apply for the K-1 visa at the US Embassy nearest where they live.  Once USCIS approves the USC petition, then the onus falls upon the beneficiary to do the necessary steps to acquire the Visa.

Your work status isn't relevant to the USCIS portion of your approval.  They just need the facts of your case.  Even if you didn't work the entire time, you can still get approved, it just may mean needing a sponsor on the next stage of things.  It's at the interview where you need the ability to prove your affidavit of support with documentation such as work records, tax returns etc.  If you can prove that at that time, then you are fine.  If not then you would need a co sponsor who could fit the financial criteria.  Either way that has no bearing on your G-325a form, so just fill it in with all your factual data and you'll be fine
