I'm a US citizen corresponding with my girlfriend in Malaysia.  We're both the same age 53, met on a Christian dating site and are interested in getting married.  She doesn't fit the profile of someone just trying to escape their country for a better life.  She has assets in ML, including a house,  a good life financially, and family in good shape financially as well.  I'm also very financially stable as well with a pension.   My girlfriend recently filed for a tourist Visa to come visit me here.  She was interviewed at the U.S. embassy in her country and turned down for the tourist Visa because the IM officer interpreted our actions as intending to get married since he saw we met on a dating site.  He then advised her to apply for a different Visa.  I have no problem with that but am concerned that this is a "black mark" against my girlfriend in the eyes of immigration and may be detrimental in my applying for a Fiancee Visa after my trip to Malaysia.  Does anyone have any thoughts on my situation?

I'm filing for a K1 Fiance Visa for my fiance in Malaysia.  We're filling out the above forms at present.  My fiance was not legally married to her first husband but just had a traditional Indian ceremony.  Therefore there are no records of them being married or separated; he left her.  My fiance then married another man who she was legally married to but he filed for divorce and now they are legally divorced; we have all the documentation for this.  My first question is, should we list the first marriage even though they weren't legally married and no documentation of marriage or divorce?  There were children by the first marriage but they have either died or are out of the house on their own and my fiance has no legal responsibility for them.

 

My second question is about filling out form G-325a.  We're required to list my fiance's Mother and Father, their date of birth and death.  We have no record of either or what these dates are.  My fiance's relationship with her mother and father was very difficult so she has no knowledge of these dates or even where to find them.  Will this lack of this info cause problems for us in the petition process?  Should I seek an immigration lawyer in my case?  Thanks for any help you can give.

You don't need a letter from your employer, paystubs and taxes are fine!

But if you do want to send a letter, make sure it has a letter head with the company logo, it should tell how long you worked there and I guess how much you make since income is the important thing here...

My parents have agreed to help out until she and I can afford to move out on our own (once I get a full time job). So we do have co-sponsors able and willing to pay for her every need. My parents and I have never been on welfare. My job history, well... I'm not sure you could call it "decent". I've helped out at my dad's business for free for many years and I've volunteered for another business. As for paying jobs, I have only had those 1.5 months working part time for Wal-mart and I've kept the pay stubs. It's something, at least. I hope to get work with them again soon, since I'm on their "hire list" when they start hiring employees again. It's just that you can never know when that will happen.



Well how about looking for something else while you wait for wal-mart?
Only 1,5 months of work will probably not help, how old are you?

Anyone can enter the US to get married, that is perfectly legal. It is when you enter with the intent to marry and adjust status that you are in trouble. That is fraud. But marry and then go about it the right way is just fine. Still have to go back to Canada in other words.

I didn't have to do the x-rays for my medicals, I was pregnant and it was no issue. Get in touch with the embassy and talk to them about it, the doc might be wrong. The only thing when doing the medicals when pregnant is that they will only be valid for 6 months instead of a year.

About getting your marriage "registered" in Sweden you need to send a certified copy of your marriage license to skatteverket. If i don't remember completely wrong there is also a blankett to fill out. But that one you can find and print on there web page.

Can you postpone the interview perhaps? Once you get the visa you will have i think 6 months to enter the US. But also remember that registering the baby as a us citizen abroad will take some time and you might want to let the baby have his/her first vaccinations before flying. So taking all that in consideration your fiancé and baby might not get here until beginning of next year.

She will not be able to get her vaccinations when she is pregnant. And her medical will only be valid for 6 months. You know that you don't have to rush the next step, once you have the Noa2 you have quite the time frame to get the rest done. Also, when the baby is born you need to register the birth at the us embassy so he or she gets the citizenship and that can also take some time.....

No pregnancy is not a valid request to be expedited, i was in the same situation so i know it sucks. But then again, if it was everyone would just get pregnant and get in the country faster!
What you should do now is gather all the paper work so you can report your child's birth abroad and get his/hers American passport!

Don't call uscis about it, if you got your Noa2 your papers will be sent to the NVC.
We had a similar issue, but I brought it up at the interview just to make sure the visa had the correct spelling. It was a type error made by someone at uscis and no problem to fix.

A...The spouse cannot re-enter the US unless they have "advance parole" authorization (application form I-131). Advance parole allows you to re-enter the US before approval of Adjustment of Status. Without advance parole approval, the USCIS (INS) will consider you an intending immigrant without a valid visa, and you will be denied entry. I'm a little confused at the question. You are filling out the form for your fiance? You do realize that he must actually sign the document before it's sent in with your application, right?

I really can't say what you should put down, but if it's the beneficiary who had the "under the table" work, then I don't think it would be much of an issue as far as tax wise or anything since it's the US government and not the UK that is reviewing the forms.

The problem you're likely to encounter is when they ask how he supports himself if he's unemployed for 5 years, and if you lie and they find out, then you face the very real possibility of a denial.

Hopefully someone can advise you on what they may have done.

I can say that my fiance was payed cash and never had to file taxes over there because her job didn't pay her enough to require taxes to be filed. We did put it on our forms and I don't expect any issues to rise from it, but we are just beginning the process.

If they have a smart phone that can access wireless, then you could check into the airports and see what they offer for wireless plans (many have some sort of free wrieless, I would have checked, but you didn't state which airport in New York) and he could either email you or download a texting app that works over a wireless connection (Skype, Yahoo, WhatsApp) just to name a few. I have used airport wireless connections to contact my fiance on trips and vice versa and we've really never had any troubles.

I wouldn't worry too much, but sense you have the case number, you can always try calling them and insure they have the correct address. Honestly, I was surprised at how fast mine showed up, but if you're worried, you can try calling, but you might want to wait another week before doing so. Receiving your NOA1 is nice, but there's another good 5 months before they actually do anything with your case, so there's honestly no rush.

I got the exact same message as you (even down to the date). It seems that it is something that they are doing now, and that is getting an alien registration number attached to the case when it's first received. It's merely a sign that they have it in the system. We still have quite a wait in front of us.

That's my assumption as well, but I read a discussion on here the other day where someone with a K-1 was being asked to pay it. I am figuring that t's not a fee I'll have to pay, but I figure it's better to be prepared to pay it and not owe it then not be prepared and find out that you do. Since the OP seems to be attempting to figure total costs, I figured it would help to have that number. Certainly won't hurt :)

Once you're done with the AOS you have the ROC fee too. They get you coming and going!
