So, we quickly booked our 2 roundtrip tickets - and the total price is less than one ticket was for the exact same flights and itineraries one week ago. I guess no one was buying tickets last week! There were lots of seat choices as well on the flight, so everything is falling into place quite nicely, thank you!

Next step - rent a car. I noticed at one of the car rental agencies their cheapest vehicle to rent was an SUV and their economy cars were more expensive, hehehehehe!


Kathryn, have you ever used priceline for rental cars? I do it all the time and end up getting them for next to nothing...if you're the type that needs everything to be done well in advance, I wouldn't recommend it, but I usually book my cars a couple days before the trip and you can get them for half the price they list...

I think if I were you, I would put together a lot of evidence showing ties to Canada and attempt to visit your husband in the US again. It sounds like you had the wrong Customs Officer on the wrong day. This forum has many examples of people visting their loved ones in the US after having been denied at the border. As long as you didn't sign any paperwork saying you wouldn't attempt to enter again, I would treat your denial as an isolated incident. Our particular denial resulted in us signing a paper that explicitly told us that my wife couldn't enter the US until the visa was obtained.

Of course, it's all up to you, and if you don't feel comfortable then by all means don't try to come over again. I would advise against bringing all your belongings though, which is what probably tipped them off the last time wink.gif

They will know when you file for the visa, so be honest at all times at the Border.

I believe he can go to the nearest Canadian Embassy wherever you live and apply for a waiver of sorts. I'm not sure how it works for anything beyond DUI/DWI, but you might check into it. Did the Canadian Border Patrol say he couldn't try again?

My wife and I were in the same boat as you regarding your denial. Did you sign a "Withdrawal of Admission" form? If you did, it won't affect your visa process now, but it probably would be best to avoid trying to enter again without the visa in hand, which it sounds like you guys already know. If you have repeated denials after being told not to try again, it could result in negative consequences down the road.

If you didn't sign any forms, but were just denied entry, it is possible to visit the US, but you should be prepared to show strong ties to Canada that will lead a rational (big assumption, there) border guard that you will return...mortgage statements, letters from work showing you're on leave, etc. Without those a border guard will assume that you're making THE MOVE and will complete your immigration requirements from within the US, which is a no-no.

The most important thing is to always be honest with the Customs folks. However, don't volunteer anything, just answer their questions honestly. Doing otherwise could really F things up for you.

Best of luck to you both. My wife and I know exactly how lost you're feeling, since we were there 10 months ago. It gets better...

I was under the impression you needed to show all deposits for the past year. My bank doesn't have smart enough people to do this on their own, so I had to print out all my statements for the last 12 months, add all the direct deposit transfers as well as deposits up, show them how much it was, and basically feed them a letter they could copy. I also had them show any assets I had through them and balance remaining on them (trucks, boat).

The only thing they really knew how to do was notarize it.

If you're not planning on actually immigrating to the US (at this point), I don't think you have anything to worry about. Like the previous poster said, you should make sure that you do have some evidence of your ties to Canada, but be honest with Customs if they do ask. You're not doing anything illegal by coming to the US to get married. If and when you decide to move to the States, you can apply for an immigrant visa at that time (DCF route will most likely be the easiest and quickest for you at that point)

Apply now for the K-1. You can apply for a Consular Birth Abroad, US Social Security number, and US passport (for your child) if your child is born overseas. You can add your child when he/she is born later in the process, and if you take care of all of your child's dual citizen paperwork, the child will not need a visa. If you're in Anchorage, you can go down to the Immigration Office at 10th and Gambell and they can help you fill the paperwork out. You probably won't need a lawyer with the vast resources on this site, but if you decide to get one, I can tell you who not to get in Anchorage!

Hi Guys this is Mike from Toronto and first of all............CONGRATULATIONS to you both on passing your interview!!!!! FABULOUS!!!!!! Mine is on the 30th of June(GOD, that's next Monday for heavens sake.......LOL) so doing flip-flops emotionally at 3 in the morning......lol.

Sorry I don't have a profile up yet as I just discovered this amazing site last week but I couldn't help notice your advice on having a denial on your record. Last April, based on my frequency and duration of visits to see Debra was asked to "Withdraw my Application for Admission" at Pearson Airport because at the moment I didn't have documents(utility bills, proof of employment, etc) to prove my intent to return but came back a week later and was given a 6 month B2 Visitors Visa. Then just on May 13th past I was refused a TN work Visa(before I received my interview letter) based on the fact that my 1977 Guelph University degree said "Bachelor of Science" as oppposed to "Bachelor of Computer Science"......lol, can you believe that???

So sorry to be so long winded about asking if you think that these 2 denials spaced more than a year apart will adversely affect my interview. All other extensive documentation as been given to me by my Lawyer and it seems like almost a slam dunk........lol, but just wanted perhaps a more educated opinion about things!!!!

Did you get your picture taken by the webcam and have your fingerprints taken? And did they give you a "Withdrawal of Application for Admission/Consular Notification" form I-275? If you did, you're in the same boat as my wife.

I've asked numerous CBP officers on my travels back and forth to visit my wife, and they all have different answers, but none too encouraging. I called Toronto Pearson CBP, and they were really rude about it. But the majority of the people at CBP that I've talked to cautioned against trying to get back in...it basically comes down to you having strong enough ties to Canada that you'll return after visiting your spouse in the US. This would be your job, house payments, college classes, etc. But, even if you could provide that, most of the CBP officers said that it was highly unlikely that they would allow someone to go thru after being denied. I asked at the US Consulate in Toronto while we were there for our son's CBA, and they recommended we not do it either. But that CBP officer who told you that you may have luck with another officer was right...it's just a very, very low chance of actually getting that one officer who's nice enough to let you in.

If you didn't go before a judge and have a hearing, at this point, the denials of entry won't hurt you in the long run. Or so I've been told by the CBP officers. But if you keep trying and keep getting denied, it may impact you down the road, there may be a point where it does affect your visa application. Because if you did get the form I-275, you probably were told not to try again until you had your visa in hand.

Others may have different suggestions, but we are playing it safe and not even attempting it.

When your I-129 and I-130's are approved, you will get an NOA2. This will say that your paperwork has been sent to the NVC. The NVC will send you a letter saying it has been processed and that they have sent it your respective Consulate. The Consulate will then send you Packet 3. When you send back the checklist and paperwork that the Consulate asks for, they will give you an interview date.

In summary, you won't get your interview date until after you've sent back Packet 3 information. You've got a little while before that happens, so hang in there! good.gif

This probably doesn't help you since you're not in Canada, but we sent ours Canada Post on Thursday morning. Purolator said they couldn't send it because it was going to a PO Box. Not sure if UPS or FEDEX run into the same problem.

Not to hijack your thread, but did the K-3 seem a little light? I'm assuming they only wanted the checklist because they already have some of the documents, and the rest they'll only need to see at the interview. Or will they want some of the paperwork before the interview, like the police background report?

Also, what did you put on the expected entrance date to the US on the 156 form? I entered that it was pending our K-3 visa approval...hopefully that works.

It would appear from Liz's spreadsheet that over the last four or five months the actual wait for a K visa interview in Montreal has been a little less than 3 months from the time Packet 3 was sent back.

You don't get to pick your times, but I've emailed Montreal with questions and they've been very good about getting back to me, so it never hurts to ask. I would think that if you wanted to get an interview date at a specific time, you'd be able to ask for it when you send your Packet 3 back, but I'd bet it wouldn't get you in any sooner. I am actually thinking about asking for a certain period of August, even though I think our interview will actually be in June or July.

Don't get caught up in the "touches." We didn't have any touches after waiting over 6 months, then all of a sudden both I-129 and I-130 were approved the same day. In fact, if I go to the USCIS website and type in my case number, it still says recieved and pending, even though my paperwork is in Montreal already.

Don't get discouraged...sometimes it's good to take a break from VJ every once in a while because it can get really depressing to see everyone else waiting, and people getting approved, etc. Even though we're all happy for everyone who moves along, it's a reminder that we're still waiting, which can get tough. But every day is one day closer to getting that magic visa smile.gif

It sure seems like things fly once you get the NOA2, so just hang in there! good.gif

Firing our lawyer didn't slow us down at all, if anything, it made us feel more in control of the process. Not sure why you're getting rid of him, but this was the letter I sent our ex-lawyer.


My wife and I have decided that we are no longer in need of your representation during her K Visa application process.

When I signed our fee agreement on June 19th, 2007, you said that you would put forth your “best professional efforts” for us. After our I-129F packet was sent out approximately 50 days after our I-130 NOA1, you assured me that your office would do a better job with our case. Yet your office initiated no communication whatsoever since then. Furthermore, an email that I sent to you on December 28th, 2007 was unanswered until January 14th, 2008, with your explanation that it had somehow went into your spam filter. I found this completely unprofessional, but even more concerning was that further email correspondence to your “xxxx@visamerica” account has also gone unanswered. I understand that you are extremely busy with many cases and that delays may seem minor to your office, but to me, every day I am separated from my wife and infant son is extremely painful. The bottom line is that I can no longer trust your office with the welfare of my family.

On June 19th, I paid you $3,500 to represent us through the I-130/K-3 and AOS process. I believe your office has earned no more than half of this fee in preparing the K-3 forms, and that we are entitled to a refund for the AOS that your office will no longer be performing for us. We would like to collect our I-130 and I-129 F files and any other paperwork that your office has in your possession on Friday, February 15th, 2008. I expect that this will give you sufficient time to make any copies you feel are necessary for your office to keep. If you require any further explanation from us you may reach me at my email address.


There are lots of people here who can help you get thru pretty much any scenario you will encounter. Unless your case has special circumstances, I would get rid of him. You are entitled to any paperwork that he has submitted on your behalf, but I would call your service center to inform them that you are removing your choice of agent as well as sending a new choice of agent form. Legally, he is supposed to forward any correspondance to you from Immigration, but in my case, he waited a long time to do this. Luckily, I had already received the paperwork from USCIS and it seemed to be duplicate.

Oh, and ask for some (or all) of your money back. If he doesn't want to do it, "Fee Arbitration" and "Bar Association" are very strong words to sprinkle into any conversation, as long as you have solid reasons to fire him.

Has he been working in Canada while living with you, or has he been "illegally" living in Canada? If he's been there legally, you may want to investigate the Direct Consular Filing option, also found in the "Guides" section. It seems to take a lot less time then the K visa process.

As far as visiting during the visa process, you can as long as you establish strong ties to your current home, job, etc. Lease or mortgage agreements, a note from work saying they expect you back on such and such date, utility bills, etc. Even then it's not a "for sure" thing and it is up to the particular border officer to decide if you are making the big move. No guarantees there...

Haole is right about the K-3 versus the CR-1. It seems (to me) that the CR-1 is taking about the same amount of time as the K-3, so if I were to do it over I would have done the CR-1. Read the guides at the top of the page to see which one makes sense for you. The K-3 was supposed to get you together with your loved one the quickest (of the already married visas) but it hasn't been working that way lately.

Well, if it makes you feel any better, I wish they would have cancelled my I-129 and let me go with a CR-1 rather than a K-3. In my case, it would have been about the same amount of time, and the CR-1 is a better visa due to it's cheaper cost and no need to adjust status when your spouse gets to the US.

In our case, we filled out my wife's name as her married name; but everything that came back to us from the Consulate is in her maiden name (that's the one on her passport) and they instructed us to use that name for everything forth.

Since you've already filed, I wouldn't worry too much about it. If you get an RFE, you get an RFE. As Pushbrk said, I would complile as much evidence as you can in the meantime. You may need it down the road at your interview, (or sooner) so better safe then sorry.

Unless your case involves unusual circumstance, you really can handle it with the resources here. But as Carol and Bruno said, you would probably get better advice here if we knew your story...

Our K-3 took almost a year. We go home, as a family, on Thursday after 14 months. Keep with it, it's worth so much more in the end smile.gif
