Agreed.  My wife and I never went through secondary questioning either, the immigration officer just asked us a few questions at the counter and we were on our way.  Our POE was LAX.

Copy and paste is the best way because you can condense your conversations in a word document and then print them out.  We had chat logs for the petition and we also took them to the visa interview.  We had Skype and Viber chat logs.  We only printed a sample of our chats, one page per month.  We had maybe 40 pages of chat logs altogether.  At the embassy interview, they never even asked to see it.

I called the nvc a couple weeks ago and they told me that once they receive our paperwork that they'll be sending a bill out for the i-130 & something else which came out to be $440. You are getting the I-130 (petition for alien relative...or spousal visa) confused with the I-134 (affidavit of support).  You filed an I-129F petition for your fiancé.  You do not get processed at NVC, they will not send you a bill and you pay nothing to them.  You also do not fill out an I-130.  Once your case is received at NVC, a case number will be generated for your petition and it will be sent off to the embassy where your fiancé will interview for the visa.  Normally it only takes maybe a couple days before its in transit to the embassy.  You can call NVC every day, ask them if they received your case yet and if so if they have a case number for you.  They will ask for your USCIS receipt number.  Once you have your NVC case number, you can track the case to see when it leaves NVC and arrives at the embassy.  Track the case here:  https://ceac.state.g...AKjMWCuebHqOw==  Choose Immigrant Visa, and in the box below enter your NVC case number.

 

Once your case is at the embassy, your fiancé will need to do things to prepare for the visa interview.  One of the things needed from you is the Form I-134 affidavit of support.  You can print out the form for free here:  http://www.uscis.gov/i-134

He would need a waiver if he has an approved I-129F petition that is less than 2 years old, or this petition will be his 3rd one.  I needed a waiver with my petition.  You basically just write a letter requesting the waiver and the reasons why, and this letter is included in your I-129F petition.  In my case, I explained that my ex had left the marriage, and that I had withdrawn all of my support of her AOS application.  I included a copy of the divorce decree and a letter from USCIS confirming my withdrawal.  I didn't have any problems.

It is not fair for anyone to suggest it takes a year or more for "healing" after a bad relationship.  Healing will take as little or as long as it takes, for some it could take a few days, weeks, months or years.  Just like falling in love with someone can be love at first sight, or it could take years knowing someone before you finally feel you are in love.  The point is, only the heart knows when it is ready and NO ONE can say otherwise.  If the OP's friend is ready to start a relationship now, then go for it!

You should have work already before going to the interview, preferably at a salary above 125% of the poverty level.  You will need to provide an employer letter and your most recent pay stubs when you go to the interview.  I can't verify how well Bogota will accept assets if you will use that instead of income.  However, they would definitely accept a qualified co-sponsor.  Any USC or LPR can be a co-sponsor.  You can ask your family, friends, whoever you want as long as they have an income above 125% of the poverty level for their household size plus your fiancée.

If you are using assets, remember they need to be at least 3 times the difference you are short.  For example if you are short $2k, you will need 6k in assets.  If you are using ONLY assets, you will need close to 60k in assets.  If in doubt, bring a co-sponsor...they are accepted at the embassy in Bogota.


Sufficient salary is necessary if you don?t have a co-sponsor, because U.S. immigration law requires that all K nonimmigrant visa applicants establish that they are not likely to become a public charge. ?Petitioners should be able to demonstrate their ability to maintain an income of at least 100% of the federal poverty guidelines for their prospective household sizes.? Where are you getting 133% from?  You only need 125% of the poverty level for an affidavit of support.  For a household size of 2, you only need to make $19,662...so  yes your income is sufficient.

Once you arrive in the US with a K-1 visa, you will have to marry within 90 days.  After you are married you will file AOS paperwork for your conditional green card, and also at the same time you can apply for EAD and AP.  EAD will allow you to begin work in the US before receiving your green card, AP will allow you to return to the US before receiving the green card.  It will take about 3 months AFTER filing to receive the EAD/AP card.

You will fall under the IMBRA, but it should not affect the I-129F petition too much.  The only way it would affect the petition is if your fiancé needed a multiple filing waiver (for example this is his 2nd petition in less than 2 years, or his 3rd or more petition).  In that case the waiver could be denied, effectively denying the I-129F petition.  But in your case he doesn't need a waiver, he simply needs to disclose all of his convictions with the I-129F petition.  When you have your embassy interview, the CO will be required to disclose to you (as if you didn't know already) the entirety of your fiancé's criminal history.  This disclosure to you is how the IMBRA is involved in your case.

 

Basically, your fiancé's criminal conviction does not disqualify him for petitioning for you.

A lawyer is not needed at all, and for that price of $5K it is too much!  The process is really so easy.  And your hubby is wrong, it will not cost close to $10K for you to get the visa.  You will pay $340 for the petition, $265 for the visa, and $245 for the medical.  This is $850.  You will also have smaller expenses for gathering your documents like NBI, Cenomar, NSO birth cert, etc. but those costs are not much at all.  In total, you will still spend less than $1000 including all incidental expenses.  I spent less than $3000 on my wife for her process and that included all the visa processing from petition to visa AND my flight there to Phil and our 2 flights to US (we flew together).

 

I was dating my wife for about 8 months before I filed the petition, and I also had only met her for 2 weeks in person.  There was no issue at all with our process.

a) Nothing is given at POE.

b) Yes you can apply for your SSN before marriage

c)  Do you have a copy of your Form DS-3025 you received at your medical exam?  If this form is complete and you have received all required vaccinations AND your medical is less than 1  year old, you only need to send in the DS-3025 with your AOS forms.

d)  The fees for filing AOS is $1070.  This is for all AOS forms, including EAD/AP.

e)  Only the person applying for the AOS needs to submit the G-325A.  The person applying would be the K-1 visa holder.

f)  No, there is no longer a need to wait since the I-94 is electronic.  You can go to the SSA office and apply as soon after your POE.

g) After the marriage ceremony, the marriage license needs to be returned to your county recorder's office to be officially recorded in the records.  You need an official copy of the marriage certificate after it is already registered with the county.  This may vary from state to state, and the speed at which you can receive the official marriage certificate can vary as well.  In Iowa, I was able to return the marriage license to the county recorder's office the next business day, and get a certified copy the same day.  I was married on a Saturday, I received my marriage certificate the following Monday.  You can either go into the office and have them give it to you, or you can request they mail it to you.  It's faster to just go in and get it.

h) The wedding itself (court or church) isn't what determines how fast you receive the marriage certificate.  What determines that is how fast you can get the license to the recorder's office and how fast the recorder's office can register your marriage and give you a certified copy of the marriage certificate.  In our case I asked the judge if I could return the license myself, which she happily obliged. 

I)  You do not need to send proof of relationship with the AOS packet.  All you need is the required documentation.

I'm about to send in our I-129F package, but first have a question that I'd love to hear some feedback on. My fiancee and I both currently work for the same employer, a school, but are planning to leave our jobs after this month to begin careers as freelance translators. We've both translated part-time for about 3 years now, and have a pretty good idea of the market, our earning potential, etc, and so are excited about the change.

 

As we'll also both be moving (we live together now, but while we're waiting for the I-129F I'll be moving back to the states, while she'll be living with her family), I've prepared a separate statement regarding these plans, to inform both the uscis , and the embassy of our planned career/address changes. Do you all think that preparing this additional statement is a good idea, or is it too much information (i.e. should I just write down the information asked for on the I-129f and not worry that our jobs will be different when the interview comes)? Is there any way that the fact that we essentially plan to start a business together will be held against us when making our application? 

 

Secondly, I want to use the fact that my fiancee and I traveled back to the US once before as proof of our ongoing relationship. I have the airplane ticket records, but discovered yesterday that my passport is missing the entry stamp to the US- I think the local Chinese visa office stamped my current Chinese working permit over it. As my fiancee has her stamp visible in her passport, my current plan is to include a note of explanation on this in the packet,  to essentially tell the USCIS that they should be able to check my entry information in their system and compare it against my fiancee's (we arrived and left together). Again, do you think mentioning this is a good idea, or is it too much explanation--should I give up on using our entry stamps/records as evidence?

 

I have several other issues like this, but I guess my main question is, in your experience, is giving more information/explantion than is required on the I-129F application, as I currently plan to do, a good idea or a bad one?

Including your career/address plans for the future with the I-129F is not needed.  When your fiancée has her interview at the embassy, this is when you will need to prove your support.  They are interested that you meet the poverty guidelines, not so much your career plans.  If when your fiancée attends the interview, you either need to have enough income and/or assets to meet the poverty guidelines, or you would need a co-sponsor (if one is accepted at your embassy).

 

Ticket records are not proof of meeting, they are only proof you bought the tickets.  Examples of good primary evidence include:  boarding passes, passport stamps, receipts, etc.  You can also include secondary evidence such as photos, but these by themselves do not prove you have met in person.  It is not needed to include a note of explanation or ask them to search USCIS records.  YOU are the one to provide them the information they need, not the other way around.  If they don't have what they need in front of them, they will request more evidence from you.

A website is not required.  USCIS and the embassy do not look at electronic media, and would not look at your website.  Depending which country your fiancé is from, your lawyer may be partially correct about the photos and affidavits (for showing proof of relationship).  For the initial petition, the only proof you need is a letter of intent.  At the embassy stage you will need evidence of an engagement (which an updated letter of intent usually works), and proof of a relationship.  Some consulates don't require a lot of proof, and other consulates require a ton.  You would receive a bit better advice if you updated your timeline and stated which country your fiancé is from.

For the addresses, you don't have to put the complete street address, you can put just the city/state and that will be fine.  I was able to put all my past jobs on one line each.
