Somehow I just knew you guys were having the best time, lol! It is great to hear that! Yea, we will have a great time too once USCIS takes their claws off our K3 petition and actually forwards it to the NVC. I can't believe they approved the I-130 for a second time, lol! As long as by the end of this month, my K3 is there, they can approve my I-130 50 more times if they want, lol! I will be glad when I can come to this thread and say I finally have an interview date.

Thanks G! Here is another update. I received a second NOA-2 on the I-130 this morning in the mail so I promptly got on the phone with CSC to see what was going on. To make a long story short, I got to speak with the adjudicator who stated she made a "boo-boo" and did not realize it until after she did it. I told her I was not as concerned about her "boo-boo" on re-approving the I-130 as I was about where my K3 petition is and has it been forwarded to the NVC? She said, in fact, that it is in the bin to be forwarded to the NVC and to check with the NVC in 30 days. She said I should be looking at the end of March before it actually reaches the NVC. So again, we shall see.

Yes, Kathryn, and you know what? Even though I was hoping to have a sooner interview date, May just actually might be better as we are getting tax rebate checks starting in May, so my tax rebate check will more than likely pay for my husband's airline ticket to come home. Everything may be working out for the best now that I think about it.

Thanks Cheryl, but there is a worse twist to the story. I was reading in another thread where this person was told by someone named "Becky" with a thick Asian accent had said her file was put on hold because she called the RFE line too much. Guess who I talked to last week who I thought was so nice and helpful??? You got it, Becky with the thick Asian accent, but she was helpful to me, or so I thought. Now I am wondering after reading that post if she will really do what she said she would and whether it would really take 2 weeks to get a file sent back from NRC??? I hope my nightmare is not about to come true!!! I will just keep praying and keep hoping all your good thoughts coming my way make a difference.

Hi Amoro,

Divine Mercy's timeline is not a common one. She was originally told that her I129F was cancelled because her I130 was approved much much earlier and she HAD to follow the I130 path. When she found out her I129F was approved, she stopped the I130 and continued on with her I129F only.

For most cases, this scenario does not happen because USCIS either hold the I130 for adjustment of status, or administeratively close the I129F... locking you into one path.

If the I130 NOA2 states that the "spouse is in the US" that means USCIS have made the decision for you and will hold the I130 for your adjustment of status. If you decide that you want the I130 to continue on anyway, you can file another form (mentioned on the NOA2) to "kick start" the I130 back on the way to the NVC. This additional form will take roughly 6 months to action and will cost additional money.


sorry I missed this before.. C&J summed it up. My I130 was approved w/in about a month of filing so they decided that since my I129F no longer had a pending I130 it was going to be canceled. They apparently forgot to mention this "new policy" to the adjudicator because he/she approved the I129F rather than terminating it. Once you have both approved you have nothing to worry about. They will forward your I129F onto the NVC and get you off to the embassy for a K3 interview. You're all set.. and congrats by the way!

From what I have been seeing.. correct me if I'm wrong.. I paid the pre-July 2007 fees for both petitions. The new trend seems to be that those who filed after the fee change, those who did not pay an I129F fee, are being terminated. Maybe the fact that I paid for the I129F is the reason they approved it. Who knows. I guess it's fruitless trying to make sense out of a chaotic system.

Hello everyone,

Here to update you on my case. I called NVC last night just to hear once again that my I-129 had not been received at the NVC and it was 4 weeks yesterday since approval. I just got off the phone with USCIS and talked to an amazingly nice, helpful lady. Usually don't come across ones this nice from there. I told her the problem and she got on the phone with NVC to see if my information had made it to NVC and, of course, they told her no. She got back on the phone and took my home phone number, cell phone number, and my name, and said she was ordering my file back from the National Records Center because she thinks maybe they forwarded the whole file, I-130 and I-129, there instead of splitting them up and forwarding the I-129 to the NVC. She said it should take no more than 4 weeks for it to reach the NVC. She said it could take up to 2 weeks for the file to come back to her. She actually gave me her name in case I had not heard from her in the two-week time period she gave me. I actually felt like I was treated like a human with feelings for a change. I hope that is all the problem is and maybe it won't take the two weeks she told me. I can only hope!

Gee, I wish I could go and meet you two. Number one, I live in the Midwest and we just got one foot of snow here. It should be melted by Monday though as the temperature will reach 60 degrees on Monday and I have no time off from work. Need to save my vacation time for Mike's interview, if that ever comes about, as my petition is still not at the NVC yet and it will be 4 weeks this Wednesday since it was approved. There are times I feel like crying cuz it doesn't seem that I will ever get away from the clutches of USCIS, but I have to keep trusting in God.

Both Ose-n-me and I got approved on the 15th jan and we have our petitions there now. I really feel your angst, just continue to call and bug NVC. Your stuff has to be there somewhere. I would like to ask you a question. When you called NVC, what number did you give them? The WAC # for your I-129F? I just want to know that I am giving them the right thing.

I gave them the MSC#. Not the I 130, but rather the I 129 K3 number. Hope they see it soon. I know how frustarting this can be.



What is an MSC#? I understand from calling USCIS this afternoon that USCIS keeps the I-130 until my husband comes into the USA on his K3 and then he has his interview here in the states. I have been giving the WAC# from my I-129F, but I still don't know what the MSC# is that you mention. Where do I find that number?

Inspired by SoCalWaiter, I decided to call CSC, via RFE trick. Basically the laidy explained all the prevous touches were triggered by my I-129F being cancelled. Why? Well, if I am submitting an I-130 AND an I-129F, and they will be approved simultaneously, the I-130 takes higher priority so USCIS decides to move forward only with the I-130.

She said my case was on the queue for revision. She couldn't say if it will get reviewed tomorrow or the day after, but in her own words, it will be reviewed soon.

So, I guess I am happy to know my case is in the queue, but I am a bit sad to learn I will have to wait now for the CR1/CR2 process (which by the way, I know very little of). Yes, when approved, my wife will enter the US as a resident.... but I don't want to wait any more!!! Long term it is the best way to go... short term it is soooo frustrating!!

There really just is no rhyme or reason to what is going on at USCIS. It really seems that they pick and choose whose I-129 will be forwarded to the NVC and whose will be cancelled. Both my petitions were approved simultaneously on Jan. 9 and I, too, called USCIS today after calling NVC who told me my petition was not yet there, even though people who got their petitions approved 2 weeks after me have their petitions already at the foreign consulate and have interview dates. She told me that it had been mailed on Jan. 9 but that it takes NVC awhile to enter the info into their system. That doesn't even ring true to me when someone's petition is approved on Jan. 15 and their petition is at NVC on Jan. 23 and is now in Nigeria and their SO has an interview date. Juan, don't be too sure that what she is telling you is the truth. Look at the case of Divine Mercy who was told that her K3 was terminated because the I-130 had been approved for so long. She started working on her I-130 and just found out this week that her K3 was approved after spending over $400 on the I-130, so now they are switching back to working on the K-3 which brings her husband home quicker.

Congratulations Puerco! Your petitions were approved the day before mine, so I wonder if that means that mine may be at NVC as well. I tried to call just now, but it keeps transferring me back to the menu stating that all their operators are busy with other customers. Has this happened to anyone else? Is it that hard to get through to a live person? Is there another way of checking if your petition is at NVC and getting your number other than talking with a live person?

Hi Amoro,

I had an RFE that I sent in Dec. 26 and they received Dec. 27. You should get a CRIS email stating that they have resumed the case. I did and they resumed my case on Jan. 7 and I got CRIS notification on Jan. 9 that both my petitions were approved. Maybe that will help you to calculate approximately when you might see your approval. I was told it takes the mailroom a little time to enter the info in the computer and then get it back to the original adjudicator. Once the adjudicator gets it back on their desk, they resume working the case immediately and I found that to be the case. On your CRIS email, it will tell you that you can expect a decision within 60 days, but it won't be that long. Hope this helps. Good luck and hope for a speedy approval.

I sent my RFE on Dec. 26, they received it in their mailroom on Dec. 27. I received the email that they had resumed working the case on Jan. 7 and they approved both petitions on Jan. 9. Hope this is of some help to you to calculate when you might receive your approvals. Good luck!!!

I'm hoping to have the case finalized at the NVC around March... Maybe an interview by Dec or Jan 2009.... AP till June 2009 and hopefully he'll be here by the end of June 2009. How's that for slow?
Someone from Ghana was denied a CR1 pending a DNA test on their american born child (husband is Ghanian, wife is US born Citizen.. child belongs to them both). Even though it is a spousal visa and the child is already american with a birth certificate to prove it, they have to provide both mother and father's dna proof that they are BOTH the true parents. My husband and I are planning on going ahead and getting the DNA test before hand so they cant put us into AP just for that.

I am still waiting on them to resume my case after RFE. I called yesterday and I was told that my RFE had not been entered into the system yet and to call back next week if I don't receive an email first about them resuming our case. I informed her that I received the RFE in the mail on Dec. 26 and sent what they wanted back on Dec. 26. My RFE was delivered to their RFE mailroom Dec. 27 and gave her the name of the person who received it. She said they probably got a lot of RFE's in the mail during that period and because of the holiday's everything is a bit slower, but should pick up now. So if I nothing from them by next Thursday, I will call again. Just wanted to update everyone.

No, the postal system is not that slow in the US. USPS is actually very good. There is a little slowness between Dec. 16 and December 27 or so because of the Christmas cards and packages that get mailed. But don't expect the RFE in the mail for a week or two. Urge is correct. Email told me they sent out an RFE for me on Dec. 12. I got it Dec. 27 in the mail. The postmark on the envelope said Dec. 20 so it took 7 seven days which is 2 days longer than it took for the other two NOA-1's, probably because one of those days was Christmas, so wait just a bit longer before you call them.

Yes, I filed May 18, 2007, and am still waiting for an approval. I had to call them because I was beyond their processing times and they started working on mine at the beginning of December. I got sent an RFE on Dec. 20. I got it yesterday and sent them what they wanted the same day. They now have what they asked for, so I am looking for my approval very soon now. Give them a call using the "RFE trick" and find out the status of your petitions. If they see that they are out of processing times, your petition will be placed on an adjudicator's desk to be reviewed. That is what I did and I am almost there now.

You are welcome Amoro. I had noticed last month when I was checking what I had sent in for my I-130 and found that I only sent the first page of my divorce decree (Deb kicks own butt). They wanted a copy of the entire decree, especially the page with the judge's signature and my ex's and my signature showing that it had been finalized. By only sending them the first page, it showed it had been filed, but not finalized. I made copies of every page and had sent them that last month, but since they had not requested it yet, they evidently did nothing with it except throw it away. They have it now, so hopefully my case will resume quickly and we will see our approval. I hope and pray you get a quick approval after you send them what they want also.

I'm so glad it was what you thought and not a complete surprise. Now that you have sent the requested information, I pray they approve your petitions soon. We still don't have an interview date. Our petition was sent to the embassy from NVC on Dec 12th. My husband will go to the embassy tomorrow to pick up his packets and hopefully the interview date. He was sent home last Friday, as were all the others who showed up, because they were told they did not come on time. He was there at 6:30 a.m. They told him to be there tomorrow at 7:00 a.m. and he told them he will be there at 6:30 a.m. like he was on Friday. I pray that things go better and he gets what he went for. Hang in there, Deb. It's all going to work out!

Hope you had a merry christmas. Everything is good here. I called he embassy on Dec. 20 to inquire about the RFE now that I think about it. I looked at the case status online and our case was touched on Dec. 20 and 21. I think they went ahead at that point and resent the RFE because it was postmarked Dec. 20, the very day I called. In any case, I am glad I got it, it is sent in, and now the wait begins again, but hopefully for not too much longer. Since that is all they asked for, there couldn't be anything else to hold up the approval. The guy said over the phone that once they get what they asked for, they will approve both petitions together. I pray that tomorrow Kingsley will call you with good news of the date of his interview. I am so happy for you two. You are such a cute couple! I wish all the luck in the world.

You sent stuff three weeks ago without being asked for it? Well, if it was something required that you forgot initially, definitely have copy of that ready for when you get the snail mail. They almost never add things to a file that you send in unsolicited. It would be too hard from them to track (even more now with the huge pile of petitions they have to wade through). They would even have trouble getting your response to the RFE in there without the original barcoded RFE letter serving as cover for your RFE respone.

Thanks Tomeca! I am hanging in there the best that I can. It was probably the stuff that we discussed earlier didn't make it into my file even though I sent it last month and they had 3 weeks to put it in there. I think I wasted my time and money doing that, but oh well. We are all at their mercy. We have to do what they ask in order to be with our husbands, so I have to suck it up and keep going. Yes, I happened to go through what I sent last month to make absolutely sure that I sent everything that I should and I found that I had not copied and sent every page of my divorce decree, especially the page with the judge's signature. (Deb now kicks own behind!!!) I sent it express mail with a cover letter with my WAC number in the subject line and both our names in yellow highlighter so it couldn't be missed. I would think that they would have some semblance of sense to see yellow highlighter on a cover letter highlighting the WAC number. Can they not enter the WAC number and names into the computer and find out where the petition is and include it??? I wouldn't think it was that hard, but maybe for them it is. Anyway, they mailed out the RFE yesterday and surprisingly, our case was touched again today for some reason...who knows? I will still keep everyone updated on what the RFE was. I have a copy of everything sent, so no problem. I am ready.

I really appreciate your encouragement. However, I hope it doesn't take six weeks for them to resume working on my petition. U r right, My Honey, the RFE was for the I-130, not the I-129F. As far as I can tell, they only looked at that one once. But you would think it would also be for the I-129F since I sent in the exact same paperwork. Go figure! I will let you know what the RFE was for when I get it in the mail. Thanks everyone!

I am sorry to hear that you got an RFE. I did get one too for both the I-130 and the K-3. I received the noticed on their website on the 28th of Nov. and got the actuall snail mails on the 6th of Dec. I sent back the requested documents for both on the 10th. and I am now waiting to see what happens. I sure hope that I can see an approval by the end of the year now. I have long ago discounted the issue of the holidays. I hope you have what they are requesting, I was tensed up but later found out that what they needed was my sons birth certificate. Good luck and hope that we all get approved soon

Let me know how long it takes before you see on the website that processing on your case has resumed. I would like to know. I am glad that I am not the only one, especially with a husband or wife in Nigeria, that got an RFE. Thought I would be alone on this one. Let's keep a stiff upper lip and hope for the best.
