That is why we are here on the VJ to encourage each other and express our emotions. Man, are those words true!!! With this entire process I have experienced so many emotions from the greatest high to the absolute low... Also, people tell you just a little more longer but, they have no ideal and have never experienced what you have experienced unless they themselves are going thru the process. (I actually hated hearing just a little more longer...) You will get to that next thread. Keep on moving forward and I know what really helped me was planning the future with my husband. All these positive thoughts helps this crazy and uncalled for waiting game...

Thanks for your encouragement also. The lady yesterday told me over the phone that my petition is on someone's desk right now, so I think I will get the Christmas present I want, an approval, lol! As you can see in my timeline, this morning the date on my I-130 has changed to today's date and I-129F was changed to yesterday's date, maybe phone call generated, but I am focusing on the one that shows today's date which I want to believe is the adjudicator working on the case hopefully. My husband is excited because I told him the news this morning when we chatted online. He is having a dinner this Sunday at his mother's house this Sunday in honor of our marriage (traditional celebration) and then he will host another one when I go to Lagos for his interview which I hope will be by January. I have money saved enough to go to Lagos at any given moment, lol, so I hope it gets approved soon so I can celebrate with my husband and his family for an approved interview, lol.

Thanks everyone for keeping me encouraged. I really need it right now more than you know. Feeling really depressed.

Thanks My Honey! It really helps when there is someone else out there that has gone through the same things as you to keep you feeling like there will be a light at the end of this long, grueling, dark tunnel they keep us in. There are people on VJ who filed in July who are already being approved and here I still sit, not approved, and I filed in May, I should be moving on to the NVC now, but noooooo, they have to make us suffer just a little bit longer. I talked to my husband this morning and explained the situation this morning. We are realling hoping that the change to today's date on I-130 means they are now actively working on our petition. We will stay positive and think that maybe by the end of this week or beginning of next, we will see our approval.

June 19th - NOA1 (Never received NOA1, got WAC number from the check encashed and checked online)
9/20/07 - Touch

July 23rd - Sent I-129F
Aug 14th - NOA1
9/20/07 - Touch

I can sympathize with you. Next week, yours will reach the six-month mark. My is almost a month over the six months. However, I just looked on USCIS website and noticed that the I-130 has a date changed to today and my I-129F has a date of yesterday. I called USCIS yesterday, so yesterday's date probably is generated from my call, but today's date on I-130 looks hopeful. The lady told me that our petition was on someone's desk right now to be adjudicated, so I am hoping by the end of the week or next week to have my approval, so we can finally move on in this process with everyone else that was on this thread.

Hi Amoro,

I started calling because I am now more than two weeks over the processing time. I wouldn't start calling them until you are at or over the six-month mark. They will just tell you to wait until then anyway. That way, they will be more apt to pull your file if you are over the processing goal. It might be a good sign that your case was touched. That means someone has picked up your file and looked at it. It has been the norm for people to see touches and the status not change lately. Some people don't see any touches, but still get approval notices in the snail mail. I would wait a couple of weeks to call if I were you.

It's great you got a nice lady! I called NVC on Thursday to check to see if they had received our I-129F yet. The lady was extremely polite. The whole call, waiting and all, only lasted about 7 minutes. I couldn't believe it after the lady I talked to at CSC. Yes, waiting is what we do. We should all be pros by now.

Apparently, the lady kept to her word and actually put our file on someone's desk because the I-130 was touched today (Sunday), but no touch on I-129F. Hope they don't pull something like they did with Kathryn and approve my I-130 and let the K-3 sit so long that they terminate it. (I pray that they don't).

Don't worry Kelly I hope this is it (the nice cool.gif sweet star_smile.gif approval), and the touch to apear on your I-130 but not in your I-129F is usual nowdays with many of the late approvals in Vjer's, like my case, I hope you get your approval for both by mail tomorrow yes.gif

Thanks Wintime, but I think my hopes have been dashed again. There was only the one touch on Sunday and nothing since. USCIS likes to dangle a carrot in front of your face and get you excited and then snatch it back, lol! This whole process is about to make me crazy wacko.gif I will be making another call if I don't see some movement by Thursday. I am one of the last on G&A's chart to get approved and we are now over their processing times as of Nov. 18 and now it is Dec. Thanks for your words of encouragement though! We are still waiting to for our case to get to the NVC. I have not called them yet as i am travelling and do not want to hold on the phone for 30 mins from Europe. I will wait and call them in a week when i get back.

G&A, Thanks, I won't give up and I'll try with the senators but I really don't have any hope that it will do any good. The one senator's office's immigration guy is a total moron. He butchers the most straightforward requests, this will make his head explode. The other senator's office hasn't gotten back to me. I think I'm going to take a USCIS press release to him which shows what they did was not "policy". Maybe he can get them to answer for that. Last I talked to them my case was still "pending" but will be terminated once its off the shelf. Thank you for crossing out my I129F with black, I have been given the kiss of death after all. Have a great time on your trip!

I understand how you feel. It is sad watching everyone get approved while you are still pending. Now I will have the pleasure of watching everyone's spouses enter america while I'll still be waiting for an interview (Lagos CR1 interviews do take AT LEAST 10 months and the majority of them end up in AP which lasts another year or so, CR1 in Lagos is basically a death sentence). We might very likely be celebrating our 2 year anniversary before he comes in which case I'll get to see my son turn 3 before he lives with his father. Hang in there, at least you are still in the running for a K3. I know it's hard and frustrating, count your blessings. Having your husband's passport picture issue all messed up might have saved you from my fate, since they seem to focus on the fact that you filed the I129F after the fee increase. Maybe that would have saved me, who knows. They all seem to make up whatever they want.
I don't believe it will take them another 30-60 days to approve your petition. They are just giving you an over estimate to cover their own butts.

Thanks for your words of encouragement. I saw some of your posts but was at a loss of words as to what to say. My heart went out to you and I really didn't know what to say or do to help you feel better. All I could do was keep you in my prayers that things would work out somehow. I believe that God can make a way when there seems to be no way. We have to trust and believe in Him. After all, what God has brought together, let no man put asunder (that includes the USCIS). I really don't see how filing the I-129F before or after the increase helps or does not help anyone's situation. Why do they focus on that? That seemed to make the difference to her as to whether I was out of processing time or not. Why????? Maybe someone more knowledgeable and experienced could give me an explanation for that???? Would really like to know.

Maybe using James' shortcuts will help cut some time off of your wait for CR1 and pray over everything and maybe that will keep you out of AP or any more delays.

I think calling with the RFE trick is what got me behind... I called so much that a rep one day told me if I called in again I would be put thru review..... well I got bold and told her it was my right... lo and behold I called again and poof.... in review I am....

My recommendation to all that follow... when you call get the persons name and ID number so that if that happens you have someone to fall back on


Latest I have been told is in 30 days I will be adjucated... so I guess I have to be good to get out of the penalty box

I am sorry to hear that they put u on review. I haven't called but one other time and that was at the beginning of November and they told me it was not on an adjudicator's desk yet. I didn't say much cuz my 180 days was not up yet. Now I am two weeks past my 180 days, so now I have a right to ask. The lady who answered was very nice and very helpful and told me she would take it out of the file and place it on an adjudicator's desk immediately and I should hear about a decision in the next 30-60 days, hopefully not that long. This was only my second call. Now I will wait and see what happens.

I want to congratulate everyone who has been getting your approvals!!! However, I have been getting depressed watching those who filed before me, those who filed at the same time as me, and those who filed way after me getting approvals and there is nothing for me, not even a touch. Since I am now two weeks over processing time, I decided to give USCIS a call this afternoon. Good thing I did because they had our petition sitting in an "A-file"???? I am not sure what an "A-file" is, but it was not in a place that an adjudicator was going to look at it. She at first said that it would be January or February before it would be adjudicated. I then asked what date did they honor on the I-797, the received date or the notice date? She said, the received date. I then stated that if that is true, then my petition is out of processing time because the date on mine says May 18. She then asked if I had filed an I-129F and I told her yes, that I had to file in the middle of August since I needed another passport photo of my husband which he mailed on June 29, but it didn't reach me until the beginning of August. She told me, "Oh that makes a difference. You filed your I-129F after the fee increase so you didn't have to pay a fee. That then puts your I-130 out of processing time." She said she would pull my file and put it on an adjudicator's desk to be looked at and that I should expect a decision within the next 30-60 days. God I hope and pray it doesn't take that long!!!!! We have already been waiting for six months as it is. I have been very patient, but now I have to admit my patience is starting to wear a bit thin and it gets very depressing seeing everyone being approved and I think I am about one of the last ones on G&A's chart that has not been approved. Hopefully, this lady did as she said and maybe I will see an approval in the next week or so.

I dont think/hope it will take that long...half the time these people dont know what they are talking about. They once advised us to comit visa fraud by entering through the VWP and staying in the US hahahah. Stay positive (i know its difficult) your time will come...hopefully sooner than later. I am really really trying, but it sure is getting hard to keep any semblance of patience. I shudder to think how long we would have been waiting had I not decided to make that call??? A majority of our thread have been approved and I am left eating "approved petition" dust. Hopefully for not too much longer though. At least the website updated with today's call which is more than some people are seeing. I just want to look in a few days and see an approval notice, that's all. I hope that is not too much to ask???? Thanks for the words of encouragement though. It helps to know someone cares.

Yes, it is official. They are not updating the website completely. Kingsley's Princess was approved, according to the website, for I-130 only. Today, she got both approved petitions in the mail today, I-130 and I-129F. It should be just any time for my husband and me. We sent our petition in on May 18, so we are over due as of Sunday. Gotta keep praying!!!!! Congratulations G & A!!!! I am so very happy for you two.

I called yesterday as well and nothing changed on the website for me either. When I looked this morning, the date changed on I-130 (which is the case I called about) changed to today's date, so look again tomorrow and see if it changes.

Melissa, I hope your approvals are around the corner. They are processing I129Fs well after your date, I wonder what the hold up is? I thought by sending them together, you were going to get approved ahead of a bunch of us who sent the I130 in April and waited for the NOA1

I sent in both forms at the same time at the end of April and I don't see any significant differences, I'm still waiting for my NOA 2's. I think that no matter what you do nothing can speed up your process, we are all in the hands of the slow service centers especially California Service Center.....


Divine, are they still going to adjudicate the I129F or will they eventually notify you that they won't because you no longer have a pending underlying I130 which is required to get an I129F approved? This happened to Neenuh. wacko.gif

YGandMAT.. don't believe everything they tell you. Hang on to some hope. Who told you that? Was it one of those idiots that answer the phones or did you get a real USCIS worker? If I were you, I'd wait a few days and see if the I-129F catches up, if not, do whatever it takes. Try to get it expedited, what's it going to hurt to try? Call your congressman.. do whatever you have to (within legal limits of course). At least you won't feel like a puppet waiting for the puppet master to decide your fate anymore. I called my US Rep two weeks ago. When I called for the 3rd time to find out if they are working on my case they were annoyed that I was interrupting them while they watched the Price is Right (yes it was blaring in the background) they informed me that the "guy" who handles that was out of the office.. I got that line every time. I finally just called my Senator's office and they seem to be more serious. Hopefully I'll hear something in the next few days. Of course I came up with a possible reason for them to intervene not just that I'm tired of waiting. Everyday is a struggle waiting helplessly. If expediting was a possible option for me, I'd try it.

I think what got them to approve it was that I recently changed my stateside address, probably ended up putting the application on the top of the pile instead of the bottom (thanks to all the VJr's for that trick wink.gif ) so I hope to see the approval for the I-129f soon too. Since I sent in both applications at the same time they may have ordered them by I-129f dates instead of I-130 dates....who knows. Good luck to you, you'll be seeing something soon!!

My details are pretty much same as YGandMAT's... I saw three touches last week(please see my sig below) but no updates whatsoever on CRIS after that. As a matter of fact, I just checked it again like 10 mins ago and it STILL shows pending I-130/K3. OMG.. I still cant believe that I actually have TWO NOA2s in my hand right now..

Approved I130/K3: 10/30/07 (This is the Notice Date in NOA2)
Mailed out from CSC: 11/02/07(Friday - saw on USPS mailing envelope stamp)
Received at home: 11/05/07 (Monday) Much to my surprise because USCIS CRIS status still says pending.

I have the same dates as you. They received my papers on May 18 and I received my NOA-1 June 7. No touches since I sent in K-3 in middle of August. They touched both on 8/22 and 8/23 and nothing since then. They seem to have slowed down yet again on approvals.

Yep. I have called for a receipt. They said to allow the processing time frame. I did have a touch on it on the 29th of June, but thats it. I will keep you informed when I receive anything from USCIS. I remember when I called USCIS and asked about that, they said that Chicago is just a distribution center. How is your week going so far? I wanted to let you know that I received my NOA-1 for I-129F in the snail mail today, August 27, 2007, a day after your estimate on the chart. The I-130 was touched on August 22, I am guessing because they received K-3 petition? The received date on the notice is August 15, 2007 and the notice date is August 21, 2007.

By the way, I sent in my K-3 without the fee even though I filed I-130 before July 30, and stated that I sent no fee due to it was after July 30 on my cover letter and on my NOA-1 it states that the fee was waived, so I can confirm that you do not have to send the old fee or the difference between the old fee for the I-130 and the new fee for the I-130, send no fee at all. They do accept it.

Please update me on your chart the next time you do it.

Hi Deb, Glad you got the NOA1. These guys @ Chicago work like a fine clock. I wish the other centers were that predictable. Actually i had updated the chart but have not post it and i just checked to see that i had 8/27 as the est. date! Told you MSC is good!

Actually since it is after July 30, I sent the K-3 petition directly to CSC where my I-130 is pending since that is now the directions that we have. CSC is the one that sent the NOA-1 to me quickly.

Thanks Shreyans! The reason it took that long is because some yahoo at USCIS did not separate my K3 petition from the I-130 folder before they sent it to await my husband's arrival in the US. I waited the 2-4 weeks it usually takes to reach the NVC and finally called USCIS to find out what was going on. They ordered my file back from national records center and found out what I said above. They then forwarded it 2 days after receiving it at USCIS and it arrived in 2 weeks from the time they sent it. That was the reason. Good luck in your journey!

Then your written NOA2 would have said something to the effect that your relative was in the US?

This would be back to the standard procedure, post November 2006, if that's the case.

It's interesting that our conversations have swung from last summer and through the fall, how to keep the CR1 case moving, back to panic over keeping the K3 alive. There are some countries where K3 is a real advantage and then there are the families that only filed one I-130 initially and are counting on K4 visas for children to go with the K3 for their parent, who were really hurt by cancelled K3's. It will be interesting to see how all the cancelled cases end up being resolved.


Then your written NOA2 would have said something to the effect that your relative was in the US? (Yes, my NOA2 did say this.) I hope all cancelled K3's will be approved as Divine Mercy's and some others were even after being told the opposite.

Here is another one. I filed my I-129 and it was received at USCIS on Aug. 20. Both I-130 and I-129 were approved at the same time on Jan. 9. It is now March and neither one of my petitions have made it to NVC. I called USCIS to find out what was going on at the beginning of Feb. They ordered my file back from National Records Center and found that my K-3 had never been separated from the folder and forwarded to NVC. They said they would be forwarding to NVC as of the last of Feb. In the mean time, the original adjudicator for my petition decided she would approve my I-130 for a second time so I called again to find out what was going on. She stated she made an error and did not realize it until it was already done. I told her I was not as concerned about the 2nd approval for I-130 as I was in where is my K3 and has it been forwarded to the NVC. She checked for me herself and said that the K3 was in the bin waiting to be mailed to the NVC, and that it would probably be the end of March before it arrives there. I will be checking both petitions to see which one makes it there or if both do and keep everyone posted. At the moment, the only touches my K3 received while it was back at USCIS was twice at the end of February. My I-130 was touched and approved again on FEb. 26 and then there was another touch on March 2, a Sunday. There is a possibility with all the touching going on with the I-130, that this is the petition that they are forwarding and I really hope that isn't the case because of the history Nigeria has in the way they deal with CR1 interviews and visas. I have seen only one VJr make it through one interview and be approved for a CR1.

LOL! I can't blame them either. I must confess I've neglected this site a bit since my wife will be here in less than 48 hrs. Oh, I am so happy for u! I'm getting closer to being with my husband. We have been married a year on March 10 and we still aren't together. But at least we are getting to the light at the end of the tunnel! I think his interview will probably be in May. The latest scheduled interview for Lagos on VJ was April 22. Lagos is starting to come through now. I think every VJ'r that has gone through Lagos so far has been approved. I know my friend, Kingsley's Princess's husband just had his interview on March 10 and all they did was look at their myriads of pics. They didn't look at chats, phone records, or emails. The guy seemed to love their pics and only asked him 2 questions...where did they meet and describe their relationship. The CO was quite satisfied with just that. The CO also was impressed at how well their evidence was organized which her husband did the organizing. I think if you go in their with a confident, friendly attitude, you pretty much have it made.

I think me and gogo are the two caboose's holding up this show, lol! We're going to make it though! Hope your wife has a safe trip home.
