I have noticed conflicting advice with regard to filing taxes whilst the spouse of a USA citizen is out of the country. This is the procedure we used. It is recommended that once married, for maximum financial benefit, the spouses file as married, filing jointly. The foreign spouse does NOT need to be in the USA in order to do this.

Firstly, it is impossible to e-file, as e-filers need SSN's for both spouses. As the non USA spouse will not have an SSN, it is necessary to apply for an ITIN number.

The procedure is as follows:

Download IRS form W7, and the instructions from the IRS website.

The foreign spouse must complete the form, sign it and send it to the USA spouse complete with a notarized copy of their passport.
On receipt, the USA resident has to file taxes by mail. I highly recommend Turbo Tax 2010, as this program allows a the IRS tax returns to be easily printed and filed. As stated above, you can NOT use the e-file feature, you print the tax return the old fashioned way.

Once you have completed (married, filing jointly) and printed the return, gather your supporting documents, attach your foreign spouses completed W7 form to the front, and mail to:


Internal Revenue Service
ITIN Operation
P.O. Box 149342
Austin, TX 78714-9342

You must do this before April 17th 2011. Once this is received, an ITIN number will be issued, and the tax form processed. You should get your refund in around 8 weeks, as it takes 6 weeks to get the ITIN number allocated.

That's all there is to it.


Copies of documents must have an Apostille also.

Pretty clear... They tried to get him here to use the loophole of AOS. Let's all be honest with each other and call everything what it is. COs are not stupid. You tried to get him here on student visa, get married, and apply for AOS exploring loophole in the law. They caught it and now you have a problem. You need to be upfront for anyone to give you advice. From your timeline it is clear that you applied for visa knowing that you will get married, right? Why student visa then? This is pretty obvious.

I-130 askes for former spouses and in russian, a mans last name can be different than a females. Also, a son can take the name of a grandparent to continue the name if the death of the grandparent end the family line. I plan to petition for my future wifes son, who has a different last name than his mother or father. The mothers name ends with ...bekova and the fathers name ends with ...bekov and the sons name is totally different. Someone please tell me that this is routine! If not, what can I do? Thanks!

My future wife has a son that is 16 and an unmarried daughter that's 21. Can I petition for both of them? Do I petition the 16 yo as my stepson? When I do petition, I use a separate petition for each person, right? After the petition for my Wife is granted, what does my Wife have to do to include them on her cr1? Will she have to petition for her daughter after she is a permenant resident? This is such a confusing and expensive process for an average man like myself. I was fortunate enough to save enough money to visit my wife to be for three months. I'll definitely be hurting in the pocket book when I return home. It's just doesn't seem fare that you have to pay so much to be with the one you love. I am keeping my faith though. I know that my Wife and I will look back at this experience and it will remind us how much we love each other and that it is truly meant to be. If I win the lottery, I'm going to law school and just doing pro bono immigration work!:star:

If I were you I would contact my congressman's office. I wouldn't worry about where I live. Go ahead and take the job so you can meet the income requirements. It says on the Ivory Coast embassy's website that they will process emergency cases. Good luck!

The advice you're asking about came from a member coming from or bringing a loved one from highest fraud Consulate in the world, relative to US Immigration. Sweden would be on the opposite end of the fraud spectrum, so visit as you desire. No need to plan extra trips just for evidence. You'll be filing shortly after her trip here and your marriage. Silly to wait, in my opinion.

american university in Germany and live here with my german fiance. We

The alternative of course is a K1 Visa and then an adjustment of status in the states but I do not want her sitting around in the U.S. waiting for her green card without being able to work or go to school... Please help us.

Yes, they are asking about me. My husband check the copy of 1-130, and says he didn't tick any box that would indicate I was married before. I check the box, married and check the number (1). Because I am married. We went throught this all before in 2009, and was approved. I move there, I move back because of sickness in family. The problems was at the border, where they told me I had to abandent, because I didn't know how long I would be. Now we had to start all over again. How do I prove I was not married before, am, still married to my husband in the US. It is a mistake or something. Is it possible that immigration made a mistake? Can my husband called them?
My husband was married before, and has included a copy of divorce. They are naming me.

and I believe everyone is required to meet the poverty guidelines so your argument that people cannot afford it is baseless and does not hold substance in it.

By providing the affidavit of support you are basically saying you will support your dependent so when you can do that i don't see how one cannot afford higher fees especially if you can be with your loved ones sooner?

H1B visa or something i don't remember has an option of premium processing i think..so in that case isn't it unfair for others who are not using premium processing for whatever the reason? if people have options between normal and premium processing they will choose whichever they want and again this does not have to be at the expense of normal processing filers.



Obviously you have no idea what it is like to live at 125% of poverty level! I think my taxes alone should get me timely processing so I can be with my spouse.

Don't send too much though! It kind of makes you seem desperate, IMO... There is plenty of time to show them all your stuff at the interview. Give them some extra stuff and of course all the required things and send asap!! I think even if you have the required form, they still take it, but you wanna make sure it's right.

My question is when the government sends a check or deposits into my bank account how is this possible
when the Wife is in Georgia and she can't endorse the check.. Because I applied for her ITN number will they deposit into my bank account anyway..
I called my bank and they said deposit could be rejected because her name is not on my account.. My banker said wife had to be present to be put on bank account.

Hello everyone,

i am trying to help a family member....he is from Mexico, he has been here extending his work visa for the last 6 years. during his stay he ended up marrying an American citizen. Now he thinks that he needs to go back to Mexico to extend his work visa or apply for the green card. i am telling him that he should not go becuase they might not let him come back right away. I think that the smartest thing for him to do is for his wife to file I-130, petition for spouse. And then once he gets his green card then he can go back to Mexico whenever he wants to, for a visit. Please let me know what steps he should take.

P.S. is the I-130 mandatory or in his case maybe he can just to a change of status?? Let me know, thanks for everyone

I thought Kazakhstan abolished the Exit Visa law in 2002. My Wife says that the Migration Police are requiring her to get notorized statements from her children, parents and ex-husband, giving her permission to leave Kazakhstan. Has anyone else run across this? Is it legal? Is there any way around it? Does anyone know the specific law that abolished this requirement? I searched google but found no answers. We can get these statements but it would be nice to avoid the extra expense.
