One thing I miss about Canada: Snow. Yes, I miss snow. Living in California we don't get a lot of rain let alone snow. I could use some white stuff.

well we plan on living in texas but we will be in maryland for 6 weeks for the birth of our child. looks like I should be able to do it in texas. not sure if I should try maryland since I'm gonna be there longer than 30 days

Taking it there then going to TX will be pointless. Wait until you get to your destination.

I have come to understand MOST people are flaky. Sara and I have 1 friend we can trust. The others we know and assume will simply flake.

The odd thing is this is a California trend. I never experienced that in BC.

QUOTE (Debbie A @ Sep 10 2007, 05:03 PM) <{POST_SNAPBACK}>
Sorry, maybe this sounds dense but I am not familiar with the "30-60-90" day rule. Are you suggesting that I wait 90 days AFTER my son is lawfully in the US before I apply for a change of status? I don't see any problem doing that, except I was concerned about authorities making some effort to deport him if I don't apply right away. My understanding was that he was more likely to be allowed to stay AFTER he applied; is that a misguided notion?

This is based purely on my experience and what lawyers have told me PERSONALLY. But if you apply within 30-60 days the chances of a flag being raised are higher than if you wait 90 days. The intent to immigrate is obvious in some cases and sometimes they don't care. This is not based on science really it's more of whatever anyone feels like doing/telling you.

I would at the very least contact an immigration attourney and ask a question based on a free consultation (first one usually is). They will give you their honest 2c based on dozes if not thousands of instances like yours.

Yes, if he is allowed into the US, he can apply for his I-485 based on the pending I-130. One issue though may be preconceived intent to immigrate. Basically, it's not ok to enter the US as a tourist with the intent to immigrate. Filing an I-485 immediately may raise some flags (though chances are USCIS won't really care). I'd suggest that you contact an immigration attorney about this.

The intent issue is something I have always had a hard time reconciling.

It's pretty hard to grasp, yes. Any lawyer I talked to say leave AT LEAST 60 days. Over 90 is best. Some immigration officials take offense to a jump in and red flags are raised. Gotta be very careful with this.

CanadaWhoohoo case finally updated
I've been checking patiently for awhile now for the MSC number to update. This morning it finally did. My 485 is received, additional evidence received and the case is pending.

Please cross fingers, pray or wish me luck. I am beyond nervous and have some strange horrid fear my luck runs out here.

Canada485 process and procedure?
I have a question, I searched for the answer but couldn't find it.

I sent in a 765 with my 485. In order for my 485 to get approved does my 765 need to get approved? If the 765 is denied is my 485 auto denied?
If my 765 is approved, when does the 485 go into processing?

I am confused I guess on what paths the 485 goes on and what it depends on in order to get approved. IE if my 130 is gold, is the 485 a shoe in? Sorry getting neurotic as every hour passes.

Cheers. kicking.gif

When I was 16 I had my mom lease a car for me. I lost my job and couldn't pay the bill and neglected to tell her. 3 months later she gets a call from the bank.

To make a long story short TD Canada Trust put on MY SIN that I was delinquent. 2 years before I could even get credit. Even to this day they won't even give me so much as a cell phone because of that.

Banks suck.

CanadaYou got a large package from immigration
It turns out that because the I130 was filed before the 485 they assumed I was applying for an entry Visa. NVC said I have to email them my case # and my new AOS case number and they will put the NVC case on HOLD. If my 485 is denied, I can open the NVC case when I am in Canada and enter that way.

Sort of a neat backup. May be a good route to go in future for other applicants and I wasn't even intending on that.

Sounds about right. I am going to have to call them first thing tomorrow morning (7-30-12am EST are their hours blink.gif )

Do you think this will be a big problem?

Okay we just opened it. Dated September 10th, it says:
1) Enclosed Affidavit of Support AOS Fee Bill must be paid
2) When we receive the AOS fee we will send you further information on the Affidavit of Support (I-864) forms

I was under the impression there was no fee for these forms first off. No biggie it's $70.

Then I got a DS-3032, which I don't think I need to fill out?

Is this good or bad?

You're clearly not a stress freak. Me and the OP have this is common, my only plan is how to plan on what to do if I am denied. I haven't really considered how to celebrate if (when actually) we are approved. There is no reason why we wouldn't be approved.

But every time I see a case update or get a letter or a notice I freak. That's just how my wife and I operate. We expect the worst, so when something great happens we are floored.

I can't stop refreshing the online case status for my AOS. How do you people deal with this waiting and delay? I've been in the system since April and I feel like I have hit uscis.gov more than I take steps in a day.

What do you do to sort of calm your nerves with the wait? As this is the last step I've become obsessed. It doesn't help that I am stuck at home all day playing videogames and not contributing to our lives for about a year.

It seems to me that's a very backwards system and is intended to keep people in their places. I hope the new administration will address that.

Healthcare has been an issue on the last 3-4 administrations plates. Clinton tried to push it hard, it didn't happen. It has also been a top "to do" for incoming or potential presidents. NO ONE has solved it. The US just isn't set for universal healthcare, it's too "dog eat dog" down here.

CanadaAnyone thinking of remaining a resident somehow?
QUOTE (neiks @ Sep 16 2007, 10:01 PM) <{POST_SNAPBACK}>
Sorry, Canadian citizenship in itself does not make you eligible for healthcare. Healthcare eligibility is based on where you physically legally reside. It varies by province but generally they require you to be physically present in the province for 6 months of the year or at least 183 days of the year.

With that being said, just want to add the downside of the Canada's "great" health care system. Don't get me wrong, I'm a huge fan of our system in Canada but by no means is it a total blessing. My friend has just been diagnosed with a brain tumour. She is on a wait list for treatment. The tumor has grown an inch in a month and she has already had to wait a week to hear when she can be scheduled for surgery. The long waits for crucial treatment are just a reminder of the frustration people have with the Canadian system and the downside to goverment run healthcare.

I am sorry to hear about your friend and her problems with CDN Healthcare. This is why I will always prefer US Healthcare. If you can pay for it, you can get it done nearly immediately.

CanadaShould I stay or should I go...
For the record, I don't think anyone was thinking you WANTED to break the law.

I am in the same boat as you. I visited my fiancee and I ended up just... well staying. We got married 3 months after I came down and we are adjusting status in the USA.

What I did is what lawyers say NOT to do in every situation because USCIS doesn't like it when visitors marry and stay. I narrowly made it into the country, and had to give officers a VERY detailed log of why I was coming down. I was going on a cruise with my wife (at the time fiancee)'s family in Mexico. So I had to give dates, times, ports etc. I was allowed back in and then just didn't leave and started shipping my stuff down.

I can't work, I can't play, I can NOT leave the country. Don't do what I did. I may be with my wife, but I think she is tired of supporting my cheese-head a**. LOLL

I believe it was something like 22,000 Canadians go to the US every year. I could be very wrong but that number stands out off the top of my head for some reason.

CanadaElection Speak
The liberals CAN NOT enact any legislature that is too left or too right, which means they never do anything. If you look at the record they have it shows they don't do ANYTHING that could anger any one side because Liberals rely too heavily on NDP/leftist swing voters and Rightwing/PC/Conservative voters.

But then when the "Conservatives" do something they SHOULD do, they get slammed. They need to change their name to the "All Canadians" and they would not get so much flak.

Harper is doing a fantastic job. Look at the dollar.
