"Thank you for your letter to Congressman Royce regarding the words “File Freeze.” The files are frozen for inventory purposes. Once the inventory is complete they will continue with the oath ceremonies. You will not lose your spot in the line-up."

This is what we heard back from the Congressman. So I guess we're just in a queue for an Oath, does that sound right?

If you wanna talk to a human, just input your application number then keep saying "Operator" or "Representative" until the system transfers you to a human. The first person who talks to you is gonna read your online status and will not be helpful at all. keep asking him/her questions like " How come....?" and "I'm worried that something is missing from my file...who can help?" then you will be transferred again to a higher level Officer who will have full access to your file and will give you all the info you need. hope this helps. I tried this, they were not helpful. Read my status but would not transfer me to the 2nd level IO.

My interview letter has still not arrived. It has now been 30 days and I am obviously very worried since it never takes this long.

Still no Oath letter, and the 24th is coming fast. Looks like I will be in April after all. Very frustrating/upsetting. I have to fly down to go to the oath. Waste of time and money.

4 days after interview and USCIS has not updated my case online. I don't have any idea when the Oath letter is going to go out or what the status of it will be (maybe it will be in May for all I know)

So I sit impatiently waiting for the last time going stir crazy!

Approved.
I went in, appointment at 10:35, called in at 11:00. Swore to tell the truth. Then he went through the application and confirmed everything.
We did the test, I don't remember the questions it happened so fast. I got 6/6.

He didn't ask anything personal or anything outside of the norm "Are you a communist or Nazi."

He told me my Oath letter will go out and I will more than likely be scheduled for the 24th, but there's no guarantee. He also suggested I get passport photos taken and download the passport application from the state dept. website and take it to the Oath ceremony so I can send it in right away.

I have a feeling I am going to get pushed to April for some reason, which is bad news. But only time will tell - now waiting one final time on USCIS... for the Oath letter.

Nice, I did do a frantic search afterward also and read about the bio. I wish it said "Biometrics Letter Mailed" not RFE. Some consistency would be nice... but honestly this is the last leg of the USCIS journey and I don't care anymore. LOL!

What did not you send with your application so that they are requesting evidence?
Mine is based on 3 years only cuz i am married to a USC. I just sent the application form, check, 2 photos and copy of my green card because I already sent EVERYTHING less than a year ago in my I-751 application, and will have everything at the interview.

I sent taxes, green card, wifes birth cert, copy of apartment lease.... everything they asked for to the T.

There is nothing you can do - period. Contact your congressman, that's about all that can be done. USCIS doesn't actually care if you're inconvenienced. You're #94285875 of #245887538765 applicants. You don't matter, so pleading or being upset doesn't matter.

Sorry to hear about your misfortune. Contact your US Representative and outline your situation. Do not rant, keep it to one page and explain the situation clearly so they can effectively help you. ( I say this because the longer it is and the more emotional it is means the assistant has more work to do... they hate that ;) )

You really should have figured out what you were doing before you filed anything. You're here in the USA. What makes you think you need a visa? Visas are used to enter a country. What you need is legal resident status. This is achieved by filing an I-130 and I-485 together as well as the supporting documentation.

The process is very confusing and hard to understand - we did what we thought was right. Considering how many possibilities there are and how uninformative the USCIS site is I'd say we did pretty well understand what we thought was the right procedure.

Given the fact that I think you're right - how would you go about rectifying this and fixing the situation?

Don't feel bad if you did something wrong. It IS confusing and unclear. Alot of things seem to be contradictory too.



Agreed. The process is crazy, so don't feel bad :unsure: . What's important now is for you to NOT LEAVE the US at all (check Stacey's post) and send in the I-485 asap.

Thank you SO much everyone for your support and suggestions. We have finished filling all the supporting docs and 485 and are ready to send it in (just have to wait for the report of my medical exam which should be 100% fine)

I am a little worried Stacey and Dan. I am getting sort of mixed signals from both of you. I am looking at the K-3 and the I-130 option and I am getting a bit nervous.

I am hoping you're right Stacey, as we haven't filed anything other than the 130 and the G325s. They said if they require more info they will contact us. Seeing as how I did not marry for citizenship and I didn't marry intentionally to get around any laws or Visas (we eloped at the Santa Ana courthouse) everything I read said we should be fine. Now I am worried about the 485 should have been sent in at the same time which we can do as it is completed. The 129F I haven't even heard of until reading today so that is certainly not in the picture.

Now I am crossing my fingers again! lol

I should clarify though, are you filing an I-130 with I-485 (Which would be AOS)? or just an I-130 (Which would be CR-1 or K-3)?

Sorry I didn't know the technical term was K-3. I have (my wife has anyway) filed for the I-130 only. In what we read and researched they recommended that first, then the I-485. We can send that in also as we have it done. (would it be too late to send it in as a sort of addendum?

Here's the deal, I am looking for some advice and some help.

I am a Canadian citizen and I met my (now) wife while attending school on a F-1 student visa. We kept in touch and decided we wanted to get married but kept the option open as to when. 2006 in October I was invited on a Cruise to Mexico with her Family so I entered the US on a B-2 Visitor Visa. When I was admitted I had to give my entire itinerary to the customs agents in the secondary (back) room in the Vancouver customs check point at the YVR Airport.
I was admitted and came down and went on the cruise. I was entered into Mexico without problem. When I came back into the US at Long Beach port I was brought back into the second room to confirm all of my details and dates and claims. I was admitted back into the US.

During the stay I decided I didn't want to spend more time apart from my fiancee so I proposed.

We were married January 4th of this year.

We were confused about the process so we didn't file our I-130 until April 14th 2007. Had I known all we needed was the I130 and the G325's we would have submitted in January. We were under the impression we needed the forms showing support etc all at the same time so we filed our taxes and got our records in order early only to find we didn't have to do that.

Anyway my question is, due to the fact that I am now overstaying my B-2 BUT I am in the system for a visa, am I okay? Do I risk deportation when I come in for an interview?

Thanks to everyone who had positive and constructive advice for me. My wife and I have filed all documents 485, etc and are now waiting for an update. I feel comfortable now with how things are going. I am a bit nervous for the interview for some reason but I can usually calm myself down.

Just waiting on the when and where for the interview at this point. Thanks again!

I think we're the friendliest bunch around too. My husband thinks it's weird when I chat with Canadian government employees or people in billing or whatnot for all my old Canadian bills/accounts. I was on the phone with the EI lady and we were talking about the summer, differences in Canadian/U.S. bureaucracy, vacations, etc. He thought it was weird... I told him, that's just what we do... we're friendly and we chat!


Hahaahha yesssss I get the same thing all of the time. The building I am in has a few Canadians, and I have a flag on my car. I am stopped at times and when I see other flags or hats or markings of Canadians we ALWAYS stop to chat even if we are in a hurry. My wife doesn't quite get that because in California you walk with your head down and ignore everyone.

I do feel comfortable when I have a chance to chat with someone. For example if I am on the phone and I slip an "eh" conversation always ensues. I do love that part of the culture, absolutely.

To be honest there really isn't any sort of spirit I hold for my home country. I am more American at heart anyway, as I am an Imperialist and someone who enjoys political action. While the US is a clusterf-k when it comes to politics, it makes more progress than Canada.
