Hello Guys, we just received a letter from USCIS stating they want Both of us for an interview in VA which is fine with us but since last December we've been living in Paris, France and we filled for an address change and we got an email confirmation of that.

Now the Interview is scheduled for March 13th, what should we do ?

we're planing to call USCIS to fix this mess for the 20th time since December, last thing they told us that they're working on April 2013's Petitions and our file was transfered to DC Field Office

correct me if i'm wrong we're filling for an i-130 to get a visa to the US, how im going to be present in the interview ?

I just looked through my documents that were approved.  On both G325A's and the I-l30 I had a bunch of NONE's and only one N/A.  one the I-130, a questions was - "14 If you are a lawful permanent resident alien, complete the following:  Date and place of admission ...."  For this question, it seems to me that saying NONE would mean I am a lawful permanent resident alien, but don't have a date and place of admission.  So I put N/A.

My input in this is as follows; i know it may sound mean but i am being very neutral and looking at it from the consular point of view

 

When they asked you why you never went to India or were not interested in going to India or even visit his each others family , but would rather visit your friends in vacation trips, that raised a red flag on the seriousness of your relationship. I repeat again not that you dont have a relationship but the all the consular has is the picture you painted to him by your answers which makes the consular think and wonder. coz if i had a fiance' who is not interested in visiting my country and my family then, what kind of a relationship are they having.

Secondly as you stated that you stated that you prefered to go vsit his friends and not his family while remember, marriage is a unity of two families,

Honestly, it does not matter where you get engaged but you have to help your case and do drastic measures, just to make your case worthwhile, for example, i met m fiance in russia while studying there and she was living with her Aunt, her parents lived in Republic of Georgia, i decided not to propose to he rin Russia but in Georgia with her parents present, she had Russian permanent residency but i asked her to go back to georgia for the whole year when her case was being processed and have her interview in Georgia.. in short is .. no matter how many documents you have .. you have to help your case not only by assumption but by substantial evidence .. 

 

But dont loose hope.... if you read my timeline you will see that on my first K1 application, i got DENIED too .. so i know what you feel..

this is what i would do .. send a letter to the USICS asking them to close the peition .. and then refile a new K1 visa but this time .. overcome those short comings that i mention above... and please .. safely keep all your boarding passes and travel documents.. so that you can send colored copies of them  when you apply next...

 

People do say that now get married and apply K3 visa.. i am proof that i applied K1 visa twice back to back and i got approved... you stil have hope dont loose the hope

all i can say is .. Be smart and Help yor case by doing stuff that will boost your case like pictures with his/ her family members in their country makes your case much more genuine ....

My fiance's alphabet is georgian , so this is what i did

I dont speak Georgian and cannot write in Georgian

 

i asked my fiance to send me an email with her full name, address, city , country  written

in this format:

 

Name ( First name, Middle name, Surname)

address:

 

I then copied the name on MS word and printed it.

i cut out the name precisely using a blade and using glue, i stuck it on the application paper place asking you to write your fiance/spouse's name in their native alphabet.

I then made a copy of that page

walllaaaaahhhhhh

 

you have a well fill in form with your fiance's name printed in Arabic,

Remember do this after filling the whole form, let this be the last option

after that .. you can sign the form

What matters now is that the current pasport that you have , the issued to you in 2011, that passport should have the NIOMETRIC feature on it.

Even if you had your old passport and it was still valid, that passport would be irrelevant because as per the new immigration laws, the US will only issue visas to the new generation pasports that have the BIOMETRIC FEATURE

The passport on the LEFt is the new one,, look at the small sign at the bottom.. so in order for you to get a visa, your passport should have that symbol for you to know that its the newer technological passport

I realize that now after spending a few days reading through the threads posted on this forum. We were ignorant and arrogant in thinking things would be different because I'm Canadian and could get in and out of the US fairly easily. I'm not planning any more attempts to cross the border. We're doing this the proper way starting with the I-130. I don't want to risk being banned from the US because moving to Canada isn't an option for us. Fingers crossed that there are no hiccups in our application process.

That's a good question and I keep replaying the interaction with US border agent trying to understand what happened.

 

I was trying to go into the US as a visitor but the agent did not feel I was eligible because I am married and no longer have a job in Canada. We also mentioned that I was planning to get my status changed while I was in the US but we were waiting to start the paperwork to make the move permanent because I still have commitments in Canada.

 

She said my intentions were no longer to visit the US but to stay.

 

My husband sent the I-130 today and we're going to be contacting an immigration lawyer to see what my options are to get back into the US even just for a visit.

Hi everyone,

 

This is my first post so my apologies if I've broken any forum rules.

 

I just got married to an American (three weeks ago). I was already in the US but returned to Canada for my mom's 60th. I was denied entry back to the US as a visitor because I'm now an intending immigrant. So my husband and I are in the process of submitting the necessary documents for me to return to the US where we intend to live.

 

Can someone confirm or correct my understanding of the process?

 

1. My husband has to submit the I-130

2. We wait for acknowledgment (2 acknowledgments)

3. Once the I-130 is approved, I will need to go to the US consulate office in Montreal for an interview

 

I know the above is a very simplified version of events but I just want to make sure we're starting off on the right foot. The US border agent told us to apply for a K-3 visa but I've been reading on this forum that there really isn't any value to the K-3 since the I-130s are being approved sooner and also the cheaper method.

 

Any help would be greatly appreciated. If I had known all this beforehand, I would have begged my mom's forgiveness for not appearing at her 60th until after I got an adjustment of status while in the US.

My fiance is a USC, I am Canadian.  We have applied for our K1 visa and received our NOA1 on December 3 2013.  Since then, my fiance has been offered a job posting in Italy (for a year).  He loves it there and would like both of us to be there, together.  It would be a great experience.  Question is;  does anyone know how to go about this?  If we get married; would I be "allowed" to stay with him for the time he is there?  Also, when we come back, would I have to come back to Canada, or could I just apply for the k3 visa while I am overseas? Any comments or experiences would help at this point...Thx!

I am a Canadian citizen,  just sent out packet 3 (to Montreal); sent DS-160 confirmation, biographic page of my passport and a scanned copy of signed checklist.  Those are the only items that were on my "list" of things to email.  

Maybe I am getting ahead of myself here but on the Packet 4 checklist it says you need to bring the DS260 confirmation.  I am confused and am getting conflicting answers. Do I actually need to do the DS-260 also? 

Also, does my fiance need to fill out the I-134 or the I-864?  Whats the difference?  

Any info/input would be greatly appreciated!

I am awaiting packet 4 for K1 visa (from Montreal)...so I know that I still have plenty of time to finish preparing my paperwork.  On the checklist it specifies to translate birth certificate (or any other paperwork) to English.  I was born in the province of Quebec, my birth certificate is in French.  Where do I go to get a a birth certificate translated to English?

That says that medical must be done 6 days before interview. Does that mean at least 6 days? I mean can we not do the medical part before the interview is scheduled? Because we have expedited the I-130 and expect to expedite the nvc part (once I get the case number) I'd like to get things done as soon as possible. Thanks.

Good morning. I have looked, but have not found an answer to my question. I am the USC and my wife is in Panama right now. Our I-130 was just approved this week and I'm waiting for it to be moved to NVC. I think I have that part all figured out. However, when and how do we schedule for a medical appointment prior to an interview? Or does NVC do that for us? Also, when does she need to have a fingerprint appointment? And how do we do that? I know a lady from USCIS told me on that happened during the I-130 part, however, my I-130 was expedited after only a month. Thanks for the help in advance.

I emailed the Panamanian embassy and was less than enthused about their reply, so I hope to find an answer here. This is what I wrote:

 

"Dear Sir or Ma'am,

I am a US citizen that is seeking a immigrant visa for my wife that is a
Panamanian citizen and currently living in Panama. We have just had our
I-130 approved and are entering the National Visa Center portion of the
process. My question refers to the medical appointment. How does that work?
Can we schedule an appointment now? Or do we have to wait for the NVC to
make an appointment for the interview? Also, when is my wife supposed to
get fingerprinted? I haven't heard anything about that yet. I'd like to get
as much done before hand to save time if possible. I have had the I-130
approval expedited and expect the NVC to expedite as well, so anything we
can do to prepare for the interview would be helpful. Thank you for reading

You should not begin interview preparation without notification from the NVC."

 

Are you kidding me? What kind of reply is that? Just tell me NO you can't have the medical appointment right now. But they didn't even say that. Clearly, I am expediting and trying to finish what I can control as soon as possible. Does anyone know an actual answer to this question? And I STILL don't know when or how my wife gets her fingerprinting done. Anyone have any info on that? I asked these questions on this forum before and was instructed to ask the embassy...a lot of help they are. Still no answers. Thanks for anyone that replies though!

She doesn't need to make an appointment? The Panamanian embassy is not helpful at all. I asked these questions and they they said don't prepare for anything until after the NVC says so :/.THANKS

My case status has been updated and states hay my i-130 has been shipped to the NVC today. Now when should I expect a case number from NVC? I was going to start calling in a few days. Also, is fingerprinting needed for a cr-1 visa? I have seen different things about this and just want to be sure. I have no idea about how to schedule an appointment for this or when we do.
