IR-1 / CR-1 Spouse Visa Process & ProceduresExpedite request taking too long? (merged)
It's now been a month since I requested expedite of this and STILL NOTHING HAS HAPPENED. They tell me to wait to fax anything in until I get something from them in the mail. It's been over a week since they supposedly mailed it and I still haven't received it. I also have a congressman caseworker helping me they still haven't responded to him. What makes all this worse is that my wife's embassy interview is next Tuesday! ####### uscis??? What is taking so long? Does any one have any insight on this?

Not really, if you are requiring an expedite isn't it in YOUR best interest to have your stuff together to send it in?  You really shouldn't need any deadline if you are requiring and expedite right?

good luck

Of course I don't need a deadline. I'm ready to fax my evidence right now (have been for a month). I'm just saying it's funny that they give deadlines when they take forever to do anything and my expedite should have been approved already

Now today they finally gave me a fax number...but told me I can't mail any evidence until I get something that they sent me in the mail (slow mail) What?? Is this common? I read the forums daily and haven't heard of this before.

And they have me a deadline of August 15 to send evidence in. REALLY? Uscis is giving ME a deadline?? Laughable
I meant I can't fax any evidence**

It's a military expedite. And I've already talked to 6 tier 2s and they ALL tell me to wait for an email even though I've asked for a fax number repeatedly. They say that the national benefits center is just backed up with a lot of cases which is the reason for the delay. But I read here that someone at the same location was given a number over the phone and told to send in evidence (also for a military expedite).

Mod: please keep this one and delete the other one because I'm more likely to get help in this section

I submitted an I-130 on June 25 and requested expedite on July 1 by calling uscis. I still have not received any email or fax number for which to send evidence. I was told that my case was assigned to someone on the 17th of July, but that's it. It's been nearly a month since I requested expedite and I see other people getting accepted within days. What is the problem here?? I haven't received a denial either.

I also submitted evidence to my congressman on July 2, to attack this from 2 directions, and he hasn't heard anything either. Anyone have any advice? Thanks.
By the way, my case is at the national benefits center and has a MSC code

Update: the congressman guy said he's waiting for a phone call back from uscis regarding the decision. And I talked to a tier 1 at uscis today and they said someone was finally assigned to my case on the 17th. Finally getting somewhere with this

Ok more information regarding this: I talked to a tier 2 today because they told me to call after the 16th. Well the tier 2 said the reason that my case HASNT EVEN BEEN LOOKED AT for expedite review is because it is sitting in a mail room and no one knows that it needs to be expedited until they pick it up and open it. Is this real?? I've seen many cases of petitions being looked at within days of the expedite request. If what the tier 2 says is right, then t won't be looked at for months before it is finally expedited. This seems like a BS answer. Anyone know anything about this? Thanks.

I am an officer. I have a letter from my commander which I am using as evidence as to why it should be expedited. It just doesn't make sense to me because my wife's case was expedited extremely quickly (again, with help from the congressman) It seems like a no-brainer that my stepsons case would be expedited so they can immigrate together (and for the military reasons that my wife was expedited for). A month to reply back to an expedite sounds like a foul, am I wrong?? Ahhhhhhhhhhh

I have. They are dragging their feet too. I submitted all my documents on July 2 to my local congressman....and a week later he said he still hasn't submitted anything to uscis. Im going to call him on monday but have a sick feeling he'll say he hasn't done anything yet. Ive tried both avenues and I'm lost as to what else I can do :(

Please dont move! i posted this in another section and no one has helped me :(.

Hello all, this is my story: I have already filed an I-130 for my wife and that has been expedited at the uscis, then the NVC, and has already arrived at the embassy. Then I filed a separate I-130 for my stepson (plans has changed, which is why I didn't file them together). It arrived at uscis on June 25 and I requested expedite on July 1st. I have not heard anything back from them yet. Not even an email with a fax number so I can send more information and evidence. The first tier 2 I spoke with submitted the request and said I'd receive an email with a fax number to send paperwork to. No such email has been sent to me. I talked to a tier 2 again today and he said I should hear a reply by July 16, or possibly up to 1 August!!! Does it really take 30 days to send an email with a fax number?? Am I being screwed over here or what? I KNOW i will not receive a reply by the 16th but there is nothing the tier 2s will do to help me until that day. Anyone have experience with this? By the way, this expedite is for military reasons, and I've read here that those often get approved within days of the request being made. Thanks for any reply.

K-1 Fiance(e) Visa Process & ProceduresI-134 and I-864 Help please

Thanks for the info, I'm looking for a different answer though. Both my fiance and I are below the poverty line, so I don't know how to fill out I-134 because of this reason. Should I be filling out both, ahhh I don't know what to do with this poverty line stuff once I receive my NOA2. If I submit the I-134 myself (Im the petitioner) I won't be above the poverty line. I'm afraid of being denied even before filing the I-864 with a joint sponser.

K-1 Fiance(e) Visa Process & ProceduresI-134 and I-864 Help please

So I'm the petitioner myself, and I filed a I-129F form for my fiance to come and get married in the US. She lives in Colombia and I currently live in Colombia with her for almost a year now. We've been together for more than a year and I met her in the US. I have a US address that I live at, which is with my parents.

I work in Colombia, but I have no billing address here in Colombia only US one or anything like that in Colombia I just teach English privately.

The problem is here.

Both me and my fiance are below the poverty line, but my parents have agreed to help us financially with bring us above the poverty line and we will live with my family in the US for the beginning.

I want to know which form I fill out I-134 or I-864. My family will be well above the poverty line. Do I fill out both forms? Or do I fill out only I-864 for the joint sponsorship with my family?

What is the process steps to filling either out and submitting the form.

Please help things are confusing for me at the moment.

K-1 Fiance(e) Visa Process & ProceduresI-134 Co sponsor Question

So my father is co-sponsoring my fiance and I. I want to know when he fills out the form and submits tax returns or even a W-2. Can he black out certain sensitive information such social security and stuff like that since he would have to end that overseas to my fiance for her interview?

Also in question 3 does he put in my fiances name and information and put father-in-law.

Also how does my father (co-sponsor) answer questions 8, 9, 10, and 11. I'm a little confused on those questions.

Also I have looked up samples of I-134s and they have proven only a little helpful.

K-1 Fiance(e) Visa Process & ProceduresQuestion 7 I-134 currently working outside US

You can say you are working but that income won't count for anything.

So in general when I go to the Interview it won't matter and everything will check out ok as long as my co-sponsor shows sufficient income for my fiance and I.

K-1 Fiance(e) Visa Process & ProceduresQuestion 7 I-134 currently working outside US

So as of right now I am working in Colombia and living with my fiance at her families house. I have a low paying job here making.... only $2,000 a year approximately.

My question is do I fill out question 7 normally with this overseas job or mark it unemployed since I'm not in the US working. Once we have the interview and if we're approved I will have a job very shortly upon my return to the US.

I have a co-sponsor already so no worries on that.

K-1 Fiance(e) Visa Process & ProceduresI-864 Agreement and Risk for joint sponsor

Hi, so my question here is regarding the I-864 form agreement and risk factor for a joint sponsor. I want to know after the joint sponsor, or in this case my father, is it possible for me to file another I-864 in the future even after my wife has her green card in order for me to take full liable responsibility for, say like after having her green card for 2 years?

If not is there anything out there separate from this that can limit or lower the risk say for example a form my wife signs agreeing to never sue my father for any circumstances (not that she would)?

i want to know this due to my father being a little cautious due to having to be liable for her for up to 10 years. Just hoping there's something else out there to help secure his financial safety from government over reach.

Any help is appreciated.

K-1 Fiance(e) Visa Process & ProceduresK1 Visa forms Co-sponser needs to send to my fiance.

Hi, my fiance lives in Colombia we are preparing for her interview. We are not sure of the date yet, but we will know soon. Anyways, my father is co-sponsoring me and my fiance. I want to know every form he will need to send to my fiance attached to the I-134 form for supporting evidence.

Can he send a W2 rather than a tax return, will that be acceptable? Also I know he will send a letter from his employer, but what else will he need to acquire.

Also once my fiance does get her K1 Visa is she able to stay in her country for example 3 months and then come to the United States and get married 60 days later, since the requirement is 90 days once you "enter" the United States. I read somewhere you have up to 6 months to enter the US to get married once your K1 Visa is issued.

Thanks for any assistance.

K-1 Fiance(e) Visa Process & ProceduresI-134 questions

1. Question 7 I don't make an annual salary and I've only been working for a month essentially. I don't run my own business so I don't need to submit a tax return I presume. What do I put for my salary on question 7 if I make an hourly plus gratuity?

2. Question 10 My father is co-sponsoring for me so I presume he puts "none" in this area since he has not submitted any petitions previously. Yes, no?

3. Question 11 Since my father is co-sponsoring for me my fiance and I will be living with him for at-least a year so I presume he puts "I intend" and then below put "to support with room and board." Yes, no?

4. What do I put in the box under Oath or Affirmation of sponsor? Do I put my Name?

For Question 7 I have 3 pay stubs ready recently acquired since from reading the directions of this form is all it seems to state.

K-1 Fiance(e) Visa Process & ProceduresQuestion 11 on I-134 Form

My father is joint sponsoring for my fiance and I. I want to know what he would put for Question 11 since my fiance and I will be living with him for at-least a year.

Should he put just room and board?

BradLinaNot TellingColombia2013-10-29 13:29:00
K-1 Fiance(e) Visa Process & ProceduresAnnual Income, Question 7 on I-134

So I'm not sure what to put here. I make an hourly wage + gratuity, but the main problem is I didn't work from october 2012 to september 2013 so almost a year. My tax return will be for the first 9 months of 2012 which i was working. I just started working again now and I've worked for a Month so far and acquired 3 pay stubs.

So my question is how should I go about putting annual salary since if I add up what im making just based off of one month of work won't really match up with what my tax returns says especially since my pay stubs will vary each time. Should I just put my year to date for present time?

my wage is

$7.00/hr + gratuity

Year to date for one month of work is $2,000.00

My letter from my employer states about 1,300 for my year to date, but thats only because I had it written shortly before my most recent pay stub.

My father is Co-sponsoring for me and is NOT self employed. So if I read and understood what it says on I-134 for Question 7 he does NOT need to submit a Tax return correct? Just 3 or 4 pay stubs. He makes well over the Poverty Line 100,000+.

If he does have to submit one will immigration be upset if he blacks out his SSN?

K-1 Fiance(e) Visa Process & ProceduresFiance Letter of intent

When using the example from here, do both my fiance I have to submit one each? Or is it just the Petitioner that does? When I submit one since I'm the US citizen I imagine I would reword the part about who is entering the US within 90 days to third person which would be "her," if you understand what I mean by that.

This is for her interview by the way.

Do I need to provide any other details outside of what the example shows? Or is it fine like it is once I put the appropriate names where they need to be.

K-1 Fiance(e) Visa Process & ProceduresFilling out DS-230

So my fiance has to fill out DS-230, but we are wondering about question 43a and 43b because my fiance had come to the US in the past on a J1 Visa in which she lived and worked for 2 years. She was issued a SSN and I presume you answer yes on the form and state the number. Would it be viable to check yes again to receive a replacement number or does it not really matter either way?

I don't understand these questions myself. Both of these are under 43a.

Would you like to receive a replacement
card? (You must answer YES to question
43b. to receive a card.)

Yes/No

Do you want the Social
Security Administration to
assign you a SSN and issue a
card? (You must answer YES
to question 43b. to receive a
number and a card.)

Yes/No

These 2 questions seem very similar in the way they are written. Would she answer yes to both since she had a previous SSN issued to her when she had her J1 Visa?

K-1 Fiance(e) Visa Process & ProceduresCo-sponsor question

hi,

all have to send taxes, the same as the sponsor. USC and LPR are supposed to pay taxes. immigration requires that you send taxes to see if you have made above the 125% over the poverty guidelines

why?

My co-sponsor is paranoid about his SSN and has had me black it out and refuses to submit any other way. So we're ultimately worried this could get us denied due to not showing the SSN, but we are showing EVRYTHING else.

hello guys, finally we're back in here to get some info about our case, now w're looking into filling K3 Visa and when we called USCIS they informed us that they're working on april 2013 filers which happen to be our month, it's taking a long time.

we have the package ready to be sent.  Now we are wondering if we should include a check for the amount they're requesting or just  the NOA1 would be sufficient?

IR-1 / CR-1 Spouse Visa Process & ProceduresRequest For Applicant Interview . . . WHY ????

we're in contact with our congressman and even his office couldn't get an answer from DS, we contacted USCIS at least 20 times since we actually moved and, we contacted the consular here in Paris and they told us they can't request the transfer of our file here we need to do so ourselves, every time we call and speak with a tier2 they say that our file is sitting in DC's Field Office and not assigned to an officer yet and we need to go for the interview and we tell them we're out of the country.

We requested our file to be moved to France back in December while my wife was still in DC  and the weird thing is that the lady which she spoke to told her that our file is now transfered to France and all we need to do is to go and have the interview in Paris and when we got here and went to the consular they told us nope they didn't receive anything
