Since you did a wedding ceremenony and doesn't matter how small it was. You are not elligible anymore to K-1 visa. K-1 visa is only for the unmarried couple there is a reason it's called FIANCEE VISA. Don't try to play the game with USCIS and Consulate a wedding ceremony is a wedding ceremony, you are not elligible. If you hide it from them, and they will find out later, your wife will face a life ban from ever entering US.

What you read about K-3 is correct it is virtually doesn't exist anymore. And there is 99.9% chance that you will be converted to CR-1 Spousal visa. While K-3 was slightly faster not by much standard processing for K-1/K-3 visa is 6-8 month, very rarely you will get it earlier. I would recommend stick with CR-1 since you married, while you will need to wait longer, there is more benefits to it. First of all CR-1 is an immigration visa, so your wife will get her 10yr permanent greencard and no worries about being able to work, or do AOS, or ROC and in 3 years she will be elligible for the citizenship.

While I went the K-1 route, it was due to the complications for me getting married in the country of my fiancee. It would take me longer to get an approval for wedding there then just go the K-1 route.

Good luck on your journey and think twice before you want to hide something from the USCIS or consulate.

Actually Fiancee visa is quicker to get (about 7 month) but more expensive and have some stipulations. While spousal visa is longer (10-12 month) however allows you to work and travel right away.

K-3 virtually doesn't exist and not used anymore. So since you are married go with CR-1/IR-1 visa and you child can qualify for CR-22/IR-2 visa. There is really no other route for you. Sorry to break the bad news but there is nothing fast about this process the CR-1 visa would take you about 10-12 month. While some people get it faster the 10-12 month this is what you should expect from the process.

Unfortunately there is nothing much you can do. It's been awhile since K-3 is getting administratively closed and the CR-1/IR-1 replacing it. I am not sure if really have to go to Kenya, may be they can transfer it to some other consulate closer to Mauritius. Try to find which closest consulate process spousal visa and ask them to transfer there.

The validity on the visa after approval is 6 months . What I find interesting is that everyone says the K3 is obselete,but I have had 3 separate appointments with 3 separate immigration officers over the last 4 months with the most recent 3 weeks ago and all 3 instructed me to petition for a K3 visa. That is because your attorneys have no idea what they are talking about, which happens quite a lot. Drop your attorneys and go CR-1 route.

The case will be sent to USCIS for review. The USCIS will contact you and let you know what are your options. The reason you were denied is that CO doesn't believe in your relationship.

You can wait for USCIS to contact you, which could take several monthes or you can get marries and start new petition for CR-1 visa. But make sure to document trully everything so there will be no questions from the CO on your relationship. You will need to cover all the bases for the initial denial so it will not happen again.

Your attorney is correct.

K-3 existed when process for CR-1 and IR-1 were taking very long time. Now since they are in normal range, the simply go with CR1/IR1 process and not K-3. Before even starting my paperwork I got a free consultation from the friend who is an immigration attorney. And he simply explained to me which route is the best and for what country. In my case it was simply K-1 would be the best choice.

Good morning dear VJers!

I`m an AOS applicant and adjusting from student visa. My biggest mistake was to submit I-130 stand alone. It was filled out correctly to the best of my knolege though. So now I submitted my AOS packet while I-130 is still pending and got rejection notice on a mail yesterday stating the following:

Based on the information you provided, your priority date does not appear to be current. Please refer to the Visa Bulletin published monthly by the US Department of State, Bureau of Consular Affairs to determine availability of immigrant visa numbers in your immigration category. When your priority date is earlier then the correlating cut-off date listed in the current Visa Bulletin, you will then be eligible to submit your I-485 application.

Do you think it is a mistake???

Please help, any answers would be greatly appriciataed.

Ok, here I`m back. I didn`t have to do the trick. I deceided to call one last time customer srvice line and finally got someone who knew what needed to be done in my case.

When my hubby was joining AF 7 years ago they made him sign a long paper stating all his violations, residence history (he was an LPR back then) and that he will give up his other citizenship when he becomes USC if necessary. I know that paper was for obtaing security clearance because you have to have one just to join. When he became a USC they made him cut his old passport at his ceremony (I think it was at the ceremony). This is just a reference. We don`t know if that action ment renouncing his old citizenship or not.

Is she still married to your farther??? If yes that is a good sign. because if it turns out she is not an LPR you have a path right here to file for PR based on her entering legally and being married to USC. I really don`t know how you should do that but you have to figure out her status first. What about her parents by the way??? Are they PRs or USCs or neither??? If they gained their status before she turned 18 years old she was suppose to get that status accordingly. If non of that apply then she is probably not a PR regardless of having alien number (it is not only issued for PRs). So it all starts for you to figuring out her status and it is going to go easier after that.
If she is a PR then she doesn`t have a reson to be placed in removal.
If she isn`t a PR file for PR based on marriage to USC immidiatly. After paperwork is accepted and pending there shold be no problems until decision.

Let me ask you this: did she vote in any presidential election in USA??? If yes and she turnes out not to be a USC then you have a big problem. Just a reference.

C'etait une question legitime, apres presque 3 mois a vivre ensemble je trouve etrange que vous n'aillez rien a vos 2 noms, au moins un compte en banque... Quand je suis arrivee c'est la premiere chose qu'on a faite, et pareil pour la voiture, elle etait au nom de ses parents mais on a pris l'assurance a nos 2 noms histoire de. Tu peux te faire rajouter aussi sur sa facture d'electricite ou de gas.
Mais independamment de l'immigration tu vas avoir besoin d'un justificatif de domicile pour pleins de trucs si ton nom n'est nul part ca va te poser des soucis.

Je viens de recevoir mon rendez-vous pour l'entretien de l'AOS, ce sera le 11 octobre.
Je suppose que cette fois le but est de prouver que nous sommes maries pour de vrai...Le probleme c'est qu'on a pas vraiment de preuve.
Pas de compte en banque en commun (d'ailleurs si on en ouvre un juste avant l'entretien? ca va pas faire louche ?), pas d'assurance ou de facture a nos noms, pas de photo puisque nous nous sommes maries qu'a la courthouse pour le moment ( le mariage avec photo et tout etant en juillet 2012). Je suis donc un peu perplexe.
Des idees ?

Sinon, ils posent quel genre de questions? Est-ce que mon mari peu venir avec moi?
ca dure combien de temps?


Tu n'es meme pas sur son health insurance, son assurance voiture?? vous vivez ensemble au moins...

In France you make your PC request via the internet and it is mailed to you within a couple of days. For my past visas (F1 and J1) to the States I have provided the American Embassy with this internet ordered version and it was no problem

I know a lot of people have already asked a lot of questions about the affidavit of support, but I couldnt find an answer that fitted our situation. And as the timelines seem to get shorter and shorter I better start looking into it now!

My bf (American citizen) has recently found a job, he makes over 50k/year, so it is well above the poverty line. However as he has been living in France with me for the past 2 years his American taxes are really low for 2007 and 2008. So we are wondering if we need a co-sponsor or not. (for info he doesnt have any assets, only his salary).

Besides, if we need a co-sponsor we could ask his dad but that would create a lot of family drama, so we would rather have a friend of ours co-sponsor me. I've read that some consulates accept non-family members as co-sponsor, some dont. Anybody knows about Paris consulate?

Our NOA2 arrived so fast that we were caught of guards. And then my fiancé being a guy ("there is plenty of time hunny") isnt helping, lol! Hopefully we will get the transcripts within a week too.

We are in the process of prepping everything for the embassy interview. 2 weeks ago I have asked my fiancé and his dad (our co-sponsor) to order their tax transcripts at the IRS toll free number, of course they have only just done it now (when I found out I wanted to strangle them!!!).
Could someone tell me how long approximately it takes before having the transcripts in the mail once ordered?
Plus, would it be acceptable to present a copy at the embassy and not the originals? I understand that the I-134 form should be original, but would copies of transcripts be ok?
