If you are only taking a short trip like several weeks not an issue at all.

US Citizenship General DiscussionHelp with continuous residence status
If I am not mistaken in order to qualify for a permanent residence, you have to spend time in us at least 180 days each year. Based on what you described seems like you fine.

US Citizenship General DiscussionGoing to Oath Ceromony by yourself Experience

If applying for the three year marriage has only been maybe one or two reported incidents where the IO requested to meet the US citizen spouse. This is from thousands of posts. I went with my wife, her IO couldn't even turn her head to return my, hello. One recently reported his wife was at a near by restaurant when asked by his IO, could bring her here, not necessary was the reply.

Just saying the odds of your IO wanting to meet your wife is tantamount to winning the Powerball. But with marriage, sure want to see her papers.

There is no meeting with IO, as the OP is going for the ceremony he already been approved.

US Citizenship General Discussionoath ceremony dates in December, is there a cut off date?
If you are still waiting for the decision that means you are not yet elligible for Oath. You can only be scheduled for Oath when you will get approved.

So most likely it will not happen in December, as you probably would've been notified already.

US Citizenship General DiscussionBad Timing? Passport Needed - Christmas Travel
Also since you are driving to Canada you can just use your Citizenship Certificate that you receieved it is an official document and allows you to cross the border. We did that with my sister, when we went to Mexico, we were also driving, and had no problems in and out.

US Citizenship General DiscussionWhen to file my wife's N-400?

Hello to all!!!

I have a quick question... My wife's 3 year mark is on March 26, 2012... (I have OCD therefore I want to prepare everything within lots of time... LOL). I would like to know if I can submit the N-400 package 90 days before the 3 year mark... That is how I did the Removal of Conditions package and had no issues at all... Is this ok for the N-400 package as well? Will this not cause any problems?

I really appreciate any insight on this matter.

Thanks a bunch!

Kelvin

This is exactly how you do it for N-400 as well, 90 days prior to the 3 years and you will be just fine.

Good luck

US Citizenship General DiscussionNaturalization Interview!

Also, does the spouse get to go in the interview? I did for the visa and for the AOS, we did not have an interview for ROC.

The letter asks us to bring certain documents unless we sent them wth the application, which we did, but as for the AOS interview, I plan to bring it all again. I did for the AOS and they never asked for it, I just sat there like a potted plant with the box on my lap.

Another issue, maybe. There are two IOs at the St Albans office and Alla does interpretation for both of them! So she will be interviewed by the people who are her clients. Maybe. They may have a supervisor do it or something.

Garry,

No you don't need to go to the interview, neither it would help her anyway :)

You can find simple test questions on-line or even possible on the USCIS website. They asked me about 10 questions and never listened to answers anyway thought it was in Las Vegas about 5 years ago. :)

Congratulations on almost finishing your journey and good luck at upcoming interview.

US Citizenship General DiscussionCitizenship
There are certain benefits to US citizens, while LPR's are not elligible. No one makes you to obtain a US citizenship if you don't want. However you have to consider few things. Renewing your GC every 10 years and pay the hefty fee to the USCIS, and make sure you do not abandon your status by living outside of the US for more then 12 month. Other then that you can remail an LPR forever.

You are an alien. Not sure about where they put this number, may be look at the documentations you filed. It should be there.

US Citizenship General DiscussionUSCIS contacted after became a US citizen
As fake as it can be. The few things that just strike out of the email !!U R G E N T!! and IMMEDIATELY. The USCIS will never capitalize or include words like that. Even if it is urgent, they will send you a certified mail but not email for sure.

While the address could be valid, here never would be an email like that sent to you, especially after your case is closed. If you want to provide full email address I can check if it is really exist. They would send you an official letter, they are not very good in using emails notifying on the case status changes, left alone send you an email after 6 month. I doubt they still have your information.

I agree with others who said report it as a crime let FBI deal with this, this is a serious crime.

US Citizenship General Discussionpls HELP ...4 years 10 months question

thnk you sir/ma'am for replying... but here's another question but first a little background/history...

i had my green card since 1999.. went home to my native land for school in 2005 and was there for 1yr 8 months, came back in june 2007.... i know i broke the 5 year eligibility and started from scratch... now im exactly 4 and 10 months...

i read somewhere that those whose has got the green card for over 5 years, you can't file 90 days before. Instead you have to wait until you have been in the US for at least 30 months during the past 5 years?? is this true??

What the 30 month really mean is that you have been physically present in the United States for at least 30 months out of the previous five years. It doesn't mean that you have to be presenet in the US for 30 consecutive month before filing.

US Citizenship General Discussionpls HELP ...4 years 10 months question
No it will not count against you. As long as you haven't been absent for more then 6 month and resided at least 50% of the time within US you are elligible to apply.

Seems like you threw away your NOA-1. While it is for information purposes it does have sensitive information, like your case number, alien resident number etc... If you can find it would be just better for you. Because if you want to contact USCIS, with any questions, they will ask for your case number.

Good luck.

US Citizenship General DiscussionDenial of Citizenship

On which form did he actually claim to be a USC, I-9 perhaps? I-9 is an official immigration form so that is definitely verified by the USCIS.

He was applying for a job online since it is a government job. Most likely it is usajobs.com. When you submit the application they do have ability to verify information, and it was flagged. Another question is what agency he applied for if it is a DHS, CBP or ICE, it would get flagged right away.

US Citizenship General DiscussionDenial of Citizenship

Only an IJ can take away his GC.

Not sure if this is true. I think USCIS have a full authority to do that. I am sure the IO will file a report and he might go into removal proceedings.

Not a good news at all. I agree with others members try to get a really good attorney, however since the claim was made to get a US Federal benefits such as Federal Job, there is no way to overturn it. There is no waiver for that, and most likely will result in deportation, and life time ban to enter US.

May be a good idea to start looking for possibilities to move with your husband to his country.

CanadaI-864???

My interview is coming up on Sept 7th and I've had my paperwork complete for a while now... I've just going through everything and had a question about I-864 form... I must have over looked this but ... Do we have to complete this form too??? or is it only if we have a co sponsor?

I-864 is not only for having a co-sponsor, but for the primary sponsor as well.

You do need this to be filled out and provide enough evidence to show, that your petitioner can support you. You also required to bring to the interview.

Canadaanyone give up on k1?

CanadaProof of ongoing relationship (interview)
While they may not ask for it, to be on the safe side I would recommend to print it out and bring it in. You don't want to get denied or delay your visa, just because you didn't feel like bringing it. Bring as much as you can, better be safe then sorry.
Oksana & MaxMaleUkraine2011-10-24 05:15:00
CanadaOk VJ friends, I need some advice,
You can't apply for a CR-1 visa if you are not married. You can only than apply for a K-1 fiancee visa. Don't try to lie on the border as they can find out the truth. It is all depend on the CBP officer. Your fiancee would need to show strong tight back in order to get thru.

Good luck on your journey.
Oksana & MaxMaleUkraine2011-10-19 21:27:00
CanadaProof of relationship
Proof is needed for every country, as the fraud exist in every country. While most of the time they may not look at that, you could be one of the people they might. Also if they will see you provided only limited amound of evidence they will question it.

You need to get as much evidence as you can.

If you don't have boarding passes is not a big deal. You can show your itenerary with the copy of the entry stamps in the passport. It will proove that you traveled on those dates.

If you do calls over skype like if you are dialing his number or he is dialing yours. You can go to your account online, and they will have 3 month worth of logs. Also you can get skype to skype logs from the skype itself. Just do a print screen of them or copy paste them and print it.

Better have reams of evidence, and not being asked for it, or have little and being questioned about it.

Just a suggestion

CanadaI-864 for K1 Interview?

10 days until my fiance's interview and we were going over documents needed. I went back to check off Packet 3 and notice it listed the I-864 under the I-134. I just signed and fed-exed to her an original signed I-134 at considerable expense. Does this mean I need to send her the I-864 as well?

Anyone who has actually had an interview know if this is true or not?

Some embassies will use I-864 instead of I-134. Check with your embassy.

CanadaStudent Loans in the U.S.
As long as you have a GC you can get student's loans. Student loans are not considered federal benefits, since you are required to repay them. While they are an extra expense they worth it trust me. I am burried with student loans but it was worth every penny for me.
Oksana & MaxMaleUkraine2011-12-01 08:54:00
Canadaone question before interview
You can bring all of that requires to show that your significant other makes sufficient to support you. There is no such thing as "only". You must bring everything to show the financial support as well as the proof of bonafide marriage.

Since it is free go for it. You never know but it could become usefull. I am preparing my AOS packet now and will be applying for it in few weeks, and I will include for AP as well.

CanadaI 864, I 864A, I 864 EZ, I 864 W or I-134

CanadaMarrying in the US
As long as you leave the country to wait for the appropriate process it is not an issue. If you get married you will not be eligible for K-1 Visa and will have to go with CR1/IR1 visa.

RFE can be for anything. There is no way to know till you get a notice. We received one for the vaccination, as soon as we sent it back, we got the GC in 45 days.
