Well that's sobering. So what happens six months after the NOA1, I call, and it is lost? Do I have to re-file and wait another 5 months? Or maybe they can expedite in that case?


Don't get paranoid. It happens very rarely that it get lost. After six month you will be able to put a service request and contact your congressman, who can put in a request as well with USCIS. But yes you would be able to request an expedite based on the USCIS error.

Hopefully you will get approved fast and will not need all those steps.

Surely the chance of them losing the petition after the NOA1 but before the NOA2 isn't 0. It is sent from the Texas lock box to the service center after all. Or is the NOA1 sent from the service center, not the sorting facility?


Well there is always a possibility. But nothing much you can do and as Baron mentioned just wait. The infopass will not help you, as you will get always the same answer you are within the processing time.

this is what i have on my packet for the k1,

cover letter (table of content of whats inside)

  • 1. payment
  • 2. I-129f
  • 3. G-325A and passport syle photo for me (i signed the g-325a, i wrote my full name on the photo do i need to sign it too)
  • 4. attchment of my employer of last 5 years, (i wrote see attachment on g-325a)
  • 5. my whole copy of u.s. passport and a copy of my citizenship (do i need to sign this somewhere)
  • 6. letter certifying intent to marry from me and her both signed
  • 7 proof of having meet in person, ( i have my itenarary, my passport stamp, and about8-10 pictures of us together) do i need to add?
  • 9. proof of ongoing relationship, ( i have some letters from her 3 letters with stamps, i printed out couple of conversations on yahoo, and copy and paste some skype logs to word document around 10 pages)
  • 11copy of my decree of dissolution of marriage, ( i was divorce so this is the divorce paper works)

is there anything im missing? please help and let me know im just final checking now and getting ready to send

1. How about G-325A and passport style photo for your fiancee.
2. Proof of ongoing relationship is not required to file it, it will be needed at the interview stage.
3. Make sure you have a court certified divorce decree just a regular marriage dissolution will result in RFE.

Do you have the G-325A from her with her original signature? And her passport size picture?

Oh and while the G-1145 is optional .. I suggest you include it too, so you can get email and text notices

Get the Tax Transcripts. They are not that many pages as the return. 1099's could help since you don't have pay stabs. 12 Month Bank Statements might be an overkill. Get 3 month prior to interview. Kyiv is pretty easy embassy, as long as you can show them your current income you will be just fine.

You already have sufficient evidence of ongoing relationship, and those types of evidence are usually not recommended.

Put the photos first. This is most likely what they will look for anyway. And don't try to arrange it all nicely, as they will ask her to take it all out anyway.

My petitioner is my husband who does not pay taxes and gets paid off the book.Again,he works for nightclubs doing promotion for their events.The club owners did not ask for his social security number and his checks are not under his full name.They did not issue him any form related to tax or anything.He does not get paid on the same day every week and the amount varies.He lost his "real" job in 2009 and thats the last year he paid taxes.In 2010,we were broke and were financially suported by family.He did this promoting thing on the side and was paid mostly in cash.In 2011, he started getting paid in checks...Now we ordered transcripts from 2007,2008 and 2009. You have several issues going here.

By working under the books, he is not only cheating himself, but it is illegal as he is lying to the government. You do need to come clear with IRS, even if you don't make any money you are still required to file taxes. I would recommend hiring a CPA, who can do your taxes for missing years.

While having a co-sponsor is helpful, your husband will still need to file an I-864 for your sponsorship and he will be required to show documentation. The co-sponsor will be used if he doesn't make enough to support you, but he is still responsible to provide the documentation. I don't see how can you explain that you didn't file taxes, the law is pretty clear. Back file the taxes and then submit your paperwork. Don't lie to the government they will find out and hunt you, as well as they will penalize you for that.

Took me 8 because I was too lazy to file for citizenship for 3 years. If you enter on K-1 Visa your are eligible to apply 3 years after AOS is approved. In my case I entered by DIV Lottery so I was elligible after 5 and still took another 3 to file :)

You will get eventually mail from the NVC that your case is forwarded to the embassy. It might take about 2-4 weeks for NVC to do that. Most likely they haven't even got your case from USCIS.

As far as transferring the case, you are out of luck. You will have to interview in Abu Dhabi, they will not transfer the case because you are not a resident of Philipines.

Good luck and just hang there the longest wait is over.

I have a point of entry question. My fiance's airline itinerary takes her to New York JFK and then on to Florida. Does she go through passport/visa control at JFK or Orlando? She has a 2.5 hour layover at JFK. If she has passport control there. will she have time to make her next flight which is in a different terminal? I appreciate any help...

2.5 hours in JFK it is a little bit of a pushing. I am a USC, and allowing extra time for myself if I fly thru JFK. Also if your fiancee is flying on Aerosvit, they usually late by at least 1.5 hour. I would explore the possibilities changing the JFK to ORL flight to a later time if possible.

Getting Visa after the interview is usually not a big deal. Most of the time it is delivered within 7-10 days, unless your case get put into AP (Administrative Processing), usually applied to high fraud and middle eastern countries, which France is not (but could happen). If you do get put into AP there is no time on how long it will take. It could take from months to years. But I wouldn't worry, if you are approved you should get your visa pretty quickly.

We had our interview in January and we did filled out the DS-230 Part 1. Nothing is getting sent to the embassy, you just fill it out and print it. What I did, is filled out those forms printed them and took it with me when I went to visit. Since we already had the interview date, I just couldn't stay any longer, we signed the forms that needed, and the rest of them she signed in the embassy.

Everything you mentioned, is also required for I-134. And both your fiancee and your fiancee mom, have to fill out a separate form. So two forms, your fiancee as primary, and your fiancee mom as co-sponsor.

You have to interview in a country where your fiance/fiancee is legally residing. So if he/she is not a legal resident in Italy, you will have to interview in their country of birth of any country where he/she can be legal residents.

None of it is true. Embassy doesn't communicate with the attorney. All the heads up he will give you is the same as you can read on this forum just by going to your country portal, and read embassies reviews. This is not an exam, so what kind of thing it is 1 question wrong??? The CO is just trying to establish whether this is a bonafide relationship, so you have to make sure to provide plenty of evidence. Being from high fraud country doesn't help a lot. And if it is a bonafide relationship, why would you need any heads up, you should be ready to answer any questions related to your application or significant other.

Everyone gets questioned / interview at airport – severity of the interview depends from case to case and person to person.
You need to provide little more detail about as what the conversation was, what were the questions and what were the answers.
Just officer by himself cannot put someone back on the flight and cancel a visa, it has to go to chief immigration officer on duty at that time and his approval is required.


This is not true. My fiancee (now wife) haven't being asked even one question!!!


However I do have to mention that CBP can refuse entry to the USA even with K-1/CR-1/IR-1 or any other Visa. Visa doesn't guaruantee admission to the US, it is an authorization to go to the US. It is up to the CBP officer to allow or deny entry.
While questions about how the house look sounds weird, I think there is more to the story.

The DHS and DOS are two different entities. While DHS is approving it, the DOS still can refuse the visa. The DHS will not care about all those small things, as long as you provide documentation satisfying the requirements you will get approved.

As far as DOS is concerned you will have to provide sufficient evidence of bonafide relationship. And for some embassies and Lagos, would be one of them age difference is a huge factor. Were you presenet at the interview?

Thanks. Yes, I have the I-134 for myself and we have co-sponsors that filled out the I-134 and I-864. I also have a number of documents proving my domicile in the States (you can live abroad and still maintain domicile). I have a mailing address in the States (my parents house) and I currently work remotely from wherever I am and have a letter from my boss saying that I can continue working from the States. The above list is definitely not all that I have! It's just the relationship stuff that I was less certain about... Thanks again!

While you seems to be fine with the evidence you have.

As was stated earlier it would be fine for normal country, however high fraud countries can be more strict, and you should prepeare for it.

You are just in the third month, you will have to wait at least till you are in your 6th month. It usually takes about 5 month for application approval.

As other members already answered the other 2 questions I will answer the third one :)

The medical exam is usually done in the morning before noon. The paperwork will be ready for your fiancee pickup around 2:30-3:00 PM on the same day. So she will have to wait for a few hours and come back to pick it up.

Its best provide an email address and phone number so you can get text/email updates than relying on the website alone...


This doesn't guarantee anything. If they don't update website you will not get a text or email, as it is all synchronized.

No one on VJ will recommend you a lawyer. Lawyers are just taking your money and definitely not speeding up the process, but in many cases slowing it down.

This site have plenty of information on how to fill up the forms correctly on-top that members are really helpful. I did it myself and never regreted even a second going thru this process without a lawyer.
