The only thing I included from the time before I received the conditional GC were a couple of vacation pictures and cards we received for our first anniversary and the first Christmas. Everything else I sent was dated sometime during the last 2 years only (bills, mortgage statement, etc). We'll see if they come back asking for more... :whistle:

How is it not relevant? Same question although the story is presented with a slightly different scenario. It's one thing if the wife took the kid outside the country and intends to keep the kid there without the father's permission - this has legal consequences. Different story here where wife went on a vacation for a month and parents want to keep her there for a while longer and husband is desperate to get his wife and kid back because he thinks it's too hard to be without them.

Sorry you feel that way, as said, it was luck, the reason she asked for it, was that no NOA1 has come in, its been a month, and i am travelling, remember, if its at the officers discretion 'how' they want to help, henceforth its called a service center right??

well, in that case I would have taken the stamp in the passport unsure.gif now you still have no NOA and no stamp and only the hope that maybe you will get approved soon. sorry, seems like I don't get it...

If you take the extension letter and face the light, you will clearly see 5 or 6 seals through it. I believe one can find it hard to fake the letter.

probably depends on the airline or the place you are departing from - both Lufthansa and United wanted to see the card, even if it's expired, because the extension letter refers to extending the status for a year from the expiration date of the card and they need to enter that date into their system.

If I was looking for a job and a prospective employer told me they wouldn't hire me because I can't provide a valid GC as proof of employment eligibility (an that's what it's all about), I would take that I-9 and throw it in their face. After all, you have to proof that you are authorized to work, not your immigration status.

I lectured them and told them that this was discrimination. Quite honestly? I'm once again at that point today where I would like to just throw everything at USCIS. Give me my new Greencard!!!!! I've waited for half a year - yes, I realize that the processing times for Vermont are still shown as March 2007. So I have a long way to go still.
I am writing this from Frankfurt airport and I am getting sick and tired of the hoops they make you jump through just to get back home to the US. United clearly doesn't understand the extension letter. And I already know that on the other end I will not be greeted with a friendly "welcome home" - no, it will be back to secondary inspection where I will have to wait for an hour or longer just to have someone call their supervisor again because the immigration officer too doesn't understand the extension letter and what to do with it. I've made this experience a couple of times over the last 2 months.
There is nothing I can do to move the process along - but I can get upset to at least vent my frustration a little bit innocent.gif

this could work but it could also go wrong. You have to show that you have not abandoned your residence in the US. Just returning for a visit every 6 month could look suspicious. Having the re-entry permit would help with proving that you have not intended to abandon your residence but are just temporarily out of the country.

you should apply for a re-entry permit (form I-131) - this will allow you to stay out of the country for up to 2 years while keeping your GC. However, if you have a conditional GC you will still have to remove conditions.

I don't think I would worry too much about having USSR listed on the GC. They will still need to have their Russian passports to travel anyway. At least the GC is valid!

This won't help you or anybody else here determining the processing time at USCIS

At the very least it would cut down on all these threads/lists where people add their names to track their process. I like the tool on this website but a database like this is only as good as the data we all add to it. If everybody just blows it off and prefers to manually keep lists that can't be sorted and it tedious to maintain then that's a sad thing.

Hello everyone,

I have some questions regarding becoming a US citizenship. My wife came to US with the K-1 Fiancee Visa. We got married in March of 2008. She got 10 years green card. We have been married over 3 years and we live happily together. Now she wants to become an US citizen. I know she has to file the US Naturalization (N-400) form. Is that right?

1.) What applications do we need to send?
2.) Can we submit the applications for my wife now since we have been married at least 3 years?
3.) I have been unemployed about 2 years but my wife has a job. Can we still file the applications?
4.) How long is the process or how long do you have to wait to be approved?
5.) After she has been approved, what are the next steps?
6.) Does she need to take the citizenship test during the interview? Are there alot of questions and what kind of questions will they ask?
7.) If she does not pass the test, will she has to submit the applications again and start the whole process again?
8.) My wife is Vietnamese. Will she loses her Vietnamese citizenship after she becomes a US citizen?

Will try to answer one by one.

1. It is N400, you can download it from USCIS website and instructions as well.
2. You have to make sure that it's been 3 years since temp greencard
3. There is no financial requirements for citizenship, so yes you may apply.
4. The process depends on the office where your application will get processed, could take as long as a year. Mine took 5 month in NV.
5. She will have to go thru biometrics, and interview, and oath
6. Yes she need to take a test: reading, writing and oral. You can find samples on USCIS website or just google it.
7. She will have a chance to go thru the interview 2 more times, before she will need to resubmit.
8. Not sure about this one. It is depends whether her country accepts dual citizenship.

I got my citizenship 4 years ago. And when I was young and stupid I was arrested for misdemeanor which was eventually reduced to administrative violation. I declared everything on my N-400, and never got asked a question about that on the interview. And 2 years ago I got TS even with this arrest.

Just wait 3 years, don't push on the USCIS. As a lot of people are mentioned you are lucky not to be charged with lying. While I understand that it was the missunderstanding, this is how they understood it as well.

Also you mentioned that ticket was dismissed??? There is no dismissal if you are paying the fine, you've been found guilty. So your case is closed, but not dismissed.

I am going to file for a Certificate of Citizenship for my adopted children. It will make things easier if they have to apply for stuff.
I am filling out the N-600 but have a problem with part 3, question 5
Information about entry into the United States and current immigration status:
A. Do they want the date of entry when they came on their K-2 or do they want their last entry?
B. Depending on answer A I guess I fill with the information
C. I entered as a ... depending on A
The last time they entered in August, they used their US passport! But when they entered in 2008 they came on K-2 and their German passport.

The Date of Entry means original entry to the US. So in your case it would be the K-2 entry.

I am somewhat confused how did they got the US passport without being yet citizens. Are you sure it is US passport and not AP?

US Passport is only issued to the Citizens of the US, not even to LPR.

Alla gets her citizenship and then we file an N-600 for Pasha. Sergey is over 21 so he will have to file his own N-400 it appears.

The only question now is, can he still get citizenship after 3 years or does he have to wait for 5 years?


I hate to brake the bad news but 3 years only apply if the person is married to the USC. In this case I believe he entered under K-2 visa, and will be turning 21. So he will need to wait 5 years since obtaining greencard.

While it is not really clear but go ahead and read it here.

What about the two LPRs? We list them of course, but do I pay the biometrics fee for them? Will they automatically become citizens when Alla does? Is Alla the only "applicant" and the boys just get bestowed?


My mother got her USC thru naturalization, and after she got hers we filed N-600 for my sister she was 16 at the time. So check the requirements for N-600 this may answer your question. I am not sure if we did it correctly, but it worked for us.
