So I need to stay in US whole 2 years or I can get permit to stay in Singapore and when I do remove conditional (I-751) I stay in US. Can I do like that ?

As a green card holder you can't be absent from US for more than 6 month. You need to maintain your residence in US. Which means at least 180 days out of the year you have to be there, otherwise you can loose your status, as immigration will consider that you abandoned your residency. Since your husband works overseas, you may be able to obtain an exception, but better check on that with USCIS.

Just wondering if the affidavits from friends and family members stating that they know we are married and living together must be notarized. I read something about it in a post from a few years ago. I realize that the letters are not required, but I want to provide as much evidence as possible. Anyone know about the notarized part?


Depend in what status you are. If you are applying for ROC, then letters are requried, if you are doing AOS, then they are not. But you don't have to notorize them, only let friends sign it.

Nope. You are reading way too much into that.

Where does it say that the documents listed in those 5 bullet points MUST be produced? The only MUST about the affidavit, is that if you include one, it MUST be the original.

The bullet points are examples of good documents to provide - nothing more. The onus is on the applicant to provide the strongest evidence possible, but the key phrase is:

"Submit copies of as many documents as you wish, to establish this fact and to demonstrate the circumstances of the relationship from the date of marriage to the present date"

If an applicant wants to submit an affidavit, that's their choice. It is NOT mandatory.



I might be reading way to much. But as I said better be safe then sorry. I submitted as much as I could with my I-129F and didn't got an RFE. If I have a way to avoid any questioning from the USCIS I will do that.

a one year extension? if you mean the letter you get after USCIS has received your i-751, that is standard procedure.

this sounds a bit far-fetched. care to elaborate?




if you feel that your evidence of cohabitation and financial comingling is strong, affadavits are not necessary. if you feel that your evidence needs support, they are an option.


if you are in a bona fide marriage, you will not have much difficulty convincing USCIS of that if you submit an organized and complete package.


I am not talking about a letter. My friends received a new GC which is valid only for one year. As well as they received an RFE to submit an Affidavit from friends. They do have a bona fide marriage, they own a house, car, etc... and have a child together. And still were required to submit it. So as I always say: "Better be safe then sorry".

affidavits are NOT REQUIRED but are accepted as a form of evidence for the i-751.

And as they don't need to be notarized you could have written them yourself so they aren't really a great form of evidence.

The instructions for I-751 reads that affidavit of support is required. And such people may require to testify before an IO. So I would say they have to be done no matter what.

I know people who received RFE for not sending Affidavits, and instead of getting a full 10yr GC got a 1yr extension. As other members noted there is not need to notorized, I would get affidavits and send it all together. Better be safe then sorry.

I have read that with an explanation it should be ok. And I do have a good explanation. Anyway that should not be a prove of my love for him and as some people say...USCIS does not care about last names. Will call them to confirm though


The only explanation I've seen from you is cultural reason. Don't think USCIS will accept that as a good explanation. If you really want to get your maiden name back, just go to the court pay the fees, and let them make this decision. So it will become official.

And in my culture it is actually a standard for the wife to take husbands last name, I was never insisting on it. But my wife wants to do it.

Hello,

I'm a US citizen & my wife & step daughter came to USA on CR1/CR2 in Oct 2010. They received a conditional 2 years Green Card which expires in Oct 2012. After reading some notes I found out that we need to apply for the Removal of Condition within 90 days of the expiry date, which would be starting Aug 2012. We have plans to travel to home country (Pakistan) for summer vacation visiting the family during June-July-August of this year 2012. My family plans to stay there from June 15 to Aug 30th. Please advise:

(1) Since CR1/CR2 is a conditional Green Card, still needing to have the condition removed, is it advisable to travel outside the US for 2+ months while we are still in the 2 year conditional period? No problem as long as you below 6 month

(2) Do most people travel during this time who are in this situation? It is up to the individual

(3) If travel, is there any danger of any issues to be encoutered at the port of entry when coming back to US? No

(4) Is there any danger of any issues while we file for removal of conditional after a travel has been made? No
I greatly appreciate your detailed responses/experiences.

You don't need to file anything to change the sponsor. Just file I-864 for yourself and thats it. As long as you make enough, you will be fine.

Same happened to me. I called USCIS prior mo mailing my stuff and they had a new address on file but reminder came as redirected mail from the old one. I just put new address on all the forms and that did the trick.

Wow I can see how this can be scary.

We aren't quite to the point of applying for ROC yet, but trying to start gathering stuff up.

As of right now, we have the DL with same address, all the insurances, ie. car, life, medical, but my biggest concern is the utilities are all in my name and when I questioned the bank, the only way I can get my husband's name on our mortgage is by refinancing it. NOT planning on doing that right now!!

Is there some other way to get his name on the house?


You shouls be able to put it on the deed. Our mortgage is on hubby's name but deed is on both, however, things have been done like this at the time of purchase.

In addition to all the jount evidence I would also recommend detailed cell phone bills which show how much you call or text each other, pet adoption papers if any, not just checking acct or credit card statement but the breakdown by cardholder showing how much each one spands (shows that it is not only joint, but being used as joint).

Thank you. Just to clarify, He got his conditional greencard shortly before we met. He and his wife went to the interview. She put him out right after that.


I feel like you need to concentrate on collecting evidence of the fact that he got thrown out of the house BEFORE you met. Although I am not an expert but this sounds like a WAWA case to me, but I am not sure if he can still file another I-751 WAWA style after first I-751 denial. The other important thing right now though is keeping an eye on his legal status. Since he has been denied he has probably received a letter of removal proceedings. Just keep in mind that if he can't get his 10 yr GS this way then he will have to leave the country and you will have to start the process all over again (K1, K3 or CR-1) because he originally came on K1 and his legal presense in the USA may be vital for that to come through.

Thanks for the reply. I'm sorry I keep saying he/we. Everything is he. Since we are not legally married(yet), all of the paperwork thus far has been filed independently. Yes, his wife put him out after she abused him mentally, emotionally and financially. He moved in with his cousin. About a month later i met him. We became friends and soon after started dating. He was very honest with me about his situation the entire time. We fell in love and i asked him to move to GA from FL (I live in GA and he lived in FL). He did, and we've been living together happily ever since (3 years). He filed his i751 on time with the extreme cruelty waiver. He could not file with the divorce waiver because he is still not divorced. he was afraid to file for divorce because he was told he could not be in proceedings when he filed his i751, so he waited, filed the i751 and is now ready to file for divorce and we plan to marry. I hope that clarifies everything. I think an option may be to file another i751 using the divorce waiver after the divorce is final. It's my understanding that the IJ will not order deportation if another i751 is pending? I don't know if that's true? He was also considering i-360, but if they said he didn't have enough evidence on the i-751, then the i-360 may have the same outcome.

Do you know when he received his first GC? Divorced or not the actual relationship with his wife fell apart too fast and thats what immigration cares for. Talk to a GOOD lawyer. This case may have more complications if you marry and try to adjust together since he came on K1 and can only file for immigration benefits with the original petitioner. God bless.

My wife finally got her bio letter yesterday.

NOA1 date: Nov. 8, 10
Bio letter date: Dec. 28, 10
Bio appointment: Jan. 25, 11

50 days for the letter, and another month for the appointment.
So if you're in DC metro area (esp. northern VA), unfortunately we're in this for long.
I guess the back log for the bio in this area is really long.
But we're going to try walk-in next week.

Did any of you guys go to 8850 Richmond Highway, Alexandria, VA 22309 for AOS?

When I went there for my wife's AOS two years ago, the place was EMPTY.
I really can't believe there's backlog that long right now.

When we moved from CSC jurisdiction to VSC, I thought all the process will be shorter.
K-1 visa in CSC took a lot longer than VSC three years ago.
I couldn't be more wrong. Sigh.


I went there for AOS in the end of 2008, it was moderately busy back then. Come on nation's capital!

Hi! I´m glad you could do it!!!!!

I got my appointment letter today for Jan. 27th, but I have a problem: I'm pregnant and in bedrest, this means I can't drive or even stand for a long time. My husband will be working on the 27th, and it would be impossible for me to go there alone, or pay hundreds of dollars for a cab :wacko: I would have to reschedule, and I don't want to do that... I'll definitelly try the walk-in sometime.


After today I don't see any reason for an unsuccessful walk-in. Good luck and congrats on the baby!
