I have tried several “calling cards” and some other ways of calling the Ukraine and have had poor luck in finding a low rate with good sound quality, I can hear her fine, but she ccould hardly hear me. I would go the Magic Jack route (free) but in her area where her parents live the internet is not good. Alla got approved today but she will need to call family, any suggestions????

I use Jupiter to the landline it is about 8.9 cents and to the mobile about 11.9 cents pretty cheap and good quality. Also what I did for my fiance and we will do it for her parents. Skype subscription to call USA for about $4 a month and it is unlimited well (4000 min). So they can just use skype to call her on the mobile or the landline in USA and Canada. Pretty convenient. I just put it on my CC and pretty happy with quality and everything.

This is the best news I could get this morning from my fiancee, who attended the interview in Kyiv, Ukraine.

Her Visa was approved. I guess we are the lucky ones it only took us 5.5 month since filing to get the visa.

I can't be more happy then that, finally the LDR is coming to an end!!!

Yes. It would seem that a stray petition will occasionally make its way into the hands of an adjudicator earlier than expected. It was most likely filed erroneously during sorting, but if everything is included for approval, the adjudicator simply approves it. I was hoping I'd be lucky like this too when I received some touches in quick succession. I'm starting to think it's pretty rare (unless it's a petition for a Haitian or Dominican beneficiary) something goes on behind the scenes to accelerate approval of these petitions that we are unaware of. I would expect 4-5 months right now for NOA2. Most October filers have received approval and they are coming right down the line with the November petitions. As long as they direct enough adjudicators to the K1s, approval really shouldn't be more than 5 months when if you're filing during such a slow time of the year (December - March have the least number of petitions submitted typically).

Hoping a speedy NOA2 to you man. Hope your girl can get here by summer too! I'm praying for a May approval and maybe a June interview at the latest...After looking through some timelines, it seems that Kiev can schedule interviews pretty quickly too. Quite a few people were getting them 2-3 weeks after contacting the embassy. Once it's in the system things can move pretty fast.

I'll be glad when I see some more VSC petitions coming through. Once they hit those December petitions it should starting rolling again.


Ukraine is usually pretty quick in scheduling interviews, when I called for mine they offered one 3 days later. However with Euro 2012 the things will slow down, so you should expect some delays. I wish you will have a speedy process.

The I-94 was required when my wife entered in 2012, as well as we entered on her parole document later in 2012. They never took it from her. I would double check, as they should've left one part in the passport.

I was told that if my mom is going to be the sponsor... I still have to do the I-134 Affidavit too? but is the I-864 Affidavit something I have to wait for USCIS to give me if required from me after I send my I-129F packet? or it's something that my mom and I have to fill out and include?

You don't need I-134 to be included in your packet, you will only needed at the interview stage.

You and your mom both will need to fill out I-134 prior to the interview and present all the supporting documentation. Also make sure that your consulate do accept co-sponsors as some don't.

It is hard to answer the question without this information.

Just to give you a quick rundown, if CO's said it will go back to USA, that means they didn't believe the relationship and want to deny the petition.

Please provide information in what embassy you were interviewed and what kind of questions you were asked. Sending it back to the USCIS is not a good thing. They are suspecting the fraud relationship, and trying to deny it. You will really need to explain all your sitation better, like the age difference, cultural differences etc.... too many factors, with out them it is hard to provide you with valuable answer.

Never leave blank on any of your forms as the USCIS don't like it.

The USCIS requires to fill all of the blanks on the forms using "none". While this is somewhat unique situation when there is no family name, I would call USCIS for instructions.

Though the main question is if you are applying for spousal visa which you are. This means that you are married, didn't your wife got your last name during the marriage??? Also look how it is on the marriage certificate for her name and do exactly the same.

I(the petitioner)am a US citizen who has a kidnapping felony that was in 1995. I was 19 and took possession of a vehicle without letting the person out. I was young and drunk. It was an adult and there were no physical harm or violence or sex acts. I was sentenced to 2.5 years. I also had several DUI's. Last one was Feb 2002. Since this time I have had excellent character and live an pure moral life. I even had a ministry to the Philippines which is when I started thinking of marrying a Filipino.

From what I read, my prior felonies may prevent me from obtaining a K1 Visa due to IMBRA but that it would not affect me getting a spouse over with a CR-1. Is this true?

Would marrying over in the Philippines and then applying for CR-1 ensure my success? or do I still have a slim chance of getting a wife over here because of my felonies. I surely would not want to end up married to a woman that I could never be with.

Please someone who has knowlege of this let me know because I dont want to invest many months or even years into something that has slim chances of working out.

Also, if there is some other way around this please let me know.

Wow what a story.

You have two things going on here and it wouldn't matter whether you are applying for K-1 or CR-1 they both could be an issue with your history.

While DUI itself most likely will not cause an issue.

You more have to worry about being a convicted felon with sentencing, which potentially could deny your K-1 or CR-1 visa. I would recommend hiring an attorney, as your case is quite complicated and kidnapping is not a small charge. I've heard people with domestic violence having issues. So get with attorney, as this would be your best option if you want to pursue this route.

My spouse got the medical done today . After the medical she got 1 sealed envelope with the Label written for Consulate General of USA. This is a sealed envelope. Beside this she got another envelope that has the X-ray sheet and one vaccination report sheet. I thought you are suppose to get 2 sealed envelope, 1 goes to Consulate and other you hand over at the POE, is that right? Should she have gotten 2 sealed envelope?

No, You should've only get 1 sealed envelope for consulate.

You will get another sealed envelope for POE when the Visa is issued.

Simple Mobile might be a little bit of an issue. Since this is one of the companies that doesn't have contract and no billing is provided. Does she use a calling card or she is calling directly from her phone? The reciepts for the calling card might be helpful as well.

I haven't gotten all the details yet (if there are any) but my husband said that his BMI was extremely high (51). We knew this might be an issue because he is extremely over weight.

The U.S. medical doctor said his high BMI kept him for receiving an 'automatic pass'.

I can't imagining the embassy denying someone for their weight, especially if they have no intentions of getting any medical procedures to fix the issue which could possibly cost the U.S. We plan to both get healthier when he gets here by eating better and exercising more.

Am I correct on this? Our tickets are booked, I arrive on the October 13th, interview on 14th, fly home together on 29th... I know the flights are a risk in theirselves but is his high BMI really an issue?


I don't think BMI would stop you from receiving the visa, if there is no other medical conditions. They more will be looking at other medical conditions like tuberculosis, aids, etc..., so BMI shouldn't be an issue.

As it was mentioned you can't just switch to CR-1 it is a start from scratch and you still need a co-sponsor there is no way around it.

As far as work. With K-1 your fiancee can start working as soon as he will get EAD, which usually takes about 3 month after submitting the AOS packet no need to wait for AOS to complete.

It is not required however in some cases for "hard" consulates could be beneficial.

Also some consulates doesn't allow it.

So his brothers wife has offered, and her mother did too. They live together so if Im right his brothers wife would do a i864 and her mom would do the i864a, right? Can they sponsor if they are not immidiate family and the other lady is only family of our sister in law.

Anyone can sponsor doesn't have to be a family member. as long as they meet the guideline requirements.

Is that right? Or do I need to wait for the Green Card? I have an SSN already (from previous job in the US). I fi have to wait for the GC - approx how long does that take? Anyone know?

Just a few things to comment.

If you get married you are not elligible for K-1 anymore. K-3 virtually doesn't exist anymore as everyone is getting converted to CR-1.

CR-1 is longer but saves you overall money and time in the long process and allows your wife/husband to start working upon arrival. You can't file in the UK all of the filing will have to be done in the US.

K-1 on another hand is faster, but more expensive, and require additional processing once in US before you hubby can start working or travelling.

Don't expect to recieve any waiver of meeting within 2 years. While they are listed it is really hard to get them. Doesn't seems like your situation would even be considered for waiver.

On Aug, 2011 we decided to take our relationship to another level and we have decided to get married. Now 26 he 25. I am currently waiting on my U.S. Passport and I plan to travel to the U.K. and get married with him there. We have kept records of messages since 2007, pictures, money transfers, gifts, letters, and I'm currently having trouble getting my phone records of him calling me long distance with my Metro phone... :(IF THERE ARE OTHER WAYS OF OBTAINING THESE RECORDS PLEASE SHARE SUGGESTIONS...) TNK :) He's talked to my Mother and Family through Skype and asked for my hand in marriage and recorded that meeting. We plan to record the first time we meet at the airport and also of course the formal proposal in person. :)!!! AND The civil marriage it's self as proof for (K-3)... if that is the best route for us to take instead of the (K-1)?

Hi everyone,
I ll have my interview end of the november actually 22nd. I ll go to US with my parents and they ll stay a week or so. And we decide to have our wedding there when they are there too. So this is my question. They applied for tourist visa and they got an interview appointment for next week.
And i decide to buy our plane tickets for 9th of December. Will it cause a problem to have plane ticket before the interview? My parents have to show their plane reservations for a visa. So if they ask me i bought my ticket or not what should i tell them at the interview???
And can it cause a trouble for me to go there with them?


Don't buy a plane ticket as there is no guarantee they will be approved for a Visa. Just show them an intended itenarary, but make sure your parents have to show strong ties back home so the CO will see that they are planning to return back home.

Just as a side note even with your visa, there is no guarantee you will get it on-time. Also there is a possibility due to the country you are from you might be place in AP (Administrative Processing) and it could take several months before you get visa. Don't buy or plan anything till you get your visa in hand.

i m new here help me if i m doing anything wrong. i m waiting for interview date to be scheduled at Bombay embassy for my wife, my case was completed on 09/06/2011. i m assuming that i will get interview date on 2nd week of October. i hope, it will work out. :(

My question to you all is When i wife get here and she get her green card in a month or so. When can she go back to India? can she go back right after she gets her GC? she need to go back because she is doing her master and she will be finished in May.

Help me out what do in this matter. any idea any suggestion ??

Unlikely you will get interview for October. Most likely November or December. Once she get a GC she can travel, just make sure she don't overstay 180 days, as she will loose your status.

It might be a problem. You have to proof to the CO that this is a bonafide marriage, that you've seen each other have enough pictures together (it is preferably with family member though), and have other evidence like skype logs, phone logs, email, mail, etc...

They will probably ask you why your family is not on the pictures and doesn't know about your marriage.

Its been almost 3month and we don't even have the receipt #...

Im trying to call USCIS almost everyday and all they say is our case is under review ...

I think its taking longer than normal due to my husbands (USC) identity theft case 2years ago... Im not sure

How long is "under review " going to be ??

And is there any ways to make it shorter ... ?

I need at least receipt # to apply K-3 visa but I feel like i have to wait forever ... !!

You should've get the NOA-1 it would have nothing to do with your husband case. I would try to get a hold of them. Did they cash the check?

You most likely have at least about 3 month since NOA-1 before you will get your NOA-2. Don't expect it to be a fast process. If you will have an RFE they will send it either to you or to your lawyer. Not sure why you used lawyer, as they can't really do nothing to expedite the process or guarantee anything.

Those timeline are only based on the forum users who enter their timeline. So you can't count on this to be an accurate timeline. Each case is different and processing time could be different. Look at the USCIS website for more accurate timeline.
