I've commented on a post similar to yours before. My emails and chats are very graphic at times and what I've done is blacked out words I was not comfortable with someone else reading. If you have ample emails or chats msgs so that you may just exclude the ones you don't want to send that can be an option as well.

Congratulations! Are you going to Ecuador just for vacation or are you planning on living there for a little while?

If you are planning on living in the US, as she entered the country on a F1 visa the easiest would be for her to adjust status from within the US, so no waiting time apart, and no need for an interview in Ecuador. I am not sure if she will be allowed to travel abroad during the process.

If she returns to Ecuador without adjusting status and after her F1 runs out my understanding is that she will have to apply for a spouse visa, this is a several months process.

If you are planning on living in Ecuador for a while then you are the one who should look into visas to live there :)

This may sound strange as most applicants are trying to obtain visas as quickly as possible. I filed for my wife in June and after 6 months of nothing, I graduated school and just moved to be with her (in Argentina). We were among those transferred to CSC in dec, so I expect approval within a few weeks. Since I am already here, have my legal residence ( it took about 2 weeks) and have a job here; and given the current economic situation in the US we want to stay here awhile (12-18 months), but don't want to withdraw our application in the US. I guess we will drag our feet through the NVC and try to stretch out the process.

Does anybody know how long we can/should delay without risk of being withdrawn? How does schedueling the interview work? Can we ask for a later appointment? I know we have 6 months to immigrate from the day the visa is issued, if we were to enter and get the conditional green card, how long can we leave the country before running into problems?

Call me overly skeptical, but I think the USCIS uses the processing times as a handy excuse to keep a restraint on immigration numbers. No politician is ever elected by allowing more immigrants (even legal) into the country. Unfortuneately we are too small a minority to ever have a voice over all the "get tough on immigration" people. I dont think they really want to lower the processing times, despite all the lip service

I found this forum a week or so after I mailed in my I-130. I did not include any of the recomended evidence of a bona-fide marraige. Am I going to get a RFE? Also, since we live in seperate countries, and don't have any kids, the only evidence on the list I could produce would be sworn affidavits. Should I start assembling them?

Sorry for not being clear. My family's accountant prepared my taxes and I'm pretty sure he did everything by the book, including reporting my Ecuadorian income. But ultimately it adds up to very little by U.S. standards. I think our best bet is just to explain anything and everything and hopefully have my parents sponsor my husband. Thanks for the replies!

I'm a US Citizen about to enter this process with my Ecuadorian husband. My concern is the financial requirements, I believe it is called the Affidavit of Support(? still new to this). It says they will request copies of my last three tax returns. The problem is that since living in Ecuador for the past two years I have barely declared any income on my US taxes, literally almost nothing, because I have not earned any money in the U.S. for the past two years and I am paying taxes to the Ecuadorian government. It's not that I don't make money, there is just no documentation of it on U.S. papers.

Has anyone else been in this situation? How can I handle it? Is the only way around this to have a co-sponsor, perhaps my parents for example?

Your insight is appreciated.

I'm a USC getting married in less than two weeks to my Ecuadorian fiance here in Quito. We want to file the I-130 fairly quickly following the wedding because I am moving back to the U.S. at the end of August to begin graduate school, and like everyone else, we want the separation to be as short as possible.

My question for today is regarding where to send the I-130 petition. DCF is not allowed in Ecuador, so we have to send our papers to a USCIS lockbox, I'm just not sure which one... I am not a legal resident of Ecuador but I have lived here for most of the last two years. Before moving here I lived for one year in Arizona, but I will be living in the Washington DC metro area (either DC proper or northern Virginia) when I move back to the U.S. in a few months.

So, when I file the I-130 I will live in Ecuador, and the instructions say for people living abroad to send the documents to the Chicago lockbox. But again, I'm only here a few more months. So the other option may be to base it on my last U.S. address (in Arizona), in which case I would send the forms to the Phoenix lockbox.

Thoughts on where I ought to send it? We want to get everything right the first time.

My husband (the beneficiary) had an incident at a former job that became messy. It's not worth going into the details of the event, but suffice it to say that an accident happened and his employers got extremely nasty about the insurance claim and, long story short, my husband lost his job in the end. The problem is that my husband is worried about listing this employer on the I-130 because he fears that USCIS will contact them, and the company will say malicious things about him, which will negatively affect the petition. Is that a real possibility?

We both know it is important to be truthful on all forms, and that is of course our intention. But we wonder if anyone has any insight into what kind of checks USCIS does for past employment? Do they just verify the fact that you were employed there? What purpose does this information serve, really?

This thread had me crossing my fingers and sitting on the edge of my seat for the last few weeks. I just saw today on USCIS that our petition was approved yesterday after waiting about 2.5 weeks. I was jumping up and down when I saw it. I got really used to seeing "Initial Review" on the Case Status page, so I had to blink a few times to make sure what I was seeing was real! :)

1. Country USC resides in: Ecuador
2. USCIS field office or DCF?: No, this is not an option in Ecuador.
3. When did you file I130: Sent it on June 29, received NOA1 on July 6.
4. How long has the USC been living abroad: 2 years
5. Do you reside in the country legally: Yes - I am here legally but I am not officially a "resident" of Ecuador
6. What is the reason for your residence: I'm on a cultural exchange visa.
7. Did you list your overseas address on I130? Yes, and the G-325A's.
8. Did you send the package from abroad? No, first I sent it to my parents so they could add some documents. Then they sent it to the Chicago Lockbox.
9. Did you include evidence of your residence abroad in your I130 package? Yes - a copy of the lease for our apartment, copy of bank account info, and a copy of my "Movimiento Migratorio" from the Ecuadorian National Police, which is a register of all the time I have entered/exited Ecuador and proves that I have lived here for two years.
10. Did you mention that you reside abroad in your cover letter? Not explicitly, but I included my address below the signature.
11. Has your case been auto expedited? How long between NOA1 and NOA2? YES! 18 days (or 12 business days)
12. Where did we sent it to: We sent it to the Chicago Lockbox, and they forwarded it to the CSC.

From what I have read, if you probably should call to see if they have received your package. I sent mine by overnight
mail and requested a signature and it was actual delivered on the 20th and signed for...this was on a Saturday!

I am surprised that your spouse, doesn't know what to do.

There is a whole process after the marriage that you need to do.

You have to file I-485 for the status adjustment, together with that you can file for Employment Authorisation (EAD) and Advance Parole (AP). All the forms and insturctions are available on the USCIS.gov website together with fees (approx $1030).

After you get approved you will get a temporary GC for 2 years, prior to your 2nd year expiration you can file for remove temporary condition, and upon approval you will get your permanent resident status.

It is a lengthy process and does take time, so be ready to wait.

Good luck on your journey, and tell your current spouse to get his things together as he should've known all of that.

This could be a difference in the exchange rate. However you also said that they charged different amount for your fiancee and a kid?

My fiance had his interview last Sept. 8 and according to the consul he is approved. It's been two weeks now and we still don't have the visa and when I called the US embassy in Manila they said that it is under AP. Anybody had the same experience? What does this AP means? Will he still get his visa? this is soooo depressing :(


AP - means Administrative Processing and could be for several reasons.

Once they are done with AP, most likely they will issue a Visa, it's just might take time. There is really no time frame how long AP can take.

It's Oct, 2011...My income from 2000-2008 was more than adequate for approval. However, in 2008, I went back to school to become a doctor. As a matter of fact...in the Philippines where I met my fiance 4 yrs ago. I'm at the end of school and would like to bring her home to the US now. However, I don't have an adequate income meeting the minimum requirements over the past 4 years. However, my income potential as a physician in the US should count for something, right? Or, even with my previous position as and ICU Nurse and US Army Officer Reservist should be adequate right? I'm NOT SO SURE...so, question is....K-1 or I-130 ? I've heard that the US Embassy in Manila doesn't accept co-sponsorships...true or myth?? HELP...I start my internship in the US this March. Thanks


You must to get a co-sponsor. Potential income is never accounted for. Everyone can say I potentially could make 200K, however not everyone is making money like that.

With no property, savings the chance to get a tourist visa would be slim to none. They CO will not even look at the affidavit of support, as your parents need to qualify on their own, and need to proof a strong ties back home. In your scenario they can't show that, as nothing really holding them back there.
