We got married in the US on June 21, 2008 (we were engaged August 1, 2007 and made plans to get married in Sweden in August of 2008...we talked to an immigration attorney to see what paperwork we needed to get started in June, and the attorney suggested the best thing to do "is get married in the US, now" and get the paper work started immediatly).

We filed the paperwork on July 3 which included: I-130, I-485, I-131, I-765 with all fees and supporting documents. We received the Notice that all of the forms were received, and the checks were cashed. We got the ASC appointment Notice for biometrics, and completed the biometrics. We had already bought tickets to and planned a wedding in Sweden, invitations sent, lodging arranged, etc. etc. So it was not a total loss, we decided to make the trip our Honeymoon and have a great party (besides we should have the 131 before we left, and if not receipt should be eminant). We started to worry about a week before we were to return and still did not have the 131...we cancelled Maria's ticket and I came home alone. Now after a week on the phone and hearing "any day now" over and over we have heard that the I-130 was approved on 09/19 and will be sent to the NVC, but the I-485 was conciderd "abandoned" when Maria left the country without Advance Parole and will be denied (notice to follow).

Now Maria is stuck in Sweden (don't get me wrong, Sweden is a nice place, however, we would rather be togeather) with no place to live, no job, and only summer clothes (Remember...we went to Sweden on our Honeymoon for vacation) We can make due for a while, but we need to resolve this as soon as possible.

Finally...My question is this: What do I do now? What kind of Visa will get her back home, so we can wait out the rest of the process togeather? And how long should I expect the proccess to take?


You cannot go I-485 route any more because she left US without Advanced Parole and cannot come back now to finish AOS. She needs to withdraw I-485 not to wait for deniel. You need to figure out how to go CR-1 route from here. Like another poster said since your I-130 is approved that should not take very long.

As far as I know last transfers were made to CSC on Aug 25-27. There has been no transfers to CSC for the whole month of September crying.gif .

The latst priority date has been approved is March 3rd.

Processing times has moved from September 3rd, 2007 to November 26, 2007 kicking.gif .

Congratulations to all approved in September and Good Luck to the rest of us. Hopefully won`t take much longer.

Is it ok if we do not have a joint account? We are just going to submit the marriage certificate, his birth certifcate and the forms.
Is this ok or are we going to receive any RFE?


Please calm me coz im about to cancel this filing! mad.gif


Instead of doing joint account you can request an additional card for him, that is joint finances as well.

The US government has decided to outsource all the work of USCIS to China.
US is melting down due to the credit crunch. Banks are no longer giving lones to other banks.
The reveres happened at USCIS. The sister VSC was falling behing because some bad lones it gave to H1B (outsourcing agaents) and forgot to take care of it's own babies (CR1/IR1/K-3,K-1).
VSC start melting and asked brother CSC to take care of the babies. But by that time the bad loan virus was transfered to CSC and made it sick. Now both brother and sister need help which mother (DOS) can not provide. The father (USG) has no money to take care of the family and decided to call the healthy bank (China) for help.

All the processing of I-130 will be done in Shanghai from now on.

Thanks for the quick response. We called and they said they would send one off. Several weeks later, we called again and they said that they do not send copies but will send a note saying they sent an original copy.

Take a seat back and relax. YOU DID NOT DO ANYTHING WRONG. I was in the same predicament when I was filling my tax return. I was worried that despite being married how can I file as single? What if they reject my application on this basis of filling single??? But to tell you the truth, your tax return is used to verify your income, not your marital status. They have your marriage certificate for that, which will serve as a legal proof that you are married.

I also filed my 2007 tax return as single. My case is complete from NVC without any problem. You didn't do anything wrong. Your husband wasn't in US for the tax year and he was not dependent on you financially, so technically you can not claim an exemption on him. If you had filed jointly, all you would have done is increase your exemption by 1 because he didn't contribute any income as your spouse. But this would be semi-illegal because he is neither in US nor dependent on you. So you are fine the way you have filed. That's why I filed single for my wife. Plus, your filling single basically allowed govt. to collect more tax from you biggrin.gif. So I don't think they would have any problem with you.

I agree. And plus filing under "single" or "married filing separately" does not differ in the amount of deduction you get, therefore you pay the same tax. All government cares about is $$ you owe to them. So since it does not make any difference you should be fine. And also, filing under "married filing separately" does not put any responsibility on you as far as your spouse filing under the same matireal status or not filing at all. You are simply not responsible for other people, even relatives.

What worry us the most is that if we dont pay this next semester he will be out of legal status according to the counselor said. So I was wondering if this is true and also what would be a solution if we cant pay school next semester. Thank you.



It depends on rules of school. Find out if person is eligible for in-state tuition after marrying a resident of of the state. If so then the minute he receives his greencard he is eligible. If that lady will disagree report her to appropriate services.

It's almost 5 months now since we sent our I130 and I129 and until now we still haven't heard anything from VSC. Congratulations to the Feb filers who are getting approved. I miss my husband and i want to be with him more than anything.

Last week, i emailed the ombudsman and got a reply. However, what i thought was a personal email looked like a "copy and paste" of the other email replies that the rest have gotten. My husband wrote his senator again too. he wrote one before we started the process and of course that hasn't been replied to.

Desperation. Maybe that's why we do this. But only because we want so much to be together. I pray that the Lord will touch the hearts of the VSC people who work on our papers. These are people's lives. No matter how bad the economic situation is in the US, i am willing to leave my job and be with the one person that i love the most. Because life only happens when i am with him. Without my husband by my side, i'm just mere existing.

Well, I have a totally different scenario here. I`m gathering all the paperwork for my hubby USC to get a tourist or visitor visa to my country to meet my parents in the summer. And there on all the forms it directly asks about the date of the arrival and departure which you can`t know unless you have a ticket.... So, I don`t know if it depends on country rules, visa type or anything else, but I think you can buy tickets anytime you want, it does not man you will take the trip. Just make sure you get ticket insurance just in case embassy will do some unexpected tricks.

Better listen to the guy above. They view advance purchase of tickets as arrogance & ignorance. You can forecast the dates or write after visa issuance.
Its also unlikely that you will get a tourist visa based on what I was told in my 3 attempts. None were in Russia but the training & thinking is the same.
I was told at the Embassy by the officer they would not issue tourist visas to people married to USCs because they would not return to home country. The " strongest ties " rule is tough to overcome. Embassy officer told me it was a classic " Catch 22. Also if you get the visa he may be turned away at the POE; the visa doesnt guarranty entry.
I hope you are right & I am wrong but a mistake can be expensive in many ways.

I don`t get it, are you talking about visa for me or my hubby??? Perhaps, I didn`t explain myself really well. I`m already in US and helping USC hubby to get a visitor visa to Russia and they assume he already has tickets and ask for exact dates. OP is in the process of getting CR-1/IR-1 which means the immigrant HAS a USC spouse and thats what visa is based on, so he/she cannot be turned away at POE because of that.

To OP:

I agree with the rest of replies that embassy simply does not want to be responsible for losses you might have by booking tickets too early. But hey, ticket prices are growing too with time.

I was printing some old emails for my coming AOS interview today and noticed that me and my hubby have used much more informal laguage then I expected. I'm not a shy person but some words should really be mucked if we let other people read, especially some seriuos immigration officer. I know many of you use emails as a prove of ongoing relationship for the interview at the consulate/embassy and I'm sure your emails were not very formal either. So, what should I do? Just take black marker and muck some single words so meaning stays. Or there are other way to deal with this???

I've commented on a post similar to yours before. My emails and chats are very graphic at times and what I've done is blacked out words I was not comfortable with someone else reading. If you have ample emails or chats msgs so that you may just exclude the ones you don't want to send that can be an option as well.
