Lawyer in the interview in the consulate??? First thing I hear that. Not sure if he even be allowed in. As there is really nothing a lawyer can do.

You really need to cover all the bases they accused you in before trying to reapply again. I am not sure how much time you are spending together, and what kind of evidence do you have to proof that this is a legit marriage. It is not uncommon for them to check social networking sites especially in the high fraud countries. May be you should have a better evidence that will proof to the CO your relationship.

The only thing to say about your lawyer, he is keeping his pocket full with your money, but there is really nothing much he can do. Besides filing the paperwork.

If you are married your are not elligible anymore for Fiance Visa but only for CR1/IR1. Since you are married for more then 2 years you will go IR1 route which will give your wife permanent 10yr GC.

If you leave with your wife in Ghana and legal resident in Ghana for more then 6 month your are elligible for DCF in Ghana, which is the fastest route. Otherwise you will have to file here in US for her visa, and it usually takes between 10-12 month for IR1, if you are a Citizen, may take longer if your are a LPR.

Seems like the CO didn't like some of the things on your petition and being from a high fraud country is a red flag. The reason to send the file back to USCIS is with the intent to deny.

Hopefully people with Morocco experience can provide a better assistance.

The IV Fee is $240 which you will need to pay during the NVC Process, plus there are also other fees which comes during the CR1/IR1 process. You can check all process here:

The affirmed case by USCIS doesn't give you automatic visa, or guarantee. USCIS and Embassy are two different entities and operate differently. While USCIS approves the petition it is up to the CO at the embassy to determine eligibility for the Visa, USCIS doesn't do that.

Also issued visa by the embassy doesn't guarantee admittance to the US, it is only an authorization to go to US, however it will be up to the DHS, whether to allow or deny entry.

Yes it is for the immigration so you will need from both places. In Ukraine it could be obtained from the Ministry of Internal Affairs, you may want to contact Ukraine Embassy for that, when you will get closer to your interview.

I am also thinking of keeping things simple and non-complicated, and NOT mentioning my wife's Turkish citizenship at all on visa docs. Just that she is a Ukrainian citizen and we have been living in Turkey until this time.
I wonder if this would cause any problem down the road.


Don't lie to US Immigration. They will find out eventually and can only cause more problems.

Correct/Pravda :) My wife has 2 citizenships. She is Ukrainian, and we have been living in Turkey for the last 4 yrs, because I am (USC) originally a Turkish citizen, so we were originally staying and living in Turkey, and that is why we applied and got a Turkish cit'ship for her.

It is true that Ukraine does not recognize dual citizenship, and US does not recognize, either. But I myself am a citizen of both Turkey and US.
(Additionally, our 3.5 yr old son is a citizen of Ukraine, Turkey and US! Kinda like James Bond lol)
However, every law and citizenship to its own. I know that US laws does not see dual citizenship as a problem, judging by the US Ankara/Turkey embassy website.

It is just a matter of how to mention/fill out on immigrant visa docs (I-130/G-325A) as far as I can see.


Actually US does recognize dual citizenship and I am a dual citizenship as well.

According to the State Department you need to obtain a police certificate from every country where you lived since being 16 years old. I am assuming your wife left Ukraine when she was older then 16, otherwise she wouldn't be able to obtain a passport, so yes you would need a police certificate from the Ukraine.

As Pinguin mentioned put Turkey since this is where you live now.

Are you sure your wife have 2 citizenships??? As Ukraine doesn't recognize dual citizenship.

I would write Turkey, since this is ultimately where you will have an interview, and this is the latest citizenship she received. Also make sure that your wife will need to obtain a Police Certificate from Ukraine as well for the interview.

You can always try to apply for it. But you have to make sure you can show strong ties back to your country. Having immigration petition could play bordersome. Either could help or ruin it. The worst case scenario you will get denied, it will not impact your immigration petition.

We are no where near being approved but once we get visa to leave a country is it ok to stop off somewhere else before heading to the US. For example, we would be flying out of Morocco. I wanted to travel to Belgium to visit friends and they can meet my husband; then fly into NY after a couple of days. Is that possible? Do we need to tell the consulate we expect to have a stopover in Europe? Will we have problems in London or whereever airport we fly into in Europe?

Consulate doesn't care how, when and to where you will fly. They even don't care about your POE, all they care are you elligible for the Visa, this is their job and not your travel plans. You can fly accross the globe and visit every single country before your entrance to the US.

Based on what OP said, he was found not guilty due to the lack of evidence. While his case was dismissed it is different being found not guilty, since he didn't commit the crime. While lack of evidence will give you a not guilty verdict, if new evidence could be found he still can be prosecuted, it doesn't mean that the crime was not commited. I am not trying to scare OP, but he needs to understand a difference and face possible circumstances. It is really all depends on the CO, how he will see it.

While it is possible to adjust a status from Tourist Visa. I do see one huge red flag that USCIS will catch. He will get divorced on 26th and marry on 27th???? This is as RED as it can be. They will suspect visa fraud right away. So you either need to have a relly good evidence of relationship, or it will be a problem. As far as financial support, you most likely need to find a co-sponsor. Since he is claiming his kids on taxes they are considered dependents for him.

Nope. Correctly filed would have been married filing separately. Married is married.

However this is very very rarely an issue at interview.
Op your wife can amend the taxes later if your wife chooses.


 

I stand corrected you are right MFS is what she should've file if they were married in 2013. I missed that somehow, as it is very rarely beneficial to file MFS.

While you are married if you don't have Social Security number or ITIN you are not eligible to file with your wife. So your accountant did it correctly filing as single.

 

You can male the package as single especially since you are using co-sponsor. There is no need to amend anything as you are not eligible for this yet. However when you will get your SSN and Green Card, you may want to speek to your accountant ammend your 2013 tax return and include you. Or you can reach out to me, I am IRS Certified Tax preparer, and I can assisit with that as well.
