If you get married in Japan or Korea and apply for a spouse visa CR1 she will get a green card as soon as she enters the US and so she will be able to work right away. I believe the process takes about the same amount of time as a fiancee visa K1, or only a couple months more. If you do the fiancee visa, she will have to apply for an adjustment of status after you get married, and will not be able to work for several months.
In terms of sponsorship they look at your previous years tax returns and your current employment. In our case my USC fiance was living with me in France as a student, so his previous tax returns showed zero income, but we were approved on the basis that his new job in the US was paying him enough. But if you can not show proof of employment in the US then you will need a co-sponsor. $15,000 is not enough assets to sponsor your fiancee on your own. 125% of the poverty line for a couple is somewhere around $21,000, and without a job you would need to have the liquid assets to cover this amount by 3 or 5 times, others will confirm the right numbers.

In order to petition your soon-to-be fiancee for a K1 visa you will need an address in the US, and also proof of revenue in the US, or a co-sponsor. If you start the process while you are still in South Korea see if it would be possible to use your parents (siblings or friends) US address on the K1 visa paperwork until you get back to the US and have a place on your own; also US employment proof might be tricky if you are still living in S. Korea when your fiancee goes to her interview for her visa, but you could easily counter that one if someone in the US is willing to sponsor her.
In terms of timeline, it usually gets between 8 to 12 months for the whole process, and then once the visa is used your fiancee will have 6 months to enter the US, so if you start the process sometime this fall she should be good to go next summer. Not sure where she should file though...
For proof of your relationship you should keep plane/train stubs showing that you traveled to the same places, pictures of you two, if you live together already it should be fairly easy to find documents with both of your names of it.

You still have time, so study the "Guides" from this website and you will have a clearer image of the whole process.

Thank you all for the replies. I suppose that makes sense as for an initial entry into the US. On a similar note however, is it not possible to obtain advance permission to leave and re-enter the country for the purpose of getting married once my fiance' enters on the K-1 Visa? I did not understand that it was ONLY possible to marry in the US.


You also have the option of getting legally married in the US, and then go back to the UK once your fiance has her/his GC or at least advance parole for a religious and family celebration...

Hello. I am sure the following questions have been asked many many times....If you could be kind and point me to the right direction, I will be much obliged.

Questions:

1) When completing the G-325A, I put my job title as "Engineer", however it has changed to "IT Support". Will this cause a problem when I complete I-864 or any other document from this point forward?
2) When I applied for my wife, I did it as a K3, sent the I-130, then I-129F. Now, I want to drop the K3 and only continue with IR1/CR1. What do I need to do to drop the K3 and just go with CR1?

I am a July filer, so hopefully my time at NVC should come up soon, thank you in advance for taking the time to read it and assisting me.

My $0.02 is to go for a IR1/CR1 rather than the K3. It might be a month or two longer in processing time however financially its less expensive and less time consuming. Also, when you you send the K3 documentation, your I-130 gets pulled out (loses it place in queue) and then put back in. So you kinda lose time there initially.

You should start to get the PCC (Police clearance Certificate) now. Depending on where your spouse is, it make take about a month or two. The following process I had to go through:-

1) My wife did not leave in Dhaka, so she took her Passport to the local police station for the PCC.
2) Once the PCC was created, it was sent to the District Police HQ, from there they sent it to Dhaka (Home Ministry)
3) It stayed there for a weeke or so, sent it back to the Police HQ
4) Step 2 & 3 was done using local snail mail
5) once the PCC was received, then it was taken back to Dhaka, notrized, and submitted to Foreign Ministry at ~8am
6) Picked it up the mext day around ~3pm

Overall I believe we spent close to 2month for this doc.

My VJ prediction is getting closer and closer after going off further and further. That thread about filling in our timeline did help a lot. Thank you. Now, I'm hoping I really do get my NOA2 in by mid-July. Now it's beginging of June (almost.) Should I go ahead and start getting police certificate in order? That's the only I am concerned about not having in time. I have never ever saw a pcc and don't even know where to get one from. I imagine it's from the police station.

Is there a Bangladeshi who can chime in on this? Everyone else also welcome to help me.

I am in almost the same boat. We sent in one PCC, per the NVC website, but in reality they require another type. So we made that sent it in, and got an RFE for a third PCC. I've emailed the NVC, talked to 3 operators and a supervisor and they all say wait 8-15 days for review.

What are the chances they get it right on review? My hopes aren't very high considering everything

An apostille is a certificate that authenticates legal documents between countries. It isn´t common in the US but quite common in Argentina. I had to get all my US documents apostilled to get married and residency in Argeninta, so we went ahead and did the same for her documents to go there. I dont know exactly where to get one, she is a lawyer here and did everything, I will ask her and post when I see her later.

We did submit the 3 affidavits ( I-864 for me and my father with I-864a for my mom), the denial was at our embassy and that is exactly what they asked for from the other case. I would think that if the partner just signs the I-864 that should suffice.

My best guess is that if the sponsor co-files with his wife (where both their names are on the tax return or w-2) they want acknowlegement that the partner has knowledge and gives their consent to the sponsor agreement. A couple was delayed a few weeks ago because they needed the partners signature.

We filled out an I-864a for my mom, to accompany my dad's I-864 as my co-sponsor. Good advice from the lawyer!




Hello VJ friends. I have a question regarding a co-sponsor affidavit of Support. My husband's cousin is helping us by filling in a co-sponsor Affidavit of support. The accountant who helped my husband to fill in his affidavit of support, told that his cousin's wife signature will also be needed. So, I am confised since I haven't read anything about it in the instructions. Why would his wife's signature be needed if the joint sponsor is just my husband's cousin? I would really appreciate your help in clearing my confusion

As long as he will go back, and wait for CR-1 visa in his country. It will be totally fine, and will not count against you. There is nothing wrong in getting married within US, as long as beneficiary doesn't try to AOS within and will wait for proper procedures in his country of residence.

So yes you can file I-130 while he is here.

Yes you can get an RFE after 4,5 and even 6,7,8 month. They will not send an RFE till they are starting to adjudicate your file. But hope for the best that you will get approval without an RFE.

Since you are already married you need to apply for CR-1 Visa. It may take about 10-12 month to get this visa and sometimes longer. Setting a specific date not a good idea, as it may need to be moved due to the slow process or some other circumstances. CR-1 Visa is the only legal way to do it if you are planning to leave permanently in US. So get your docs in a row and submit ASAP. If your wife is currently living with you and legal to leave in England you might be able to file for DCF which is slightly faster, though make sure that London embassy actually have USCIS office. If it doesn't then you are in for a wait and have to file to the Chicago Lockbox.

It is hard to say how much longer after you reply to RFE. If your expedite is approved hopefully it will not be long after that. Also one more thing USCIS Expedite doesn't give you NVC expedite. So you will have to request it again at NVC stage.

Most Mena countries have mandatory AP. For some people it takes several weeks while others takes monthes. I believe the longest one I heard was 2 years.

You will get your notice within several days. The call center don't have this information. You have to understand when officer talked to your wife he only looked at the expedite request and not into your file. Seems like they looked into your file and found out that some information is missing. While I understand it is frustrating, you will have to wait for the notice. The US mail is not bad and you will get it in a matter of days.

Do not pay attention to K-3 as this visa is pretty much obsolete.

You fall under IR-1/CR-1 depends on how long have you been married.

Forget about 4 copies it is very old and obsolete information. You only will need one copy for each person.

While there might be a chance to get it approved. It would be really hard, and it all will come when the crime was commited, what crime tier the petitioner falls into and what type of crime. I also think they will look in when the crime was commited and how many years have passed since then less then 15 years, may require a really strong evidence that the person changed, and will not harm no one. While it seems like it is possible it will take some real effor to prove it. AWA crimes are considered especially heinous.

Attorney will not help there is no waiver for that the law is pretty clear and reads as follows:

Immigration Law
The Adam Walsh Act amended 8 U.S.C. §1227(a)(2)(A) by adding section

So the OP really have no choice in bringing his wife here. There is no way it could be approved. I am not saying that OP is criminal, and I believe that he is now of a good moral, but law pretty specific and it is a serious crime.

I haven't had any luck finding the answer to this question using the search function here... How does one submit the seperate applications for children's visas, during this process? To be clear, my fiance and I plan to marry in Belarus in November. After I return, I will submit her I-130 to begin our process. She has two children that will come with her....

So, Do I send this in all together- Wife and step-children's I-130, filing fees, passport photos, etc? Or am I supposed to send each petition seperately?

Lockbox is nothing but a place where all the mail have been sorted, validated for initial documentation and check cashed. After that they are forwarded to the service centers that will do actual adjudication of the file. There are currently 2 service centers that are processing application Vermont and California. Your NOA1 that you will get, will say in what service center your petition is in.

AS long as he got visitor visa, never violated his visa stay, and have strong ties back home he should be fine. But as always you never know. For the most parts, just be honest and show strong ties back to the home.
