Hi,

Yes, I lived in India for one year (August 2010 - August 2011), which is where we met and became engaged. It's not an arranged marriage, as I'm not Indian. While I lived in India, I met his family and my family visited me and met him. So USCIS does not need proof of the validity of the relationship?? They only want to know that we've met in the past two years? This seems contrary to what I've read.

USCIS only need the proof of meeting. However for the interview in the Embassy this is where you would need to see the proof of the relationship.

Even though there is a requirement for meeting each other within the past 2 yrs for the 1-129 application, if you can't meet due to some reason, just provide a rationale, and supporting documents signed by family members stating the nature of the relationship, intent to marry. If you are in the USA as a citizen, and can financially go to India to meet your finance, that is ideal, and RECOMMENDED. However, if you can't go for reason, you really need to make sure to explain why you can't meet him.

While the waiver for the meeting in person exist. I heard that it is really hard to get as you really would need to show the hardship and etc... which financial situation might not do it.

Hi all,

I'm just starting the process of applying for a K-1 visa for my fiance in India. Both his and my family support us and I have met his family and he has met two of my sisters. I want some of each of our family members to write affidavits stating that they know us, they know about our relationship and our plans to marry and they fully support our relationship. I have drafted an affidavit myself, but I was wondering if anyone out there would be willing to share an example of a successful affidavit that they've used. Again, I'm referring to one that supports our relationship, not the fiancee letter of intent nor the financial affidavit.

Have you met each other? This is an initial requirement to apply for K-1 visa. All those affidavits would be helpful for the interview stage but not for the USCIS. USCIS is only looking at the evidence of meeting in person.

The K-1 visa requires that both of you had met at least once within a two year period. You can come to her, or she can come to you, or you can meet in some other place. There is a waiver available, however I heard it is really hard to recieve. While medical condition could qualify the main question will be asked why you can't come to visit. So if you want it to go as smooth as possible make some arrangements to meet with her.

Since I am in the process of getting a K1 Fiancee Visa for my future wife and her daughter. Is there any tax writes offs for this process ? Once married "we' will get a child tax credit deduction of $1000.

Also just to add, make sure that you send in the exact amount!

Our application was sent back because there was an extra 10 dollars (it was 350 written on the check) and they asked my fiance to re-submit the application with the correct amount.

It caused us a delay of about 2 weeks.

I provided a lot of evidence in the first set of documents already, and i have all financial records together. Both of our visas are good, and i need to get some things like vaccination records.

Just make sure that your husband provides all the evidences needed for the affidavit of support, even if he isnt making enough money, they still want his info. If you havent filed your taxes yet, he should ask his employer to write a letter stating his salary.

Hi all,
It's my first post here but I've been following the forum for a few weeks now. My USC husband to be (getting married next month)and I were looking to apply for a spouse immigrant visa this summer shorlty after our wedding. We live and work in the UK so we were going to apply at the US embassy in London.

I'd like to ask whether a bad affidavit of financial support (i.e. 0 income in both 2007 and 2008 and no tax returns for those years, and a small income in 2009 because the main sponsor(immediate relative) only started working full time in Aug. 2009) is likely to be a problem to our credibility even if a joint sponsor is used. We are planning to use his mom as our joint sponsor and she makes way more than the 125% of poverty levels, which is good. But given that he has no tax returns to present for 2007 or 2008 due to lack of income (he was an unpaid trainee in 2007 and a student in 2008) and a low income in 2009 due to the fact that he only worked for less than half that year, would that count against our financial credibility/weaken our application? Or would they not care as long as we have a joint sponsor?

Let me say that my fiance has been working continuously full-time for the same company since August last year earning a very decent income. So would it be of any use taking his pay cheques to the interview with us to prove that, because we won't have filed for the 2010 tax year yet?
Just to clarify that all this is UK income though, so it would probably count as 0 US income anyway - and the joint sponsor would be even more necessary. But just to show that we do have some good job prospects and earning potential. I know this won't count towards the approval of the I-864 itself, but maybe will be a plus to our application as whole?

If you have a solid co-sponsor, then you should not worry about it, unless London consulate does not use co-sponsor (ask in the UK sub-forum to make sure). We were in the same position for my fiance visa. My husband had just found a job and had been a student the previous years. Just make sure to document his lack of revenue and tax filing with a letter where he states that he was a student blablabla.

If filing on a tourist visa is indeed allowed, then you might want to take a trip outside the US for a few days or weeks, and then return, starting your new 6 months on the tourist visa afresh. The problem with that is that the Immigration Officer at the airport could pick you up as trying to stay there to work illegally, if they see the stamps on your passport having dates so close to each other and you're seen to have stayed a whole 6 months the first time. You get what I mean.
I'd choose the safe option to be honest.


Anybody correct me on that one if I am wrong, but I think it is a really bad idea to leave the States now, and re-enter on a tourist visa to adjust status as he is already married to an USC, wouldnt it be considered fraud?
best road to go is either CR1 spouse visa, but need to go back to Greece or UK for that; or directly adjust status and stay in the US until the receipt of GC.

Well from my point of you all the insurances (health and appartment) paper work proved that we lived together as it shows the same address for the both of us. Dont you think it is primarely evidence?
We also intend to send the boarding passes from this summer when we travelled to the States (+ stamps from passports + one picture)
We also have a sales contract of a trip we took to Tunisia together in 2008 (+stamps from passports + one picture).
Paperwork from his school in Paris + commencement invitation to his graduation + one picture of us at his graduation.

I understand that bank accoun info isnt necessary proof that we met within the last 2 years. But all the other evidences stated above should make it, dont you think?

Hi, my American fiancé and I are starting the whole K1 process. We have been living together in France the last 2 years, as a result we have plenty of documentation (health insurance cards, joint bank account, apartement insurance contract...) where both of our names are mentionned. The only "problem" is that all those documents are in French, so we are wondering if we need to translate such documents or if a quick explanation of what they are is sufficient? (to send with I-129)
Is anybody in the same situation? what did you do?
Question about pictures of us now. We met back in 2005 so we have PLENTY of pictures of the both of us. I thought about sending 2 pics per year we were together, so about 10 total. My fiancé thinks we should send more. Then i read on the Guideline to send 2 to 5 pictures. What is your personal experience. The more the better? or it could actually be a bad thing to send too much with the 1st package?

If I were you I would not mention this work experience, because if I understand you correctly there is no evidence of your bf working (no tax report, no work-contract and so on). As it seems that he was working on the black market from my point of view it would be better to not mention his employer, because if USCIS or UK gov. checked they would not find any record of your bf working for this company. Besides I do not think that unemployment on the alien side is a problem, as long as the USC can prove sufficient revenues.

In most cases yes. A co-sponsor must be a US citizen or legal permanent resident. SOME consulates do not accept co-sponsors or allow family members only. I do not think Paris is one of them but you can check the consulate website


Unfortunately the American embassy in Paris website does not provide this information. So if anybody who knows if Paris accepts non-relative co-sponsor or not is more than welcome to let me know blush.gif

I can certainly not pretend to have the right answer. But I am wondering why take the risk to delay your K1 process with applying for another visa in the meantime when you are already at the P3 stage?! Correct me if I am wrong but your fiancée is only a couple months away from getting her visa K1 and getting to the States.

We didnt have any printed date on our pictures, so we wrote it on the back, and along with the pictures we sent other evidences which would help date the picture (Ex: picture of my bf and I at his graduation ceremony + a copy of the ceremony invitation showing the date and place; picture of us in Tunisia + stamps from our passports). I hope this will legitimate the date we handwrote on the pics!

Hi,

Our K1 is somewhere over the Atlantic between NVC and the Paris Embassy.
My fiancé (the American petitioner) has changed address on October 1st. Therefore he is completing the I134 paperwork with his new address, but our K1 file had his old address.

1st: is it going to be a problem?
2nd: should he change his address on USCIS website? As our file has been sent to the embassy is it still considered pending at USCIS? (There are 2 different procedures whether your case is pending or not)

From what can be read on VJ Dehli's consulate can be a tricky one. So to not take any chance if I were you I would front load my petition with lots of pictures and evidences. I think that if you submit pictures taken all the same day it will look a bit odd. Take pictures everyday, take also pictures with the family, and at the engagement party as it seems important.
Provide copies of your passport stamps and boarding passes, keep them preciously so your fiancée can show the originals at the interview later. If you have engagement party invitations or something like that, send a copy and also keep an original for the interview.
It wont hurt to front load your petition, and you have to chance to go to India before filling, so you can "built" your petition with many evidences.

It sounds like good evidences of having met in person and of ongoing relationship. Despite what certain people might say it is probably better that you provide evidences of ongoing relationship along with your I129F and not only pictures.
As this hotel where you met is your stronger evidence of having been in the same place, could your fiancée add some kind of evidence that she worked there? This way you will have the receipt showing that you lived there + evidence that she worked there. (just a suggestion).
Also as you were a student in the US, I would personally add a copy of visa + a transcript. So no doubt you were in the States and it is where you met her!

Then for the interview later on, you will need to prove that you are still involved into the relationship, so I would suggest you start building that now. Emails, post cards to each other, phone bills. If you can also plan a trip to have more pictures it would be even better.

I'm a newbie to this forum, It's so difficult to find parts pertaining to my questions searching all over the site so please help me here kind people. I'm starting off so new to everything

1) How strict are they with these forms? Do they nit pick on tiny errors such as should I put N/A or "none" for the boxes? I cant decipher which one to use.
USCIS is strict with the forms, and indeed it is better to put NONE when there is a question where you have nothing to say or N/A when the question is not relevant to your specific case instead of leaving a question not answered

2) #10 on the form, it's asking me for my birth certificate. I have American birth certificate, am I supposed to put my certificate number on it ? and the issue place number? -The problem is on the example form it says I'm not supposed to put anything in that slot unless I got naturalization??
In our case we ticked "Birth in the US" and included the BC number and place and date of issue + a copy of the BC in the package

3) How accurate is the example forms? I have found the example forms very accurate and they were of great helpShould I just follow them exactly to put "none" instead of N/A and for example they have 3 slots for "List of children of fiance(e)" Do I put N/A or none on all the boxes? or just one box on the top left corner?if your fiancé does not have any child then you can just put NONE on the first box

I'm not sure if these little things would make my form bounce and cost me $455. I'm scared. Could someone experienced please help me? Thanks. :]
Not crossing a T wont cost you your application to be denied, at the very worse they will send you a RFE. The most important is for you and your fiancé to prove that you have met in person within the past 2 years, then follow the guidelines and example forms and all should be fine

If you paid the fee with a personal check, when USCIS cashes your check they print your case number on the back, with the Vermont center it start with EAC...
So if you can get this number then you can check your case status online before receiving your NOA1.
If you have an internet access to your bank accounts you can probably see a scan of the back of your check once it has been cashed.

DMVs and Social Security office employ a lot of lazy idiots. But I have also met really nice helpful people there, you just have to really look for them, lol!

Once you get the EAD I advise that you go to the SSN office with ALL of your documents (you know because there is always something missing), and then it should not take them more than a week or two to send you the card.
Just make sure you have everything: passport, marriage license, EAD, NOA1 for your AOS, proof of residence (that might be the tricky part as you cant open a bank account or be on the lease without a SSN), try to be put on the gas or electricity bill. You would think that the USCIS NOA1 with your address on it would be a good proof of residence, but nope, not for the DMV I went to, so be prepared.

Unfortunately now that the I94 is expired there is not much to do. It sucks, but the EADs are approved pretty fast, 1 to 2 months, once you get it you will be able to apply for everything.
I know the wait at home not being able to do anything is a killer, but soon it will be over and you will be living a "normal" life.

We were in the same situation last year. My fiance had only had his job for a couple weeks when we applied (he had just graduated).
We got a co-sponsor (just in case), but the Embassy in Paris did not take the co-sponsor paperwork saying that my fiance's current income was enough, even if he had no tax history for the past 3 years (he had been living with me in France).

Hi everyone,

I am really confused about how to best go about getting married! I have recently become engaged to my French boyfriend (I'm a US citizen), who currently lives in Switzerland. We want to live in the US (I'm in grad school in the US right now), and we're trying to figure out when and where to get married. The main concern we are having is that the day he quits his job he will have to continue working for 3 months. And since we don't know when the K-1 visa will come through, it will be very hard to know when he should quit his job. My question is if we get a K-1 visa, he comes here and we marry, can he then go back to Switzerland to finish his work contract, while also applying for permanent residency in the US? I'm guessing not. What other options would we have? Get married in France and then apply for a spouse visa to the US? We really want to marry in the US. Could he come under the visa waiver and we get married, and then go back to Europe to apply for the spouse visa? Or do we still need to get a K-1 even if he is planning on leaving the US?

If you choose the K1 route, he should give his leaving notice once your NOA2 is approved. The Paris embassy stage takes from 2 to 3 months. So it works out pretty well that way. Besides even if the visa is issued a bit faster than that it is valid for 6 months, so he will have plenty of time to get his things in order.
I did it that way and it worked really well.

I know i read somewhere that I as the fiancee who lives in another country does not need to sign any papers "G-325A" letter of intent, I just want to double check if this is still how its done? or do i need to print out the forms, sign them and send them over to my fiancee in the u.s that will be sending the paperwork ?


For the K1 application the foreign fiance has to fill out the G325A and sign it, and also write a letter of intent and sign it. You will have to send those to your USC fiance to be added to the package.

K-1 Fiance(e) Visa Process & ProceduresStarting K1 while fiancee is in the US

Bear with me... this is a little long, but any help will be much appreciated. :) My fiancee and I really want to be together as soon as possible, and it seems like the below idea could make that happen, but I would definitely like to hear from anybody who has tried something like this our could provide some feedback on the idea.

My fiancee (who is in China right now) already has a B2 tourist visa that is valid through November of this year. She can stay in the US for six months on this visa. Since the processing time for a K1 visa currently seems to be about 6-8 months, what I want to do is to have her come to US on the tourist visa while we wait out the K1. It seems that she would have to go back to China for the visa interview, but that isn't a problem since that would be happening right around the time the tourist visa expires anyway.

This could happen in one of two ways:
1) I submit the I-129F to start the K1 application, she comes to the US, waits out the six months, then goes back to China for the visa interview before returning to the US on the K1.
2) My fiancee comes to the US, I submit the I-129F, she waits the six months, then goes back to China, does the interview, and ultimately comes back to the US on the K1.

The advantage of option 1 is that I can send in the I-129F right away to get started on the K1, then make plans for her to come over here. The point I'm not sure about is whether or not any red flags would go up at the border if she arrived on a tourist visa, but with a K1 application already started. I'm aware that she wouldn't actually be able to apply for a tourist visa after I send in the I-129F, but in this case, things are a little different, since she already has the tourist visa...

Option 2 seems a little safer. We would have to wait a little longer to start the K1 application, but to me this seems like a perfectly legal use of a tourist visa, since her intention is not to get married and immigrate (until the K1 goes through). But would USCIS have any problem with an I-129F being submitted while my fiancee is actually in the US on a tourist visa? I know they ask this on the form, but it's less clear what would actually happen if you answer yes.

Sorry if this sounds incredibly complicated... well, it is pretty complicated. We just want to be together as soon as we can and this occurred to me as one way to make that happen. Any feedback?


Both options are possible, but with option one you run the risk of your fiance being questioned at the POE when she comes on her visitor's visa, even if what you would be doing is perfectly legal, it could raise questions from the customs office.
If I were you I would choose option 2 just for the peace of mind. You could have all the documents ready, and as soon as she enters the country on her B2 you send the I-129 package to start the process.

I was able to get a temporary insurance through AXA insurance(the French branch) but I believe they are in the UK too. They had an option for people residing in the US, it was something like 80 euros a month, I took it for 2 months, until I could get under my husband's insurance.
I see that your local USCIS is in Fairfax, VA, where will you be living? I am close, in Alexandria, VA.

If you get married in Japan or Korea and apply for a spouse visa CR1 she will get a green card as soon as she enters the US and so she will be able to work right away. I believe the process takes about the same amount of time as a fiancee visa K1, or only a couple months more. If you do the fiancee visa, she will have to apply for an adjustment of status after you get married, and will not be able to work for several months.
In terms of sponsorship they look at your previous years tax returns and your current employment. In our case my USC fiance was living with me in France as a student, so his previous tax returns showed zero income, but we were approved on the basis that his new job in the US was paying him enough. But if you can not show proof of employment in the US then you will need a co-sponsor. $15,000 is not enough assets to sponsor your fiancee on your own. 125% of the poverty line for a couple is somewhere around $21,000, and without a job you would need to have the liquid assets to cover this amount by 3 or 5 times, others will confirm the right numbers.
