While CR-1 is cheaper, the main thing is that the wait is longer. And I don't want to be any longer without my honey.

I choose K-1 just for the timing reason. I would rather pay extra but be together sooner.

Also you can work and travel approximately after 3 month, so it is fine with me, by the time she will get settled, we can already go to our honey moon.

well, I'm going to marry in the US next year and my fiance said that if I work, after we get married, he's going to lose his benefits, but if I don't he could get more benefits. The thing is, he's not unemployed so...

has anyone been in this situation before or know any info that could help me to understand it? Of course I want/need to work so I wonder what are the benefits US government can provide to their people (married or not).

Let's get things straigt first.

In order to apply for a fiancee visa, your future husband will need to sponsor you. How he will do it by sitting on unemployment benefits???. He will need to get a co-sponsor. Not every embassy allowing co-sponsoring, you would need to check with yours.
If you will go to work, he might loose benefits (not sure here) as this is not a part of the immigration. If you will apply for additional benefits, then you will become a public charge, and who ever sponsored you will have to pay it back to the government. I think your future husband need to do an additional research, as he is not telling you the whole story.

Good luck on your journey, but I don't think he will get what he wants.

So my fiancee is flying in on Wednesday, 31st, in the afternoon. Moscow > LAX.... Anyone knows how long it usually takes from disembarking to exiting the airport? I read some posts that say it takes anywhere from 30 minutes to an hour. My fiancee read on her site that it sometimes takes 2 to 3 hours. Anyone?

I am assuming she is flying on the K-1 visa, which requires her to go thru immigration process. She read it correctly it does take about 2-3 hours.

She doesn't have to worry about getting to the wrong line. She have to go to the line for non-US citizens and they will direct her to immigrations.

Congratulations on your almost completing your journey. You waited longer so 2-3 hours wont make a difference. :yes:

Can't agree anymore here. VCS is the slowest one.

I thought the same thing but it's just an estimate according to the information others submit on this site. I would check weekly, then daily because I noticed the same thing. I got my NOA1 in mid July and the NOA2 on Aug 24. That timeline estimate kept giving me earlier and earlier dates and I thought that was very incorrect, especially since many people had been waiting four months or more.....,but it was on the money with the estimate. I would say, don't get your hopes up but know that it's very possible it comes earlier that you initially expected.


Thought yours NOA2 is different for K-3 visa, then ours for K-1

I noticed the processing from NOA1 to NOA2 increased from 70 to 88 over last month or so.

How would the file dates being processed go backward. I think I must not understand the data being reported. Can someone explain this?


You have to understand that all those timelines are just estimate and they are based not on actual results, but on the VJ members who submit their dates. Also each case is different, it is likely that a case with later NOA1 date could be processed faster. You just recently submitted your application. You still have a ways to go. Don't put yourself to those timelines.

I am not sure what other topics you are talking about. But actually getting K-1 is not that hard, as longs as you have enough evidence of the relationship and you don't have some circumstances like criminal records etc....

But reading your previous posts you sound like you dont hold a sec.clearance. I know what I'm talking about -I'm in the process of obtaining a TS.
Now, getting to the point. In Ukraine, all churches ask you first for a civil marriage cert before they proceed w/ the ceremony. Oksana can clear this thing out by visiting the nearest church in her area in Ukraine. If the marriage cert exists, you're ineligible for the K-1. --it's clear as a day outside, 3:18pm PST.


I just was trying to understand if the church wedding could impact K-1. And I already spoke to my fiancee, and we decided that she will come here and then we will get an AP and will go there and do church ceremony for her family.

On the side note. I am holding a TS already for 3 years.
And this is a reason, I don't want to commit any fraud. Could be I misspoke it in one messages which got you confused.

Actually I don't want to commit fraud. I just wanted to explore all the angles. I really appreciate the input and advice. Also this fraud could impact me, as I am working for Federal Government and holding Security Clearance, which I don't want to loose because of that.

Eve after the approval you cannot if this is documented wedding. When you enter on K1 at the POE you have to be free to marry to enter the country. Don't underestimate POE! They ask a lot of questions and CAN deny entry. If they do they will cancel K1 if you are married. Don't complicate things. By getting wedded in Ukraine you are creating potential inadmissability issues and create absolutely unnecessary problems. Just don't do it. If you reaaaaally want to have church wedding in Ukraine wait for K1, get married in a quick civil ceremony here in US, file for AOS, get AP card and do whatever you like in Ukraine!


What about if they don't document it. How is USCIS will find out about that? (obviously I wont tell them).

It may. It depends if it gets registered in any documents. Basically, during the interview for K1 (on the forms) you are claiming that you are not married. If you have a wedding it may be considered as marriage and may force you to cancel K1 and apply for CR1. If I was you I would not risk it...


What about if we will do the church ceremony, after the approval. Can she still enter on K1 or we will need to re-apply for CR-1. As far as I know, church weddings in former russian republics are not considered as legal for the court bindings.

We were planning to have a religious ceremony in church in Ukraine, but do the court wedding here. Does the religious ceremony can impact our K-1 process.

ok to clarify he said that they will hold the AOS beyond the 90 days of the initial K1, that way i would have to send her back. And if the interview takes place after the 90 days they won't immediately approve it.


Tell your friend to register here and read about K-1 Process. While they AOS will go beyond 90 days most likely, having NOA that your case is pending considered legal stay in US. Plus she can work and travel during the time while AOS is processing.

You've never heard of it because it's nearly impossible to get. The only people who manage to get expedited on a regular basis are active military members who have an upcoming deployment. Getting an expedite for any other reason is extremely rare.

I understand your feeling of frustration. That happened to me yesterday and hours later I was approved. I even called the USCIS yesterday to see what was going on. You should try to get your petition expedited. That's what I tried to do last Thursday and the Friday morning they emailed me letting me know that my expedition was denied because my petition was already with an adjudicator. So try getting it expedited. Whether or not you decide to do it, your petition will soon be approved.


It is probably a newbie question. But how can you ask to expedite the petition? I just have never heard it for K-1 Visa.

Strange question but a realistic one: if there is a layover for the next flight at an airport other than airport of origin and not in the US for point of entry, can the K-1 VISA holder go outside of the layover airport for a hotel stay, or is this restricted?

Seems like we are from the same country for K-1 visa :)

Unfortunately K-1 visa only entitles you to enter to USA. If you have a layover in Europe which would be common to fly from Ukraine, then you would need a Shengen Visa to get out of the airport. Unless there is an agreement between UA and the country of no visa entry which is not a case for the european country, so you will not be able to leave the airport. If there is an hotel inside the airport and some do have it. If I am not mistaken Charles De Gaulle in Paris is one of them, then you can stay there, other then that you can't.

I would recommend look at the direct flight from Ukraine to US (POE NYC) and then connect to your final destination.

We are currently in the process of our K-1 visa, waiting on NOA2. We still have a long time to go and wanted to see each other in a mean time. Unfortunately I can't travel to her country as I am in school, and can't just do it. We were thinking to try to open for her a Canadian Tourist Visa, so we can meet there. Unfortunately for Ukrainian citizens, it is not that easy to get a visa, I am wondering if she will get deny a canadian touris visa, how it could impact our K-1 interview, will the look at this if the denial stamp will be in the passport.

Any feedback suggestions are really appreciated.

Holy smoke, I know I just filed our K1 pkg, however I was checking out the next steps in the process and the 2nd NOA, acknowledging K1 petition approved, the processing time for this step is 5 months alone? It seemed to not matter whichever service center, except Nebraska, (not sure what their times meant)...., but I've talked to people who were bringing their Filipina finace here and I know one guy said the whole process was 4 months...there were some 5 month folks...seemed 6 was sorta common..?

I mean it is what it is, but didn't think just that one step was 5 months. Too bad living near DC doesn't help or I'd just drive the 50 mins downtown and take care of it, if I could, lol.

Rejected tourist visa to the USA, could be a red flag. However if you have sufficient evidence to show that your marriage is not for immigration purposes you should be fine.

However each case is unique. That the case was updated doesn't really mean someone look at that. It could be that it was moved from one cubicle to another.

Also it is really hard to based on the VJ timeline, as it is strictly dependent on VJ members to update their timeline.

Hang in there as I said CSC is usually pretty fast, not unlike VSC where I am waiting on my case.

So, me and my girlfriend of 4 years are taking the big step, and she will be looking to relocate from Paris to San Francisco to live with me (I'm a USA citizen, and she is a French citizen). Problem is that after having already dealt with the long distance relationship for so long, it is pretty daunting to see that the whole k-1 visa process can take 6-8 months before the application is approved and visa granted, since that means we still wont be together for that much longer. So, I'm trying to figure out if there are other faster ways of applying for a visa, or if there are ways she can still be in the USA while the visa is being approved. Here's my specific questions:

1. If applying for a K-1 visa, can she still travel to the USA under the standard holiday/visitor visa for up to 3 months? So, can she enter the USA under the visitor visa while the K-1 visa is being processed, and not yet approved?

2. I have read of people coming into the USA without the K-1 visa, and then getting married while in the USA. Once married, they then apply for an AOS while in the USA. Is this process any faster? Would the person be able to get a work permit before the AOS is completed? Or, would the person not be eligible to work in the USA until the AOS is completed?

3. Would the process be faster if we got married in France, and we then applied at the US embassy in Paris for a visa? Not sure which visa to apply for at that point?

Will answer as much as I can based on your questions.

1. Yes she still can travel. A good suggestion will be to carry the NOA-1, so the CBP officer will see that you are in the middle of the process in case of questioning at the POE.

2. While it is doable. This could raise a red flag, as basically she entered US as a visitor but got married. While she disclosed at the POE to the CBP officer that she is just visiting. I wouldn't recommend this option.

3. You can't file for a wife Visa in Paris. This is a CR-1 Visa, which you can only file in USA.

4. Pretty much same thing as number 3. Not much of a difference she still would need to go to Paris for interview, and can only be in US for 90 days.

5. It is all depends for how long she have to go. If it is only for a few weeks or a month this will not be an issue.

As a side not for all of it. You already waited for 4 years. Why don't you just apply for a visa that seems to be most appropriate for you and wait the required time.

You have until October 31st--the expiry of the I-94--to get married. Once married you have completed the requirements of the K-1 Visa. You then file for AOS, but there is no real time limit to do so. Once the I-94 expires you are out of status if you have not yet filed the AOS. This means you can be detained and taken before a immigration judge who will tell you to file AOS ASAP. Once you file AOS, you can carry the I-797 form around as proof that you have filed and are in the US legally.

Why does it take a week to get the marriage certificate--oh I see you are taking about the original correct? I was able to get certified copies the day I submitted the original and used that to file the AOS. I did take the original to teh AOS interview and another copy. The IO looked at the original and kept another copy. I would see if you can get certified copies the day you submit the marriage license to the county clerk.

You do need EAD to work. However you can get SSN without having EAD, but it will not grant you work authorization.

While I've been on this site for a short period of time. It is my understanding that all the timeline is solely from the people who register and provide their timeline but not from the USCIS source. It is possible that you went down because some people just registered but submitted their K-1 before you, while others just getting into updating their timelines.

Don't get yourself tight to this timelines.

I think you are confusing yourself. If you get married you are not elligible for K1 Visa anymore. K1 visa is a FIANCEE visa not a wife visa. If you are planning to get married prior to applying for a visa, you are most likely looking at CR-1, as K-3 is rarely used at this point.

The financial information is the same as for K-1, K-3, and CR-1.

On the financial support you would want to show the tax returns for the last 3 years. If you fiance/husband doesn't have sufficient income you can try to find a co-sponsor.

Hey guys! Im going crazy bout all this K1 process...waiting is killing.,really. So im looking for some option. Maybe you can answer my question.
The situations is so that i was in US on my J1 all summer 2010. 20th of Sept 2010 i came back home. Engaged with my sweetheart. On october 2010 he hired the attorney for starting k1 process but on february 2011 she failed and quitted. Cant explain how upset we were. My love found another attorney and on april 29 2011 she sent our I129f to TSC. On may 2 2011 they submitted it and we got NOA1. At this very moment nothing is really changed. We are still waiting on NOA2. Dont know how long more it will take. And i cant bare it. In November my love has bday and i long to spend it with him. I promised him. But i see no changes in our I129f. ''Initial Review''. Im asking is it possible for me to obtain for B2? Just come and see my love for even one day? Im ukrainian student still. When i came on sept 2010 home from US I took a year away in university. So on December 6 2011 i have to come back to it to continue my studyin'. And in june 2011 i'll get diploma of bachelor degree.
PLEASE...let me know your thoughts bout my situation. Is B2 visa a possible way for me? US Embassy in Kyiv is very strict about issueing visas.

Yeah, Ukraine is tough on B2 Visa. While a student status could help. Make sure you bring to the interview if you decide NOA-1 from your I-129F this my help. I want to see my fiancee and she is in Ukraine and I am a student in the US. So kind of hard for me to travel as well.

Chat logs don't help to establish that two have met. What about if there is no family pictures? I would assume they want to see that you met, and not necessarily with family.

Hi all! :)

Just joined after stalking the website for quite a few weeks! I sent my 129-f package on the 21st and just now noticed 3 things. Figures after I sent it 2-3 days ago! Hah. ):

Firstly, I only included boarding passes and pictures of us together with dates on the back. I did include a passport photo but it unfortunately didn't dawn on me I should scan all of the pages, is this something that could be a issue given the evidence I've already submitted?

Another is with the G-325a form, I made a mistake that I just caught by looking at the scanned version. I misunderstood what it said with, "City and Country of Residence" for my parents and had put "N/A" (thinking it meant the current residence) for my father and somehow that's all I managed to put. So for that entire box it just says "N/A"! Can't believe I missed that..! I think I kept checking so many times over it that when I saw a box filled out I instantly looked elsewhere..

The last matter is with my birth certificate. It doesn't have my fathers signature as he wasn't there, and there was no back to it at all so I said so in the cover letter and.. put a sticky note on it just in case. My mothers signature has also faded a bit.

Would be grateful for any opinions on this matter, I wasn't sure of the seriousness for the things that I described that would cause a RFE.


Since you just submitted and don't have a NOA-1 yet there are few things that could happen.

They could completely reject your package, and tell you what you missing, so you can resubmit it, or they could send you an RFE.

Birth certificates could be one of the RFE's to explain why there is no signature, another one could be on G-325a. However it is more likely will depend on the adjudicator and how picky he wants to be.

My fiance has a tourist visa for 5 years. I will apply for a fiance visa within a day or two for her. She is planning to visit me in December while the fiance Visa is being processed. I was told that there is a good chance they will not allow her to enter the US using her tourist visa since the immigration officer will see that she filed for a fiance visa. The plan is to have her visit me and stay in the US for a few months until the American embassy schedules a fiance visa interview for her then she can fly back. Since her entry to the US is not 100% guaranteed, is there a form we can apply promising that my fiance will go back once the paper work is done and she will have the interview for the fiance visa? I just don;t want her to fly to the US and they deny her entry. I want to guarantee her entry to the US.

There is never a guarantee entry to the US even with Visa. Visa doesn't guarantee you entry, but only allows you to travel to US. It is just a metter of CBP officer at the POE. Be honest, have your fiancee have a copy of NOA-1 and be honest with the immigration. While I haven't read any specific cases here that the entry was denied it might happen.

The embassy got my papers on 22 sept and i am still waiting for them to call me for the interview... Should i wait or simply call them to see what is going on? What you guys think? :blush:

Have you recieved your packet 3 already and send it back?

You have to do that first before you can schedule an interview.

I've asked the same question earlier about that on the forum. As I am facing the same situation with my fiancee.

I was told by many members don't do it, as it could hurt later in the process.

We decided to come here do all the paperwork as required, and then just do religious wedding later to fly to her country and do it.

I would recommend don't do it. Otherwise it might hurt you back.

However it doesn't change the situation that OP got 2 kids. While he might not claim them on the Tax Return this is not what USCIS will look for. So for USCIS they still would be counted as depended whether they are claimed on Tax Return or not.

USC should download the affidavit of support form, complete it and send it to you with all of the supporting documents. You would also need the evidence of the ongoing relationship. Whether you have it or him you will need it.

Yes, I lived in India for one year (August 2010 - August 2011), which is where we met and became engaged. It's not an arranged marriage, as I'm not Indian. While I lived in India, I met his family and my family visited me and met him. So USCIS does not need proof of the validity of the relationship?? They only want to know that we've met in the past two years? This seems contrary to what I've read.

USCIS only need the proof of meeting. However for the interview in the Embassy this is where you would need to see the proof of the relationship.
