Hey Everyone,

I need some advice on a situation that is happening right now. My boyfriend lives in England while I reside in America. He was visiting me this summer for two weeks and I plan on going to England in April. He will then be back in July until the end of August. We have known each other since we were 14, now 26, and just started dating again a little over 6.5 months. We dated from ages 15-17 too but broke up because the distance was too much for such a young age.

I work at a job with high-risk teenage girls who are very violent. Recently, I got hurt at work due to this. I had a concussion, later post concussion syndrome, along with a cervical strain. This has caused me to be out of work for about a month and to receive workers comp.

Meanwhile, my work has decided to close because of all of the staff getting hurt. There were 5 different workers comp cases within a month because of all of the violence. The workers comp adjustor is a real piece of work and is very frustrated with all of the cases from the same place. The workers comp lady even had someone hacked my computer and found out about the visa stuff. I told no one but my parents. She even threatened me for fraud if I were to file saying I had a job. We didn’t even fill out any paper work yet so I was really freaked out that she even knew about it.

To get me off of workers comp the adjustor had my work create a job for me to do. She is pushing me to get laid off like most of the other staff though. She said that if I did not take the unemployment and severance check that she will deny my claim. I definitely do not want to be unemployed so I need some advice. It’s very hard to find a job around here and I don’t think I can live on my savings for very long.

We were plan on getting engaged when I went to visit in April 12 and then filing soon after that. I know that your not suppose to be on any government funded programs so here are my questions.

1. Is workers comp considered government funded and did it hurt our chances of being approved?

2. Will being denied my workers comp claim hurt our chances since it can be placed on my record?

3. Can the denial cause me to not be able to enter another country?

4. I am going to avoid unemployment if at all possible but if I can’t find a job right away will being on unemployment for a short time hurt our case too? Even if I find a job way before we file?

5. Should I hire a lawyer if it is going to be this complicated?

You have nothing to worry about.

First of workers comp doesn't considered a federal benefit and even if it would you are a USC and elligible for that.

The only downside you have for not having a constant job and stady income, you will need a co-sponsor for your visa who makes enough to co-sponsor your fiancee. Other then that your case will be just fine.

I don't see a reason for a lawyer as I said earlier your case is pretty simple.

Hello all,

I am an American citizen engaged to an Italian woman. We are investigating starting the process to gain her authorization to live and work in the US. I have been reading the forums and info here, but am still uncertain.

Background: We met at UW-Madison when she was doing an internship and I was in school. We have dated for 3 years and both have visited each other multiple times. I am in Italy with her on tourist visas, and she has at various times received A Student Visa and two separate internship visas in the U.S. Proving/verifying our relationship should be simple in any circumstance.

Outlook: We are hoping to move together to the U.S. ASAP. Initially we were thinking of doing the K-1 visa, but I am wondering if getting married in Italy and then applying as spouse would be quicker and more efficient. She has a successful career started in logistics, and wants to be able to work in the US as soon as possible.

Question:

Which approach will get her to the U.S. and legally working the fastest? (Considering the legal marriage process separate from an awesome wedding celebration...)

A. Get legally married in Italy soon, then apply as a married couple for residency and work authorization.

B. Apply as fiancée, get legally married in the U.S., then apply for change of status (residency, EAD, etc.)



If anyone could fill me in that would be great. I have seen the various tables and everything, but I am still unsure.

There are 2 different approaches you can take.

CR-1 visa which is a spousal visa. Slightly longer in the process, but a little bit cheaper on the processing or K-1 fiancee visa, slightly faster, but somewhat more expensive, and takes sometime before your fiancee will be able to start working.

There is no reason to follow up till 5 month period as USCIS will answer call us back.

While they are US Territories, they are also considered POE and you are required to show passport or GC to come back. So stay away. Same applies to St. Thomas and St. Croix, and Guam

i started working in september, after my education was completed. i'm working in construction, making 10 dollars an hour. but, because of the current weather in my area, working has been cut down to anywhere from 15 to 30 hours. with these hours, i do not make anywhere near what i need to make for the i-134. but in the spring and summer, i make more than enough to support myself and my fiancee. but i won't have evidence of that, since i started working so late into the year. when i file for taxes, it'll only show my lessened hours.

would the fact that i have next to *no* expenses appeal to the CO at all? i literally have nothing but personal expenses (entertainment, fast food, etc.) and an unsteady income

can i explain this to the CO through a cover letter? would there be any point in explaining this at all?


You will need a co-sponsor. The CO will not care whether you have expenses or not. There are guidelines that need to be followed, and the CO will not go around it. So find a co-sponsor.

Gotcha, thank you for the info! I've gotten my senator & congressman involved, not sure how much that will help now that they no longer quote "5 months" for Vermont, and claim anything that's after March 15 is within normal processing time.

As you are trying to make a sence of it without having your timeline in place, so may be you even didn't started the process.

Don't plan anything before you get Visa in hand. There is no promise that it will take 5 month. They provide estimate 6-8 month, and as other posters said, not case is the same as well as no wave is the same.

Just hang in there you will get it.

I am pregnant and expecting our baby in February. We have started the visa process, but until my fiance gets here, I will basically be the sole financial support for myself and the baby. My fiance is from Cameroon and working on his Ph.D. in Korea. He is on a student visa and only allowed to work 20 hours a week. He has to pay his rent and expenses out of those 20 hours, so doesn't really have any extra to send home. He definitely wants to help but I don't see how that will be possible.

Right now I have government funded insurance since I didn't have my own private insurance to cover my pregnancy when I got home. I also receive WIC. I am currently looking into childcare assistance because there is no way I can afford childcare and expenses on my salary. I don't have anyone who can watch our baby for free when I go back to work. I will try to look into other cheaper options for childcare, but the going rate in my area is around $700 per month. There is just no way I can afford that on my own. To receive childcare assistance, I have to apply through the Department of Human Services for a program that offers childcare certificates. I would be responsible for a small amount of weekly childcare, but the rest would be covered by the state. I probably qualify for other types of assistance as well as I will be single with a child, but I want to take as little help as possible. My question is, will receiving public benefits cause problems with having our K-1 visa approved? My brother has already agreed to be our co-sponsor since my income would be sufficient for 2 people but not 3. My fiance also has two bachelor's degrees and an MBA, as well as work experience, so I hope that carries some weight at his interview. I am in school working toward my certificate in medical transcription and plan to go back for a Master's. This is really frustrating because if my fiance could be here, that would solve most of my financial difficulties. He could stay with the baby until he received legal permission to work, at which point we could easily afford childcare. With his degrees and experience, he has a much higher earning potential than I do. If anyone has any information on how public assistance can effect our chances, please let me know. I am really stressed about this.


You government assistance have nothing to do with K-1 Visa. You are USC and you are elligible for that. As you mentioned you have a co-sponsor, I would also double check with embassy if they allow co-sponsors, as some are not. Your fiancee education have nothing to do with Visa approval, they don't look what he can potentially make in the future, they look if you have a means to support him.

If you got denied, there is no way for second interview. Your paperwork will be send back to the USCIS for possible revocation. It might take months before you will here anything. You can try to contact your congressman, but most likely you will need to wait till the case will make it back to the USCIS.

What you can do is to close your K-1 petition get married and apply for CR-1 Visa. Though you will really need to overcome all of the concerns of the CO about legitimaty of your relationship.

There is no issues scanning or copying at home. As other poster mentioned FedEx doesn't certify the copy. So it is all the same

HI All, our Noa2 was approved on 8/10, and was sent from NVC to the consulate on 8/18. Since then, nothing. Should I be concerned? Is there any way to determine where it is? I have emailed, and they confirmed back that it left on 8/18, but that's all the info I can get from them. Any help is appreciated. Tks. Darryl

Have you tried contacting the consulate?

Contact the consulate with the case number that you got from NVC. They are your next step in the process

i think it should be ok. while i cant guarantee this there is a good chance that they wont even ask for a co-sponsor and the wage slips should be enough for your fiancee. i do find it strange though that an employer wont take a few minutes just to write a letter but it does seem to be a very common thing now :)


I work for a huge corporation with over 400K+ employees, can you imagine if only 1% will ask for a letter like that. They will do nothing else but will write letters.

In order for house to be qualified as an asset, you would need a new appraisal, as well as show that is paid off completely and don't forget that they will only count it as 1/3 of the income requirement, so make sure you have enough to cover the 125% of the poverty guideline.

Hello Everyone,

My fiance and I sent everything in to the VSC on July 6th then it was sent back as they changed the fees so we had to send in a new check.

This was sent in and noted as received by the VSC as of July 22nd

My question is has anyone else submitted around the same time (July 22nd to the VSC if so have you heard anything in regards to your NOA2?

The other reason I am asking is our lease is up on our flat in Germany in 1.5 months and I need to know if we should change the address on on our application to my fiances home in Poland.

My NOA1 was dated July 27 in VSC as well no word on NOA2. If your fiancee will be moving to Poland than yes, you will need an address where your fiancee will be able to get the packet 3 and 4.

Hi all, I just saw this thread and thought i'd chime in. I got my NOA2 on November 25th. NVC just received my case today and the lady I spoke with told me it had arrived in the building but would take another 10-20 business days to be put into the computer. THE WAITING NEVER ENDS. FML.


I thought when they get it they assign the embassy case number right away is that not the case???

If you would want to contact someone it would be a congressman/woman. But why would you want to do that based on your timeline you are still within reasonable amount of time from your NOA-1.

Usually people get one RFE. However there been cases after you send response to the initial RFE, they can issue another RFE based on those responses.

I recently visited my fiancee and completed the G-325A form which has an the expiry date of 06/30/2011. There was no updated form on the USCIS site at the time. However, upon my return home I checked the USCIS forms on the site and the have indeed a newer from which now expires on 08/31/2012. The site says Previous Editions Accepted. Upon looking at the Form I had my fiancee sign, I noticed a typo. My questions are, should I correct the typo and how or should I re-do the G-325A using the new form and have her sign? I will be visiting her next week but not sure which is the more sensible thing to do. I had planned to mail in my petition this week.


According to the latest USCIS instructions there is no need to sign G-325A from fiancee. You can send it without signature as she will sign it in the embassy when will go thru the interview. Just check everything again an send it. You are fine with using older forms as they are accepted. I sent mine with no signature and it was accepted by USCIS.

I just joined the forum. I met my fiance online a few months ago. We met last week in her home city in Russia and we have decided to start the K1 process. I have reviewed at various places what is necessary to send for the petition. I do not see where a copy of her passport is necessary but she has read on Russian sites that it is. My fiance does not have her international passport yet. Do I need to provide a copy of her international passport with my petition?

You don't need a copy of her passport, however you want her to start the process of getting international passport as it could take sometime.

The K-1 Visa process is a lengthy process and you should prepare yourself for this wait.

Since you met each other you shouldn't have any obstacles on this part.

However there are few issues that I see right from the spot.

1. Your financial situation - are you working? Because you need to be able to show a proof of income when going for the visa interview or have someone who can sponsor your fiancee.
2. Unfortunately K-1 visa can only be done overseas, and she will have to go thru interview out in England. She can visit you here, but staying no, since she can't violate the imigration requirements on the stay which I believe is only 90 days, and after that she have to leave. You better off start your process, and get ready for a wait.
3. As far as paper work there are only several things you need from her: G-325A (no signature), Letter of Intent, and passport photo. Everything would need to be filled out prior to the interview.

Usually, consulate asks for last 3 years of transcript. If she will be unable to qualify on her own, she can get a co-sponsor, to help with this requirement.
