The petitioner should recieve the email from NVC about the case number, and then you the beneficiary should recieve the packet 3 from embassy.

I also filed in july in VSC and hoping to get mine soon as well :)

Usually it takes 1-2 weeks to get visa. If you were approved you should get yours pretty soon. There is a possibility it went to AP.

It is really hard to say, and embassy usually not really good in answering questions.

Other countries rejections dont impact your US ability to get a visa.

Hi All!

I had a question regarding the translation of certain documents to English. Does this need to by done by a goverment certified translator and be notarized etc., etc.... or is it okay to just have a professional translator do the translation? Any advice regarding the translation of documents for the K1 visa will be greatly appreciated! (FYI the translation is from Spanish to English)

Just a professional translation should do it.

For example I am translating all my documents my self. My fiancee is in Ukraine and she got documents in Ukranian and Russian. I am fluent in both of those languages including english.

If you are fluent in Spanish you can do a translation yourself as well. Just certify that you are fluent in both languages.

The person needing the tourist visa applies alone. You as a friend have nothing to do with the application. He was denied because he didnt understand or meet the strongest ties rule. All of these cases are decided on their own merits which should include a written statement indicating why the person must return. Keep in mind USCIS views all people with any type of visa as an intending immigrant. That must be offset in the application some how.


Just a small correction not USCIS but DoS. USCIS doesn't issue any visas.

I read about the expedite process sent by one of the petitioners. Whatever reasons for her decision to call USCIS, is for the USCIS to decide whether to approve it or not. It's their discretion anyway. I am writing this to ask anyone for an opinion. A good friend of ours gave me this info regarding expedite process, so grateful. My fiancee is the petitioner we mailed our I-129F July 20 and got NOA1 July 22, 2011,until now we are still waiting for the NOA2. The reason why we need to be together soon is that my fiancee needs to undergo biopsy again on Oct 5,2011 for his vocal cord. He needs me very much. He lives alone and longs for me to be with him during this time. Will we be qualified for the expedite process or will it affect our petition. Please help me with your honest opinion. Well as you said it is at the USCIS discretion. Usually it granted for the military personel with scheduled deployment.

While you are talking about medical condition, even if USCIS will approve your expedite processing you are already in October, and you wont be able to make it on-time anyway. It still will take sometime before you will get your visa approved and everything. Even with expedite process you are still looking at several monthes. Since expedited for USCIS, doesn't transfer to the NVC or embassy.

Had my interview on Monday this week,lady was very nice,cracked jokes during the interview.My lawyer was present.IO took my I94 and wrote in my passport my alien # and cr6 sec 245 and her name.Gave me a letter saying a reply will come in the mail.I am looking up my status and nothing has changed as yet.The IO did make a comment about our age difference.MY husband is only 12 yrs older than me and looks very young.I am 37 he is 49.I do not date men my age,no disrespect cause I have had a very bad heartache with exes.

But anyway I am nervous.Lawyer said we did good and leave it in Gods hands.We answered all our questions ans had lots of documents.She even said she had enough.

Anyone with this problem?


Based on what you said here you should be fine.

You don't need to send originals with packet 3, but you need to bring them to the interview.

They could ask you about previous marriage of you and your fiancee. You will need to show the proof for divorce, but nothing to worry about. A lot of people are divorced and filing for K-1 (I am one of them).

Don't worry as long as you have enough evidence to show the relationship you should be fine.

Assuming all documents are in order and you can show proof of bonafide relationship, no one will look at 3 years. As it was mentioned earlier even 35 years difference were getting visas.

I just came from Kyiv in July visiting my fiance. And it was great beatiful city a lot of places to go. While a lot of my relatives are from Kyiv, this was my first visit.

At least that is how I read it...


Seems like the Moscow is harder on you guys. I am going thru Ukraine consulate, and they DON'T require translation of documents that are in Ukranian, Russian, and well of course English. Though I am preparing to do a translation anyway, since it will be needed for the AOS.

As a side not, I am working for DoS, and I am surprised how each country approaches it differently.

Just found VJC yesterday and all the info here has been very helpfull. I have met three times with my fiance, twice in Russia and one time in Spain. Just popped the question to her on 10-2-2011 while in Gran Canaria Spain))))))). Now I get to start the K-1 jorney. I am in the prosses of getting things together but am stil on the wall on wether I should do it myself or hire an imigration attorney. Part of me just wants the peace of mind to let sombody else handle all the paperwork. Any imput would be helpfull. Thanks.



Actually hiring an attorney will not give you any peace of mind, but just more headache. The only thing attorney does is fills out paperwork with information you have to supply him. Why don't just take time and do it yourself and save this thousands of dollars those attorneys will want.

This website provides you ample of information to do it yourself as well as people are really friendly and will answer all your questions for free.

Note also that attorneys doesn't guarantee any results, while they say they do.

And if you really want to pay, why don't you pay me to do it for you, I won't charge as much as an attorney, will do it for half a price :rofl:

I am about to fill out the I-485 form and I noticed that it required the biometrics. The I-751 and N-400 that I will be filling out in the future also requires the biometrics.


-- Do I need to do the biometrics one time only to cover each form (I-485, I-751, and N-400) or three separate times?


-- Will I be given a paper copy of the biometrics once finished?

Yes you would need to pay each time the form is requiring biometrics so with that said it would be true for I-485, I-751, and N-400.

You will not be given any paper of your biometrics.

No. She never lived in Russia and the Soviet Union no longer exists.

Of the three Ukrainians in this house, my wife and two sons, ONLY our oldest son needed the Russian certificate because he had been a student in Russia for more than 6 months when he got his visa.

Corrections

1. Our son, a Ukrainian, got his Russian police certificate in less than 3 weeks. It is best if you already have your police certificate from the former Soviet Republic you lived in, in our case Ukraine. Ukrainian certificates take about 3 weeks also

2. Petition approvals expire in 4 months, not 6 months. Notify the consulate before 4 months if you need an extension

3. Emailing the consulate and being polite resulted in ??? You need a police certificate from each country you lived in. If you do not have it at the interview they will give you a 221g notice and hold your visa until you bring it.

I do not know why you would mention it is not an issue for those born after 1975? Our son was born in 1991 and needed a Russian certificate because he goes to college there. You need a police certificate from ANY country you lived in after age 16 for more than 6 months cummulative time.

Your other suggestions are good. The police certificates are valid at the consulates for 12 months, We had ours in hand even before we filed the petitions. Way too many people are sitting around checking useless online "case status" reports and not preparing for the next step, that is true.

I am not sure about your country.

But I can tell you, while you think it is just a ritual and not legal, it is depends how the CO will look at that, as they may consider it as legal ceremony which will make you ineligible for K-1 visa and you will need to apply for CR-1 (spousal visa).

Ok, So here I am. I always translated or notarized documents for the fiancees, petitioners, husbands and wives for submission to the USCIS. I never thought I'd be one of those in this queue waiting for my own fiancee.
I filed with the Vermont Service Center on August 10, 2011. In September I sent additional evidence to the USCIS , letters from three US Citizens who vacationed with me and my fiancee last summer and lots of photos , my divorce decree, his divorce decree. Never heard from the USCIS since. I finally called them yesterday and told them that the USCIS did not get back to me at least acknowledging the fact that they received my evidence. They didnt even write back to me and say Hey, stop sending this stuff, we'll ask you. The representative on the phone told me that it takes 5 months for a decision and could take another two at the National Visa Center. When I asked her who could I call in Washington DC about this misinformation they show on their website she told me I could expedite this case.
I need help, how do I prove to the USCIS that my fiancee do not have a place to live. I got an email today asking me for additional evidence. What else could I show them. Helppppp, pleasee:)


You will get a letter in the mail for what evidence they are looking for. As long as you have a proof in meeting within last 2 years which seems like you do. You should be fine.

On the other hand there is no missinformation it does take up to 5 month to approve petition. There are several options to expedite, and I am not sure if yours apply it.

And you only filed in August, normally the process take between 6 and 8 month. There are people that patiently waiting and filed way ahead of you.

My fiance and I filed our petition last June 22, 2011 and got our approval 84 days after that. We received the NOA2 and we got our MNL no. We know that we can able to schedule my interview and medical while I'm waiting for his income supported documents, etc. The problem is, he resigned from his job at this moment and still not securing any employment letter from his company. I don't want to call for schedule of medical and interview if I can't able to provide the said certificate.

1. Will this affect our visa application?
2. If we cannot able to get employment certificate, can we request for extension until he can find a new job?


Well most likely your fiancee would need to find a co-sponsor. This could delay your process.

It's just interesting why would he quit a job during the process.

Since you already filed. I assume they already took the money out of the account too, so you already have a case number. Don't worry they will not start the removing proceedings very next day. They have higher priorites for removing proceedings than people who filed for ROC later.

My fiance' had her interview in Manila on Tuesday. Said thinks the counsel said "approved" and gave her back the photos I had submitted with the I-129F. So now we are just impatiently waiting for the text that the visa is ready for delivery...I hope. I had heard about a "pink slip" that people are given if approved but they just gave her back her appointment letter with the biometrics stamp on it. Does anyone have this same experience? How many days did you wait until you were texted by the courier? Thank you for your response....


If they took her passport and she paid for the courier, she should be fine.

It might take about 10 business days before the passport with visa is delivered.

You need to fill out the I-134. Whatever you sent 6 month ago is somewhat outdated. You want to obtain most recent informaiton.

K-2 can arrive later and you can do AOS later. But note that there is an expiration date on K-2 visa, which will require her to enter US, prior the expiration. You can only adjust K-2 ones she enters as she needs I-94 in order to apply for the AOS.

Also 1-2 month is not enough to get an AP for travel. If she will leave US, prior to AP, it will mean she abandoned her status and the new filing will require, it will take longer as, only your wife to be could petition her daughter and it will take years before she will become USC and will be elligible to file, which my take another few years after that.

So just think what is the best for your wife to be, and her daughter.

I suppose any action is ok but when my husband called Senator Finestines office they said it would take a few weeks to process the request & a few more to get a responce. It took two weeks for them to have time to call USCIS. It then took 30 days for the good Senators staff the send the written responce to us. When they did they sent it to the wrong address.
Sending the info by fax is fine. Calling that afternoon is wrong because they will know nothing at that time. Give it a try & let us know what happened.


This is why you don't call a Senator, but call a Congressman. Congress is dealing with USCIS and not Senate. I've seen a lot of people going to Congressman and getting help.

I'm new at this and will be sending my I-129F petition for my fiance who lives in Japan. Along with other proofs such as airline tickets and photos, I am also planning to include our email correspondence. However they're written in Japanese. Would it be possible to translate the emails myself and signing my name that I am competent to translate or do I need to have someone else translate? I'm also including screen shots of calls using the Viber iPhone app. I would be very happy if someone could give me some info about this.

Just to send petition for I-129F, you will need only the proof of the meeting within last 2 years. Like boarding passes, pictures with dates, passport stemps. The rest of the evidence will only be needed during the interview stage and not required at this point.
