The requirement is 1 year for living in the foreign country and 6 month for current country where you are currently residing. If his country of nationality would be Quatar then you would need one, if not then you are good to go.

Read this carefully. "Police certificates from each country in which the applicant has resided for one year or longer. The certificate(s) must be issued within one year of the date of the visa appointment. NOTE: An applicant must present a police certificate from his/her country of current residence and country of nationality, if residence in such country exceeds 6 months"

The will not care about your status there. THe only thing USCIS cares about is meeting within last 2 years, it is embassy who will require proof of ongoing relationship.

I am somewhat confused you said you overstayed in Spain but your country says Columbia. So where your fiancee will get interviewed. Is she legal in Spain? if not she will have to go to interview in Bogota.

I have never heard or read anywhere that a co-sponsor in Manila is not allowed! This is incorrect, bad, misleading information and should be "ignored!"
Anyways, you will need to provide the USCIS proof that you meet the minimum sponsor requirements. The easiest way for you to do this is to include a "co-sponsor."

Usually Manila doesn't allow co-sponsors for K-1 visa, but they do allow for CR-1. OP you better off to get married in Philipines and apply for CR-1 with co-sponsor.

While I am in a different scenario, as I have all my taxes and everything. The CO even didn't look at all the evidence that my fiancee brought, but just took I-134. While your current income is the main driver and you are above the 125% of the poverty line. Just get ready that you might need a co-sponsor, better to find one now, and if you will not have to use it then great. But in any case you will have all your fronts covered.

The good thing Ukraine does accept co-sponsor, so you should be fine.

Doesn't seems like you have any proof meeting in last 2 years. You would need passport stamps, boarding passes, hotel receipts, etc... showing seeing each other since 2010. If you haven't submitted it, you will get an RFE, if you don't have it then it is a bigger issue, as they will not approve petition without meeting in last 24 month, while there is a waiver available, it is usually pretty hard to get thru.

So most likeley you will get an RFE for that. As far as naturalization certificate you probably will be fine, I only send the front, and never got an RFE.

Pictures is secondary evidence. They don't care about your emails from 8-10 years ago. What USCIS cares about that you've seen each other within 2 year time frame prior to applying. This could be anything like passport stemps, boarding passes, hotel reciepts, credit card reciepts. And remember pictures are NOT primary evidence. If the response satisfy the adjudicator the RFE usually getting processed within few weeks, and hopefully you will get approval after that.

What you can do and it will be legal by all means. She can come here get married, she will leave to go back to her country while waiting for a Visa. This way you don't have any issues. However it still will take about 10 month for a Visa. Pretty much you don't have really legal ways on doing it, so she can give a birth to child in USA. I would go with the safe route. Also you don't want her fly here, and then she can denied entry, because CBP may suspect something. Think first of your priorities. Do not play games with USCIS.

Even if your child will born in Albania, he still will be considered a US Citizen, you would just need to apply for CRBA in the embassy, to get a childs passport. So not a big harm here.

There is no way you can't get your fiancee here in 6 month. She will have to give a birth to a child in Albania. If you will apply now for a fiancee visa it will take about 6-8 month to get it. If you will wait till you get married in september and apply then for CR-1, you will have to wait 10-12 month since filing. So faster would be fiancee visa, then you will need to get married here.

On tourist visa she required to show strong ties back to her country, which will convince CO, that she will return. Being pregnant and having US fiancee will make it even harder, for a tourist visa.

Your check should be for $1070 which will include the I-485 fee as well as biometric fee it is all in one check.

Our plans are for her to reside in the USA - eventually. I do not know the term "AP". We are thinking as of now she will remain in her country for a least a year before making the permanent move. The objective for this year is to have the required visa to allow her in and out of USA without issue. I need to have a clear-cut plan of action as soon as she arrives for the wedding. I am not sure on the SSN requirement for my state (thank's for the heads-up).

If she will come on the K-1, you will need to get married and file for Adjustment of Status and Travel Document ("AP"). She will not be able to use a tourist visa, as she doesn't have one and they already so an intent for her to immigrate with K-1. Just get married in her country and when ready about 10 month prior to move file for Spousal Visa (CR1).

If she is planning to work in her country why are you filing for Visa now? After she will enter US and you will get married which could take about a month or tow as some states require SSN to get married. You will need to file for AOS with AP. To get AP will take another 2-3 month, then she can travel, but you don't want her to stay long in her country, as in order to obtain a GC she requires to maintain a legal presence in the USA.

There is really no way to change the form. I would call them ASAP and talk to them. Not sure what will be the impact but it may delay your case and you may need to refile. Since if you made a mistake on I-129 you probably made a mistake on G-325A as well.

I am not sure about the requirements for children, however I will answer you about the name change, as this been posted a lot and we have the same situation.

You have to make sure that you buy her a tickets on the name that is in her passport till she gets a US Citizenship or change her passport to reflect the her new last name (which by the way can only be done in Ukraine). So book the tickets on the name in the passport, and when she will be coming back she will use her AP with the marriage certificate.

Max I do not remember which line I went through, but all three visits there customs opened my luggage and they went through it. The first trip I had my lap top and brought an older one I had in my luggage for for Alla. When the bags went through the x-ray machine , they were on me like flies. Wanting to know why I had 2 lap tops, was it a gift and how much it cost, as they were having me open the bag with her lap top. I told them it was used and once they saw the scratches on it and the hinge damaged, they lost interest. :rofl: So which line should I go through when we go back???????

I always go thru the green line. Though what I do the things that might be interesting them, I put in my pockets, I understand that you can't put laptop in your pocket, but only one laptop is usually not an issue. As I said I had 3 iPhones, but they were all in my jacket, so I was never questioned, and I am pretty sure with the right bribe you can get away with anything :)

Red line. Air France lost my bag. I went to Lost and Found, not realizing that Lost and Found is operated by Customs. So they had me fill out a customs declaration for the lost bag (nothing to declare) then took me in the red line and the rest is history.


You are not the first person complaining about Air France loosing the bags, thankfully I have never used them, and never had issues.

If you trying to make a living in the US on those guidelines you really need awakening call. What is really interesting that the guidelines for 48 states are exactly the same. Well here is a reality. To rent a 1 bedroom appartment in Metropolitan DC area will run you about $1500-2000 a month. And even that is already above the minimum poverty just for an appartment. So guess what there are a lot of bridges, so you probably will end up living under one of them if you only make the poverty line and trying to raise a family. However you could find similar appartment in another state (Nevada) for only $600-700 a month. So where is the true poverty???

Just think about that for a second when you think oh I make 2K more than a guideline, so I can afford a family.

This reply is correct. The US government does not recognize dual citizenship. If you are a US Citizen, you can still be a citizen of another country at the same time. The US won't make you renounce the other citizenship, but they don't officially recognize it. Either you are an American citizen or you are not. As for whatever other passport you hold, that's your business.


Yes, sorry France and USA won't recognize the double nationality but they accept it. You can hold both passports. With your American passport you will be solely American in the eyes of the US government, and vice-versa in France.

I am worried, because as to everything I've already read on, everything says that it is the SLMCEC that forwards the passport to the embassy..But in my case was that, I was given back my passport.. My passport was given to me along with the vaccination worksheet and the cd..But then im worried what that might mean..is there anything wrong with the result? Will that mean , me not passing? is it really the case, that they're the ones to send along the passport? I have never heard that medical office forward the passport to the embassy. Embassy will ask you for the passport when you will go for the interview. Medical office have nothing to do with that, I don't think you need to worry

The petitioner should recieve the email from NVC about the case number, and then you the beneficiary should recieve the packet 3 from embassy.
