don't even think about telling them about the pregnancy, because they might ask for DNA test for the baby, meaning u will have to wait till the baby is born, to have the test done, and as u already know, this will take forever. Just pray that everything is done before she has the baby


Wrong. The medical exam results will go to the Consulate. Lying about that will cause problems.

The notarized statement from the USC father is an excellent idea and I would get on that post haste. Also, if the fiance is 9 weeks pregnant, there better be documentation that the USC was in Vietnam with her at the time she conceived. If not, a whole other can of worms is opened, so make sure your evidence of that trip is close at hand with the letter.

Actually I have to disagree on one point above. If the medical exam shows that the foreign fiancee is pregnant, and the CO suspects the USC might not be the father or might not know about the pregnancy, it could cause a delay while the CO confirms that the USC is aware of the pregnancy and still intends to marry the beneficiary. I'm not speculating here, as I have direct knowledge of such a case. I'm sure it depends on the Consulate, but it's better to be prepared. Just in case, I would give the fiancee a notorized letter from the USC stating that he is aware of the pregnancy, that he is the father, and he still intends to marry the fiancee. Anyway it will do no harm to have such a letter even if it's not needed.

I had a similar problem, so I called the consulate and they changed it. Just to make sure, I also emailed the change and sent a letter as well. After that it wasn't a problem.

If your baby is born in the Philippines, the baby will still be a US citizen but your fiance will need to register the child with the US consulate, as a "birth abroad", then get a US passport for the baby.

If she can get a CENOMAR in her maiden name the marriage probably wasn't registered.

Even if that is true, if she has been using her married name and it's on her IDs (passport, etc.) she probably is going to have a problem.

BTW, what name did they use on the I-129f?

This will be caught when you go to interview. Its why they now do the document verification. Women there will get a new name, birth certificate and passport to circumvent having to get an anullment. Your I-129 F is not valid and you cant put it on hold.You both were not free to marry when you filed so its not any good period. You will have to start it again after her anullment. Secondly the G-325A has information on it that is fraudulent now since she was not truthful on hers. You send in the I 129F under penalty of perjury that the information is true and correct. They will not take this omission lightly or that she has 2 birth certificates and has a prior marriage.

Thirdly why did she wait all this time to tell you when clearly this needed to be dealt with before you filed. That would be a MAJOR red flag on her.

You have a mess on your hands and its not going to clean up easily. My advice is to cancel the K1 before its process in manila and verified. Get her anullment and then reapply, possible with a K3 since you will have IMBRA to deal with filing 2 petitions within 2 years.

What you have here is serious and you need to stop the K1 before it gets worse.
Get her anullment, then reapply.

Anullments there cost and take time. Good luck...

Be advised that getting a new name, birth cert, and passport is sometimes used by women in the Philippines to avoid having to getting an annulment.

Your fiancee's friend is mistaken and your conclusions are correct. Your fiancee will be able to travel outside the US after she receives her green card which will probably be 3-6 months after filing the I-485.

US Citizen has a 10 year IMBRA hold that will need a waiver filed in order to file I-129F for another person.

Foreign citizen does not have such a limitation.

So we march on remembering those before us and truly truly feeling their angst but not their outrage.
The least we can do, for all the good that can do, is to say "this too shall pass"....
that ofcourse is easier said than done when the phone bills continue to pile up and the distance sometimes seems even further. Staying positive would be my approach once i am convinced that it is out of my hands and doing whatever else can shorten the process would also be a way to help ease the pain.

Today, VSC sent out an e-mail approving the K1 petition. We move onto the next phase and perhaps now i can begin to truly ask questions about a variety of stuff...I-134, NVC etc etc....

To the >100 club members, no words can make that big an impact but we must put it all in perspective...you know...Sudan; Katrina; Pakistan earthquake; Tsuanami etc etc...The delay you are experiencing may actually pale in comaprison to some of these events and the lives that are still reeeling from them. When next you want to vent, please pause and consider those other people...........

The I-129F states that I should include "original statements from you and your fiancé(e) whom you plan to marry within 90 days...".

I took original as meaning that we should write it ourselves rather than use the examples provided here. The problem is that my fiancee doesn't speak english well enough to write a legal-like statement.

Any recommendations? Should I just use the example letter? Should she write something in her language and get it translated?

I thought it might be good to use the example and then let her translate into her own words and language and include it under the body of the letter.

Thoughts? Suggestions?

Ya, it needs to be the original signed paper. The only thing it MUST say is that you intend to marry within 90 days of the beneficiary entering the US as this is a requirement for a K-1. Everything else is fluff, but it's a nice place to say really nice things about your fiance, how you met, what you have been doing since you met, how you feel about your fiance, etc. I cried when I read my fiance's letter, and she did too when she read mine. Vermont has always been quicker than the other centers, why is a great question. But now, CSC is handling 3/4 of the country for fiancee visa's. Both the Texas and Nebraska centers now forward their I-129F to CSC so that explains part of the delay and of course IMBRA explains a lot of the current delays. As to the random approvals, well CSC has a pretty weird track record right now. The best thing is to try and be patient. That sounds easy but it can be maddening and down right frustrating waiting for these people to do their job.

I know that when I and my new wife went for her green card interview, the file we had was quite extensive. They had stuff in that file I didn't even know we had done. Just remember all of your paperwork that was filed and multiply it by 10,000. That's about what gets sent to the USCIS centers every week. How else would you explain the huge backlog of applications.

About filing in Vermont if you live out of that region, well it has been done. But you will need a regional address that can be used for your filing application. I have a friend from a western state that filed with his mother's address in New York. His application was approved in about two months and in December he will celebrate his third wedding anniversary. So, it can be done but you need to be careful and have someone you trust handling your mail. How he got around the aspect of reporting financial ability without disclosing his actual residency I don't know. Maybe because that is presented only to the embassy and not the USCIS he was able to get away with it. But, the thing is, it can be done.


Hmmm, if you use an address that's not your real address that could be considered fraud and you could be denied just on that. Is it worth that risk?
