I spent a couple of weeks searching for an immigration law firm to help me out ... then I stumbled onto this site, read and re-read and re-re-read the FAQs, FORUMS, and GUIDES, and we have decided to tackle this process on our own. This is very exciting. Based on what I have read tho, I think I will take the $!800 I saved to hire a lawyer and instead get a gym membership to work-out the upcoming stress from all the waiting it looks I will be doing .....

So .... my very first question. I saw the notice that the I-129F Rev 5/23/06 will be accepted until 2/18/07. Since we are just starting to gather info for the initial petition, I seriously doubt we will be able to get this done by middle of next month. But the FAQ and USCIS links for the I-129F form still link to this old form ... where can I download a new post-2/18/07-acceptable I-129F form?


If you find the new one let us know, we're still looking for it. :lol:

Sometimes a woman in the Ukraine will tell her American BF that for enough money she can pay off the right people and get a tourist VISA. Then he sends the money for the VISA and the airline ticket, and poof, she's gone! :o

hello everyone, im just new here on this site, i finally can post my questions....Me and my US fiance is almost 2 years in relationship just through the internet, cards, letter and phone calls..
He cant be here because he suffers fear of flying.. MY marriage was annuled in September but i just got my annulment decree,, but its just confusing that the heading written there is CERTIFICATE OF FINALITY? Is it the same document needed for visa? Hopefully he can send the I-129F this week...
And one of my never ending question....
Is anybody around here can share with me the changes of my case, extreme hardship due to fear of flying and he is 57 years old..?

You will not get a hardship waiver for that. You have to meet him in person and you will not get a tourist VISA to the US to meet him so he must go to you. Maybe he can take a cruise ship? He could probably get hypnosis treatment for his fear of flying. Anyway if he loves you he will find a way to get to you.

I hate to even mention this but I have heard this excuse, that they are afraid to fly, from guys when they can't commit to a woman.

There are a lot of things about this process that are difficult or unclear but this isn't one of them. The specs for US passport/VISA photos are published and clearly-stated. Why do people insist on making make something complicated out of something that is simple? Seriously, if you are going to make a big deal out of something like this, what are you going to do when you have a REAL challenge? And, if you can't afford to get another set of passport photos, how are you going to afford the rest of this process?

Hi all. I just have a quick question as I am getting ready to send in my I-129F petition. In the official instructions about the passport photos that we have to submitt, there is no mention of the paper size that the photos have to be on.. but I guess standard American passport photos are 2"x2". However we already had ours done in Canada and they are 3"x2" and they weren't terribly cheap so I don't really want to have them done again. So my question is, do the photos have to be 2x2 (despite this not being in the official I-129F instructions) or will our 3x2 pictures be acceptable? I'd hate to get an RFE for a little thing like this.

And you do because you were not scrutinized for your 25 year age difference? :huh: :blink: If this visa process as described by all here on VJ hasn't demonstrated how "different" each case can be, then I'm not sure what does. The OP posted a question, seeking answers from readers. Some will have had "scrutiny" because of the age difference, some NOT. This is not a right or wrong type of answer and :lol: about other's answers will not make yours more CORRECT.

Hello all,

I have filed for the K1 Fiance VISA for my Filipino Fiance. I was there working for 5 months on business and we met and the rest is history. To make a long story short my Fiance was 2 months pregnant when I returned to the USA. When I filled out the application it asked for "Children" but it never did specify "Is your Fiance pregnant" hence I left this section as "None".

With that being said the due date for our child is August 2nd, 2007. I just received the receipt for my application today on Jan 22, 2007. They are stating on the website that my application has been sent to the California Service Center and is pending. The website is also stating that they are currently processing applications from July 17, 2006. I expect that our child will be born before the VISA process is finished.

Can you please advise what steps to take? Should I notify the US Immigration that my Fiance is pregnant? Will this adversely effect our ability to get her VISA approved? If her VISA is approved can she bring the newborn with her to the states or will we have to file another application?

Please advise as this seems serious! :D

First, ignore the processing date on the USCIS web site as it's usually way off and useless for anything except making you mad.

By the dates you gave I think it's likely that your child will be born shortly before the interview. The child will be a US citizen because you are a US citizen, but you will probably have to make another trip over there to register the child with the US Embassy. I believe the baby will able to travel on your passport and no separate VISA is required for the baby. Your fiancee's K1 VISA will probably be unaffected but she might be asked about the child.

In case you are about to ask if you can get an earlier interview because of the pregnancy, the answer is probably NO, unless there is some other medical reason to make it urgent. Just having a bun in the oven won't do it. :lol:

Yeah, really. Take care of the kids you've got before you go trotting off to a foreign country to spend money on a new girlfriend. Maybe he'll have to learn PATIENCE and wait until he has enough money to pay the child support and then get a passport. I agree it's going to be difficult for the filipina to get to Canada. Or anywhere for that matter. It's just a tough place for a person to get a travel visa.

Well, we all know he should pay off the child support first, but that wasn't the question was it? The the overdue child support was from many years ago, and due to a lot of financial problems over the years he just never was able to pay it off before. He's paying it down now but it's a large amount and it will probably take him like 2 or 3 years to finish paying it off. Do you think his GF will wait that long?

So, back to the original question. How can they meet?

Until Jan 1, 2008 US citizens can go to Mexico and Canada without a passport, right? Can a Philippine citizen get a tourist VISA to Mexico?

How about any other US territories? Puerto Rico?

I have been waiting for that question to come up. She has no telephone. We chatted for several months online before she borrowed her cousin's phone so that we could talk to each other. One of the first things she told me on the phone was " I am a male", no mention of a birth certificate, just " I am a male". You can imagine the things running through my mind. The following week we were chatting online and I just came out and asked. I could see her laughing on the cam. She promised me that she was born a woman. She then explained the birth certificate problem. I spent two weeks with her earlier this summer. I never really felt comfortable with the situation until I did my own extensive examination. Her daughter and C-section scar kind of put my mind at ease. Hopefully, we get this birth certificate fixed and the story has a happy ending.

So, if the applicant was convicted or court martialed for any of the crimes listed, then the answer would be YES, otherwise it would be NO. What's so difficult about that question?

It's probably better to at least let them know up front that you know she is pregnant and you believe that you are the father. I know of at least one case where the beneficiary tested positive for pregnancy at her medical exam. Since the petitioner didn't know about this, and hadn't been with her in a few months, and she wasn't showing yet, the CO suspected that the petitioner might NOT be the father. So ... the CO delayed the VISA until he got a letter from the petitioner stating that he still wanted to marry her. Apparently since the CO thought that there was a possibility that the petitioner was not the father, the CO didn't want to approve the VISA only to have the petitioner refuse to marry her after she entered the US if she was pregnant by another guy.

Please share how you packaged up your I-129F application.

I read the guides, and finally found a link that discussed using a two hole punch and a fastener to put it all together. I haven't done that yet, but I will go reformat all my documents to include room at the top for a two hole punch and go buy the fastener... If I really need too.

I was just going to send all the paperwork in one stack, with those sticky tabs as separators, in a manila folder, and put that in an envelope for mailing. Is that good enough? Any other suggestions for what has worked for you?

If you have 1.5 inches for a I-129F, you probably have WAY too much stuff in there and you're even more obsessive then I am (mine was about 1/2 inch). :lol:

IMO all this hole punching and ACCO fastening stuff is a waste of time and money. What's the point? They're going to take it apart, throw away the stuff you bought, and assemble it the way they want it anyway. :hehe:

I just grouped everything logically and used a few staples and paperclips. I put the loose photos in plastic zip-lock bags and stapled those to a sheet of paper.

I kept 2 extra copies of my entire packet - one with the original receipts, plane tickets, birth certificates, etc. and the other with copies of those. The one with the originals will go with my fiance to the interview in case they ask for any originals. We will also take additional proof of ongoing relationship to the interview, such as letters, emails, receipts, etc. which were created after submitting the petition.

All required signed forms and letters of intent to marry sent to USCIS must always be originals.

Make 2 copies of everything you send. Keep one of the copies in a safe place and give one of the copies to your fiance for the interview. Your fiance should also take proof of your ongoing relationship (letters, emails, receipts, photos, etc. obtained after petition filing) to the interview.

I'm done filling out all the forms and getting all the documents, now I need to assemble my packet.

I'm planning on going to Kinko's today and making all the copies of the forms and documents.

I just have a few questions about the assembly process....

When I send in my I-129F packet, do I send in the photocopied version or do I send in the originals?

When I'm making my tabs, do I need to make seperate tabs for mine and my fiance's G-325A or do I just make one?

Lastly, I heard that for all the documents like my birth certificate, fc-029, letters of intent, and attachment (basically all forms that aren't from INS) I should put a label on the bottom with I-129F original submission. I just want to know if I should or shouldn't. I've heard some yes's and some no's.

We stayed at the Lotus Garden and liked it. A couple of our friends did too.

It can be an issue if the CO at interview suspects that the USC is not the father (due to the evidence and timing of visits, etc.). I'm not speculating on this in fact I know some people personally that had this happen to them. The CO put the VISA on hold until he got a letter from the USC fiance confirming that he knew about the pregnancy and still intended to marry her after she entered the US.

If you mean it will take about a year to get her here on a K1 visa, that's about right, and now that the two of you have intent to marry and for her to immigrate, K1 and marry in the US or marry first and CR1 or K3 are the legal options available to you. If working is important immediately upon entry, then your best choice is marry abroad and CR1 visa.

Since you met her after she arrived, she could have stayed, married you and adjusted status but it's too late for that now.

That is incorrect. You have to show that you met in person WITHIN the last two years. You can apply right away if you have evidence that you met in Feb.

Once is enough to meet the basic requirement. More is better. You may get more questioning about your relationship if you only met in person once.

Why don't you see if you can talk him into visiting you again anyway? If he loves you he should be willing to do that for you. wink.gif

I suggest getting the SSN in her maiden name ASAP, before you get married. It's easy to change her name on the SSN after the marriage.
