My NOA1 was 7/18 and NOA2 9/18 and I don't have clue why i got it so fast. I've wondered if the "simpler" petitions go faster. I've suspected that divorces and such requires an extra pair of eyes or possibly different personnel/routing but I have nothing to back up my hunch. I can only say that mine was an "uncomplicated" petition.

Here are the details if it makes any sense. I have no idea if any of these have any affect, but here it is:

Used a lawyer for filing - she mailed the packet not me
IMBRA-complaint I-129F form
No divorces
No children
Ages 55 (mine) and 29 (hers)
No criminal record for either of us
Met on Cherry Blossoms Feb 4, 2006
My name is unique so name hits are impossible (I suspect hers is too)
Filed with TSC but forwarded to USC immediately
I made sure all the information was accurate (I delayed it 2 weeks correct some things)
All my forms were triple-checked by me, labeled in groups and arranged very neatly
I included a lot of stuff that my lawyer told me to but wasn't required until later
No RFE
The only touch was 10 days after receipt.
Oh, and our Statements of Intent were beautiful (they would make you cry, really)

I was notified of my NOA2 approval on 9/18/06. Today, I see that my "touch" date has updated to 9/19/06. That seems strange to me. Why did they touch me after I'm approved already? Anyone else notice their touch dates being updated after their NOA2 date?

The only thing that the Statement of Intent MUST contain is your statement that you intend to marry within 90 days of your Fiance's arrival, signed and dated. Everything else is fluff, but ... my fiance and I used ours to make a statement to each other and they are nice enough to make you cry. She likes to read mine when she's bored or lonely. (L)

I think they sometimes like to just throw curve balls at you and see how you react. One of the tools of investigation and security is unpredictability - it throws the subject off balance and if they're lying they make a mistake.

There has also been some speculation that over-documentation is a red flag for fraud. My statement of how we met was one line with NO attachment, "I met my fiance in her country on June of 2006". Of course I also had the photos, plane tickets, hotel receipts, as well as the receipt for engagement ring, emails, etc. and a Statement of Intent that would bring tears to your eyes. :D

I just sent what my lawyer told me, even though some of it was MORE then required (i.e. copies of my passport AND birth certificate).

I got through to the Embassy in manila. They said it wasn't a problem and I could send a letter or it could be corrected the day of the interview. I asked for the correct address to send a letter but then she said it really wasn't necessary and it can easily be corrected at the interview. She also said that this is a common problem at NVC. :wacko:

I called NVC and they verified that it's incorrectly spelled in their computer files so the Embassy will get the incorrect spelling as well. They said I will need to contact the Embassy to get this fixed.

Well I'm happy to see that I received a letter from the NVC stating that my I-129F petition has been forwarded to the Visa Unit at the Manila US embassy, but my fiance's name is spelled wrong on the letter. I don't know why they have it spelled wrong, as it's correct on all my forms. Is this going to confuse the people at the Embassy? Is this going to be a problem?

Hello to all and thank you in advance to all who reply.

Like everyone else, I am trying to make my petition as presentable as possible (this is an original submission). I bought fancy binders and made a really cool letterhead for our letters, indexed and tabbed everything. I put everything in those plastic binder inserts so that I didn't have to hole punch anything. Here is my concern:

I am afraid that the evidence that we have met in person within the past 2 years is lacking. I have read many posts recently wherein an RFE was received for more evidence of the within 2 years meeting.

My evidence consists of: (1) my fiancee's ticket from Russia; (2) a receipt for her return ticket to Russia; (3) copies of her J-1 Visa (stamped on her entry, but not her exit); (4) a copy of the page of her passport stamped on the date of her return to Russia; (5) a copy of her social security card; (6) her I-94 Departure/Arrival Record NUMBER (the actual I-94 was taken); (7) Two affidavits from the partners in my firm stating that they saw us together within the past two years; and (8) two photographs with hand written places and dates on the back. Is this sufficient evidence?

Of course, I am also including emails and telephone records. My concern with the telephone records is that the bill doesn't show a name or phone number - just the account number -- will that be a problem?

From what I have read, this is not the way to do this. If he wants to bring her to the US as a Fiancee, he needs to go through the K-1 process. If he wants to bring her here as a wife, he needs to marry her then bring her here on a K-3. Bringing her here on a tourist visa (which probably has a low chance of success anyway), marrying her then filing for a K-3 is definitely frowned upon by the USCIS. He will probably end up either (1) married to a woman who is an illegal alien or (2) married to a woman living in Malaysia who has a very hard time getting a K-3 visa or (3) filing a K-1 after a failed tourist visa attempt and trying to explain that in the petition and at the interview (this is the most likely outcome and it will at least delay her arrival in the US).

I am no expert on this, it is only my understanding from what I have read. If he wants to marry her, he should choose either the K-1 or the K-3 route. The tourist visa is not an acceptable alternative or shortcut.

If she really came here on a tourist VISA with intention to marry, that would be immigration fraud and she probably knows that. It's likely a scam to get the money for the land.

He should go there for a visit, then do a K-1 or K-3, or nothing (probably the best choice in this case).

Hi everyone,

I have a question about sending documents to our fiance (I'm the USC). I will be attending the interview with my fiance whenever that may be and so I figured that I don't need to send all those documents (affidavit of support, proof of relationship, etc) to my fiance because I can just carry it with me on the plane.

This would be safer and since I'll be there a couple days before the interview we'll be able to organize everything together and I'll know FOR SURE that everything has arrived.

What do you think?

:crying: My fiance applied my K1 to TSC in June, 2005. It got the effect of hurricane.( I guess) So my case was transferred from TSC to CSC. It nearly took 7 months to arrive to NVC. We got assist from CIS ombudsman, so my case can arrive in NVC in the end Mar., 2006. I can't believe it have been staying in NVC for another 7 months. Every time, he is told the case has been investigated by Washington agencies. I don't know what we can do apart from waiting. We have hired a lawyer, but the lawyer was so so incapable. Who can tell me which agencies I can look for to help us? It should send to Guangzhou Embassy within 1-3 months. But it is still in USA. Why my case is so unfortunate? When can we get together? I hate to even ask this, but are you sure your fiance is being honest with you? I'm sorry to suggest anything here but I've heard of cases like this where the guy isn't totally honest with his fiancee. Have you spoke to the NVC yourself?

A birth certificate is a requirement for a K-1 visa, I do believe.


The way I got the story, she got a new BC, baptismal, passport, and CENOMAR with the new name too. :o

I guess they don't have anything like a SSN number there, so maybe they can get away with that, but it seems to me that it would be fraught with peril.

I just heard of the case of a legally woman in the Philippines changing her legal name so she could get a K1 VISA. She didn't want to wait for an annulment which can take a year or two. By changing her name, she is shown as unmarried in records so she get a Certificate of Non-marriage and can get a K1 VISA. How can she get away with this? #######, isn't there a place on the USCIS forms for "other names used"? If her fiance knows about the previous name and lies on the forms can't he be in legal trouble well beyond the denial of the petition and VISA? If it was this easy, why don't all married women in the Phils do this rather than waiting for the annulment? #######, huh? :blink:

As other poster's have noted, the consular section in Morocco can be difficult - it's a high fraud post.

You have 4 children and your fiance is a student...... I think you should worry less about which K visa is 'faster' and worry more about how your fiance is going to demonstrate that his interest in you is more than a ticket to LPR status. Find an immigration attorney who has experience dealing with the consular section in Morocco and review the details of your situation with them.

We have known each other a year. I did not agree to marry him until June. I was given the choice where I wanted to live...in Morocco or in the US. As I am an only child and the only grandchild that grew up near my grandparents (they are getting older and are ill) I picked living here at least as long as my grandparents are alive. I have chat logs from June until now saved. I doubt after reading then anyone can doubt that there is a relationship there. I could be wrong though...Plus there are letters and the relationship that I have with his family there and here. My relationship with his family is one of the reasons we are as we are. Between our families and our religion that is what brought us together. I don't know how you explain that to someone, or show someone on paper that. And I guess I didn't expect someone here to think he had bad intentions toward me. The funny thing is he says he will wait however long he has to wait for us to be a family. I cry because my daughter woke up crying the other night thinking he would never come. So it is me that is more concerned with how quickly he will get here.

IMO you need to get a thicker skin to hang around VJ and to get a K1 or K3 VISA.

Forget what YOU think your chat logs show. The only thing that matters is what the people at USCIS and the foreign Embassy think about your relationship, so you should try to think like they do.

Keep reading these forums, and be patient. They don't call this site VISA Journey because it's easy or fast.

Hello everyone...

I am leaving to go to Morocco in 10 days. I was originally going to get married then, I started reading here how long it takes to get a spouse into the US. I sat and cried for 2 days. I have 4 children and they are very attached to him. They talk to him online and on the phone. They mail him things and such, so there is no way I can imagine making them wait that long. It is hard enough for me to wait that long much less children. That is when I noticed that if you apply for a K-1 it seems to take a lot less time then a K-3. Can you tell me if what I have read is true? Will it be a shorter time if we decide to go the way of K-1 instead? If we do, can you tell me is there anything I need to do while I am there. I feel so lost....as everything seems to be changing at the last minute. I am overwhelmed, scared and lost.

He lives in Casablanca and is a student. He has family there and two brothers here. So he has family both places. Do they consider this a risk when issuing a K-1? I live in Missouri. How do I tell what the time length is for the K-1 in my area?

You should look at the Guides on this site, they're pretty informative.

You can check the timelines yourself, but I think the K1 and K3 are running about the same length these days, with the K1 being only slightly shorter. If you get married on your trip there you will have to do a K3.

If you decide to go for a K1, make sure to get photos of you together on your trip, and save all your trip receipts, boarding passes, everything! For the K1 you have to show evidence that you met within 2 years.

Since you are just going there now, plan for a total 1 year journey. You might get lucky and do it in less.

I don't think his family situation is a risk, if he never violated any any immigration laws.

I am in the initial stages of getting a girlfriend to the US. We met on line and she and I want to proceed. I have read a lot of info on the net, but I am confused by all the information. It seems that the K-1 visa is the Fiancée Visa. But I did read that the fastest way is to for my Fiancée to apply for a tourist visa and then apply for a change of status. I could go there to meet her as required, but the expense and time away from my job to go to the Philippines would make things tougher than necessary. Besides, if she came to the US, we could spend more time together to see if how things may work out. But I also read that if the intention is to come to the US on a tourist visa, with the intent to marry, the visa will be denied.

I hope someone can help me with this confusing process.

She will not get a tourist VISA. You need to do a K-1 or K-3. If you can't afford to go there at least once, you won't be able to afford the whole process.
