K-1 Fiance(e) Visa Process & ProceduresInitial packet questions

Greetings,

I have gathered almost all of the elements for my initial petition which I am planning to mail next week. I have a few questions:

1. How do I represent contract work? Do I only need to include employment, or do I need to add self-employment/contract work (where I work for myself and am not the employee of another company)?

2. I have worked multiple contracts at once, and currently work for 2 employers. How do I present this on my petition? (The form itself asks for an "ending" date for the second job listed -- can I write in "Present"?)

3. I took photos with my fiance when he was here in July, but my digital camera didn't have the date setting on so it didn't "stamp" the date on. Can I just write the dates on the back and is that acceptable? Or is there a way to add the dates to the photos? (Obviously this would not be fraud since they would be honest and correct dates for each photo.)

4. In my letter explaining how we met and detailing my supportive evidence, do I need to talk about how we first met (online) and courted? Do I need to include any personal letters (I have many if needed, handwritten ones as well as email.)? Or do I just need to keep things simple and say we met online at this time, fell in love, exchanged letters/gifts etc. and met in July and so forth? How much detail should I include about us? Do I need to put in our shared interests and such?

Thank you for your help.

Mairzy

1. How do I represent contract work? Do I only need to include employment, or do I need to add self-employment/contract work (where I work for myself and am not the employee of another company)?
I would suggest listing this as "self employed".

2. I have worked multiple contracts at once, and currently work for 2 employers. How do I present this on my petition? (The form itself asks for an "ending" date for the second job listed -- can I write in "Present"?)
I would list both jobs, and yes the end date for current job is "present".

I wrote the date and location on the back of my photos.

4. In my letter explaining how we met and detailing my supportive evidence, do I need to talk about how we first met (online) and courted? Do I need to include any personal letters (I have many if needed, handwritten ones as well as email.)? Make sure you state that you "intend to marry within 90 days of arrival in the US" as this is a K1 requirement. Everything else is fluff, but can be used to make a picture of a serious relationship in the eyes of the reader. My advice is to just say what's true, no BS.

K-1 Fiance(e) Visa Process & ProceduresLast Minute Panic

For months I've gathered all the evidence I need, researched my heart out, taken the most care I could to ensure my initial I-129F packet would contain all the needed materials in their proper form. Here's the problem...

I went to the copy shop today to do the copying of the whole packet, hoping to send it off tomorrow before Labor Day weekend. This has been delayed so many times so far because of little snafus, and I found another potential one day.

When I went to copy my fiance's G-325A, the bio sheet, it was only then I realized he'd printed it on old paper, yellowish and very light weight, almost the kind used in old typewriters!!! My heart just sank because it's all signed and dated, and my fiance' is now back in England [He filled it out here, I should have kept an eye on him, I swear]

I looked on the USCIS website to try and gain whether this type of paper will be a problem, if they'll refuse it or not for a detail like that. Does anyone out there know? Should I give it a shot as is? Or do you think the best thing to do would be taking another delay on the chin and requesting he reprint, and fill it out anew even if I have to wait another week or so?

Any help would be so appreciated as my stomach is in knots.

Well, I don't really know for sure but I suspect if it's clear and readable it should be OK.

K-1 Fiance(e) Visa Process & ProceduresLetter of Intent to Marry Within 90 days of Admission

I wish I knew about this website before we filed our I-129F fiance petition. Our reading at the time we both were filing the form is that we would be submitting our letters of intent, i.e., my finacee and I, 90 days prior to her entering the states. Given our interpretation, we did not file it along with our petition papers but rather thought we will send it later when asked. Well knowing this websie and the informative guides, FAQs, etc. on visajourney.com, I realize we should have send it out. :crying: Now my question from my fellow petitioners or those who have gone through the process, should i send out a letter with the letters of intent. or should I wait for a RFE letter in the mail? I already have a NOIA. My Notice of Receipt was dated August 15, 2006.

sory to hear that... this is just my opinion so i might be wrong but i think you should wait for an RFE if they will request for u or not (hopefully). coz if you send it now w/ out them requesting it and knowing the files/cases at the USCIS are tons and tons of piles, it would probably be lost or they wont give any time to find your case and match it w/ letter the of intent... just my 2 cents... but good luck

well we had the great news this weekend that my partner is a few weeks pregnant!

Im sure i have seen similar posts to mine before, but being pregnant is not grounds for having the case sped up is it?

i didnt think it was, but if anyone has any info either way, it would be appreciated as obviously my partner is pretty sad at the idea of going through X months on her own.

hopefully though ill be approved in time to come over for the last few months and to see the little monkey pop out into the world :D

K-1 Fiance(e) Visa Process & ProceduresI'm so sorry!

I’m so sorry for all of you that have had to endure additional time and stress because you were not allowed to hear how I handled my petition.

Today I received my NOA2, my Petition was approved. I filed in May, with the old form, and I never received an IMBRA related RFE.

I did include in my Petition extra documentation, and I wrote on this forum what I did, and why. However, it seems others do not want to hear something that is “different” from their own narrow way of thinking, and saw fit to delete everything I wrote.

Once, again, I do feel for you, but as for me and my family, we are going to celebrate, as we are approved and are now only waiting on Moscow!

I wish I could say thank you to this forum, but I can’t, it has not been helpful.

I wish the rest of you, God Speed, and please, hang in there, eventually you will get results.

K-1 Fiance(e) Visa Process & ProceduresK-1 Passport Question

Some of my primary evidence of having met includes passport stamps. Should I copy my whole passport, or just the biographical information and the relevant pages? It seems a waste to send 12 pages of copies when only two of them will have stamps.

I am using my birth certificate to certify citizenship, so I have no other reason to copy the entire passport.

Suggestions?

On my lawyers instructions, I sent my BC and copies of passport bio and stamped pages. I don't know if it's right, but I haven't gotten an RFE yet. I think some people are getting away with that while others are getting an RFE to send ALL passport pages.

My fiance is having trouble getting a copy of her birth certificate and may take her up to 2 months to get. Do we need it to file I-129 or is it needed when the packet goes to the consolate in Manila? Thanks in advance!!

I think the I-129F requires a passport or BC, so you are going to need at least one of those. Since she will need a BC to get a passport anyway if she doesn't have one, you're kind of screwed until you get the BC.

I suggest getting everything else ready now. Then when she gets the BC you are ready to roll!

K-1 Fiance(e) Visa Process & ProceduresOther Things Needed For I-129F

Hi Everyone! I would like to know what are the other things I needed to send to my fiance before filling the I-129f... aside from the G-325a, passport pic, letter of intent to marry, proof of singleness?

Do I need to send our hotel receipt here in my country and all other receipt , my birth certificate, nbi clearance? or i just need to reserve it for my interview? Much of thanks to everyone! ;) Good Day...

I sent with my I-129F:
Copies of hotel receipts
Copies of restaurant receipts
Copies of airline tickets and boarding passes
Copies of airport taxi receipts
Copy of engagement ring receipt
Emails (10)
Photos of us together with date and place written on the back (5)
Copies of my passport and birth certificate
Copies of her passport and birth certificate
(and probably some other stuff I forgot)

Keep a copy of everything you send and keep the originals together in a safe place.

K-1 Fiance(e) Visa Process & Proceduresand Photos...

I have exclusively digital photos with no dates (can't stand them messing up a picture) - in various recommendations I've seen most mention of having the photos printed and putting the info on the back. Sure I've done that. However, what's wrong with color laser printing them, say 2 to a sheet, captioning each photo with who, when and where? On my color laser it looks like a color copy you get at the local office supply store. That way the pics are not loose, but organized and part of the package fastened together.

thoughts?

I think you have too much free time.

Someone else did a spreadsheet showing about 88 approvals in the first 2 weeks of September. That's 176/month which is close to your estimate of 142/month. If these estimates approximate reality, the VJ estimate is VERY pessimistic, by a month or two.

Hi All. I just got my NOA1 via email 8 minutes ago:

Receipt Number: WAC0xxxxxxxxx

Application Type: I129F, PETITION FOR FIANCE(E)

Current Status:

This case has been approved. On September 18, 2006, an approval notice was mailed. If 30 days have passed and you have not received this notice, you may wish to verify or update your address. To update your address, please speak to an Immigration Information Officer during business hours.

There's NO need to congratulate me at all. I didn't post this to gloat or to pour salt on those who are still waiting from March or April or May. I am sorry to those folks who have waited so long. I sincerely hope you get your approval very soon. Again, NO need to congratulate me.

I posted this message to offer statistics and to give some hope to CSC petitioners that it's getting much better at CSC now. My approval from CSC took around 55 days. I really can't ask for more from CSC. I filed directly with CSC.

Best wishes to everyone else at CSC! I hope you all receive your NOA2 very soon in the future!

Cheers!

K-1 Fiance(e) Visa Process & ProceduresJuly approvals in one fell swoop

Just a guess, but here goes.

Suppose CSC gets evaluated on average approval time, just as VJ measures. They've approved lots of March/April/May people in the last few weeks, as they should. But it means their average wait unitl approval time has gone up dramatically, especially compared to Vermont. How to get it down fast? Approve some of the straight forward July applicaitons on the new forms.

Then once their measurement date passes (who knows when), maybe they'll go back to the NOA1 date, they way they should have.

The idea of putting new staff on straight forward cases also sounds reasonable to me.

Tom

There was a bunch of us June NOA1's who had used the old pre-IMBRA form but never got RFE's when they seemed to be bulk mailing them. Since there were some who got RFE's despite using the new forms, my hunch is that CSC designated a cut off date in June sometime (12th?) and assumed any petitions received after that date used the new forms which explains why we never got an RFE. Then, for awhile there, it seemed they were consistent about approving only the petitions that were affected by IMBRA (March - June).

Looking at Gary's latest table on approvals, there's only a handful here on VJ that are left from March, April and May. Then this weekend, several of Juner's got emails stating that an RFE was mailed to us. Perhaps, they are really down to July petitions left that they know for sure were filed using the new form?

Ya, that's a good theory and you could be on to something there.
garya505Not TellingPhilippines2006-09-19 20:36:00
K-1 Fiance(e) Visa Process & ProceduresJuly approvals in one fell swoop
I have another hunch that what has happened after the IMBRA fiasco is that they have been unable to keep the petitions in order for processing. They may have added (or transferred) a bunch of new people on at CSC and the petitions are being given to these new people in batches, the batches are out or order, and if there is anything "extra" like a divorce decree to be examined then a petition is passed to another, more experienced person to check the documents.

But, these are just hunches and I could be full of ####### (again).
garya505Not TellingPhilippines2006-09-19 15:30:00
K-1 Fiance(e) Visa Process & ProceduresJuly approvals in one fell swoop
My NOA1 was 7/18 and NOA2 9/18 and I don't have clue why i got it so fast. I've wondered if the "simpler" petitions go faster. I've suspected that divorces and such requires an extra pair of eyes or possibly different personnel/routing but I have nothing to back up my hunch. I can only say that mine was an "uncomplicated" petition.

Here are the details if it makes any sense. I have no idea if any of these have any affect, but here it is:

Used a lawyer for filing - she mailed the packet not me
IMBRA-complaint I-129F form
No divorces
No children
Ages 55 (mine) and 29 (hers)
No criminal record for either of us
Met on Cherry Blossoms Feb 4, 2006
My name is unique so name hits are impossible (I suspect hers is too)
Filed with TSC but forwarded to USC immediately
I made sure all the information was accurate (I delayed it 2 weeks correct some things)
All my forms were triple-checked by me, labeled in groups and arranged very neatly
I included a lot of stuff that my lawyer told me to but wasn't required until later
No RFE
The only touch was 10 days after receipt.
Oh, and our Statements of Intent were beautiful (they would make you cry, really)
