I assume they just mean the email confirmation you get, which says you've paid. I am sure I've read from others that is what they took to interview. Gmail is blocked here (I'm at work) so gonna take a peek when I get home tonight as I paid mine this morning also.

 

 

Yeah I'm pretty sure that's all we need. I just wondered because the way they talk about 'The MRV fee receipt' makes it sound like some mystical hand written scroll.

Your reply is mostly useless. Your comments on falling in and out of love have no bearing on the reality of my situation. I will NEVER travel to another country, I am a disabled vet. And just because I survived prior to meeting her does not mean it would not be a hardship to go through a long separation now.


She has to depart, do not petition a k1 until the first one is officially
cancelled, or it will likely show 2 petitions, once she enter that visa
expired, with no marriage she cannot adjust by any other means
 
Take this time to take pics showing you in a relationship now B4
she leaves, go visit her in her own country once, and take time to
know her its not an overnite thing....ppl don't fall in & out of love at
the drop of a hat....there may be some scrutinity from uscis
 
No hardship waiver is in the mix and they would ask how U have
been existing, It'll definitely be longer than 6 mths

HMMM. I searched the USCIS website but I could not find any information on their "stinkeye" policy.

Her K-1 visa expired the day she entered the U.S. Her I-94 allowed her to remain in the U.S. for 90 days. If her I-94 expired yesterday, then she is now an overstay. She has no way to stay in the U.S. and adjust her status because she did not marry her petitioner.

She needs to leave the U.S. She also needs to have her petitioner withdraw the petition. Once the petition is withdrawn, then you can petition her. Your petition is going to get the stink eye at the Embassy because of her back-to-back petitions and because of her overstay.

There is no ban for an overstay of less than 180 days.

 
If her previous petition has been withdrawn by the petitioner, then you can start filling out the paperwork and having her sign the things you need original signatures on, yes.  However, she needs to leave the country immediately or else she's overstaying and will receive appropriate bans.

Thanks. This is very helpful. Just needed to know if we could start the application process here. I am hoping we get an interview date within 6 months, theat way she only has to return to the Philippines for a short time.

Does anyone know if a hardship waiver might apply in this case. I am a disabled vet and her leaving for an extended period of time will be an extreme hardship for me.

You cannot renew the K-1, and you cannot adjust her status.  The K-1 is very restrictive, and by not marrying the sponsor she has NO path to living in the US legally without leaving first.
 
She needs to leave the US and you need to file for your own visa for her.  You can start the petition process now, while she is in the US.

Her K-1 visa was cancelled the second she entered the US at her POE. The K-1 visa is a one-way, one-time visa. She had 90 days to get married to her USC petitioner. My woman came the the USA from the Philippines on a k1 visa. She did not marry the sponsor. Her k1 expired yesterday.
Now we have met, we want to get married. She is living with me in the USA. She will stay less than 6 months so she does not incur a 3 or 10 year ban. We want to apply for a new K1 visa. Can we do that while she is still in the USA? We know that she will have to return to the Philippines for the consular interview.

So I've gotten pretty far with the help of the amazing guides here but I think I've hit a brick wall. I'm the alien fiance and we're through the US petition side of it and I've received a letter from the consulate in London telling me to get my police certificate and so forth. The four month deadline before expiry takes me to the middle of Feb so I'm pretty eager to get an appointment for the interview sorted out in advance because we're halfway through it already. Anyway, the issue.

 

When I try to make my appointment on the https://ais.usvisa-info.com/ site (where it took me to fill in my DS-160) I first need to add an applicant and K-1 is not on the list of visas they do there. When I bring up the list of NIV visas on that site it gives me the following.

No K there. But it was reading this http://travel.state....types_2994.html and in particular this

  • "Complete Form DS-160: Your fiancé(e) and his or her children must each complete Form DS-160 to apply for a K1/K2 visa. Go to ceac.state.gov to complete the DS-160. You must: 1) complete the online visa application and 2) print the application form confirmation page to bring to your interview."

that got me there. I went to that site, as instructed, and I filled out my DS-160 and I have the confirmation page to bring to my interview.

 

However I don't have an interview appointment, nor any way of making one as far as I can tell because the appointment system doesn't cater to K-1s.

 

I feel like perhaps I want a DS-260 or to use the immigrant visa form but the guide was pretty specific that K-1 was a NIV and I should fill out a DS-160.

 

Can anyone tell me where I've gone wrong?

Thanks for all the helpful replies. So I can potentially apply for Advance Parole simultaneously with an adjustment of status so the question really is how long will it take? Are there any guides or helpful timetables on here that narrow it down beyond up to 90 days? The date of my wedding is still flexible so if we're talking say, 40 days on average, it could be adjusted to make it work.

I have a friend's wedding in the UK that I hope to attend which will, unfortunately, fall after my wedding but before any change of status paperwork can get done. What this means is that I'll be leaving and returning to the US while still on a K-1, albeit only for a weekend. Is there any reason why this should be a problem? I'll be returning before the end of 90 days after my initial entry to the US so in theory I should still be able to return even if I was not married but I thought it was worth checking there wasn't some "one entry to the country only" limitation on the visa.

SO received 2 shots and 1 blood sample, and was told to come back on Nov. 19th for a personal evaluation, and 4 more shots >.< its going to cost another 1000php ontop of the 214$ we already paid still. Has anyone ever been through this and if so what does it consist of?

I can get all the way to the point where they ask for the passport number and case number, etc. ( can't proceed further because i don't have case # yet).

I do find it odd that it's a .COM website and not a state department or USCIS website (.GOV, etc.).

Yeah man, very frustrating that they implement these new things that don't work effectively. The passport #....? WHO's passport mine or hers? Case Type Number??? What is this.. little more detail on where to obtain this number.. in our case it would be typical the number starting with MNL.. going to save us a headache and just call the contact number they have for out there.. i will post in a few minutes about the information they give us.. >.<

The e-Census (www.e-census.com.ph) calls it a CENOMAR, Certificates of No Marriage. According to its website CENOMAR (Singleness)



A Certificate of No Marriage Record(CENOMAR) is simply what its name implies. It is a certification issued by the National Statistics Office (NSO) stating that a person has not contracted marriage. The NSO is the central repository of among others, marriage records in the Philippines. It receives copies of marriage certificates from local civil registrars pursuant to the duty of the person solemnizing the marriage to send the duplicate and triplicate copies of the marriage certificate not later than fifteen days after the marriage, to the local civil registrar of the place where the marriage was solemnized.

So, saying that... "Advisory of Marriage is the same as a CENOMAR", is not entirely correct sir.. To make your statement correct and have a point.. a CENOMAR CRS FORM 4 IS FOR THOSE THAT ARE SINGLE, and A CRS FORM 5 - ADVISORY OF MARRIAGES. TECHNICALLY it would be two different forms. IF someone goes into a NSO office and ask for a CENOMAR what do you think they will give them? A typical CENOMAR CRS FORM 4. NOW if someone goes into a NSO office and asks for an ADVISORY of MARRIAGES(for those that are married) what do you think they would give them then?! You got it.. CRS FORM 5. So when you say things like

This broad statement would confuse people going through the visa process looking for the correct answers. Here is another example of what your above sentence should read.

To sum this 1-on-1 up. For anyone going through the process please ask for a CENOMAR(for cases where your on a K-1 visa journey) or ADVISORY of MARRIAGES(for those going through IR/CR-1 visa journey.)

Well I think countries may differ.. Philippines informed my wife she can get a Cenomar if she was single OR an Advisory of Marriage since she is married. Since we aren't in the "province," how long it takes doesn't matter, she isn't going to travel to a province to get a Advisory of Marriage because others may be able to bribe someone for a faster service(if that applies.) We asked for an expedited service but they don't offer it.. 5 working days only. If this applies to anyone just heads up.. 5 days before the interview is a good thing! not 4 like us :P

For the future for anyone going through this part... they dont offer a "CenMar" at the NSO in Manila ... its called "Advisory of Marriage." You cannot obtain this document any sooner then 5 working days, per policies from the NSO in Manila.

. For my wife it was less then a day to pick up the cert. As for the visa you will need a good explanation as why your requesting the pick-up at the embassy in 'most' cases. Frequently beneficiary receive the visa in 3-5 day.

Thanks and comes to find out we need one titled "Cenmar,' I guess a NSO stamped copy of the marriage certificate isnt good enough as well as her Cenomar (Dated 8/2009) for the consular. I ordered 2 copies of the cenomar one in her maiden name and one in her married name, i dont think its going to get there in time for the interview though, so I guess we are going to go there, see what they require and go from there, if they require this EXTRA documentation then at least it will be there a day or two after the interview so we can easily submit it right away........ and I wonder if they have the option to allow her to just pick up the Visa instead of waiting for Air21 to deliver it..? what happened to me is I kept tracking my visa every single day since nov. 23 I even call to their hotline
but they keep telling me that my visa is still in the embassy and they haven't forwarded it yet but when I call
Nov. 25 9 am they still said my visa still not in their system yet so I asked them if their system is updated they say yes....
then nov. 25 11am a courier from air21 came to deliver my visa hehehe.... funny right??? i think their system is really upated hehehe

sweet thanks.. yeah they changed that Dec 1st i believe.. when I try and go on the site you provided it gives me an option to track my passport/visa but they are asking for this :

AWB or CN No. is the 9-character document number at the upper right
corner of the AWB or CN form

hmmm confusing non the less.. i also tried going to "www.ustraveldocs.com/ph" and they ask for passport AND a UID number.. thats real confusing they really dont make this that simple. Embassy hotline is always busy. :wacko:

hey I know this is a concern of yours for the child to possibly be born in Philippines, to be honest with you, its not a long drawn out process, it costs about 205$ for a crba and the child's passport. IF you are a US citizen and have the proof to back it up then the child is an US Citizen. Me and my wife are going through that with our son who is 4 months old and born in the Philippines.

Well.....what a mess (but hopefully not!)

My wife flies into Manila tomorrow (arrives at 2:10PM)

Will be at the CFO Office by 3pm (they close at 5pm)

Flight bound for Germany leaves at 8pm

The big question...

Will 2 hours (3-5pm) be sufficient time to get the CFO Guidance and Counseling Certificate and sticker (if they give her the sticker.....because she is traveling on SOFA card, not a Visa).

She already has attended the seminar. She just needs to register and get the next certificate and also the sticker....

Please tell me we'll be ok??????



Well, its cutting it pretty short on getting there, and getting back to the plane in time for the flight. I am not saying its impossible but me and my wife would be there all day due to heavy lines of people waiting for the same thing or other business.. I do wish you luck on that :/

You know, we are near the point of an interview date. I have to clear up an EASY RFE before our case goes to Manila. I had asked them how soon do interviews go out after they receive the case at the Embassy. The polite lady told me that at the end the month the Embassy tells NVC how many interviews they can schedule. This may not tie into your question but a little helpfulness :) I hope you get one soon!
