Hello- I am new to the forums,

I have a question when it regards the question "How did you meet," in the immigration interview. I met my wife through my best friend of 10years+ he is married to one of her sisters that was adobted and brought into the US at a very young age.. of course now she is 22. Me and my wife started to talk about 2 1/2 years ago as friends and then things blossomed to us getting married.

When it comes down to the question and if we give them the answer of "We met through his friend who is married to my sister in the US," is that setting us up for a skeptical response to "Did you get married for immigration reasons."

I feel honesty is the best policy but @ the same time I dont want to raise an eye brow. We have a child due in June 2010, so I mean there are ties with us to show that it isnt just about immigrating as to why we got married. Any opinions. Thanks

ok im not understand that part of the process.
here is the issue.my fiance did not have the required income to file for taxes in 07,in 08 and 09 however,he was well above the 100% poverty guidelines ( he is in armed forces,so it wont be 125% for us ).
how can we deal with that?i do realize that they will require only 09s tax returns and detail,but it just seems like too many people are getting 221 g because of the entire 3 years income.
would we need a sponsor?would it be a problem?



Most recent is the embassy only caring about the most recent tax year. paycheck stubs within the last 6 months, letter from employer should work. 221g aka RFE shouldn't be an issue if he is showing stable income and meets at the 100% poverty line in your case. It can also be based on the interviewer/conslt. goodluck to you guys

The US embassy website for Manila has this in their required documents for the interview day.. im pretty confused... we are CR1 visa and this says this about having to bring an AOS.

"6. EVIDENCE OF FINANCIAL SUPPORT. Applicants must provide evidence that they will not become public charges (that is, dependent on government welfare and assistance).
? Form I-864 Affidavit of Support for visa applicants in the IR, F, certain E visa categories, and following-to-join employment (E) applicants complete with copies of the sponsor’s U.S.federal income tax return (Form 1040) and wage statements (Form W-2s). The petitioner must provide an Affidavit of Support even if he/she does not derive any income and even if a joint sponsor’s Affidavit of Support will be providing all of the actual financial support"

Good morning everyone. Well, me and my family are near the end of the line with our "Visa Journey." We have an interview on December 6th for the CR1. So, going over the required documents for this interview step, I read that we would need to provide an AOS. I already sent one into NVC and the list of documents they sent with the interview letter shows its been received, why would I need another one? And has anyone not brought an AOS to the interview and was it ok???

If NVC acknowledges my AOS and it clearly states on the letter, has anyone NOT brought the EXTRA AOS? seems redundant.

I believe your wife is finished with the psych stuff. I agree with godsgift, I think it's only the beneficiaries who had their marriages annulled based upon their psychological incapacitation who are required to undergo the more rigorous psych test. The doctor at St. Lukes would have told your wife already if she were required to undergo more psych testing.

However, your wife is still not in the clear. When she returns to St. Lukes, that's the time when she will learn whether or not she will be required to return three days in a row to leave sputum samples. If the doctor found any abnormality on her chest x-ray, she will be required to return to St. Lukes three days in a row to leave sputum samples. The sputum samples are used to perform a TB smear test and also a TB culture.

If this happens, then she will learn the results of the smear test after a few days. She will learn the results of the culture in about eight weeks. When her culture results come back negative, then she will return to St. Lukes for her immunizations, and St. Lukes will reschedule her interview.

On the other hand, if her chest x-ray is clean, then she will simply get the vaccinations and will be finished with her medical.

Hey tahoma abd godsgift thanks for the input there I agree with you that we may be done with the psych stuff like you said that it would have been told if there was more involved... Now the 3day test thing is one I was going to be concerned of we can just hope that it comes out negative... My opinion it will be negative, but I can't predict that outcome! I will post again when tuesday or wednesday comes around to fill you all in on the results.. If I dwell on it anymore I will go crazy myself haha take care ill respond next week!

result of what? of the psych eval? if that's the case then she is still not sure if she will gonna do the psych test or not right???? but u know since i got here, i didnt read a case of applicant that has a scar who did a psych. test... but lots of annulled women did the psych eval and test... well lets hope not... good luck... :star:

btw... annulled women who are found psych. incapa. are at once sched. for third opinion.. i think one of the reason is that, when they did the psych test on the annulment their psych doctor are not accredited by slec... aside from they want to make sure the stability of the applicant's mind.. :yes:



i believe the results of the medical entirely is what we are now waiting for... possibly that sputum test results.. i wonder why its 2-3 days for results instead of most i read about "they get the results the next day." Possibly because the psych eval was included..maybe? i would think that if they wanted her to undergo further tests they would have told her right then and there, just like they do to the women who has been annulled. But, im not St Luke's or a Doc for that matter.. All I can do is hope its all good and follow up afterwards..

hi jandk, well it depends on the result of her psych evaluation... there is someone who has same experienced like ur wife, but she didnt go to a psych test... only the psych eval at slec...



ah i see.. well with my wife, she did the psych eval and wasnt told she had to take a test... all she was told was to come back in that 2-3 days to get her results and to do her immunization.. the dr. was also asking my son if he is going to be with me for xmas :yes:

well then let's pray that the result of her psych evaluation is ok so she will not go for 3rd opinion (psych test), probably the others who was told to get 3rd opinion are annulled women who found spychological incapacitated, usually they are the one who are recommend to get a 3rd opinion...

Ok, so here is the scoop.... So she went to the personal eval, and the doctor asked about why she has a scar, and my wife explained and even had to demonstrate how it happened. So the Dr. asked about questions that were answered on her questionaire. The doctor had a casual conversation with my 5 month old son. Afterwards, without having to wait in the waiting area, the Dr. gave my wife the call in number and told her that the medical is done and to call in 2-3 days to see if the results will be ready, then once they are ready she was advised to go down there and get the immunizations. So that is where we are so it looks like next tuesday or wednesday she will need to collect the results and get her immunizations.. Let me just add that there were others waiting as well, that said that they were told they would have to go for a 3rd opinion from a psych, my wife wasnt told that she would need a 3rd opinion.

I think the psych test is a lot longer than a few questions. If my memory serves me correctly, the psych test is a couple hundred questions...and she will definitely know she is taking a written test rather than answering a few oral questions.

It sounds to me like she may have to take the psych test. From what I have read here on VJ, it's standard operating procedure for St. Lukes to require the psych test for anyone who has "suspicious" scars.

If I remember correctly, the psych test is a written test with a lot of multiple choice, yes/no, or true/false questions. She shouldn't have any problem with it. You can always search for a relevant thread here on VJ.

yeah she said she went to the ground level and had to answer some yes/no questions not sure if this is what you mean by psych test..but this occurred after the physical exam/question about scar..

Wow that's unusual. Mhay had 2 go back & pay for another pregnancy test 2 be able 2 get her live shots. I forget how much the PT was though. They didn't give her the shots when she went the first time because I was in the PI & she had "contact" with me.



Hey Scott, yeah man it was quite odd, and I think I know where this is going, after talking to her / waking her up at 2am >.> she told me that during the physical exam they asked about an accidental scar on the inside of her fore-arm, asked "when did this happen?" She told the Doc that it was back in 2007 and didnt question anything else in regards to it. Then has her go down to the ground floor and sign some papers and tells her to come back for "4" more shots and a personal eval on nov 19th, so im thinking this is related to making sure she doesnt have suicidal tendencies. Just curious did your wife have to under-go a personal eval as part of her medical exam?

Hello, I know It might sound like a dumb question but I am really confused about a part on the I-485 form, ok so my husband is here on a k-1 visa and I am the us citizen and on the I-485 it asks him for the name of his spouse it says family name of spouse so do i put my family name which is my maiden name or do I put my new married name?

I checked DHL website and it says that this package doesn't exist. so I called DHL - they told me that it was sent to me on Friday evening and I should get it by Monday!

Gosh! I cant wait! I tried to reschedule my departure for 7/23 but Orbitz says that there is no availability in my class until 8/14 (I purchased my ticket last year for 8/14/2009 ) And the fist available is Business Class and the rate difference is huuuuuuge smile.gif so I guess 5 more weeks to go........ bummer!

Easy! When I was there in Dec ( K-1 ) he gave me only a receipt and 1 sheet of paper with some general information on fiancee visa and that UPS nr probably. don't worry, they know what o do and you will be fine!

you know, i was thinking about what to do and i don't want to have any problems travelling and name changing so we decided we will go to the conulate in LA this March hopefully. they won't have my new passport done before summer so i will travel on my maiden name passport both ways. i wanted to save some money getting things done in poland but the timeline is uncertain and i just don't want to complicate my situation . good luck to you all and thanks for your input!

so now i know i have to buy a ticket on my maiden name in passport. i would love to succeed in getting a new passport in poland -but then my ticket back will carry my maiden name and won't match the passport! i wonder what can be done about that!



the ticket needs to be in the name as it appears on the passport! you will not have any issues coming back when you carry your gc as well as your marriage license to show the name change.
as far as getting a new passport in poland, i can only tell you how it works in germany: once you live in another country you have to apply for a new passport through your embassy in the states.

Your ticket has to be in the same name as your passport (so maiden name). To prove name change you carry your marriage certificate with your passport and green card and you'll have no issues.

Don't know about changing name od Polish documents, but if it is anything like in Bosnia, you'll want to have an apostilled marriage certificate, with translation done. I think you can register your marriage through the Polish consulate in the US (may take longer than if you do it personally in Poland).

I need your help.
I got married (K1) almost a year ago, I changed my name and got a green card. My Polish passport is still in my maiden name (I realized I should have gone to the consulate then and get it changed but instead, I was planning to go to Poland this summer and do it there.
I need help from those of you who had it done and could give me any tips.
I don't know what name should be on my ticket (people here say maiden name as the passport stands but then how will i get back if they give me a new passport and punch the old one?). I feel bad because I was so focused on all this immigration and being ok with the US that I did not take care of my Polish 'part". thank you for your help.
by the way, what about changing name on my dowod osobisty?

I didn't have any records from childhood. The doctor himself knows which shots are obligatory at certain age. Don't worry there:-) I think I got 5 (but he combined them into 2 injections).
Your fiancee will be sent instructions explaining her medical exam. It can be all done in 1 day.

Hey, as I remember documents can be either in Polish or in English. It was mentioned in the instructions the embassy sent me. I think most of my stuff was in English.
I didn't have my background check translated into English but I got my birth certificate translated because you need it later for AOS.

The shots are not required for the K-1 visa but it's best to have them done in Poland (she will need them to apply for AOS). Safes a lot of hussle and money.
For the vaccins she has to pay extra but it wasn't much. Please make copies of the vaccination sheet she gets from the doctor. This was the only medical document I attatched to my AOS application and I was approved.

they will send all the information along with the interview date ( and of course more info on that). I had 1 month. I heard the medical must be completed 1 week before the interview but I don't know if that's true. She can have it all done in 1 day. It's challenging but when I got the addresses I checked all the 3 places on the map to be relatively close. First I gave blood in the morning then I went for an X-ray. Then I was back to collect the blood test results and then I had to go back to collect the X-ray picture on CD. In the afternoon I had an appointment with a doctor. I was in Warsaw. Good luck! It's a lot of hussle

wait for instructions. They give an address in Warsaw. I called the embassy to ask if I can get in Lublin but they said no ( I don't know why). I had to make a trip to warsaw just to get that 1 piece of paper ( it was a year ago, i don'r know if it's changed). You fill out the form while waiting in a queue, they check in a computer, stamp it and give it back to you. Then I brought it to the embassy for my interview.

Self-sponsoring is allowed at the embassy in London. Your other comment sounds like you are over thinking what they might be thinking. London isn't really going to be thinking of your motives. It isn't a high fraud consulate where they are trying to play detective to uncover your plot to get out of a third world country.

Hello! I've been using this site since January and have found it extremely helpful but this is my first post and if anyone has any advice that would be great!

 

I have my medical booked for Thursday and have sent off 'package 3' and almost have everything ready to send off the DS-2001 but am starting to have a freak out about the I-134.

My fiancé has gathered all his documents (tax returns, employer letters etc etc). His tax return shows that in the last year he earned around $17,500 which I know isn't above the 125%. He does however have around $8000 in savings which would then push him over the level. Will this be ok?? or can they deny because his actual wages aren't above the level.

 

My interview will be in London. I have quite a bit in savings too but it seems that they don't care at all how much the beneficiary has?!

Should I get his father to be my sponsor or am I freaking out about nothing?

 

 

 

Any help would be very much appreciated!

I had my medical on the 22nd August and as of yet have no interview date.... I received a CEAC update on the 12th September but have not received any mail yet so have no idea what that was!

 

 

I think my postman is going to be more relieved than me when I get my interview letter, I literally jump him as soon as he turns down my street every day.

We got our NOA2 June 26, somehow a little earlier than expected (NOA1 was Jan 22). But we are pulling for all the end of May VSC transfers to get finished up at TSC by mid-July, as seemed to be the proclaimed finish line. I think there are still a handful of transfers remaining. Hopefully everyone is done very soon and will be joining the rest of us in our new mystery limbo at NVC. ClockWatch2.gif jest.gif

I received my NOA2 LETTER in the mail today June 29th 2013. Valid from June 25 2013 - 10/24/2013. Does this mean we have until 10/24/13 to get the interview or to get married? Or is it 3 months once he gets into the U.S. and 6 months to leave his country for his Visa to be valid?

 

My impression of the timeline is that you have four months from the NOA2 date to complete the interview. Presumably the visa is issued at that time. If they put a hold for "administrative processing" then I am not sure how that impacts the four month deadline. Once you receive the actual visa, then you have six months to use it and come to the USA. At the POE, you surrender the visa (or it just becomes invalid for any further entries) and receive an arrival/departure card with 90 days validity. So then you have 90 days to get married and then immediately file for adjustment of status for permanent residency (which will be 2-year conditional GC) and then have to file later to get the conditions removed and proceed towards unconditional permanent residency and naturalization. This is my best guess.

Hi everybody! We got our NOA2 Approval notice by email and on USCIS website at 9:31 PM Eastern time, June 26.

NOA1 was Jan 22, so we got it in 5 months, 4 days. We were transferred in the first batch from VSC to TSC on May 30.

 

So, everyone that didn't get notice yet, just keep hanging in there. It's definitely coming soon. We originally thought ours wasn't coming until August, so I think the transfer was a good thing.

WHAT am I supposed to now? There's so much information around here, I don't know where to start. People talking about shortcuts, downloading forms, etc. I've collected new "evidence" of our ongoing relationship (chat logs, pictures, plane tickets etc. from our trip to Beijing in May), should I be compiling all this and snail mailing it to her?

You (your fiancée) will be going through this site for arranging the interview date, etc. You can research all the info on here. I found a link someplace on it that gives a PDF of exactly the K1 instruction that the Guangzhou consulate will be sending in packet 3. I downloaded all the forms and started filling them out already with my fiancée (in draft form, not official) so that all the info will be determined by the time we get our packet 3. There is a lot of other interesting info as well - such as "Bring five passport photos to the medical exam". Start your research and preparation early!  Maybe we'll see you in GZ!
