Hi, did you have your case expedited?, I mean by your signature you got approved Feb. 26 and already have a case number and paid the AOS fee. That's nice!

 

No expedites...even we were surprised. We just called to see if our case reached NVC and they told us "it arrived yesterday and here is your case number". I hope this is a sign that processing times are improving. :)

Which documents exactly are double-sided? It's better if they're not as the reviewing officer may not look at the back.

Guys i have a quick question regarding form DS-261.   My wife last name is Mazhar and my last name is Shahid.  No middle names, she didn't change her name at all.
 
For DS-261 for surnames what do i put? i have put "Mazhar" for her and "shahid for my section (agent)
 
2nd question for "Given names" i have put "FIRST NAME+LAST NAME which is "Mazhar" and i did the same for my section.  is this right? I feel like Given Names should only have First name?




I think it should be exactly the same as it is on your passports. Nothing more and nothing less. If you don't have a middle name and your passport shows that as well then your given name should be just your first name.

The certified copy was issued by the public notary (public notary got of course my original birth certificate) and the certified copy was translated into English by a sworn intepreter and translator by the resolution of the Regional court.

I submitted 3 pages that were bind together with a thin cord. First page: Certified copy in German (with original stamp and signature), second page: the translation of the certified copy, third page: Clause of intepreter (with original stamp and copy).

 

I am curoius too what the issue is - will call and ask today ....

 

 

USCIS didn`t have a problem with my birth certificate... :-)

It looks like it is a mistake on their part or it is just a false checklist. I hope everything is sorted out quickly.

So my birth certificate was translated into Englisch by a sworn intepreter and translator appointed by the resolution of the Regional court and was certified by a public notary. I don`t know what else should have been done .... :huh2:

 

And my original birth certificate was issued by local civil authorities. But I have only one - that`s why I got one certified copy and  translated it  into English.....

 

So yes, I submitted a certified copy of my original birth certificate that was issued by local civil authority.

And you included both the actual certified copy in German and the certified English translation copy in your package? If you have only included the certified English translation copy maybe that might be the issue.

 

Again, I am just trying to figure it out by guessing. Only NVC will be able to tell you for sure. I hope it is an easy fix of resending them what you already have.

So last night we received a checklist from the NVC that states that my birth certificate was not a an original one or a certified copy but we submitted a certified copy of my birth certificate. Could this be a false checklist? :huh2:

Was the certified copy of the Birth Certificate that you have submitted to NVC issued by the local civil authorities (Municipal Birth Registrar, Department of Health, etc) or was it issued by the hospital?

 

Also, just to be clear notorized or attested photocopies are not certified copies.

 

If your birth certificate was issued by local civil authorities and you have submitted the actual certified copy then it might be a false checklist. You will have to call NVC to make sure that they did not lose the document that you submitted.

I looked how to obtain this, so my husband has to go to india to get this form from the police seve Kendra or something like that, next available apt for this process is may 13. what do we do? can I call nvc and tell them that he will bring this passport police clearance to the interview? Your checklist will have the exact options you need to pursue. Based on the information you have provided it seems that either your husband is an Indian citizen living abroad or a foreign national who lived in India for a while. If he is an Indian citizen living abroad then he needs to go to the website of the Indian Embassy located in his current country of residence and apply for a Passport Clearance (also called as Police Clearance) Certificate which is issued by the Indian Embassy or Consulate.

If his Indian passport was renewed or issued by the same embassy they can issue the certificate within 2-3 weeks (they usually have the record of your previous police clearance at the time of passport renewal). If the passport was issued in India or some other consulate it could take up to 6 weeks because they send your PCC application for verification to the Passport Seva Kendra in India or the consulate that issued his passport.

You do not need any local certificates if you are not living in India. Also I have asked and NVC told me that in some circumstances they allow case complete with a pending PCC for applicants who are waiting for a PCC from the country they are currently residing i.e. Indians living in India have a possibility of case complete with pending India PCC but not the Indians living abroad.

If he is a foreign national who spent some time in India then the process might be slightly different and maybe someone else with similar situation would be in a better position to help.

I am an Indian national living in Switzerland but my passport was issued by the Indian Embassy in USA so it took me 6 weeks to get the PCC from the Indian Embassy in Switzerland.

Disclaimer: I have submitted my IV package but it has not yet been reviewed or approved.

NVC mentioned that in IV pkg. one should send - Original or Certified Copy of marriage certificate and benificiary birth certificate.

I will get them certified from attorney in India and gona send these pkg from India. Do my husband need to get them again certified from US Gov?

I am not 100% certain but I think you can only get certified copies from the original issuing authority i.e. you will have to go the Municipal office that registered your birth and marriage and obtain certified (another issue of the birth and marriage certificates) copies. It is not just a photocopy that is notorized or attested by an attorney.

 

I had a certified copy of my birth certificate from India (issued by BMC-Mumbai back in 1979) and my certified marriage certificate is from the US (also issued by the original issuing authority).

 

Can someone from India who has been through this please correct me if I am wrong?

Will NVC review my DS260 even though my lawyer is dragging his behind on sending in my documents? will I get a checklist if the docs aren't there yet?     This lawyer is working my last nerve.  He knows I am on the edge of my seat. I paid him... what is the problem?????????  UGHGHGHGHGHG

 

Based on my personal experience...I received a checklist one week after I submitted my DS-260 without my IV documents (I was waiting for my PCC).

 

The checklist stated "The National Visa Center received your DS-260 form. We are waiting for the traveling applicant?s supporting civil documents to be submitted to the NVC. Your online Immigrant Visa Application will be reviewed upon receipt of your supporting documentation".

 

I am not sure if this was a real checklist or auto-generated one because in my case it was applicable either way.  :crying:

It was a total shock even for us. I was hoping that we would make it to the second round of interview schedule for June but luckily things worked out for the better.

Hello everybody,

 

We called NVC yesterday to ask whether we have a Case Complete and Agent Tori (very friendly) said "I will give you an even better news, your interview is scheduled for June 2". We couldn't believe it. She said she totally understands how relieved we must feel and how exciting it must be to see the NVC process come to an end and have the date for an interview.

 

No Case Complete email or Interview Letter yet but it is exciting none the less.

 

Thank you everybody who knowingly or unknowingly helped me through the process. I am sure that this path would have been a lot longer and lonely without the information and support from VJ members. So a big Thank You once again.

 

Also, Congratulations to everybody who have recently completed this process and good luck to all who are still in the process or waiting for a response from NVC.

Hello everybody,
 
We got our third lucky break in this immigration process on May 22 when the US embassy emailed me to see if they can move my interview date from June 2 to June 4 because they were overbooked for June 2. Since they initiated this conversation, I took the opportunity to inform them that I had completed my medical on May 21 and had all the documents ready. I told them that I was just waiting for my interview and to be honest I would like to get it done sooner rather than later. I asked if they had interview slots available sooner than June 2? If not, I told them, I will see them on June 4. Within a few minutes I got another email saying they had an opening for May 27 if I was interested. I grabbed it.
 
I had my interview a few hours ago. It went really well. Our situation and my interview experience is too unique to benefit others and it will make for a very long story so I will spare everybody all the details. I will submit the sanitized version of the experience describing the embassy procedure under the Embassy/Consulate Review section soon.
 
Thank you once again everybody here for all their help and support.

Hey guys, 

 

I hope everyone will get approved soon! 

 

I have a question relating to my approved I-129F... On the hard copy where it says "notice type" there is a following note: "valid from 02/26/14 to 06/25/14". What does it mean?

 

My I-130 was approved at the same time, so I assume I can forget about I-129F, but still I am clueless what this validity period is...

According to the State Department website <http://travel.state....se-citizen.html>, an approved I-129f has 4 months of validity as quoted below.

 

"My petition expired ? Can it be extended?

The I-129F petition is valid for four months from the date of approval by USCIS. A Consular Officer can extend the validity of the petition if it expires before visa processing is completed."

 

If your I-130 was pending, the K-3 visa would have to be issued within 4 months. Once K-3 is issued it is valid for 2 years.

 

In case the I-130 is approved, USCIS says <http://www.uscis.gov...immigrant-visas> the following:

 

"The Limitations of the K-3/K-4 Nonimmigrant Visa

When the K-3?s I-130 reaches the Department of State, an immigrant visa is immediately available to him or her such that the he or she and his or her children are no longer eligible for K-3/K-4 nonimmigrant status, but rather must immigrate as lawful permanent residents."

Yes, I had a delay possibly due to the I-129F,  and transferred with August filers, but we do not yet have the hard copy describing which Service Center we've transferred to, so it may not be NSC.

1. NoelAnne: I-130 on 07Jun2013 and I-129f in June2013. Transferred to TSC on 27Dec2013 (~10 days after other neighboring I-130 filers) and I-30 approved on 27Jan2014.
 
2. Lakehouse: I-130 on 30Jul2013 and I-129f on 02Aug2013. Transferred to NSC on 28Jan2014 with August filers (~8 days after other neighboring I-130 filers).

You may be getting transferred ( I know about the case # not being in their system).
 
There is unfortunately no datarecord on this site of petitioners delayed because of the 129F.
I have seen two filers one from June and another from July whose i-130 had been held till the processing order went to the i-129F. 
 
 






Although, I have seen cases (see links below) where irrespective of whether the I-129f was filed immediately after I-130 or several months later, their I-130 was transferred along with other 'non-K3' filers (as seen in their respective monthly transfer spreadsheets). However, their I-129f was transferred along with their I-130 and was cancelled as soon as the I-130 was approved.

I am just not sure if these cases are exceptions or norms.

Transcripts are fine, but do note the embassy instructions letter asks for the most recent tax return... so they are totally acceptable.

I agree, 125% should be a goal right from the beginning since it will be required for I-864 anyway, especially if the final K-1 objective is an expectation to immigrate to the US (which is very likely the case).

 

125% may be the rule at Philippines embassy (as well as China in my situation), but the actual minimum requirement as declared by the Department of State FAQs for K-1 visas is 100% for I-134:

Do the Same Income Requirements Apply to Form I-134 as Apply to Form I-864?

No. The 125 percent of the federal poverty guideline minimum income requirement, the most recent year's tax return, and other requirements only apply when Form I-864 is needed. Applicants presenting Form I-134 will need to show that their U.S. sponsor's income is 100 percent of the federal poverty guideline.

 

 

 

However, the main thing is to provide sufficient evidence to the consular officer that there is no risk of the beneficiary becoming a public charge after arrival in the US. So, while not necessarily required for I-134, it's definitely a better approach to just demonstrate > 125% and not worry about it.

 

A copy of a tax return is also acceptable since the signatory proclaims under penalty of perjury that it is a truthful document. The complete tax return should be made available if it was specifically requested, but the info in it had also better match the transcript since this officially represents the info from the tax return that was actually filed with the USG and is verifiable. My impression from researching a lot about this topic over recent months is that consular officers prefer the transcripts as the supporting documents for I-134/864 income verification. But, every case is different and who knows what they will ask for?  devil.gif  It will be interesting to find out if they really want to sift through my 50+ page tax return or just take a quick glance at a 3-page transcript, or if they even bother to look at any of it!  blink.png

I would like some input regarding fiancé support documentation please......

 

I am self employed and a partner in 3 different businesses....I have filed an income tax return extension for 2012 and I do not receive the typical W2's or pay stubs.

 

Here is what I can provide-

 

2011 income tax returns that shows the 3 different business's and partnerships

 

Current letter of partnership in these business's

 

Copies of checks from income from these partnerships for the last 2 years

 

Copies of bank statements showing this income going into my personal bank account for the last 2 years

 

Copies of all my bank statements, investment accounts, life insurance showing my current assets

 

Verification of the current value of my house and mortgage balance... I have lots of equity

 

 

Will this be enough ??? anyone had problems with this sort of thing ?? My jobs and income documentation are not very normal but it is all there.

 

Any input on this would be great....just want to make sure I am doing as much as I can.

I have similar situation. Self employed, owner of incorporated consulting business since 1999. I am the only employee/owner of my company. I am not planning to provide as many of the items as you have listed. My income alone is sufficient to meet the minimum poverty requirement for K1 visa (100% for I-134 and 125% for I-864 to be filed later).  I do prepare W-2 for myself, and also K-1 Business Income (not to be confused with K1 visa), which are included with my annual 1040 If you are only deriving income from business profits, then you should still be receiving K-1 or similar Share of Business Income statements from each of your businesses, which serves a similar function as W-2, 1099, etc. As with you, I also do not prepare pay stubs for myself since I sometimes only pay myself a few times throughout the year, depending when my business receives payment from invoices I submitted to my clients. Often times, I don't get an invoice paid for several months (sometimes as long as 6-8 months, in fact, I just received a deposit for a couple invoices for earlier this year and had no income all year until now - but this deposit alone meets the requirement). As a result of my unorthodox cash flow, here is my plan:

 

For the I-134, I plan to only provide the bare minimum up front: personal tax transcript for the most recent filing (2012 tax year in my case). If your income in 2012 meets the poverty guideline, then you really only need to provide the proof of the annual income amount that is listed on I-134 (which should match the total income amount as shown on the tax transcript). The proof is the IRS tax transcript. You can order these online from IRS and it only takes a week or two to receive them in the for your 1040 filings. You can order them for the most recent tax year (2012), plus three years prior. So I ordered all four years, but I am only going to provide 2012 up front with the I-134. My fiancée will have the other three years with her, if they ask about it.

 

I see no reason to provide anything else in terms of financial position, such as life insurance and other equity holdings, since my annual income far exceeds the minimum requirement.

 

However, while I am technically considered to be an employee of my company, I am also the owner and, therefore, self employed. So I also ordered the tax transcripts for my business. These are also free from the IRS, but you have to mail a request form and it takes about 30 days to receive these transcripts. I have not received mine yet. I will give these to my fiancée in case she is asked about it during the interview and needs to provide evidence of the business income, but I am not planning to provide it up front with the I-134.

 

The transcripts are the way to go. They are issued by the IRS and are very simple and straightforward. Copies of tax returns are really useless, since these can be made to show anything and are not the proof of the information that the IRS actually has on file.

 

Also, the transcript clearly states your filing status. In my case, Single. This is the proof of my marital status, as there are no other official government documents for this purpose in the US. Be sure to prepare a new Letter of Intent to Marry and clearly state in it that you are single and intend to marry your fiancée.

 

Regarding my current income since filing the 2012 tax return (2011 in your case). I agree that the only thing we can do it provide bank statements showing income received since that time since there are no pay stubs. I am planning to get a YTD summary of my personal and YTD bank accounts, notarized at the bank. I doubt these will even be required, but will provide these to my fiancée also as a backup.

 

I am going to prepare a letter to include with the I-134 about my owner/employee situation, using my company letterhead, stating the name, address, etc. of my company, type of company (sub-S), state of incorporation, incorporation date, etc. (All the usual business facts.) Including a very short (one sentence) blurb about what type of consulting service I provide, and explanation of my oddball cash flow situation. I will also list the officers (which is only me), and sign it as President, which is my legal corporate officer title. I might also emboss it with my corporate seal just to make it official looking. I am probably also going to take a copy of the Articles of Incorporation, but I doubt this would be needed for the I-134 (maybe for the I-864). I still think the tax transcripts are sufficient anyway, since these documents already show most all of this info.

 

Just make sure that your fiancée knows what you do to earn a living. She doesn't need to know how it works (US business and taxes), she just needs to be able to answer basic questions about your career, if asked, which is more of a demonstration of proof of relationship.

 

Even at this point, I think I am over-doing it for the I-134. But, I have been considering about this for many months while waiting for NOA2, and finally decided on a plan once our approval finally came in a couple weeks ago.

IMBRA Special TopicsIMBRA- "International Marriage Broker Act"

Hi everyone: I met my girlfriend on "Filipino kisses". I visited the Philippines in October and we got engaged. I have not filed the I-129f yet.
I believe it is line #19 that asks if I used an international marriage broker. When I research it on the internet it seems that "Filipino Kisses" meets
the definition of an International marriage broker as defined in the IMBRA law. It also says that a marriage broker is supposed to search "Sex offender public
registries" and collect information from me, and pass it on to the girl I want to contact before they give me the information to contact her.
I know Filipino kisses didnt do any of this stuff. I have not been convicted of any crimes mentioned on the 129F and I wouldnt show up in any Sex offender
registry. However I am worried that My petition could be denied since Filipino Kisses didnt follow their rule. The Wikipedia article on IMBRA says this is
a possiblility.
I would think if this was the case that I could find all kinds of yelling and screaming on the internet from people like me who have had a good faith relationship for 6 months or more and then find out about this IMBRA law.
I would like to hear from other people who have met on similar sites that dont follow IMBRAS guidelines.

I did see an old post on Visa Journey called "IMBRA RFE question 1" but it seems that is from 2006.

Assuming that Filipino Kisses meets the definition of International Marriage Broker. And they did not comply with IMBRA. Do I need to apply for some type of waiver? Will I be permently denied?
I would realy like to hear from someone who used Fillipina kisses and then applied for a visa.

Hey guys-

I have some questions. Me and Joanie are at the point w/NVC where we paid the IV bill(400) and the AOS fee(70), I am currently waiting for signed page of the DS230 from my wife in which should be here in the next week by "snail mail." Now, The AOS has not been sent off as of yet, because my co-sponsor hasn't filed '09 taxes, so we are also waiting for that. The questions are.... IF I get the signed DS230 before AOS is ready to be sent, can I send off the DS230 first then the AOS last? If I do that, would there be any problems with processing? Will NVC send over the forms to the Embassy and still setup an interview and can the medical part be taken care of w/o recieving the AOS..?

Thats great to hear that your making all these plans almost reminds me of me, a year or so ago when I did this adventure. Like a previous poster mentioned, this process does take longer but not to much. If you look at my signature of events, You will see that its been since Nov 2009 until finally now we are just waiting for an interview. There was a time that I got the paperwork approved, and fees paid but after that there was nothing until august 2010. Thats because my wife was going to have a baby and I was going out there again, and I didn't want to have the interview while I was there, because 1. Wasn't prepared for the CRBA process for our son, and 2. JUST in case NVC needed more documents, I didn't want to be in Philippines and not have that with me.. So I waited until August to finish where I left off in April/May. Everything is almost done :thumbs:

Wow, 700 dollars, that's super cheap. I was thinking like I was going to have to spend about 5,000-7,000 dollars on the wedding. I guess we're going to have a very big and extravagant wedding. I can't wait. And I really want Cherry to have her dream wedding. She deserves it. and I want her family to be there for it; And of course her family will be my family too.

Yeah about the price of the wedding, 700 usd for a wedding in our eyes is cheap, but of course its not to them. Got to love the American dollar. But 700 was an average wedding, covered all basis wasn't cheap wasn't off the wall elegant.

And when you said you got your Cenomar, do you mean you got your legal capacity? Because I cannot get a 'No Marriage" record here in the US in my state.


Mike, about this subject... Yeah Legal Capacity to Marry, you go to the US Embassy a previous poster said its by schedule now. But you go there a swear your single and they give the document needed for your marriage to take place in Philippines. As far as anything else needed for us I was set with just that. Things change from time to time, I would always check with the US Embassy Website tons of info for you there.

Also I don't understand the 21 day passport thing. Why do I have to update it? Is it required? and will I have problems with Philippine Customs in the airport when I arrive because I'll be staying for 28 days?


Ok here is the steps.. When you land in Philippines, your going to be walking to like an endless horizon.. kidding.. you will come to an immigration check point, a bunch of people in line, stand on the left side of the lines, because like the 4-6 lines on the far right is for resident immigration. When you get to that counter they will ask you for the information you filled out on the plane, as well as your passport, they will stamp your passport, that stamp there is good for 21 days. Yes, this part is going to suck... your going to have to go down there to the immigration office before that 21 days is up to renew your passport even if its just 7 more days in which your stay is going to be. I think it was around 60 USD for the stamp to extend to 54 days total.. I would advise that you go there maybe a week before the 21 days mark hits only because anything crazy can happen; storms, brown outs.. etc etc.. so its good to be on your toes. If you get that renewal you WONT have an issue, if you don't, then you can face fines and imprisonment(i don't know from experience, I just read that on the site and I don't really want to be in a jail there)

But that is pretty much it, if you havent been there before its a way different way of living, the people are great people(majority) When your leaving the airport try and get a metered taxi, if you catch a taxi at the airport you might have the option for a metered one. There pretty much no sense in driving there, transportation within is cheap. just be careful, when you hear Special when your wife gets a ride for you, be prepared to make a whole 2 dollars for that ride lol. Tricycles are fun to ride, jeepneys are pretty cool, cramped but cool. watch your wallet, fine jewelry. flip flops, shorts and a t shirt is the style pretty much. Dont drink teh water or have ice in your cup. I am not sure where your going when you get there. Mosquitoes aren't afraid of "OFF bug spray" either. lol not kidding. but if you have any more questions send me a message and I will respond promptly.

Thank you everyone for you helpful and in-depth responses. With the K-1 Visa application requirements I misread or got confused with what is needed. That's great to know that the K-1 is now an option. I want to be with Cherry in the U.S. as soon as possible. The only thing is that we want to get married in the Philippines. I also would like to do this out of respect for her parents, family and friends. She is the only daughter in her family and this is a big life event that I know they all want to see. They're also going to be my family too so I want to share this special moment with them all. I also don't know if her parents will allow for her to leave their home without her getting married first. There are a really nice conservative family. I'll know the answer to this in a couple of hours once I talk to her. Is there a way to have a Catholic ceremony without making it a fully legal marriage. Once we are married legally are we ineligable for the K-1? I assume yes, but maybe someone here knows a loophole. I look forward to hearing back from you with your thoughts and advice about our options. Thanks.

Hey Mike good evening to you. I wanted to give you some input of what to expect from my perspective only because I went down this road your going through. So I went last year to the Philippines and my stay was only a month.. IT WAS A BUSY month indeed. We had to prepare everything ahead for this. First my wife had to get her Cenomar (Showing singleness for her part) She did that before I went there, because I believe there is a turn around time for 2 weeks.. maybe shorter, but you want to get that knocked out asap! Shortly after I arrived there I had to goto the Embassy I believe on Roxas blvd. in Manila and had to get my cenomar showing I am single and not married. I got the paper that day. Of course don't forget to goto the immigration office and renew your passport after the initial 21 days of being there. We didn't have a big church wedding due to the timing, because if it was in church there is a month full of things that would have been required to do and we just didn't have the time, so we went to a recreation hall that catered to Weddings, told them when and what we wanted.. overall i think we spent like 700 usd on the wedding that included everything, it was great. If you want to get suited up for the wedding get a barong and her dress, along with maid of honor and best man, god fathers, and god mothers, ring bearer and flower girl(s) at the malls there. not a bad price. We got married in her province so we had to setup marriage counseling before we got married it was quite interesting.. when they go around the room asking how many kids you want tell them 1,000,000 lol it was humorous. A couple days after the counseling, we were married and we signed the marriage papers it was a great time!! I would do it all over again if I could. But anyhow, after you leave she can take care of the rest like getting the NSO copy of the marriage certificate. IF you send her anything send her through fedex.. mail system sucks there. but fedex guarantee 3 day delivery to her door they even call her before they drop off. if you have any questions don't hesitate to ask add me to your friends I don't mind answering your questions.. ingat ka (take care)

Hello- I am new to the forums,

I have a question when it regards the question "How did you meet," in the immigration interview. I met my wife through my best friend of 10years+ he is married to one of her sisters that was adobted and brought into the US at a very young age.. of course now she is 22. Me and my wife started to talk about 2 1/2 years ago as friends and then things blossomed to us getting married.

When it comes down to the question and if we give them the answer of "We met through his friend who is married to my sister in the US," is that setting us up for a skeptical response to "Did you get married for immigration reasons."

I feel honesty is the best policy but @ the same time I dont want to raise an eye brow. We have a child due in June 2010, so I mean there are ties with us to show that it isnt just about immigrating as to why we got married. Any opinions. Thanks
