Presumably even if he goes back to Mexico and pretends that he was never here to begin with and we apply for a fiancee visa the lack of a paper trail there will be an issue?


They will probably know anyway, especially if he was ever turned back by Border Patrol. And if you ever lie to them, even once, they can deport you at any time [deport him, I mean]--in fact, they can even strip his citizenship and deport him decades from now, if they find out. The first rule of legal immigration is never, ever, EVER lie to USCIS.

Lucyrich is correct about the current state of the law. However, you could also file for a waiver of the 10 year ban, in which case there's a chance it might only be a few years of him living in Mexico.

There are a few people here who have done what you're asking about. I'd try asking in the Latin America forum (http://www.visajourn...hp?showforum=96 ).

I know this probably gets asked here a lot but I went back several pages and didn't find it, so ...

G entered the US for the first time on the VWP on 6/20/02 and left 7/4/02.

He came here for a job interview on 5/16/03 and left 5/27/03.

He entered the US on a J-1 work visa 2/4/04, has not left since, married July 2004, LPR status granted 1/13/05.


Assuming he files the N-400 on 10/22/07:
Part 7:
A Total days outside US in past 5 years = 460 [10/22/02-5/16/03 and 5/27/03-2/4/04]
B Total trips outside US in past 5 years = 2
C List all trips outside the US since LPR status was granted = "none"

Correct? I was going to put a note in section C saying "All time outside the US occurred prior to LPR status being granted on 01/13/2005."

Yes? No? Suggestions? I used 10/22/02 since it was 5 years before we'll be filing.

I don't think that's *quite* true. They haven't completely stopped work on N-400 applications altogether to process other higher-priority apps; they've just slowed down work on N-400s by reassigning some people who would normally process them to work on applications with higher priority. So we don't have to wait until they adjudicate every single I-485 application filed since July before they start receipting the N-400s; it's just taking [a lot] longer than it would have if they hadn't reassigned people.

Okay, so this question is driving us nuts. My husband's mum, when he was a small child, used to join everything under the sun and get a family membership. So, for example, at the age of 4 he sort of belonged to Greenpeace, Historic Scotland, and a zillion other things.

Do we really need to get his mother to make up a list of everything she ever got a family membership to, or can we just list things he joined voluntarily?

They *may* run a credit report and it would show up on that.

ETA: You're not "undocumented" (aka EWI), you're an overstay. There is an ENORMOUS difference ... one that just *might* allow you to stay in the country. So definitely do NOT put that you're undocumented.

My husband does.

One of the things that helped him was reading over the oath for the citizenship he already holds and realizing he wouldn't feel comfortable taking that either.

And all immigrants (permanent residents and those here on immigrant visas) are subject to the sane "bear arms" clause (and the other ones about noncombatant duties and work under civilian commands) anyway. It's in the forms you fill out for the visa app or AOS.

"further difficulty" would be quite the euphemism! Deportation is the normal penalty.



Deportation takes years. "Further difficulty" would first include delays in processing the N-400, *then* denial of the N-400, *then* the beginning of rescission proceedings, *then* rescission hearings including appeals, *then* the beginning of initiation of removal proceedings, *then* removal hearings, *then* an offer of voluntary departure, *then* more removal hearings and appeals, and in two or three years, it may actually include actual removal.

In other words, when they say "further difficulty" there are about a dozen steps between there and actually leaving the country.

I asked a friend who's a prominent immigration attorney in my area.

She said they probably only really *need* 3, but it's better to give them too much information (i.e. 5 years' worth) than give them a reason to deny you.

What's not to understand? 2 photos, front and back of your green card, marriage certificate, USC's birth certificate or passport (or naturalization certificate if naturalized), and 3 years' tax transcripts OR 3 years' tax returns OR evidence showing a legitimate marriage. We sent the transcripts since we'd just sent everything else a year before.

At the swearing in ceremony, the package that you receive will have the application for a US passport. In the case of a naturalized citizen when applying for a passport for the first time, you will need to apply in person.
Alan, I am going to scare you just a little bit, because this happened to me...I had to send my ORIGINAL naturalization certificate with the application so that I could be issued my passport. It is returned to you with the passport. I applied at the courthouse in Hollywood Florida. I believe if you go to a Passport office, then you can show them your certificate and not "surrender" it.

Since they have worked out the backlog, it shouldn't take too long to get your passport after being naturalized.

Now THAT is wonderful info ! Knowing what I know now after 3 years of dealings with the various agencies, there is no way I am letting go of ANY ORIGINAL stuff - I would drive to Maine and pay a thousand dollars to avoid that !

If you want to apply for every passport in person for the rest of your life, that's your right, but they have always returned my documents to me safely, and they do require original documents every time (when you renew they usually just require the original passport).

I have 2 friends who did not provide tax returns with the original application who were told at interview that they could not be scheduled to take the oath until they sent in the tax returns.

Yes, you can file the N-400 before the I-751 is approved. What usually happens in that case is that the I-751 is held and both it and the N-400 are approved at your citizenship interview.

No, you cannot apply "by January 27" because your 90-day window opens on January 28. You can apply on or after January 28.

ETA: Not to mention that everything you sent with the I-751 is *already on file*, there's no point in submitting all the things over again!

Except that if they EVER find out, even AFTER her citizenship is approved, her citizenship will be REVOKED and she will be DEPORTED and BANNED FOR LIFE.

To make a mistake, find out, and admit it is expensive and time-consuming to fix. To lie on the N-400 by putting a false divorce date in the "Date Spouse's Prior Marriage Ended" box is grounds for revocation of citizenship and a lifetime ban.

Did they change the rules again, then? I swear, in January 2007 *both* the AR-11 *and* the change of address to the pending application were done online and *only* the I-865 was done by mail. I posted about it at the time in the I-751 forum.

I was really miffed because the change of address for the application went through correctly, but the idiot who took the information on the I-865 and entered it in the computer got my address wrong. And not even like a small transposition of numbers, he/she put the wrong street name! Luckily there's no street with the wrong name in my city so by some miracle the confirmation of the I-865 made it to my house anyway.

That's a bit out-dated, isn't it? We moved a year ago while the I-751 is pending and we were able to BOTH fill out the AR-11 online AND change the address of the pending application online ... in fact when you submit the AR-11 online it asks you if you have any applications currently pending and then if you say "yes" it takes you to the change of address automatically.

As of a year ago, the only one that couldn't be submitted online was the I-865 (sponsor's change of address). And if you're wondering how reliable the online system is ... USCIS sent proper confirmation of the AR-11 and sent all paperwork on the I-751 to the correct address, so obviously the online stuff worked; but it got *my* address (from the paper I-865 I'd submitted) wrong!

Exactly. You have to certify on the I-485 that either (1) you're female, (2) you're over 26, (3) you've already registered, or (4) you want your AOS application to serve as your registration. We paid close attention to that because G. had just turned 26 about 6 weeks before we applied.
