Removing Conditions on Residency General DiscussionBiometrics question please help
Yes, and they do it again at the N-400 stage, too.

I think Gareth said there was less to it than to the AOS/EAD biometrics though, just a photograph and fingerprints.

Removing Conditions on Residency General DiscussionChange of Address

We filed our AR-11 and Change of Address (not the same thing) online while the I-751 was pending, and the card arrived today (addressed to the new address), no problems.

I like doing the address change online instead of calling because you get an instant written confirmation you can print out, whereas there's no proof you called and told them.

Don't forget that the sponsor also has to file the I-865.

Thank you for your help!

I'm not very sure how to do the e-filing, as I looked up the USCIS website, I couldn't find anything relating AR-11/I-865 e-filing..

From the main USCIS page, it's on the left side under "More Information." It says "Change Your Address with USCIS."

From there it asks you whether you have a case pending and what your status is. It will help you file the AR-11 and the change of address (if you currently have a case pending).

You can't e-file the I-865. It has to be mailed.

FYI Update:

O.K after speaking to customer services on the telephone number provided on I-751.. with no success and was told I would have to wait 6 months before they can help me, I booked up for an infopass appointment ...

Infopass appointment today in HOUSTON....I enquired as to why I didn't recieve my biometetrics appointment after a week or so after filling my 1-751 just like everyone else who recieved there's on this forum, she said it's not unusual not to recieve a biometrics appointment straight away..
I was worried that either it got lost in the post or there was an issue with my case......
She checked on her computer and found out that they hadn't sent me the biometrics appointment .. strange ...wonder what's going on ?... so the wait continues....

I think when biometrics is done depends not on the service center but on the ASC ... is there anyone else *who's also going through Houston* who's had it right away?

Xbox, your profile says you filed for K-1. This is a thread only for people who are filing the I-751 form, and only through Vermont. Vermont in particular has been having long delays sending out NOA-1s for that particular form.

Removing Conditions on Residency General Discussion10-year card
Seconded. The first date is the date of your 1st ever green card approval. Second is ten years after the date of approval of the 10-year card.

So my husband's original dates were 1/15/05 and 1/15/07.
New card has 1/15/05 and 3/20/17.

Call the Office of Special Counsel for Immigration Related Unfair Employment Practices.

The #1 most frequently asked question on their employer hotline is "Am I allowed to ask to see a new form of ID when my employee's green card expires?" and the answer is NO YOU ARE NOT.

The second is "Am I allowed to demand to see the green card to confirm the A# even though the employee showed me two other valid form of ID?" and the answer to that is also NO YOU ARE NOT.

I very much doubt that Australia is on the list of countries from which one is not allowed to be when working for the Federal government although it is true that *some* immigrants may not work for the federal government without citizenship. (I do work for the federal government and we did have trouble because we wanted to hire someone who was in the process of the N-400 and was a citizen of Indonesia and we couldn't hire her. But we have another employee who was an Irish citizen and LPR and he *was* allowed to work for us before the N-400 was adjudicated. If I had to guess, I'd say that Australia goes with Ireland and not Indonesia.)

I'd call the OSC anyway, I mean they're lawyers, they should know if this is allowed or not.

Removing Conditions on Residency General DiscussionMoving During Process
You can do it online now. We moved while the I-751 is pending and changed the address online. (You can also file the AR-11 online, but not the I-865.) It went fine, we got a confirmation of the address change and then the 10-year card was sent to the new house.

In fact, the only thing they screwed up was the I-865, which I'd sent by mail.

Removing Conditions on Residency General Discussionhow 'bout skipping affidavit?
We did not send any with our I-751. We moved cross country 1 year after the LPR was granted and so there were a lot of people who'd seen us during the first year in one place, and alot who'd seen us during the second year in the other place, but no one who'd seen us regularly over the whole two year period like it asks for.

It was approved in about 5 months with no RFEs or interviews.

Removing Conditions on Residency General DiscussionHelp me Please
Unless I'm mistaken, USCIS checks are supposed to be made out to "US Department of Homeland Security."

And anyway, USCIS stands for US CITIZENSHIP and Immigration Services (not center).

I'd send a money order. On the outside of the envelope, bottom left corner, put your A number, "I-751" and "re-submission of payment" or something like that.

Removing Conditions on Residency General DiscussionTranslator needed for Police Clearance
QUOTE (NickD @ Aug 18 2008, 06:22 AM) <{POST_SNAPBACK}>
The translator doesn't need to be certified, only the translation does.

This is water under the bridge for us, but how does one get the translations certified? The bulk of our translations dealt with showing the USCIS my wife could bring her daughter here that was quite a stack of paper. She had to be released by her biological father to complicate issues even more was living in a different county. That costs us a couple of bucks.

A translation is certified when the translator writes "I certify that this is a complete and accurate translation" (some additional verbiage, but that's the gist of it) and signs and dates it.

Removing Conditions on Residency General DiscussionTranslator needed for Police Clearance
QUOTE (NickD @ Aug 17 2008, 05:57 PM) <{POST_SNAPBACK}>
Most court houses have a translator that is certified for legal documents, you can try calling your local clerk of court, or try to find one on the internet. My wife is certified for medical, a different certification for legal, so we had to hire a legal certified translator. Charged us 50-75 bucks per page and stamped each page with his certification.

There is no such thing as certification by specialization or legal translation certification in the US. There is *interpreter* certification by specialty, and translator certification by *language*, but the American Translators Assn. does not certify by specialty. (There is a very limited credential that no one recognizes by the National Association of Judiciary Interpreters and Translators [NAJIT], but as I said, no one recognizes it and no one holds it.)

Courthouses in most states (like 40 of the 50) are likely to have certified court *interpreters* but that's no guarantee of the quality of their written *translation* work; interpreting exams are oral. Very few certified interpreters also hold translation credentials (and even fewer certified translators hold interpreting credentials, but that's beside the point).

While it pisses me off, USCIS does not require documents to be translated by a professional, just someone who certifies they are competent in both languages.

NickD, $50-75 per page seems high to me unless it was only one page, and I say this as someone who holds both the highest translation and highest legal interpreting credentials in the US (and therefore can charge the highest prices) and specializes in personal document translation. Also, if the translation was done here in the US, that translator bought his stamp for $7.99 at the rubber stamp store and anyone can get one. They're not distributed by the ATA or NAJIT.

ETA: And so that no one thinks I'm advertising, I'm not.

Removing Conditions on Residency General DiscussionWhen to file for removal

You can apply no earlier than 90 days (not 3 months) before the expiration date on the green card.

Follow the ROC guide here on VJ and you should be in good shape.

I can apply anytime during the 90 days???? The way they worded in the form is confusing

Removing Conditions on Residency General Discussion10 yrs. GC approved.
Hola amigos/amigas:

I got an email on Sept 30, 10 that says my 10 yrs green card has been approved/ordered. :P I'm very happy this process went pretty quick and we got approved without interview. Good paperwork and proofs really paid off. I mailed over 2 pounds of documents. I sent in application on Jul 19, 10, had bio done on Aug 26, 10 and it was approved on Sept 30, 10. Thanks God. God Bless everyone and good luck to all.

Removing Conditions on Residency General DiscussionCan't find I-751 extension letter
Just wanted to give an update for those that are curious...

We decided to just wing it, and travel with the green card and photocopy of the extension letter. They didn't seem to care too much; the CBP officer in Houston looked at it and casually told us we should carry the original next time but that was it.

Now I am sure it is up to the discretion of the CBP officer, but ours didn't seem too bothered...

As for anyone else checking, we were able to leave the airport in London just fine...one guy at check-in asked to look at the extension letter but didn't say anything about it being a photocopy.
NealandCariFemaleUnited Kingdom2010-05-24 23:09:00
Removing Conditions on Residency General DiscussionCan't find I-751 extension letter

If your husband has his 2 year GC - then it may work without the extension letter. I've read others who have entered the US didn't need to produce the extension letter. His green card status is already extended in the system.

Now the question is, and excuse me for my ignorance, can he leave the UK without needing to show a valid entry document for the US? If so, then I think you will be just fine. Your GC is still valid despite the expiration date on it...

hope this helps!

I think the main issue is with coming back into the POE...they don't check anything but the passport leaving the country I do believe. Then, coming back, you have to fill out the landing card and all that.

Ugh...can't believe this happened.
NealandCariFemaleUnited Kingdom2010-05-02 15:14:00
Removing Conditions on Residency General DiscussionCan't find I-751 extension letter

Sorry but a photocopy will not be accepted at any POE but you can try it. Does he at least have the physical expired GC? The CBP officer may give him a break and swipe the expired card which will reveal the extension on his/her computer.

On a side note, why would you wait till the day before an international trip to look for such important documents?
Good luck.

I know it's very stupid to wait till the day before, believe me. I have been preparing for this trip for a couple months now and just assumed my husband had the NOA. Additionally, my husband had just assumed it was with his other documents (Biometrics letter, etc) in our filing cabinet. I know what they say about people who assume too, haha. I have no idea what could have become of it to be honest and it may still show up. My husband has been working full time and going to school full time, so he has been very busy and stressed and it just came down to that really.

He does still have his green card, and he has his stamped biometrics letter and the photocopy of the NOA. Would it be possible to file for a travel authorization at the U.S. embassy in London?

And what would happen if they didn't let him back in? Would it just be a matter of him waiting in the UK until his new green card arrives?

Removing Conditions on Residency General DiscussionCan't find I-751 extension letter
So... a very stupid thing happened to my husband and I. We are traveling back to London tomorrow so he can visit his folks and suddenly cannot find his NOA/extension letter. We can't really afford to cancel our trip...we have been saving up for it for a couple years. He has a photocopy of his NOA...will this suffice? I don't want to have to risk it, but I am at my wit's end. He may or may not be approved while we're away (we will be gone until May 24), but I don't know what to do. This is my worst nightmare. HELP!

Check the I-751 instructions on the USCIS site.

http://www.uscis.gov.../I-751instr.pdf

It's there on page 3.

Thanks a lot. Not sure how I overlooked that little fact!! I appreciate the help.

Removing Conditions on Residency General DiscussionSIgned, Sealed & Mailed
Hello,
A quick question. I am having trouble finding the address for the mailing of the 751 to the TSC. I found an address for a number of other forms but not for the I-751.
Any help would be greatly appreciated!!

Thanks!
