The two versions of the form appear to be identical except for differences in revision dates and incorrect spelling of the word, "ordinance" on the new form on number 7, Part 3 or am I missing something?

For a spouse the rule is 3 years 18 months, with periods ounside the USA of no more than 6 months.

The exemption for non profits has to do with non-profits that promote the USA.

You will need to obtain a re-entry permit if you plan on being away from the USA for longer periods of time.

For a spouse the rule is TWO YEARS NINE MONTHS (or to be more exact, three years minus ninety days) from granting of permanent residency. Not three years and 18 months.

As far as I can tell, PaulFox, she apply two years and nine months after she gets her green card, whether or not she is in the US at the time, as long as your (PaulFox's) only employment while living outside the US is as a missionary (or one of the other categories mentioned above). The rules about how long she must be inside the US do not apply. But I don't understand all the details, I'm afraid.

I agree with what Yodrak wrote in another thread....I'm not *quite* understanding why we have to pay another biometrics fee?? That's just ridiculous after all the bios and checks that have already been done at this stage!!! *really angry but rant off*. I *am* going to read the guides about this process again soon, but if anyone is really bored out there and feels like enlightening me in the meantime...so is Craig going to have to travel to Milwaukee (our closest ones) or Duluth to get a stupid fingerprint or whatever done again?? (it's 4 1/2 hrs or so each way for us...argh!) M.

There are hundreds of them, there are more ASCs than there are District Offices, and so the only way to know what would happen to YOU is if someone answers who went through YOUR Application Support Center.

As pointed out on here - the notice states what will happen, but the info is incomplete.

We just got our noa-2 biometrics notice today, so this is fresh in my mind. It said if you miss the appt, you can show up any wednesday afterward, at the same time (9am for us), but only up to a certain date. For us, the appt is this week, the cut off date is sometime in Feb 2007. After that date, the app will be considered abandoned and status revoked.

So, you can miss the original appointment, but you have to get it done within a certain period of time, or else.

I think that depends on the ASC, actually. I've heard of that before from other people, but G's specifically said that he could only come on a Wednesday if he called or wrote before the scheduled appointment to say so, and that if he hadn't called or written before the appointment, the application would be considered abandoned.

So there's another tidbit of info for sen: there's no way any of us can know for sure what USCIS will do unless someone else lives in the area served by *your* ASC.

G's biometrics letter says "IF YOU FAIL TO APPEAR AS SCHEDULED, YOUR APPLICATION WILL BE CONSIDERED ABANDONED." Or in other words, they'd cancel your pending I-751 and you'd have to re-file it, plus (if your green card has already expired) you'd be out of status and could be put into rescission/removal proceedings.

On the other hand, I saw my first post today where someone seems to think their I-751 was returned for wrong fee having submitted $205.

Mailed I-751 dec 12th they received it dec14th had sent $205 because that's what the website said. Yesterday it was returned. Blue sheet said basicly it was because of the check but indicated every reason possible. The first paragraph said it "could" be because the fee was wrong, or the number amount did not match the written amount, or it was not signed. The next paragraph said that it was because the check had been changed and we were to either initial the change or send a new check for $205.
Since none of the above was true, except for the fact that the amount was not what the current website claimed, I typed a new check for $275 and sent the whole mess back today. Hope that works

I continue to think that $205 is the correct fee, that there is no fee associated with the simple photo and fingerprint appointment that is required to manufacture the card, and that whoever updated the form instructions and web site either jumped the gun on something that is yet to be implemented or is outright wrong.

Well, for what it's worth, I called the USCIS hotline and the guy says he double checked (oooo, double checked!) and the fee is $205 regardless of what the form says. He also said NOT to send any passport pictures. I'm sending them anyway.


I don't think you quite grasp the number of people who are involved in the change to a form in the federal government.

I agree this is a giant ######-up, but you can't exactly "accidentally" change a form. Changes have to be proposed by a committee, approved by another committee, offered for public comment, sent to printing for a proof, sent back for approval by another committee, etc. No one could do all of that in error. (Now, the website is a different story.)

I suspect it may be a case of a change being voted for, then while the new forms were being processed, someone changed their mind. So the forms reflect a prior decision that has been overruled by a new one.

I have an update already.

Yesterday, August 4th, we received another NOA. They request my wife go for Biometrics (fingerprinting only I think) at one of their local centers. They gave her an appointment for August 11 at 11 AM. They said you could reschedule, but that would delay your application.

This is a little bizarre since she has already done this right after we filed her AOS application 2 years ago, but maybe this is one of their new methods of rushing it through. I put together a pretty thorough I-751 package in the hopes of avoiding an interview or delay, so I am hopeful that she will receive another NOA of approval in the next month or so.



What service center, if you don't mind my asking? There are so few people going through TSC that it'd be nice to hear about what happens when you do, so I'm crossing my fingers that that's it.

1. The alien must fill out an AR-11. The sponsor (usually the USC spouse, possibly someone else as well) must fill out the I-865.

2. As I said above, YOU WILL NOT RECEIVE AN NOA-1 for the AR-11. So it's perfectly normal that you haven't heard from them, because you shouldn't. The proof is your delivery confirmation.

3. There should be a written confirmation sent for both the I-865 and for the address change (whether electronic or telephonic).

Agreed ... since the electronic AR-11 is so new (I'd gone online to print one out two weeks ago and it wasn't mentioned then, but then I lost the one I printed so had to print another yesterday), maybe an electronic I-865 isn't far behind. Not that we're planning on moving again for awhile, anyway.

I had to submit the paper and I got the mail from them saying that they receiveed my form and they could contact us at new address. Not for the AR-11 you don't, but allegedly for the separate address change you can file electronically (only if you have a case pending), there is a confirmation letter mailed out within 45 days.

There is no confirmation notice for the AR-11, although there is one for the I-865.

But now we're worried (like everyone else) about what happens if the interview letter (if there is one) or NOA-2 or green card get sent to the old address.

Of course, but aren't things from USCIS usually marked "DO NOT FORWARD"? I think I've seen that asked and answered here a lot. The post office won't forward something marked that way, and most government mail is.

I mailed AR-11 using priority mail on Jan 3 but it didn't get to USCIS in Kentucky until Jan 11. So I decided to change the address online on Jan 9 (just want to make sure I changed it within 10 days). The only confirmation I got was the confimration page (which you should pint and keep for reference - it contains date and time stamp). I used a new addess when I filed my I-751 and I assum that TSC went by the address on my I-751, not what was currently on their file because they mailed the notice to my new address.

You can call service center as soon as you move if you have the pending case (and also file AR-11 either electronic or paper form). You should be okay.


A lot of people have done it the way you suggest (by telephone) and had the mail sent to the old (wrong) address that was on the pending petition, not the new (correct) address they notified of, and then having their petition denied because they didn't respond to the mail that was sent to the old address. I'd just as soon not have to deal with going through rescission proceedings, you know?

My question is if people know if the new way of notifying of the address change (online instead of by mail) means that there won't be the problem with the address not getting changed, which there was in the past when you had to do it by phone or snail mail.

We just went online yesterday to print the AR-11 and found that you can now file the AR-11 electronically. You can also go through a separate process to file an address change if you have a pending petition, using the receipt number and (I think) Service Center name, so we did both. The second (trackable) receipt number that was on the second NOA-1 and the biometrics letter wasn't found, but the first one (non-trackable) that was on the first NOA-1 was.

Has anyone else filed an electronic change of address? Did it work? (i.e. Did you then later receive mail from USCIS at your new address?) The confirmation said that we would be mailed a paper confirmation of the change of address by the service center ... within 45 days. And that if we didn't get one within 45 days, to call the 800 number with the confirmation number.

We hadn't planned to move again until G's I-751 was approved (should be in May) but then we saw a house that was way underpriced and had to buy it. But now we're worried (like everyone else) about what happens if the interview letter (if there is one) or NOA-2 or green card get sent to the old address. We have the apartment until February 19 but I doubt we'll hear anything about our case before the end of April or early May. I feel like the electronic change of address is probably slightly more reliable than calling the 800 number since there's no reading the information to a third party who has to enter it; but I'm still worried.

We had been going to ask to have the mail held at the post office and just pick it up once a week, but they won't hold it for more than 30 days. So I guess we'll have to have it forwarded.



(BTW You can't do an online change of address if your case is at a local office, and the I-865 still needs to be printed and mailed.)

IN the mailbox, Marilyn, as many have posted. I made a little card with the names of all the mail that can be delivered to my address and taped it inside the box.
Ask your mail carrier for a card from their office as well. There is an official thingie you can fill in to say whose mail may be delivered to your box.

But of course, since you won't believe a word I say, why do I bother? ;)

I believe the name is needed on the box in rural areas only (e.g. where the houses are very far apart from each other and outside city limits). In urban/suburban areas, you only need the number.

It is considered dangerous by the post office to put your full name on the mailbox (especially in places like here, where there's a high incidence of mail theft and identity theft), they advise putting the last name only. In fact, our mail carrier wrote our names on our mailbox herself and she specifically asked us only for our last names. So what you were told the Post Office does is, in fact, completely contrary to what they do. (You are required to have your number on the outside of the box, on the same side as the flag in numbers at least an inch high, though.)

Our first receipt number was not trackable online, then we got a second NOA-1 with a different receipt number that was trackable online. That number also was on the letter we got with the biometrics appointment. However the biometrics appointment was almost 2 months ago and the status still says only that they received our application (not that they received the results of biometrics), so maybe it's not trackable in the sense that they don't update it, even though you can log in and it will find your case.

But of course, since you won't believe a word I say, why do I bother? ;)

Did you use the ZIP code thing, where you put in your ZIP code? Usually each center only services certain parts of the state. For example, in New Mexico, the northern counties go to the Albuquerque ASC and the southern counties go to the El Paso, TX, ASC.

So, we bought a house about a month ago, and we filled out and submitted the AR-11 and the change of address online. But you can't do an electronic I-865 yet, so I filled that out (on the computer, it's a PDF) and printed it and sent it. Today I got the NOA.

It has the wrong address. I live at 12345 Summer Ave. The NOA lists the address as (and was sent to) 12345 Summit Ave.

Now, lest you think this is a problem with my handwriting, the form was *typed*. Obviously someone was reading it and entering the data and read the name wrong, or else someone else was reading it out loud and the person entering the data mis-heard.

Obviously my town doesn't *have* a 12345 Summit Ave, because I did get my NOA. So the question is: do I re-do the I-865 or leave it be?

The NOA does say to notify in writing if the address is wrong.

So one has to wait for NOA and use case number in it. Nature and reason of this fenomenon is unknown to the contemporary science.


I beg to differ. I have BoA and all of our check scans are totally illegible, especially the stamps that get put on the back, where the case number goes. We had to wait for our NOA for AOS because the scan of the case number on the back of the check looked like a series of smudges.

My understanding is that some I-751 case numbers can be tracked online, some can't, and no one knows why.

Um, "you can see if and when it clears the bank"? I would certainly hope that no one would send USCIS a check that they didn't know with absolute certainty would clear the bank!

And if you meant you can see your case number on it, that's not true if your bank doesn't send you actual checks. My bank only provides black-and-white scans of checks, and they're usually illegible.

I think all are correct, but what about getting the citizenship after a year - I know someone mentioned on the forum being naturalized or in the process of naturalization after one year (I think she is with her husband deployed in Germany) under certain conditions - spouses of military personnel, not sure about government employees.


Permanent residents who are active-duty military can apply while on active duty if they've been PRs for at least a year or within a year after finishing their tour of duty (I think). Not spouses of USCs on military duty and not government employees (or spouses of government employees, more's the pity).

Wow - that is scary but maybe as you said its a random thing, I know I read a long time ago on the USCIS site that there was definitely a certain percentage of couples that had to be interviewed for quality control... did they send joint household bills etc (sure they must have done)?

I'm worried (even though our filing is a long way off) that I can't see to get any utility to put both names on our bills. Like the electric company will only put one, phone bill only has one etc etc. So we've got bills that are individually addressed to both of us - which seems kinda stupid...


We had the same problem.

We just attached each electric bill (in his name) to a cell phone bill (in my name) for the same month, showing the same address, with a note that both PNM and T-Mobile had refused to add each other's names.

I used FedEx (I really do trust the USPS and always used them before, but they're way understaffed in my state and mail is really slow). You can't FedEx to the address on the form, but if you go to the USCIS website and look at TSC's page, there's an address for "courier deliveries." That's the one you have to use for FedEx (or UPS or DHL).

The CSC date is a bit misleading. Several folks here that have gone through the CSC recently have had approval times of 2-3 months. These are applications sent in 12/06 and 01/07 so they must be processing beyond the date they have on their site.

CIS says on their site that the will only show the dates that are outside their processing range. They expect I-751 to be done in 6 month. March 15 reporting date means Sep 15. So if you see a 9/15 date it could be anywhere from 1 day to 6 month. The important dates are the ones outside the 6 month date. Which mean those centers are behind.

Looks like Vermont is taking about 6½ months right now (9/1/06-3/17/07) so I'd expect yours to be processed mid-July (12/29/06- ~7/15/07).

I think the advice above about calling is misleading, I think that what you're asking about is NOT an address change, but rather the AR-11 form, which can be downloaded from the website or can be filed online. The AR-11 form must be filed by the immigrant every time he/she moves. (It replaces the old requirement that the immigrant go to the Post Office to register their address once a year.)

The sponsor (probably the USC spouse) is also required to file a Form I-865 which is also downloaded from the USCIS site every time he/she moves.

You only need to do an "address change" (which is different from the form AR-11) if you currently have an application pending with USCIS. If you do have an application pending, you can do that by phone or online at the website. Personally I prefer the website since you have instant written confirmation of it.

Another thing is don't forget to file the I-865-Sponsors Change fo adress for together with the Ar-11 -Alien Change fo adress and dont forget to call the INS and notify them about the Change of Adress on the phone as well.

Yes, they will have access to your file. There is only one file (when they talk about your "A file," it is indeed a single folder containing everything relating to you; I've seen several) and it will be ordered out of storage by whatever office gets your next application.

No problems yet for us, we moved from New Jersey (Vermont/Newark) to New Mexico (Texas/Albuquerque), although the I-751 is still pending.

No offense..but I'm not 100% sure this is correct (and other simiar posts) - you/I can not (in most countries) translate documents and certainly not legal documents ourselves..regardless if we're fluent in the language... (In most countries.)

Please submit certified translations for all foreign language documents. The translator must certify that s/he is competent to translate and that the translation is accurate.

Birth certificates, marriage certificates, wills, diplomas, legal documents all need to be certified. Certified translations are governed by local laws in each country.

In a non-certified translation the translator is sometimes entitled to give a personal style and tone to the text, to make it more appropriate for the target audience.

Certified translations often must be an exact translation of the source and must always include a clause from the certifier together with a round seal affixed which only Certified Court translators may use, and must be certified by the translators signature, in order to be accepted by the courts and the authorities.


I would not do anything of the sort (translate myself, or use unofficial translation without first checking into it further..but it clearly says, Certified in the USCIS instructions).


I'm sorry, but I am a professional translator, and none of what you've said applies in the US.

A certified translation, in the US, is a translation where the translator certifies that he/she is competent and qualified to translate and has prepared a complete and accurate translation to the best of his/her ability.

As far as I know, there is no state that has such a thing as a Certified Court Translator, and the federal government certainly does not. Some states and the federal government certify court interpreters, but being a certified interpreter is in no way related to ability to prepare written translations.

There is no such thing as an official translator seal, and I'm sick of people saying "there must be." The only translators who have fancy seals to affix are the ones who went down to the local seal-making shop and had one made for $10. Such a seal is in no way indicative of any actual credentials.

When I have to prove my credentials, I photocopy my Certificate of Certification from the American Translators Association, but almost no one actually has such a thing and even fewer people care if you do.

I got a lease agreement in Spanish (as i live in Puerto Rico) does that need to be translated??? or should i just leave it as is and send that in with the package that we're preparing now.

I have a few other things aswell, but they are in Spanish too, translate them???

if so, how do we go about it???



I translated all of our Spanish Docs to English. If I got stuck, I used Altavista's Babelfish (on the web) to help me clarify the meanings.



As a professional translator, I'm going to pretend you didn't say that. Babelfish is abominable, and I only say that because I can't think of a word that's stronger.



In any case, of our lease we just sent the first page (that had the dates and the address of the apartment and our names) and last page (for signatures), perhaps the OP could do something similar and then only those pages would need to be translated.

Call the Office of Special Counsel for Immigration Related Unfair Employment Practices. (Just Google the phrase.) It's part of the Department of Justice.

It is ILLEGAL for them to ask to see his green card if he presents the other documents and a $100 fine for every employee they do that to. Usually calling the OSC and getting them to talk to the HR department should be enough.

Just went through this with my husband last week. They are SPECIFICALLY PROHIBITED from asking to see any proof of anything written in Section 1 (which means they can't ask to verify the A number, the excuse my husband's job gave). They only can look at documents for section 2, and yes, a driver license and unrestricted SS card are legally sufficient.
