Yeah, if you get married outside the U.S., you will take the spousal visa/K3 route, which is more involved and takes longer from what I understand. You get married there, and then you will have to wait in Canada for the lengthy processing before you can come here. If you want to go the K1 route, you can have a non-legally binding ceremony in Canada, and the legal one in the States, or you can go the other way and have your marriage in the U.S. and a big reception in Canada.

As soon as i got home from college, i went to check my status online and i saw today's date and i was like ughh? is this what i think it is and yep it was the famous NOA2, I couldnt believe it, I still cannot believe it. I called everybody LOL, my mom, my sis, ohhhh and of course my fiancee.
and now to start all over again with the documents gathering, forms filling, etc.....

I thought a copy of the NOA2 would suffice at the interview - is the original neccessary? I see conflicting thoughts around VJ on that.

Hi. I wanted to let you all know that we received our hard copy NOA2 on May 3rd and I called the NVC office today and our papers were received and our NVC# was issued on May 11th.

The NVC said that our papers would be mailed to our Embassy in a couple of days. I requested a time frame for the delivery and the NVC office said that our Embassy would receive a electronic notification immediately and then they will mail a hardcopy of our papers to our Embassy. The NVC office said that I could call DHL and ask them the approximate delivery time.

Also, I was wanting to include a timeline at the bottom of my messages. Could someone help me with that? Thank you and I wish everyone very much luck as our journey continues.

we're in the exact same boat here -- NOA2 email recieved May 3, but still no paper NOA2. also, i just called NVC and they said that our case was actually approved by the USCIS on the 30th of April "officially." the NVC recieved our case on May 11th and is processing it now -- will forward to the Embassy in 2-4 weeks, but he said really should be sooner. i'm getting really worried about no NOA2!! the first one came so fast and i just live in AZ. glad that we're all in the same boat. that makes me feel better. it needs to come soon though -- i move at the end of the month and go to Ecuador on June 1st! i want to have everything ready, in hand. other than that, so happy that things are moving right along!!! :)

:crying: BAD news guys. They told him that he needs to get a report/form/history from US Immigration which shows he's never been to the US. WHAT THE F*&$!?!?!?! Then he's suppost to DHL mail it back to them and wait to hear something! this is #######!!! i've never heard or read about such a document or we would have ALREADY been prepared with it! also, they fingerprinted him, costing $85, which we weren't expecting. :angry:

aside from being very mad, i'm really SAD! i am starting a new, ridiculously hard job tomorrow where i'll be working 80 hours a week. and we are going to have such little time to communicate. :( i need him with me now more than ever.

wish it would have went differently! and hope it gets resolved quickly.

Yeah me too! i submitted passport entry and exit stamps, emails to friends and family describing Enamanuel, digital non-dated photos, and my hostel receipt. but nothing says both of our names on the same page! and worse, i don't have anything else to submit!!! i was pressed to find just that much. you'd think they would consider the whole application together -- like that the dates of emails, calls, and text messages from the Proof of OnGoing Relationship start right after us meeting. ?!??? guess they don't? ugh!

also, i think i may have put my information in wrong on my time line. you guys are listing the Notice or Received date of the NOA1? my received date is Jan 29th and notice date is Jan 30th to CSC. i'll update my timeline.

its a long wait, but i just discovered you guys and really, i was prepared to wait until late July to hear anything. i am still afraid to believe it will be so much sooner!!! anything faster would be AMAZING!! i met a French girl in Ecuador who couldn't get a visa for him to come to France. Eventually she went down there to get married, but they were separated 14 months!! :( poor thing!

Only thing that needs to be notarized is form I-134 for the visa interview at the consulate, that is all. That is what we did , and had no problems with Guangzhou, the hardest, nastiest consulate of the State Department.


hi. this was my exact question. i have read here on VJ that the I-134 needs to be notarized, but it does not say so on the form specifically or the instructions. i just called USCIS and they said not to fill out below my signature line and it can be completed by the consulate at my fiance's interview. i am not allowed to be at the interview so should i just sign like they said? or should i sign and have it notarized like VJ recommends? i don't want to screw this part up because everyone notes it is the one of the most important parts of his interview! please advise!!

I'm new to all of this, so I have a few questions. My fiance is currently here on a J-1 visa which will expire in December. At that point we will both travel to the UK to visit his family for the holidays, and then we plan to travel onwards from there for about 5 months. We plan to return to the U.S. in May, at which point Chris will hopefully have his K-1 visa. Before I send out the I-129F, I have a few questions:

1) Can I still petition for him if he is currently in the U.S. under a different visa type (J-1)?

2) We were hoping to start the process now, so that he could get his interview at the embassy in London when we are there over the holidays. Is that too much of a rush (i.e. is there no way that everything will be processed by then)? Also, if he is assigned an interview date, can it be rescheduled?

3) Finally, I am worried about the affidavit of support. I am finishing up a master's degree, and then we will be travelling, so I won't be employed. I do have savings now, but I"m afraid that will be wiped out during our travels. Any advice?

We're planning to write a cover letter and enclose a copy of the AR-11 (form that gets sent to Kentucky).

We're planning to notify both our Service Center and the local office, since it's possible that our case would get sent to the local office if we get called for interview.

Geez. Chill. Our NOA date is 11/13/06 and G's biometrics are tomorrow, however there is someone else on this board with the same service center whose NOA date is two weeks before ours (10/31) and has biometrics the day after tomorrow.

Remember that biometrics DEPENDS ON THE ASC, NOT THE SERVICE CENTER.

Well, in this case, we were lucky to get AOS approved really fast back when we filed, so G's card expires mid-January and we've already sent the packet and gotten the NOA back.

That's a mess! We're moving in a month or so also (bought a house) and trying to decide what to do. But we don't plan to travel until May or June at the earliest anyway, so it's less crucial.

You don't send the card with the original application, but some people get NOAs that ask them to send the original card, which is actually good 'cause it's some sort of pilot program to approve you faster without interview. I think it's Nebraska/California that are doing that (I believe most Nebraska I-751s are being sent to California).

Don't know what to tell you about the move, it seems like your move is long after your date to start (if my math is right, March 29 is the start of your window) but right before you'll travel. If I were you, I'd file by March 31, to give yourself the greatest possibility of getting the NOA before you move. What concerns me is possibly not getting an interview notice, the new card, etc. *shrug* I'll probably notify TSC and the local office as well as Kentucky, but who knows if that'll be enough?

Long time no see! :-)

The NOA contains a notation that your green card is extended one year past its expiration date, travel and work authorized. How long until your NOA depends on your Service Center; Texas takes a bit over a week, but Vermont has been taking up to a couple of months, so if you're still in their territory (you're no longer in NJ, right? neither are we), I'd recommend filing as soon as you're eligible.

It's so nice to see my favorite people from back in the day returning to VJ now that they're at lifting conditions stage!

I don't see why not. My mortgage company believed us. I mean, it's an official document on watermarked paper and all that. You may never have seen one before, but I would assume they see them all the time. *You* might not believe it, but (I assume) it's also not your job to deal with these things.

Hmm, I'll have to see about that. I know my state government badge didn't get me in to the immigration office last time, but maybe the new federal one will. (I've never seen a SS office that had security, actually.)

The NOA-2 had a completely different LIN than the NOA-1. Is that normal??

The biometrics appointment is scheduled only three days after we received the notice. Glad the mail wasn't any slower, and that we were here to get the notice, and so forth!!

Thinking about asking for "the stamp" for the passport when we go in for biometrics, since we may be traveling soon. Is the stamp good for a year, or only 90 days like the original stamp, or what?

My understanding was that NOA-2 refers only to the approval notice, so I must say your use of it to mean the biometrics letter confuses me. I thought you meant you'd been approved.

That said, yes, it's normal for the first NOA-1 to have a standard-format case number (SRC-07-xxx-xxxxx) and the second NOA-1 (if applicable; Texas is the only Service Center that I know for sure sends a second NOA-1) and biometrics letter to have a different case number.

The new case number should be trackable on the USCIS website.

Unless your office is weird, you couldn't get a stamp at the biometrics appointment if you wanted to, because biometrics are taken at an Application Support Center and the stamp is given at a District Office, and I've never heard of them being in the same place. In Newark they were several blocks apart, and here they're in totally different quadrants of the city. (ASC in the southwest and DO in the southeast.)

In any case, the NOA-1 extends travel and work authorization by a year (or until your application is approved, whichever comes first), so I don't see why you need a stamp anyway. You only need the stamp if (1) it takes more than that to process your case or (2) once the application is approved.

Now, first of all, we live in a state with a population of only 1.6 million and only the northern half of the state goes to the Albuquerque office (the southern half of the state goes to El Paso, TX) but ...

G's biometrics appointment was yesterday at 9 am but since we only have one car he dropped me off at work at 8 am, drove there, got there at 8:05, sat in the car and finished his coffee, got out of the car at 8:10. He was fourth in line and as soon as he checked in, went into the men's room ... and when he came out, they were waiting for him! He was back in the car and driving away at 8:35. He made it to work at 8:50 after having asked for the whole morning off.

(Which is good, because we're buying a house, and he's already having to take off next Monday afternoon for the inspection and then two days next week for us to fly back to the East Coast to see my family, plus closing at the end of the month ... and he's only had this job for two months and they're not happy about all the time off he's taking.)

For anyone who's wondering, the whole appointment was just photo, signature capture, and fingerprints; less involved than the AOS biometrics.

Anyway. Twenty-five minutes from getting out of the car to getting back in. Going once ... going twice ...

Here is a kicker. After speaking with the USCIS Call Center, and calling my lawyer, it is determined that as long as the date on my wides EAC (Employment Authorization Card) is valid, and I have a delivery confirmation of the i-751, she should be valid to work until the NOA1 arrives, because as long as you are filed in those 90 days you are still in status, and the EAC shows that you are legally allowed to work in the United States.

Any thoughts?



What the heck is an EAC? I've never heard of it. The closest thing I've heard of, the EAD, is only issued to non-permanent-residents. Gareth's EAD was taken from him when his green card was approved because they're not needed by PRs and they're not valid for them.

Your wife is allowed to work in the US as long as she is in-status. If she filed within the 90-day window, she is in-status unless and until either (1) the one-year extension runs out if your case has not been decided by then, (2) your I-751 is denied, (3) she is put into rescission proceedings and loses, or (4) she abandons her status. (The most likely outcome, of course, is that none of those things will ever happen, the I-751 will be approved, and she will never fall out of status.)

The page about the I-751 seems to be broken, *but* I can tell that there is a different form since we filed. Even though the form is dated 8/1/06, it must have just come into effect in the last month or so, because it has only been six weeks since we filed the I-751 and it was a different form (and only $205) then.

Usually when there is a fee change, you only pay the new fee if you file after it comes into effect. So if you filed before they raised the fee, then you don't have to pay the new fee.

Um, I think the point is that the only tax years they have joint returns for so far are 2004 and 2005, because in 2003 they weren't married yet, and they won't have filed their 2006 taxes yet. So they already have the returns for all the applicable years and don't need transcripts, the question was whether it will be a problem that they don't have their 2006 return done yet.


The whole point is showing that the couple is filing joinly, just another piece of evidence of real relationship. I suggested transcripts as they are easier to deal with instead of copying tax returns.

Have you seen the new format of transcript? I had to order transcripts for one year because I'd misplaced that file folder ... the transcript was an 8 page long, nearly illegible fax. The actual tax return was far, far easier to deal with (I believe it came out to 4-5 pages including the W-2s and the extra schedules).

Yes, I-551 is the USCIS name for green card, the stamp makes your passport act as a temporary green-card, this will allow you to travel out and back in to the USA.


Thanks for reply. I have stamp on my expired passport. and I got the new one. I went to Immigration officer they told me i will be carrying both passport as they dont give stamp until expire......

Which part isn't true? The instructions only say where to file if you live in the US or if your spouse is deployed overseas with the US military or government. And that if the latter is true, you must include a copy of the spouse's orders. There are no instructions on where to file if you are living outside the US for another reason, so I would assume that it's not possible.

My view on the definition of "living" is that *if* she still has a residence in the US, she *could* be said to be "living" there (similar to the way that college students officially "live" with their parents, even if they're temporarily staying in a dorm), so jsnearline could be correct that she can file there. Obviously, of course, I'm not an immigration lawyer and don't know what one would advise.

And given how many things mailed by us to the UK, and from G's family/friends to us, have gone astray over the past three years, I wouldn't trust the international mail with my NOA-1 (an irreplaceable immigration document) if I were the immigrant (heck, I didn't trust them with mailing it from Dallas to here, but had no choice), which is why I said that *if* it were me, which of course it's not, I would make sure I was back in the US in time to enter on the unexpired green card and file my I-751 from here. Because what if I filed in March as soon as I was eligible, Vermont took two months to mail the NOA-1 (as they've been doing lately), another week to reach Virginia, then it would take another week to reach Europe even if my husband mailed it to me that day, which is a margin of only two weeks before the green card expires. And if it got lost on the way to Europe, I'd be SOL.

It's a bigger risk than *I* personally would be willing to take. What risk the OP feels comfortable with is, of course, up to her.

A couple of issues here:

1. Be careful you don't stay out of the US more time than you're allowed to without a reentry permit or do anything that would make them say you abandoned your status (like filing German taxes as a resident or US taxes as a non-resident--I don't know what else). I forget how long that period is, either 6 months or a year (I think a year).

2. You can file any time between 90 days before your card expires and the date the card expires.

3. 4. That said, jsnearline's other suggestion of just filing late is NOT a good idea. For one thing, you won't be able to re-enter the US in July or August if your green card expires in June and you don't have an NOA for your I-751. For another, the USCIS is NOT the agency that handles rescission proceedings (ICE does that) so pleading to the director of USCIS will do you no good. I suspect that, since you'd automatically be scheduled for rescission proceedings, if they let you into the country you'd probably be arrested at the airport.

5. If I were you, I'd make darn sure to be back in the US with my son (Yodrak is right about what to do about that) *before* my green card expires in June, then you can just file the I-751 when you get back.

The two versions of the form appear to be identical except for differences in revision dates and incorrect spelling of the word, "ordinance" on the new form on number 7, Part 3 or am I missing something?


And the fee change and the elimination of the requirement to send passport photos.
